MK was a waste of voeters time, they are directionless. The country has to go on with or without MK who is Zuma.
The IEC does not create parliament by mere announcement of the election results. The elected person MUST be sworn-in as members of parliament. Upon taking oath of office, it is then or only then are they members of parliament (MPs). Just like a president-elect is not officially a State President until he or she is sworn in.
The National Assembly is not constituted if it has less than 350 members. Hence, there shall be no lawful parliament if the National Assembly does not consist at least 350 members.
Section 53 quorum only kick-in after the elected persons on the party-list take the oath of office, that is become MPs.
I agree with your view. They should be sworn in 1st, then boycott if needs be. But then again they are of the view that there should be more than 58 members being sworn in. Is it not within their right for the courts to hear them 1st and allow them to present their evidence before rushing them to accepting the 58?
We saw the electoral court ruling on matters expeditiously due to respect to time constrains. Why couldn't the results be held off and allow such processes to unfold 1st. Why is everything rush rush??
I hear you, however, MK knows how the Constitutional Court is in favour of the then ruling party, obviously it will not make this case a priority and the ruling will always favour Chief Justice Zondo.
Fighting outside may result in breaking the MK into factions because there is no way the MK Party will win this case against the powers in control, actually.
For me it is an own goal, because without the MK the DANC and its constitutional court will win, not because the win will be just, but because of the power they hold.
So I think that even though the MKP is justified to want the election results be investigated but it is shooting itself on the foot by not going to parliament as well as fight the election results in court.

This is yet another clear case of how they're nonsensical and unjust. For a party that campaigned on changing the laws of the country, I think theyre doing an excellent job.

The seating of first parliament allows members to be not less than 350 as Constitution says so without 58 members of MK it's left with 342 members which is against 350 members needed for first seating

From declaration of results a government must be formed within 14days. That's where we are now as a result of the rush rush of IEC.

It is wrong to say parliament cancelled travel and accommodation arrangements for MKP members. The 6th parliament was dissolved on the 29th of May and the 7th parliament will only have its first sitting this Friday. Parliament is a body of legislators voted for by the electorate. This Phalaphala boy who purports to have illegally cancelled those arrangements has no authority whatsoever to act in that manner. He is better advised to rethink.

The parliament need 350 members to pass an act but it need 139 members in attendance to elect a president.
The ANC has 159 seats in parliament. So it means the ANC can elect a president without other seats in attendance without winning the outright majority. This is a contradiction and unjust law.
Read section 53 of the constitution maybe it will help....350 members needed only when you want to pass the legislation but when it comes on swearing of MPs u only need 1/3 which is 134 members so relax parliament will continue with its business
