      First, harvey is a lawyer, he needs to take advantage of every little weak point and press on it until it becomes a fatal weakness. So, while indeed this list probably only contains some minor mistakes, it can definitely be used to paint her in a bad enough way to let the husband assume part of the children's custody. Second, the point isn't that the husband wouldn't do those mistakes, it is that using this list would work in court, but it would be cruel because she is a good mother and they would paint her as a bad mother with the list, which would most likely result in tearing the family apart even more since there would be no way they ever go back to being cordial after that. Harvey's point is that the husband knows this and doesn't want to use the list to win despite it being presented to him as his only chance to win, and he does that because he doesn't want to damage the family even more than he already did. Thus, harvey is betting that by showing her that the husband cares, she will also try to make a step towards reconciliation and she will allow him to be a part of the kids' life

    • @docomega7862
      @docomega7862 Рік тому +10

      The court would allow her to have full custody because he would appear as unstable and unfit to raise his kids while she would appear as the perfect mother. The list would help harvey paint her as a bad mother by forcing her to admit to her own mistakes in court, thus putting her back on an equal footing in terms of bad parenting with the husband, probably granting him shared custody. This might not work in real life, but harvey is presented as able to turn a jury with pretty much nothing, even if it wouldn't work, she doesn't know that, so he can present it as a guarantee win all he wants. But, his real strategy isn't even to use the list in court, it is to show her that the husband cares about the family enough that she should let him have shared custody. So, he is betting that her human side would take the place of her reason and that she will settle, because that's what harvey does, he settles so he doesn't have to go to court in the first place
