Jamaican for Justice: Revisiting the Keith Clarke Case

  • On May 27, 2010, accountant Keith Clarke was killed at his home in Kirkland Heights St.
    Andrew. The three accused are Lance Corporals, Greg Tingling and Odel Buckley, along with
    Private Arnold Henry. It was alleged that the accused killed Mr. Clarke during the May 2010 hunt
    for Christopher ‘Dudus’ Coke, a period which also resulted in fatal human rights abuses against
    citizens of the Tivoli Gardens community in Kingston. It is reported Clarke was shot
    approximately 21 times in the incident.
    The case has been in the courts since 2012 when the Director of Public Prosecutions Paula
    Llewellyn ruled that the accused be charged with murder. The trial was slated for 2018 but was
    delayed due to immunity certificates provided by JDF lawyers, protecting them from prosecution
    for their actions during an operation. These certificates were deemed unfair and unreasonable
    by the Constitutional Review Court in February 2020.
    Subsequently, the Court of Appeal mandated a "voir dire" to assess if prosecutors could
    challenge the certificates.
    Almost 14 years later, on April 3rd, 2024, Justice Palmer handed down his ruling that the
    certificates cannot bar the trial from proceeding and it should go on.
    In response to King’s Counsel Valerie Neita Robertson’s indication of her intent to appeal the
    ruling the DPP said
