      @@TheNepaliComment I did realize I heard Dr. Manoj Shahi’s voice. I’ve been wondering about the real estate to avg GDP ratio (Nepal vs everywhere else) as well for years now. I also discussed with Dr Shahi on this exact issue post podcast and he said he wrote an article back in 2012 stating the same concerns.

    A correction at 3:24 , the tax rate as mentioned in section 95Ka(5) of Income Tax Act, 2058 for advance tax collected by Land Revenue Office at the time of registration on capital gain earned from the disposal of land or private building of any individual has been changed by Finance Bill 2079/80. The new advance tax rate that the LRO will collect is 5% if the disposal was done after 5 years of purchase and 7.5% if the disposal was done within 5 years of purchase.
    Also one should understand that the tax rate mentioned in section 95Ka(5) of Income Tax Act, 2058 is of advance in nature. Which means if the disposal was done by a registered real estate agent, then he shall assess tax as per D03 return, which means he will be taxed @ 25% and the aforementioned advance tax can be reduced from his tax liability.
    In the same Finance Bill of 2079/80, there has been an added provision which states that real estate agents must register themselves in PAN and fulfill all obligations of a registered person.

      the rates should be in accordance to the holding of land....(eg: 3 months: 50% 1yr:25% 2 yr:10% and so on), the real state is not share market....!! Everyone must acknowledge that..
      And the payment of funds during the transaction of land should be done through government portals

    Hello The Nepali Comment,
    I agree with the fact that there is a huge bubble in the real estate market(especially Kathmandu). I am also aware with the things you have stated in the video and read those articles few weeks back, but I don't feel the solution you are suggesting is practical.
    Many people have already invested in real estate and are already into this bubble. Restricting it now will only create more panic and will eventually lead to crash in the real estate industry. The categorization must be done as soon as possible to identify the potential and limitations of the land as the government suggests.
    The price of Durbar Marg being so high isn't a surprise cause land price definitely differs due to its significance. Even if you look abroad, people residing in New York or Mumbai won't go saying why can't I afford a land in Fifth Avenue or Altamount Road. There are certainly different property tax for expensive land in Nepal. Another thing I would like to add is, minimal property price for taxation and maximum property bar for taxation may be determined by the government, but the same land maybe offered 9 Cr by someone while some may won't be willing to pay even 1 Cr for that. It's all in the eyes of a buyer. (Although minimum tax according to area should be paid as mentioned in archives of Department of Land.)

      Majority of Those already owning land are long time investors who aren't selling anytime soon . A crash wouldn't necessarily be a bad thing

    I don't think you can compare what is happening in Nepal to what happened in 2008 in the US. Most loans in the US in 2008 were bad loans, with improper income verifications, very low downpayment requirements and variable interest rates. These loans were then packaged into derivatives like Mortgage Backed Securities and Collateral Debt Obligations which caused the impact of the housing bubble popping to be much greater than it would have been otherwise. In Nepal real estate is not highly leveraged in the first place. Additionally, banks should be able to easily recoup their investments on bad loans due to high downpayment requirements.
    Your suggestion of strictly zoning land for agricultural use will only increase housing prices. How will having less housing decrease housing prices? The only solution to this problem is that government should build more public housing like in Singapore. Satelittes towns like Banepa need to be better connected to Kathmandu with roads and public transit.

      Exactly, his suggestion of segregating and strictly imposing land ownership to restrictive places makes no sense in this regard.
      However any solution to this problem is going to make this bubble burst. No matter what the government tries, people will, till the very last, hesitate to sell their land at a lower price. Many many will loose a lot in their investments and no one can do anything about it. Even if government tries to catch the perpetrators, the sheer amount of real estate agents will overwhelm the government security forces, their jails, courts, everything.

    I have been working in UAE for past 5 years and want to buy house 🏠 in Nepal but what I found few years ago was discouraging. Price of Land is/was skyrocketing every year. I got no choice but to bought quick as possible and whatever land that could find in cheap price.

    There must be large taxes on real estate income for country like ours and low taxes with high subsidies on industry and manufacture. It transfers our income from a ungrowthful sector to a productive one.

    There are two reasons for sky-rocketing real estate prices in Nepal: (1) Just like there is land-ceiling in owning “agricultural” land in Nepal, there needs to be similar laws for owning non-agricultural land and housing in Nepal. (2) There is no proper rental-income act in Nepal, which gives security to tenants ( who live in rented rooms/apartments).
    Government has decided to penalize “bajo” agricultural land; this is absurd and stupid. Nepal has no defined agricultural land : what is agricultural land and what is non-agricultural land; government of Nepal does not know the classification of agricultural land. Government of Nepal should provide all-year round irrigation for “agricultural” land. Taxes on agricultural land should depend on existing irrigation.
    If government does not provide irrigation, the government has no right to classify such non-irrigated land as agricultural land. Nepal’s agricultural land& policy are fit only for medieval ancient times, they are not fit for encouraging farmers to engage in agricultural occupations.

    Unlike, 2008 housing bubble that was led onto due to haphazard lending of mortgage loans with improper verifications and financial derivatives backed on top of those mortgage loans which resulted in bad credit creating a sprial effect resulting in burst of bubble.
    Nepal's case is different as most of real estate transaction are "cash" backed requiring buyers to pay full amount in cash to sellers. It cannot be called "bubble" moreover due to large numbers of demands on centralized areas. A sudden fall in demand of these land may create obstruction to these sky rocketing prices but mind you these banks have strict mortgaging facilities which makes it more safer if prices were to fall.
    Is the prices high? "Yes"
    Is it a bubble? " No, not anytime soon"

      A bubble is when the exchange value of an asset is markedly more than its intrinsic value which being the case for housing market in most of the developing world. it needs constant backing of market demand other wise such bubble is going to pop. The actual pop itself may not be characterized by rapid landslide in market value if a value is held not backed by physical assets or a representation of such (cash). This is the case for nepali real estate. Now the moment any land reforms has to be made and it has to for any chance of development the cash held prices will come crumbling down. And it is the same reason that no land reforms of any worth will be passed in nepal and that is why nepal will never be developed.

    Really great video; however, the USD conversion of land prices in Nepal is misleading. While you may get NPR 9 crores for a piece of land in Durbar Marg, there's practically no way for Nepali citizens to convert that amount of money to USD at the suggested exchange rate or anywhere close. It's also highly unlikely that any foreign entity would pay that USD amount for the land in question. If either of the above was easily possible, Nepal wouldn't be facing a forex reserves crunch as we speak.

      Agreed 1 million %. There's not enough USD Reserves to back the total valuation of real estate here, which is the prime reason for the FX reserves depletion. Either valuation will be destroyed by international inflation or risk running the entire country into bankruptcy (running reserves into the ground).

    Mero dai, you may be right about the bubble thing, but don't compare nepals real estate with real estate of US, Hongkok, or china, we don't even come close to them in terms of price. We don't even know whether the real estate doubles in price next year. But NRB has started tighter policies but the private sector is more positive than ever. I think real estate is not that expensive, because it may become more expensive in near future. We cannot predict it.

    i am not an economist. Real estate sector is never called an industry. It does not contribute to GDP. It does not add value to local currency. Its an earning to an individual.
    Some facts we can add is maal adda passes the property is less valuation after settling up with buyer seller off the book and some amount to the officer. This takes away taxes.
    There r lots of rental property who avoid big taxes by logging rent as 30k but its 100k. That way they avoid the taxes.
    Its a good video. I wish the segment wud also hv dispositions on how to improve it too.
    Nonetheless, I always eager to watch new video from the channel.

    Capital gains tax is not only for land but ALL forms of assets such as stocks and business investments. If you increase it, you wont only discourage investment in land but also business.
    And I personally don't see anything wrong with investing in real estate. The reason behind the increase in real estate prices is simple: high demand, limited supply. Basic economics.

      Capital gain tax is levied on Non business asset only.. not for stock.. Capital gain tax rate is different in land and investment. Real state n investment co lai Matra ho
