- KEEP IN MIND: You can file one application to bring multiple
workers to the USA on the H-2B visa; you can bring multiple
employees at the same time on the same petition.
1. The US company must submit the prevailing wage determination with
the US Department of Labor at least 60 days prior to the start date of the
employment
The prevailing wage determination is basically the US Department of Labor setting: the minimum wage to be paid to the H-2B employee based on the area of employment and based on the position you were planning to fill with the H-2B visa worker.
2. The company must submit a job order with the State Workforce
Agency and the H-2B application for temporarily employment certification
form 9142B with the US Department of Labor within 75 to 90 days prior
to the start date of the employment.
The job order must be compliant with state law and federal law
Within 7 days the US Department of Labor will issue a decision and
you will be able to continue the process.
3. If the position is certified by the Department of Labor, you can continue by
filing form 129 with the US Citizenship and Immigration Services and include
the temporarily labor certification with your Form 129 application.
Good to know: premium processing is available with an additional fee paid to
the US Citizenship and Immigration Services and you will get a response
in 15 days.

Thank you for your message. You can change status in the US from B1/B2 status to H-2B status. However, change of status to H-2B is NOT done by filing form I-485. Form I-485 is an Application to Register Permanent Residence or Adjust Status.

However, a national from a country not on the H2B list MAY only be the beneficiary of an approved H-2B petition IF the secretary of homeland security determines that it is in the U.S. interest for the national to be the beneficiary of such a petition.

The H2B Visa worker is already in the US and had a contract renewal. How does he know the status of his visa(before leaving the country of origin, the validity of the visa is only 8months)? Does it mean that once contract is renewed, the visa is also extended? What are his rights, limitations and privileges while working under the H2B visa? Does he have an option to move from one contractor/sponsor to another after he finish his contract from the original sponsor? It will be a great help if you can give light to this matter.
Hello @naturelover7433. You can check your I-94 record to see your status and date until which you can stay legally in the US. To access your I-94 record please visit i94.cbp.dhs.gov/I94/#/home and select Get Most Recent I-94. You can only stay in the US until the Admit Until Date. To stay after the expiration date you need to have an extension of stay or change of status from USCIS. Thank your feedback. We will aim to create informational videos to answer your other questions.
