  • The case of Roland Molineux is an important one in US law because it gave rise to the "Molineux Rule" - the principle that evidence may only be heard if it pertains directly to the crime of which the defendant is accused. In other words, evidence of past crimes or other crimes are inadmissible. This principle is one widely established in Western legal systems - although a case in Britain during this same period (that of George Joseph Smith), offers a contrast with the approach taken in the US. The approach taken in the US is, in my opinion, a sound one - although it certainly contributed to a man getting away with at least 2 murders...

      I know! I couldn’t believe that, either. And not just 1 household took it, but at least, 2!!🤯. Wouldn’t Cornish have heard about the death of the other man? He was on the board of the club & the man died there. He should’ve been suspicious of that anonymous “gift”.

      Wow! This was a ride! I cannot understand how the justices made that decision. With or without the Barnet info, it was plainly clear that Mollie was the murderer! And not only are they fully responsible for any crime he may have committed after their decision, but every other evil criminal that has gotten off in the years since! In most cases their decision might be true, but not in this one. They were wrong & I question their reasons for making that decision. Did they have any connection at all with Mollineaux’s father?🤔

    fun fact: George Gordon Battle, one of Molineux's attorneys in his first trial, was the namesake of George Gordon Battle Liddy, one of the central figures in the Watergate scandal. Liddy's father during his younger days became a protege of the elder Battle in his later years, and he idolized him so much he named his son after his mentor.

    Mr. Maguire I can't believe that a network or Netflix or Amazon has not found you yet. Just imagine what you could do with a budget. You could take us to any of the locations that still exist. Interview families that may have relics or family accounts. You are awesome just the way you are but you deserve a much larger audience.

    Thank you once again for an extremely captivating exploration of a notorious New York City murder in the 1890s, Mark! This was worth the wait. As I can see, the geographic area of your documentaries expanded. It is no longer enough for you the British mysterious murders and you are already interested in American crime cases. As always, your documentaries underscore your higher-order thinking and literary skills and your great intuition. Bringing to life merciless cyanide killings, in the hands of a writer as gifted as you, became a fascinating crime story. It is also worth noting that, in addition to legal proceedings and gathering your own evidence, you have answered an intriguing question: what motives could drive the wealthy, handsome man of a distinguished New York family to murder?
    I can not deny my weakness in connection with the fact that for some reason I am sorry for him, especially after your words: '' they possessed what he had not .. '' Though, it does not mean my approval. ;)

    I always thought the practice of not allowing a defendant’s past history of crime into court was stupid, the fact that the first ever time it was used it set a guilty man free just proves it in my opinion. Context is everything

      I gave a thumbs up because so often in court cases the prior crime history of defendant is important ie. "He was found guilty of raping 7 other women over the course of 5 years. Should we not believe this young rape victim's testimony he raped her?" However, I do understand how it could be used to railroad someone who is innocent ie. "He was found guilty of many robberies, thus why shouldn't we believe he has done it again? A witness said he did."

      I agree with you Barbara due to the numerous court appearances I needed to attend to prove that I had been victimised. On the last date the judge agreed my case, and asked were there any previous convictions....after 10 violent offences were read out, said they didnt want to hear anymore🙄
      Of course there was an appeal, the criminal knows their rights😂 (did not show up for their appeal and waste any more tax payer's money at least💜

    At 2:29 Doctor Hitchcock smelled the scent of bitter almonds he recognized as Cyanide. But tasted anyway?! Not too smart Doctor I would say ! This was very engrossing and entertaining. Thank's Mr. Maguire for another excellent presentation. I and many other's enjoy your work !

    Some years ago I was an alternate juror here in New York. A young tourist had been shot and killed when a Chinatown gang fight broke out. All the original jurors made it into deliberation, so I was released when the court case wrapped up. It was then that I discovered the suspect's gang connections had been withheld from the trial. I had been sitting on the fence in my own mind whether or not he was guilty, but when I heard about his background I switched to guilty. - He got off.

    Liked and shared to other platforms 👍 I really enjoyed the complexity of this case and the juxtaposition to the body in the bath outcomes in which laws were changed for the belief in fairness at trials. Wow what a start though! Is it bad I laughed at the silliness of the first doctor and thought that was it...3 murders in a minute of listening but always more to people than what is first perceived. Brilliant research for writing and narrating Mark. Another fantastic journey into past cases and how your ability to tell their stories can help transfer me back to a period in history and understand the social aspects around the subject.

    I think the end synopsis was so eloquent, the scope of who and what Molineaux really was -- an in-depth psychoanalysis as it were, was so brilliantly written. This channel is expertly written and produced. How I love the use of the English language by those who can speak it properly as is done here.

      Agree 100%. English is an expressive and flexible language but nowadays I seldom hear it used properly on television (or radio for that matter). They could learn by listening to this channel!

      @@zaygezunt The language has been dumbed down to virtual gibberish and guttural utterings and baby level speak. English as a language possesses the most license, freedoms, nuance and has given rise to extraordinary achievements in literature, law, arts. Someone who can use the language to it's fullest extent might be considered a "white supremacist" and those of us who can speak and write as men of any race in proper English are attacked by the actual supremacists who have all the money and who have rigged education into idiot-land.

      @@billkarmetsky4003 Again, I agree. Those who cannot speak or write English properly are unable to articulate grievances and injustices, they remain at the bottom of society. One has only to read (or try to read) the comments on UA-cam to realise they are unintelligible. In addition, we have 'textspeak' and, of course, the inability to write on paper. Grammar is now considered too hard to master and punctuation, particularly the use of apostrophes, is dire. We must keep to the Churchill tradition; “He mobilized the English language and sent it into battle.”

    I have just listened again to this case, another wonderfully conveyed story by Mark Maguire. Top notch as usual with all the detail that I love! This was another instance of karma eventually catching up with the perpetrator who escaped justice through the legal system. As always, I am already hungry for the next one🙂👍

    Mark, many thanks for making a video from my suggestion many months ago. As influential the Molineux case has been it remains quite unknown to a lot of historical true crime fans. I suggest people also read Molineux's The Room with the Little Door. It's for free online and a short read if you are interested on his experiences while on death row.

      regarding the book, I should add that while it won't blow your mind away, it has its flashes of wit and provides an insight on Molineux's sense of humor. Not all of his pretensions of gentility were for nought.

    Re: anonymous parcels, it was common at the time to send out advertising for new products that included free samples, or to leave samples on the doorstep. (Alongside the milk and bread delivered daily or several times in the week to the household, if the sample people got up early enough.)

      Yeah but anonymously? Really? I mean no pamphlet announcing that it was a sample and telling you where to buy. Would seem that it's bad advertising if they did it that way. Still cannot believe the level of stupidity in taking this.
