    I just went through my hearing at the end of March. One of the first things the judge said to me was “ What we look for is consistency” . That was an extremely important part of winning my case.

    I'm 54. Been diagnosed with depression/anxiety/bipolar 2. I have had 5 surgeries including 3 for fusions in the L5 S1 lower spine. I'm going for my hearing in March. Wish me luck!

    Hello Sir, my hearing was August 10th 2018 and it went VERY WELL.My attorney did everything you've mentioned in your videos, we walked out he shook my hand and said congratulations you've won your case. It was an appeal. The vocational witness said "no jobs" I'm 62. Today I received a letter from the ALJ and she was going to add to the file the previous ALJ ruling. I received the letter before he got anything electronically! I can't get in touch with my attorney today but a paralegal said I shouldn't worry about it. Your thoughts please. Oh, the ALJ said if no word back she'd make her decision in 10 days. Thanks for all you do and THE GRID RULES REALLY HELP! I didn't have a rep last hearing but have learned so much from you. I'll buy you dinner when I'm in Atlanta. Best regards

    I have now had 2 major back surgeries, the latest in January of this year. It involved removal of 4 screws and 2 rods, installation of 10 screws and 2 rods . 2 years ago I had a double fusion in my neck. 1 year ago I had a 4 corner fusion of my right hand. All of this by age 53, waiting for my hearing next year.

      Jim, clearly you had significant surgical procedures. The question for SSD is not about your diagnosis or surgeries but whether you have regained function and has your pain lessened.

      Jim, I am close to your level of medical interventions. I have had two hearings and now am before the court of appeals. Prepare carefully for your hearing. Beware that you can say things in the hearing which can be used against you even if they are true and supported by the medical record. Protect your rights at the hearing by defending them.

    Thank you for this one, I am navigating the appeal process now with my back pain and I have all that you listed except surgery because that's not an option for me ( I'm sorry Mr Stench there is no surgery that will help you in this lifetime"), so this video gives me hope, Thank You Counselor.

    I had a complete AC separation of the shoulder 2 years ago. No ligaments or tendons to hold my shoulder to my collar bone. My neck and upper back around the shoulder blade seize up in burning pain. I went to my consultative examination today. I was there early this morning on time for my appointment. I waited for hours why people came in and left the entire time. They made me wait till the end of the day when everyone else had been seen. I was out in the waiting room all day with my kids. I didn't even get to see the doctor I was scheduled to see. The person I did see talked to me for 5 minutes and was extremely rude didn't even look at or examine my neck back or shoulder. The exam took place after my first appeal. Should I get a lawyer? How could they determine my disability if they didn't even look at my shoulder or neck? Thank you for your videos.

      Get a lawyer. You have valid claims that the consultative medical exam was improper and therefore invalid. Beware that they could record video of you caring for your kids and conclude that your shoulder does not cause significant limitations.

      M me Trust me when I say this The doctor that is hired in the court does nothing for you. Make appointment with multiple doctors and you can bring their records to court. My judge denied records. It's been 3 years already. This judge that I had HAS the worst record in Illinois a 27% approval. My attorneys now are going back to court asking the judge to explain why he denied the medical evidence and the 12 licensed doctors who stated their findings. If he can't or won't change his verdict then We will go to another judge above him. Our laws need to change filing and receiving benefits for proven illness and being disabled is a joke. By the way I also have short+long term disability insurance that I can't collect and is in a lawsuit since 2016. I have worked over 25 years and can't even collect employment because the doctors won't released me back to the work force and you need to be actively looking for work to collect. If I do look for employment I am going against the advise of all the doctors. Just let everyone know Congress has played a part in this. My attorney notified me with a letter stating this in December 2017.

    I am 51(almost 52). Spinal stenosis, bulging disc and herniated discs..MRI scan and x rays. On Norco, baclofen and gabapentin and cortisone shots. I'm at hearing level but it says pre hearing review. Hoping for good outcome. I'm at hearing level and only applied a year ago

    I was hit by a texting driver. In 2009 I was put on LTD from work. Applied for SSDI in 2010. 2 back surgerys 2 knee. been in pain mgn since 2011 been before 2 aljs 2 remans. on meds big pain meds. Everything you said i've done. The last alj didn't like that i'm on LTD from work of 36 years. yes i'm 55+ The lies and bull from my case are crazy. The doc said no bending the alj said i can bend?? That's why another remand. I've been trying for 8 years 17 doc's from mine to the LTD co, and SSDI's docs every one said i can't work. Really! No joke! Thanks for all the info i've watched for years. Everything everyone puts out says i should get it. But Lies are stronger than truth with SSDI!

      I had to have back surgery because someone hit me because they were using there phone driving now I can't work surgery didn't help nerve damage is to bad and the doctor said I'd have to have surgery again lol I think not!

    My appeal is 24 days away and I found this video the most important and relevant. Alot of things you said are exactly what I've done facet injections, antidepressants, working a month and quitting because I couldn't handle it. Wish me luck.

    This video fits my history to a tee....everthing in order just the way he said it..down to the depression and PTSD!! But scared to death to do this but I know I have to very soon. My mother is helping with my bills and her and my pain don't mix. #prayingforamiracle

    I have spinal stenosis, DDD, herniated and bulging disc ,sciatica.. I'm in chronic pain..My second opinion neurosurgeon denied me surgery for many reasons.. Age
    Weight...I've lost and he said there is so much wrong recovery will be overwhelming... He said if he removes 1 disc my whole back will crumble

    Should a person wait until they are initially denied SSD before they acquire an attorney? Or would it be advisable to attain an attorney beforehand?

    My pain is all in my left leg - I think I have stenosis from lower back to foot - for 17 years, not able to get a prognosis, I am now 50 and going to physical therapy again for another MRI and the pain is worse, I can't stand or walk for very long. Going to spine/pain management - I don't have any pain med to take, they took me off of vicodin, and the other stuff bothers my asthma. Got a lawyer - hope after I get this MRI they will give me a diagnosis. Do the doctors have to give a Prognosis, I've been told it's sciatica and mention of stenosis but don't know if this will be enough for a judge at the hearing?

      You need your doctor to identify specific activity limitations more than just a diagnosis. For example if your sciatica impacts your standing and walking you need the doctor to say that you are limited to standing for < 1 hour; walking < 2 hours and that you need a 30 minute break every 3 to 4 hours to rest for 30 minutes. This is just an example but I hope you can see that this level of detail would allow a vocational expert to answer questions from the judge about your capacity to perform reliably the duties of a simple, entry-level job.

      I understand I live with severe spinal stenosis and it's so painful they have been denying me for years now severe degenerative disc has also I think the injections soften my spine over the years .I try to manage it with medication but lately they talk about it so bad I am afraid to take it.But if I don't pain elevated my Blooodpressure so keep trying they have denied me over and over and I meet all my criteria. Work kg ed since 14

    This is my situation.......54 yrs old. Worked in an industrial type setting, same job, last 25 yrs. Crippling sciatic pain in 2015. Imaging showed stenosis and bulging discs along with a congenital small spinal canal. Epidural injections worked for a while but became ineffective. Neurologist recommend surgery. Laminectomy and facectomy L2thru S1. Had surgery in Sept of 2016 and sent home the next day.....WITH A DURAL TEAR! Leaking spinal fluid had me in emergency surgery a week later. This screwed up nerves in my right leg. At first it was tolerable and back to work i went. Over the next year or so the neuropathy has gotten so bad I am off work on std. Treating my condition with meds and PT. IT'S NOT WORKING. They want to put in a spinal cord stimulator but there is no way I am going under the knife again. My employer is terminating me and putting me on Ltd in 2 months.
    I guess my question is do I have a case and should I seek counsel now or wait until I go on Ltd?
    Thanks for all of your videos. I have been Bing watching them and every thing else I can on the subject. It all seems so daunting and unfair.

      Yes, I think you have a case. Sounds like a failed surgery and your complaints are certainly consistent with what you have been through. Take a look at your LTD policy - many of them require you to repay the LTD carrier if you get approved for SSD. Also many LTD carriers try to push you to hire a non-attorney rep (they often have contracts with these companies). I think you are better off with a lawyer so I would say to talk to a lawyer before starting the LTD process.

      Social Security Disability videos Thank you so much for your quick response. You are correct. My Ltd policy does require a payback or offset from my ssdi back pay, assuming I would get any.
      I will look into counsel right away. I just hope I can get my docs to cooperate.

    Treating neurosurgeon/spinal expert says condition was there years before date last insured; MRI shows multilevel stenosis, spinal-cord impingement, root nerve impingement, disc tears, spondylosis, etc.; _two_ vocational experts retained by SSA said under oath that no jobs are appropriate for somebody in this condition, because of unreliability of attendance; work records show multiple absences last couple of years; spent years trying to find _any_ job I could still do, but unsuccessful. It all added up to initial denial, then ALJ denial, then rehearing by ALJ and another denial, then Appeals Council denial (and their response clearly indicated that they hadn't even read the brief or the evidence).
    So that's what the process is like for many people, especially where you've got an ALJ who's a kneejerk denier, or (as in my case) one who got slammed by SSA for too many approvals a few years ago, and ever since has been trying to rack up the denials. It won't have much to do with whether you're actually disabled.

    I'm 62, and have had my hearing, and waiting for my decision. I have six discs gone, ostioarthritus, spodiosis, sciatica, and long term (since 2003) shoulder injury. I couldn't lay on my back long enough for a MRI, but have other like exrays, done. I collect Social Security, and do have a lawyer. Am I going to win? I did tell the Judge that there is one standing MRI in Wisconsin, but it cost 13,000.00 and could not afford to do it.

    How long could a case like this take ? I'm 56 and have spondylolisthesis and have been working in some kind of pain for around the last 5yrs I'm current having a lot of pain sitting getting injections next week but they never last .

    Do they ever approve anyone early without a hearing if there is plenty of documented proof and your doc has already written a letter saying that you are permently dissabled?

    Aside from needing surgery for a bulging disc, the MRI also shows Moderate Facet Osteoarthropathy in my L4/L5 and L5/S1 (Which is where I'll have Surgery for the Disc), Should I inlcude the arthritis on my application as well even though it has not been addressed by a physician ?

    From my third injury in 2003, my MRI film I brought was not allowed in my case. None of the doctors wanted to see it. It seems they obstruct evidence from the start.

    Thanks for the video I had back surgery in 2016 had my hearing May 2018 the judge just sent it to the writer Sep 2018 I'm still waiting! I've got depressed after surgery still can work back surgery didn't help! I've got COPD and Reynolds syndrome! And heart problems! I'm 49 years old with a lawyer!

    For my cervical spine my doctor went right to a fusion no pt or injections now for my lower back he wants to go straight to surgery as well,but I haven't did it since the cervical didn't work,now I'm an pain management Wich does no good either

    What if i have no insurance to get surgery or treatment? I am very depressed due to the diffused, congenital stenosis, bulging herniated disks, mild flattening of the central cord, mild bilateral narrowing of the foramina and arthritis. Just seen a ss dr 12/15/18. Its been a year next month without working because of the severity i had to stop working, i had missed a lot of days when working due to the tingling, numbness, stabbing, and wasp sting type feeling in my fingers, plus blurred vision, and not being able to control my urine.
    Brevard Health Alliance is a "clinic" that refers patients to specialists to pay out of pocket to seek treatment, but with no income, and no insurance what can you do but suffer. I cannot live this way to much longer and i have tried to call Disability Attorneys, left messages for them to call back and never heard a word. I live in Florida btw

      If you have applied for SSDI and have no income check with social security about what they can do. Some states will provide you with Medicaid for a few months so you can go to the specialista.

    You need to document the limitations that spine problems cause you. Your activities of daily living will be scrutinized for indications that your claimed limitations are not as severe as you make them out to be. Third party witnesses can tell the ALJ what impact your spine problems have had on your ability to do housework, care for yourself, socialize, travel, etc.

    Thank you for your videos! I check all the boxes mentioned in the video, except for I’m 40 & I haven’t been able to return to work. 2 neck fusions , 1 lumbar & spinal cord stimulator. My lawyer is asking for a supplemental hearing because my post hearing consult exam was unfavorable 😡. Have you had experience like this? This has been going on since 6/1015!! I’m tired, upset, and ready to give up.

    I have been a banquet manager and server for 40 years next year. 5 years ago I had 3 pancreas attacks it takes a long time to heal, then I broke both of my wrists they both have plates in them, then I have bunyons I had 2 surgerys on my left foot now I need surgery on my right foot mabey another on the left, I havr arthritis in my lower back and osteoporosis I shrunk 3 inches in the past year because of the pancreas I only weigh 110 I was 5 foot 11 now im 5 foot 8 they say im not malnourished and I can work for 10 hours on my feet serving people,,, some days I cring just to get up to go to the potty

    I’ve been waiting 2 years for my hearing and we have to go the avenue of electric shutoff notice and landlord intent to sell. Half dozen things you mentioned in this video fit me to a T and age below 50, otherwise grid rule would apply.

    Hi Mr Ginsberg the dds worker approved me at application level on April 3 2018 blue book for Cardiac condition and several other things I'm 42 well quility review has it for 30 days now how long are they going to take deciding someone said don't worry they won't change the decision is it true and how much longer do I have before they send a letter to me please answer thanx

    I was born with severe scoliosis. Have 7 inch rods in my spine. Have had many medical problems since. L5 was bulging. Had surgery was bed ridden . Arm injury. Other mental diagnosis. Ssi calling me first time claim tomorrow. What do I say???????

      Celena, talk about how your medical issues impact your capacity to function both physically (sitting, standing, walking, lifting, carrying, etc.) and in terms of pain (poor focus, concentration, reliability) SSD is about your capacity to function at work. Good luck.

    I have pkd n have back pain all day everyday I can't stand too long or walk far other health issues as well that come with pkd I just applied for ssi n ssdi n the ssi already denied the ssdi say a medical decision has been made were processing your benefit application 😕

      The SSI may have been denied for non-medical reasons like household income over the limit. Hopefully Social Security is looking closely at the medical evidence and will decide your SSDI claim favorably.

    I have a hearing in november i have documented anxiety depression, lumbar stenosis 2 bulging discs, DDD ,arthritis, cervical stenosis, bone Spurs of course the leg hip pain tingling crawling feeling i have a 10th grade education i was a grounds keeper for the city for 14 years( still think that's what killed my back rough ground and on a mower all day) two mri's, xrays and my Dr filled out a Rfc form for me we have tried all meds for my anxity and deprssion and on pain meds all day everyday for my back i have lost all intrest in all hobbies. I have no quality of life. Dr says with all the way my tendons are all scar tissue no chance of surgery to close to spinal cord. And the spinal stenois has caused urinary and bowel problems also. But worst of all is not being able to work and provide for my family the guilt is rough. Thank you for all you do

    I have a question. I'm 56 and just received SSDI. It starts in June. I am receiving 2 years back money. My question is do I have to take Medicare? I currently have Blue Cross Blue Shield through a pension. I have a 19 year old that is on my insurance with me. I get a survivors pension from my late wifes employer.

    OK, I have a question, I'm currently out on medical leave due to chronic fatigue, back pain and depression. I have almost every single thing you list as proof, have had full back reconstruction and full fusion, nerve pain, pain management, physical therapy, multiple xrays, MRI's, ectc. But just taken out of work and not looking like I can go back. I'm also set to see therapist for depression soon. How long do I have to be out of work before my case would be considered. I am 50 by the way and have been dealing with this back pain for many years.

    I am scehduled of have back surgery (Decompression Forminotomy and a Discectomy) in Feb. 2019. Should i apply for benefits now or after surgery ? What are the chances of being approved since I've been out of work since April 2018 ?

      I would go ahead and apply now. I would think that it will take at least 2 months to recover so you would be out of work for at least a year and therefore qualify for a closed period at a minimum.

    Will I be eligible for S.S.I if i had a decompression surgery ( I had stenois) so I just had a decompression surgery to relieve some of my pain .

    Heres a question.....lets say I am a millionaire...lets just say and NO I am not. But I cannot work anymore am I entitled to SSDI? Or lets say the last two years I made over 50k, but cannot work anymore with proven documentation. Does this hurt my case when I go for a hearing?

    i have back and neck pain and constant head aces from a work place accedint 12 years ago ive been in and out of work because i strugle working social security has been in formed and wont acept my claim and keep making me look for work im 50 now and even worse than i was 12 years ago but it dosent matter to them ive had enough im thinking of doing something drastic to them which may put me in jail my depression is to far gone and also my paitains somethink is telling me to make a point and harm.sorry if people dont understand but im tired of being treated like shit by the system that is sosposed to be working for us. punish me i punish you,,,,,,
