I have much respect for this man and his wisdom. I have been watching him for sometime now. I also pulled the list from the video so you can be mindful of the five things 1 judges prefer people for claimants over the age of 50 2 judges and disability cases prefer people with a long and consistent work history 3 judges really prefer claims where your medical problem can be imaged objective documentation 4 judges prefer cases where there is a definitive diagnosis 5 judges prefer that you treat with a specialist as opposed to a family doctor
John, you are spot on with your summary. On June 1, I have a new podcast episode called "The Five Elements of a Winning Back Pain SSD Case" that will go live at ssdRadio.com. You may find it helpful.
I watched all of your videos that were relevant to my medical conditions before I filed for disability. I just received an approval that took only took 5 months and one try. I’m a bit disappointed that I won’t get back pay but I’m not willing to have a favorable decision overturned in an appeal. I’ll take what I got and be happy about it! Thanks for all the good videos!
That's great news, But if it only took five months you wouldn't be entitled to back pay. I was approved on my second try after 14 months but they set my on-set date 7 months and that only gave me 1 month back pay so I appeal it and now they say I'm not disabled and cancel my benefits. So I just appeal that and have to go before a Judge but it may take 2 years before i see him. and now i have 0.00 income for maybe the next 2 years. I wish i could of taken it back.
@@Richard-nq3rh My understanding is that from the date judge determines onset of disability you lose the first 5 months of any benefits. As in my case it was 17 months since onset so I received the last 12. I would have been happy at any juncture whether it be 1 month or 18. The objective is to win your case. Too bad they backtracked on you but I have seen many people focus on back benefits and and appealing that may have raised a red flag with ssa. Always quit why you are ahead.
Yes back pay is good and they will do they're best to get out of paying you you're past benefits but just be happy that you're gonna get a check and that they approved you because you don't wanna argue with a judge that could over turn his decision that's a chance i wouldn't take. The more I've thought about it , trust me it's frustrating because you worked for that money but when you can't work and need an income coming in to pay you're bills i would just be happy to get both but if it came down to it i would just be happy getting an income coming in every month so count youre blessings if you win. Because some income is better than no income at all just remember that especially when you do usable to work.
Johnathon, you are the most helpful and using language we can understand. I’m glad to say I can check off all 5 boxes. I loved my teaching job for 33 yrs but physically can’t do it any more. Your videos educate people going through the process. Thank you
I've watched most videos on UA-cam about Social Security disability and I would say you are the most realistic and informative that I have found. With that said this is my case, 1st of all my work history I worked as a kid in HS at McDonald's for 3 years in HS I was in some special education classes to help me with English my English teacher even said in 1986 the year I graduated that I shouldn't pass but since I had already been accepted by the Army she would pass me, I then joined the Army for 6 years and was in the Gulf War in 90/91 I was with the 101st airborne, I got an honorable discharge when I just didn't reenlist, I then was hired by Schneider National as an over the road truck driver I stayed with them for 23 years until my drivers license was taken away due to my disabilities in February of 2015, I had 31 years of work with no interruptions. My disabilities the biggest is seizures (the doctors who have treated me don't know if it's seizures or seizure like activity I've had two separate doctors watch me pass out and go into seizure like activity with loss of bladder control, I have arterial fibrillation high blood pressure fibromyalgia joint pain migraines and vertigo. I have tried and so far failed at getting a diagnosis of Gulf War Illness but that's what I think is wrong with me. I take Valproic Acid for my seizures and migraines. Amlodipine and metoprolol for high blood pressure and afib, and Gemfibrozil for high cholesterol. I filled in February of 2015 was denied filled for the reconsideration appeal Was denied filed for hearing, at hearing everything seemed to be going my way after my hearing my lawyer said she could almost guarantee I won my case, in her words you never know what a judge will do but it looks so good only thing is onset date weather it would be when I 1st applied or when I turned 50. The judge sent me to a neurologist, the neurologist staff said I didn't have an appointment but when I showed them my appointment paperwork from SSDI they said they would work me in, the doctor took all of 3 minutes with me didn't like at any paperwork I had brought with me but said my problems seemed to be Cardiology in nature so recommended I go see a cardiologist, the judge how ever said I didn't need to see one 158 days after my hearing I got my denial letter, in it the judge said I was disabled but I could still be a "Photo Copier Operator" a job that the vocational expert brought up during the hearing but later said I couldn't do because I would miss too many days of work. I appealed but was denied so on my lawyers last advice to me before she dropped me was to reapply so I did reapply a few months ago. Any advice you can give me I still have ongoing appointments with a neurologist and a cardiologist through the VA, anything I should try and get them to put in my records thanks so much I know this was a very long conversation
I should add in my denial letter it almost sounded like the judge really wanted to approve me but thought I was just a little short, the judge went on and on about my 3 minute appointment with the neurologist of course he had no way of knowing it lasted only 3 minutes. In my new claim I put depression as a problem as well but I went into the VA for it but they said I was not clinically depressed. I feel so low just thinking about my case. One question I'm interested in is in your opinion do people have a better shot 2nd time around or do the chance of winning goes down because I waz denied the 1st time?
I was approved at age 34 with hemochromatosis, fibromyalgia, depression, anxiety and vestibular nerve damage in my left ear. I also have all of the lovely side effects that come along with it. Headaches, insomnia, vertigo and balance issues. etc.The judge actually leaned on my fibromyalgia diagnosis for the approval. I don’t know if it helped that my mother had fibromyalgia and an extensive medical history or not. The judge didn’t even mention hemochromatosis in his decision. I was pleasantly shocked. I really expected to be denied based on everything that I’ve read. My testimony was credible and I saw multiple specialists and had numerous amounts of testing consistently for 3 years before my hearing. My specific judge only had a 32% approval rating at the time of my hearing. I believe he was the lowest at the local hearing office. Maybe I fell into some kind of “quota” or something. Either way, it was a god send. I was desperate.
It sounds like your approval was well deserved but yes, you don't fit the profile! I would continue to seek treatment and keep your medical records in case SSA decides to review your claim in the future.
Thank goodness you got approved. I also have hemochromtois, which most people don't even have a clue what it is. It got caught by my Oncologist because my platelets were off the chart. I am 60 been denied, I fell two years ago onto a flower pot and broke 3 discs, herniated 2 acutely, got 2 bulging and in pain management taking epidurals , hydrocodone 10s, gabapentin, muscle relaxers and 16 other meds for type 2 diabetes, thyroid, ect all found by the Oncologists!! Was referred to a law firm by attorney Genisberg and awaiting my hearing!! I can bearly move and awaiting back surgery, but has be delayed due I had a heart attack on February 15!! I also suffer from PTSD, but that is the least of my problems, been dealing with it for yrs, but load noises sent me off. So glad you won!! With your age keep in order all your records in case they try to pull you back for an evaluation!!
Good for you. I'm 37 and have filed for disability for fibro, also. I also included my mental health issues. Just waiting on my hearing date. This is my 2nd go around.
I too watched many of your videos before my hearing. I had an attorney. I received notice that I was approved for SSDI as of today and your videos helped me to know what not to do/what to do! It was a two year process here in Houston, Texas. I am 60 years old with a severe cellulitis infection of the left lower leg with MRSA, which means it isn't likely to heal anytime soon. I was a legal secretary for most of my career. I had two surgeries in 2019. Judge sent me to a post hearing CE and the internist there said I had a severe impairment and could not work, but filled out the form wrong, so the judge scheduled another CE in January 2020, but when he received the records for my second surgery in Aug. 2019, he approved my case as of today and cancelled the next CE, thank God! Your videos were instrumental in my winning my case. Surgery is obviously one important thing that the judges look for. If you're bad enough to need surgery, that indicates your condition is pretty severe. I only saw internists and vascular surgeons, as I don't even have a family doctor. I think that did make a huge difference. You're SO right, Mr. Ginsberg. Seeing specialist doctors is one of the keys to winning disability, although it's very expensive. I had to get on Harris County healthcare program and that saved my life. Otherwise, I couldn't have afforded specialists and surgery. Hopefully anyone watching will be able to qualify for their county healthcare. It's not the best, but it allowed me to afford surgery, etc. Thank you SO much for your videos!
I want to let you know that after I filed my case, I started watching your videos. I filled in Jan. of this year. I used a lot of untraditional evidence like doctors notes stating how dangerous it was for me to work, letter from employer telling them there wasn't much they could do for me as far as work. I had 4 doctors that did not believe in doing fcr's. I also asked the ssdi adjuster to look at the grid rules because of my age and education. It has taken until today to get that answer. I have not received an approval letter, but when I signed on to the site today, it said how much I would be paid starting next month, and how much back pay I would get. I am assuming this means I was approved. I hope to get the letter from them any time. I just wanted to thank you for your videos and free advice. I am sure it helped my case. I am 56 and it has been a long 10 months. By the way, I hired a law firm that didn't help me at all with advice or even filing. All they did is just pass info to ssdi. I am sure they sill want their cut of the back pay anyway. Keep up the good work and thank you again.
I've been watching your videos you explained things by far better than my lawyer. I am 55 yr old had so many surgeries worked for 35 years and my last operation was L5s1 still have back pain and on the top of it I developed severe anxiety and depression have no thyroid and no hermons is pushing my body down hill. My court is in April after my surgery and during my case i went back to work but after 6 months i got laid off because of my lack of work in IT world. My lawyer stating I have a chance of winning this case by 90% not sure anymore take care of my health or worry about how to live. The system should at least respect those who worked and not able anymore my case is going on almost two years
First applied at the age of 42 and now I'm 52 and currently waiting on a decesion I've got plenty of medical 2 MRI'S been diagnosed with sever depression along with 2 other mental issues and with 3 surgeries and now the Illinois Dept of Human services is making my decision. Look forward to a reply. God bless..
It was 3 years before my case went to a judge but when it did he didn't even require a hearing. He awarded me my disability and went on to say in my approval letter that my case should not have needed to come to him as it was clear I was disabled. He also went on in making some very reprimanding remarks to the ones who had been denying my disability. What is remarkable is I was able to go back to work physically. I had surgery and was successful in helping me stay active. The problem and why I was disabled was because I became a liability to anyone who would hire me because of my spinal injuries and the implants to my spine. Because of my back I was no longer employable. Something I feel gets overlooked far too much in these disability cases. A client might be able to work but no longer a person that can be employed due to risk of liabilities.
I have congenital scoliosis and klippel feil syndrome, spondylolsthesis, severe facet arthritis, degenerative disc disease, bulging discs, mass effect on nerve root. I'm only 42. I have these back issues from my scoliosis and back history. Doctors told me a long time ago when I had a spinal fusion that I will develop back problems like arthritis earlier than normal age in life
Thank you very much for all of your thoroughly explained legal information. I'm quite sure that it helps people that get lost in the Dark World of Applying for Disability. Lol!! Kidding aside. Your a good man. Thank you for helping those whom have gotten lost in the legal system. Many of us could not afford an attorney. Happy Holidays to you and your loved ones-Christine
Great info! I’m 45.. MRI evidence of failed laminectomy syndrome, 20 years at previous Job making 90,000.00 a year. I hope the alj in Nj think like alj in your state! Folks this is a looong process.Im 2 years in and still waiting for a court date. In NJ it can take 24 months to get a hearing
I got hit buy a van on my bike and kept all the paper records with all Drs , specialist, hospitals and all medical findings sent from lawyer from start to finish.Cant argue with facts..
I agree and I do fit into all that you mentioned. I had my hearing with a judge July 24th & I am still awaiting determination. I'm 52, worked 15+ years at the same job, have 36 yr work history and have several health issues that I currently see a cardiologist, pulmonologist, arthrits/rheumatologist and my primary care Dr. I am also now seeing a clinical psychologist for depression and anxiety. I'm simply waiting....and becoming more depressed and anxious by the day. Idk what to do at this point.
Videos are informative. My meeting is tomorrow with a judge that only has 34 percent approval rating. Personally I don't think I should even be having one. Should all be workers comp. I'm 55 with 21 years with the same company. Eight years with its contractor before that. All injuries documented and on file with employer. I'm a lineman. They're holding my job even after two years of being sent home for being too injured, and my supervisor has since been let go. The union is worthless. Yes I do have a WC attorney. He says we're battling three major corporations with attornies at their beck and call. My SSDI attorney is through Prudential who I have personal dissability ins. through. Who by matter of fact have deemed me disabled and unemployable and why they're paying to get me on SSDI to lessen their burden of payment. Never can have too much insurance. Especailly when you have a dangerous job. Or any job. Don't count on others. Don't believe the democrats. Nothing in life is free. Someone has to pay and it's usually the hard working already over taxed person.
Mr. Ginsberg, thank you for all of your videos. They are extremely helpful and informative. I am age 50 and applied for SSDI on my own in December of 2018 and have heard absolutely nothing. Is this normal? In addition, my medical condition has deteriorated since application in addition to me developing an additional qualifying condition. Can my original application be amended to include this new information without affecting what will hopefully be my onset date? Thank you in advance.
I got it and really didnt need it at the time. I actually called and and told them to stop paying me and they said i needed to wait. Luckily they didnt because my medical condition came back. God bless American👊
45 (will be 46 in February). Fibromyalgia, polymyalgia, TBI, protruding discs in lower back, epilepsy, neuropathy,.hypertension, hypothyroidism post surgery. Each one comes with a host of side effects including confusion, pain, swelling, insomnia, dizziness, memory loss, processing issues, and more. I've been denied twice and am in my ALJ waiting period. My obstacle is I have a PhD. I have only 2 1/2 yrs of medical. I didnt have insurance previous to 2016. My attorney has been non responsive in questions. Based on just the info I've given do I have a case. I have been approved for my state's medically needy program Medicaid. I have been signed off for a disabled parking pass due to not being able to walk or use my right arm more than 25% of function
So, I am 55 and have had L4-L5 S1 fusion and c4-7 fusion surgery and been a librarian for 28 years at same library. I’ve been paying into SS for 39 years, as all my jobs have been in libraries. New herniations C3 and L5 bulging and stenosis L4 nerve damage from hot to the touch head/ ear down left arm. Out on STD because numbness of right leg which gives out sometimes so I fall. Recent shots in neck did not help, hip from bursitis, shoulders from tendinitis and trigger finger both hands. Oh, and PTSD, all documented over 10 years. Do I have a chance? Ortho said no surgery because discs are spread, all new MRIs from this year showing damage along with narrative of MRI and testimonial from partner at work . What if I’m not candidate for another surgery? Last day worked May 25. Will apply with that as disability date even though must wait until 55 in August to apply. The stress of waiting and wondering is causing more panic attacks all documented with psych for 3 years. So scared I won’t meet the bar even though all my research leads me to think I could qualify.. This is way too long and doesn’t even discuss my limitations, which are many.
I am about to go to a hearing. I have type 2 diabetes, hypertension, 3 natural fusions, herniated and ruptured disc as well as narrowing of the spine.Diagnosed with DISH from a rheumatologist. I collected unemployment because I was laid of in June of 2019, that ended in Dec. 2019. I was off EUIC because of COVID, I took it to pay bills. Being 52, how do u think all this will come together in South Carolina? Not holding u to anything, just from your personnel experience.
I had a fully favorable decision at age 27, but my surgeon said he had only seen one other case of IBD as bad as mine in his entire 20 year career, plus I made one or two of the listings I believe. Now I'm worried about their case reviews. My condition is much worse than when I first got approved. I'm 5' 11" 125-130lbs, have a severe stricture, had several nerve blocks done recently and spend half my days in the bathroom. Still I feel like they could be unfair and cut me off and I would be totally screwed, maybe even end up homeless.
Hello Jonathan. I have been watching all your videos I'm waiting for my court case. Im So paranoid now. I'm 100 tdui from the VA due to PTSD and back and neck problems. Most of my records are from the va. I recently made an appointment with an outside doctor. What should I ask my doctor to do to help me. I'm 38 by the way. I do have an attorney. I looked at the approval rating for judges here and it doesn't look good. I'm so paranoid
Hi, I have a contact at a Congressman's office that gets monthly Social Security reports about my case. I have been waiting for about 3 and a half months since I was in front of the ALJ and she (the congressman's office) has a report that has a code that reads "DWCP". Do you know what that means and dose mean that I am any closer to a decision?
I swear I love all your videos. They are all very helpful. I watched them over and over . Never get bored . But hey I have a question... Well I just had a decompression surgery . & Had my hearing July 6 . Do think I have a strong chance. This here will be my 3 surgery. The first one was a decompression & fusion @L4 ,L5 &S1 , (second surgery caught an infection therefore they went back in . (This was in 2007 ...Now weeks ago I just had a decompression.@L3,L4.. I'm worried that the judge will say "let's see if she'll get well. " But I need my SSI ASAP.. I have other health issues as well. (Stroke throw my walk off) walk with a drop foot ...I still haven't got a decision yet . But thank u for another good video .. my God bless you !!
Mr Ginsberg, I know you`re a very busy man but I have an important question that I hasn`t been addressed in these videos as far as I can tell. What if someone age 53 suffered from an undiagnosed mental illness for decades before a diagnosis and has little work history because their family helped them and took care of them? The diagnosis is schizoaffective disorder, anxiety disorder and social isolation and they`re being treated for serious neck problems with hydrocodone and two other drugs including a mild muscle relaxer. The doctor treating the mental illness is recommending inpatient hospitalization in the coming days. Thank you for your great videos and valuable information!
Can you PLEASE ADDRESS the feasibility of getting SSDI for a 100% Permanent & Total VA disabled veterans like me (retired, 21 years) who, at 49, is at a point where my numerous maladies have beaten me down to a point to where I can’t work regularly? I have years of increasing medical surgeries and other medical procedures over time (at least 15-20 years of solid medical records and treatment)… I also read that 100% P&T vets get expedited review when applying for benefits. Do you think the expedited process is a benefit for these type of vets?
Jonathan, is it ok for me to drive to my hearing. My hearing is five miles away which is about the distance I can drive due to my leg pain and numbness.
If you have no other way to get there, you have no choice but if the judge asks, explain why you had to drive and be prepared to answer questions about how often and how far you drive on a regular basis.
In regards to cases involving depression, anxiety, add - would an assessment from a neuropsychologist be considered objective evidence? Aside from weekly treatment and medication protocols, what additional evidence could I submit to support my claim?
It's a rough road that many of us take one foot in the gutter and one not. Extremely difficult for people that are single with no spousal support or other income. To this day I look back and ask myself how did I survive it.
@@ssdattorney Dont know if you produced a video on yet but was very helpful to me was having a DVR ticket. The vocational rehab expert that assisted the judge at my hearing helped the judge in my case determine his ruling
Hi, love watching your videos, very informative, I have a question: I have 7 degrees of vision left in my left eye and 9 in my right eye, I have a condition that slowly leads to blindness, I am applying for disability benefits, I have an appointment for a consultative exam, would like to know what that is and what should I expect? Thanks so much for such helpful videos!
A consultative exam is a review by a doctor on SSA's panel of doctors to determine the severity of your impairment. The consultative doc is not going to offer treatment but he/she will or should offer some opinion about your medical condition and how it might impact you trying to work. If your problem is with your vision the CE should be with an opthamologist.
What to do for learning disability cases? I know I would not necessarily want to see _their doctor_ but one who specializes in it more. I very seriously do not for even a second believe that the doctor the SSA sends me to would be able to determine it simply asking me a few questions. I don't believe that there is a way to get MRIs or other images that can prove this either. I have been in special classes even at the start of kindergarten. That may even be the time that some teacher noticed that I needed special classes. I still don't know the details of the disability or disabilities. I struggled in regular classes, I get confused *very easily* and subsequently frustrated. About what do do for those kind of cases, is it best to go to a psychologist or a psychiatrist and get their opinion? Of course get it in writing and have them add it to your medical records and send a copy to the SSA. Or at least alert the SSA that you have seen that doctor. I wonder though, when they send you the letter in the mail telling you they want you to see their doctor, can you simply go to a psychologist or do you have to ask them? These learning disabilities are much more serious than some people may realize and the worst thing is you can not tell that someone has them simply by looking at them or speaking with them. I may be due to get one of those letters in the mail in the next year or two. They send them out every 3 to 7 years or so. The way I see it 3 or any sooner is just punishing someone for being disabled and that is just mean!!
I have been a hydraulic and heavy duty macanhic for years. I've been paying ss for 30 years. and now I have had 2hernia surgeries diabetes sleep apnea rls neruppathy in my feet and legs and have had pancreatitis two times . Also I have had spinal fusion level two and also have low back pain as well as siatic pain in my right leg. I have attorneys working my case but never have I spoke with the attorneys. I filed September 2017 it's now October 2018 and I'm in reconsideration stage. And there's other things that it's just too long to talk about. Just wondering what you would think about my situation? And I am 46 this month.
When do they consider the advance age factor for someone 49 and 2 1/2 months like myself. Do they consider this when you file or the day of your hearing ? When is your age considered? Thank you Mr. Ginsburg love your videos .
Thank you sir, I’m 41 and thinking of giving up and try to find some job that can accommodate my problems. I’ll wait for recon stage to determine I’m definitely going to be on an uphill battle. Keep it up counselor!
Thanks for your fast response.I have been disabled for more than 1 year and social security knows that and I just had a hearing also so if grant retro payment, it won’t be over a year? And also do my kids get retro payment? Thank you
I have a huge issue/worry and one big thing is I am currently 24. I just had my hearing after being denied but I also had a stroke happen to me on top of my adhd, depression, and anxiety. I had to enter the hearing today representing myself and I pray it doesn't affect it. I had my judge ask not just 1 hypothetical question but 3 or 4 and I am just very very worried. Please give me some advice because I've watched multiple videos of trying to figure out which way my case went??. Thankyou
Hi I am in 3rd Appel for ssd. My lawyer 18 months before I get a court date. I am 57 years old have COPD and its hard to breath plus I have conditions called neurofibertous I was born with it. Why does it take 18 months to get a court. Hearing my COPD has gotten I go to a lung doctor.
I am 44. I have not worked in 2 years because I have a bone tumor disease call multiple Hereditary Exostoses. I have multiple osteochondroma's in my knees hips and ankles, now that arthritis is setting in my pain is excessive and my mobility has dramatically decreased. There is no cure, only monitoring my disease. Do I have a chance in getting social security benefits? I have been working since I have been 15 years old, and I have enough work history that I will recieve benefits.
Hi im 47 and had surgery on s-1 through l-4 (fusion) and was denied before the surgery. Now i am full of screws and rods. I've worked for 30 years prior. Do i now fit a "listing" and do i have a good chance now of being approved?? Thanks I enjoy your videos.
Steve, look at 1.02, 1.03 or 1.04 - www.ssa.gov/disability/professionals/bluebook/1.00-Musculoskeletal-Adult.htm. You will need your doctor to conclude that you meet a listing.
Well. Today i checked online and it says i was denied... I dont understand, according to the doctor i cant bend lift or twist for the rest of my life. Plus im on enough meds to put down an elephant... Are they just waiting for me to die so they dont have to pay? I cant walk more than approx 100ft without stopping. I dont know what to do. 30 years working for nothing i guess....
I had a: local attorney who didn't do anything for me . I went around gathering all the medical records he has on me and I wasn't really able to do it . I got a call from a firm up north that said they would take the case . They said they wouldn't be willing to fly a lawyer in from Boston to Kentucky if they weren't sure of themselves . At 47 and with a herniated disc , several bulging discs , spinal stenosis and nerve impingement I like what they are saying . They'll go back and regather records and all I have to do is show up for the hearing , which BTW they are moving back a few more months to have time to prepare
I have been diagnosed recently with both bipolar disorder and D.I.D disorders. I also manic depressant and anxiety disorder. It has taken well over 5 years observation by my Dr. Before they diagnosed me with bipolar and D.I.D disorders. I have never heard of D.I.D until then. I have had years now of loss of time and blackouts since my brain surgery. That was back in 2009. My ex wife wants visitation under supervision because of it. Will a judge look favorable towards this or will he or she look at it as pseudoscience?
My doctors will NOT offer a diagnosis. They said they would have had to test me before I got my condition; i.e. when I was healthy. WTF?!!! (I did not need to see a doctor when I was healthy.)
I got denied by the judge... my letter said even though I have a severe impairment I'm still denied... my lawyer is taking it to the appeals council..is this all a good sign??
Thanks for all your video, they helped me learn alot. My wife won her ssdi case with a full favorable decision. She is 32 with unfortunate chronic neck and many other issues. Judge said would take up to 4months for a decision got it in 33 days. Just waiting on are paperwork and are payment. Any idea how long till well receive backpay or her monthly check? 58k in back pay and 2135 a month. Thanks again ur very helpful and helps learn while we wait. God bless from michigan
VA is the hardest place to get disability in.a friend in Florida got her in 15mins of her hearing.i have been waiting for 3 years.and got denied.and I'm 48soon to b 49 n a4months
My son has Autism, he just got a job with the school as a bus aide..he makes next to nothing...would he qualify for SSD? He can't work 2 jobs, he has melt downs, anxiety (all part of the Autism).
If he is earning less than SGA (www.ssa.gov/oact/cola/sga.html), he could still pursue SSD. However, my experience has been that it is an uphill battle to win if a claimant is working part time.
Question-I am filling out the stuff on your website and requires a phone number, I have no phone and it wont send without a phone number. what do I do?
You're got to have a phone somehow someway they're is no way around that if you want a hearing. Just like the other person said you can do what they did best it's a must.
I am rated VA 100% disabled. I have been diagnosed with severe lower back damage on my spine from being Army Airborne with over 50 jumps. I have had MIR and Cat scans on my back showing nerve damage in L4 and L5 areas of my back. Plus I have had treatments with Chiropractor and Physical Therapy . Do I have a good chance at winning my SSDI case?
The chiro records will do you no good as SSA considers chiropractic as "alternative medicine." The MRI and CT reports along with your history will help. It would be even stronger if you had a treating doctor fill out a functional capacity evaluation or write a narrative report setting out your limitations on sitting, standing, walking, lifting, carrying; and a discussion about how pain impacts attention/concentration, production and pace, and reliability (i.e. needing to take unscheduled breaks or missing 2 or more days of work per month).
Darrell, the issue in a SSD case has to do with how your disc issues impact your capacity for work - and specifically what your doctor says about that. You need more than an MRI report showing a disc problem.

What are the chances for a 51 year old with facet arthritis mri confirmed and bilateral s1 radiculopaty emg confirmed. Have had long work history over 30 years in 3 jobs? Have been on std since August 2018 and now applying for Ltd. through my work. I just can't sit, stand, walk, twist, in so much pain.
Penny the better question is whether you have a doctor who will identify specific work activity limitations that, taken as a whole, would make it impossible for you to reliably perform any type of competitive work.
Sir, My hearing is in 4 days. What are my chances of winning? Just kidding. I would like to hear much more about your experiences with mental health claims. E.g., are they in general harder to win?, etc.
If at your medical they send secolgist at medical exam part and have on going fauiler and lose screws in a neck fussion and also add adhd and trouble concentrating and hand writtibg has diterriatided and very shaky when write and had your mom sit in on protion of exam and on way out she telks her u deserve it is it good sings or not

I have much respect for this man and his wisdom. I have been watching him for sometime now. I also pulled the list from the video so you can be mindful of the five things
1 judges prefer people for claimants over the age of 50
2 judges and disability cases prefer people with a long and consistent work history
3 judges really prefer claims where your medical problem can be imaged objective documentation
4 judges prefer cases where there is a definitive diagnosis
5 judges prefer that you treat with a specialist as opposed to a family doctor
John, you are spot on with your summary. On June 1, I have a new podcast episode called "The Five Elements of a Winning Back Pain SSD Case" that will go live at ssdRadio.com. You may find it helpful.
I watched all of your videos that were relevant to my medical conditions before I filed for disability. I just received an approval that took only took 5 months and one try. I’m a bit disappointed that I won’t get back pay but I’m not willing to have a favorable decision overturned in an appeal. I’ll take what I got and be happy about it! Thanks for all the good videos!
Glad you like them. I would also be likely to take the favorable. Never a good idea to appeal and approval.
That's great news, But if it only took five months you wouldn't be entitled to back pay. I was approved on my second try after 14 months but they set my on-set date 7 months and that only gave me 1 month back pay so I appeal it and now they say I'm not disabled and cancel my benefits. So I just appeal that and have
to go before a Judge but it may take 2 years before i see him. and now i have 0.00 income for maybe the next 2 years.
That's a blessing.....
I finally have a hearing after 2 1/2 years of waiting. I have had 5 surgeries including to fusions. I am also Bipolar 2. Wish me luck!
I hope you had good luck. I also have bipolar type 2 and am in the beginning process of applying for disability.
This gives me hope at 35. I have the same symptoms except my diagnosis is spinal stenosis and spondylosis with migraines and depression.
Good for you. I'm 37 and have filed for disability for fibro, also. I also included my mental health issues. Just waiting on my hearing date. This is my 2nd go around.
Wow!! God blessed in every way...yay😁😁
You are very welcome and congrats on the approval.
@@ssdattorney Thank you so much!
That is good news and you are very welcome!
God bless..
I wish u were my attorney.., in the appeal process right now. Keeping my fingers crossed
Very informative👍🏼👍🏼
I have congenital scoliosis and klippel feil syndrome, spondylolsthesis, severe facet arthritis, degenerative disc disease, bulging discs, mass effect on nerve root. I'm only 42. I have these back issues from my scoliosis and back history.
I know it is frustrating to wait from my end, I can only imagine what you must be going thru. You'll get your decision eventually.
Great explanation very simply put.
Mr. Ginsburg does a Torn Rotator Cuff / Surgery qualify as a disability??

I needed to know this

I would ask your doctor to address likely work issues you would have. Talk to your lawyer and practice your testimony - I'm sure you will do fine.
I am not familiar with that code.
Very helpful. Thank you so much
Tina, you are very welcome.
what if your a couple months shy of 50 will they give the the grid or the biased of being 50
I swear I love all your videos.
If this is your third surgery I would think that your judge would conclude that you have some serious issues that would prevent you from working.
Thank you counselor ur a very smart man .. blessings flow ur way.
Great information, thank you.
Yes, a neuropsych assessment is very solid evidence.
Could you make a video about how to avoid being homeless and destitute for the two to three period while waiting for a hearing or judgement?
Richard, there is no good answer to this question - here is a vid I posted last year: ua-cam.com/video/l35YCZqL4iU/v-deo.html
It's a rough road that many of us take one foot in the gutter and one not. Extremely difficult for people that are single with no spousal support or other income. To this day I look back and ask myself how did I survive it.

Social Security Disability videos Got it! Thank you! Very appreciated 🙏🙏
I am now having to face the tribunal without a laywer. Good luck to me!

Thankyou
How will a judge feel about people having seizures? I'm over 50
Seizure cases are tough. You basically have to prove that you continue to have seizures despite taking meds.

Yes, that sounds like a very winnable case. I'm happy to take a look - www.4socialsecuritydisability.com/free-claim-review/
Do u have any office in the Ft Worth area ?
I had a: local attorney who didn't do anything for me . I went around gathering all the medical records he has on me and I wasn't really able to do it .
I got a call from a firm up north that said they would take the case . They said they wouldn't be willing to fly a lawyer in from Boston to Kentucky if they weren't sure of themselves . At 47 and with a herniated disc , several bulging discs , spinal stenosis and nerve impingement I like what they are saying . They'll go back and regather records and all I have to do is show up for the hearing , which BTW they are moving back a few more months to have time to prepare
I would ask your doctor to write a report detailing problems you would have functioning in a work environment - that is the main issue.
@@ssdattorney thank you . I see him again on the 16th
What did the test show?
Usually you will see the first check about 30 to 45 days after the favorable decision is issued. Glad you find the videos helpful.
VA is the hardest place to get disability in.a friend in Florida got her in 15mins of her hearing.i have been waiting for 3 years.and got denied.and I'm 48soon to b 49 n a4months
Congratulations...I've been waiting for my decision since August 28 hopefully I get approved
Just finished talking to my lawyer...my case is in final stage for decision so should be hearing something in 30days
You say over 50, what if you’re 50?
That counts - 50 or over.
Hello, I have a question. Can I be approved at my SSDI hearing if I am a veteran getting 100% disability Permanent and Total.
Yes
Thank you. Your assistance is greatly appreciated.
WanonaS borrow or bum 25 dollars and get a basic tracphone from wal mart. that's what I had to do.
Social Security Disability videos , Thank You for the informative explanation.
My pleasure.
I got 6mri.2cervical neck surgeries.2bulging disc in lower back.im 48and was denied in state of Virginia.
Darrell, the issue in a SSD case has to do with how your disc issues impact your capacity for work - and specifically what your doctor says about that. You need more than an MRI report showing a disc problem.
@@ssdattorney 6mri 2ct scans1ct mylegram and x-rays.still having problem sitting standing arm and hand going numb and tingling burning in my left leg.sacrita 2to 3 times a week.
Trying for ssdi
Wow I meet 4.5 out of 5.
Are they taking handicapped people away and putting them in nursing homes run by the state you live in..
Sir,
My hearing is in 4 days. What are my chances of winning? Just kidding. I would like to hear much more about your experiences with mental health claims. E.g., are they in general harder to win?, etc.
If at your medical they send secolgist at medical exam part and have on going fauiler and lose screws in a neck fussion and also add adhd and trouble concentrating and hand writtibg has diterriatided and very shaky when write and had your mom sit in on protion of exam and on way out she telks her u deserve it is it good sings or not

grid rules dont apply .....anymore .....
Not correct. They apply but are being changed some. Bigger changes could come later, however.
What about someone who has had a stroke?
Have my hearing in September hopefully I will get approved
I disagree....
