    Module 6CN011(at University) was very difficult for me but with the contract videos produced by Metroun i absolutely killed it getting 88% for the 1st assignment & 76% for the exam.

    Excellent videos , the only thing missing is what type of contract sum FIDIC is using. You listed the NEC cost options such as Target Cost etc, but not on the FIDIC side. Thank you very much for your wonderful videos.

    Can you please confirm that the ground condition is the contractor's risk under JCT?
    I have been using JCT for up to a decade. Most times, the BOQ quantities for substructure is termed 'provisional' - so contractor can make claim should there be unforeseen ground condition. This usually using the traditional procurement route.
    I will appreciate your clarification.

      Hi Abayomi,
      Without seeing the specific contract you’re working on, we’re unable to comment on who holds the risk for certain items. However, it seems that in your example, works relating to ground conditions are marked as ‘provisional’ giving you the ability to adjust the price later on. If this wasn’t the case would you still be able to make the claim?
      The NEC does not cater for provisional sums. However, unforeseen ground conditions is still a risk which is normally held by the client.

    Isn’t the Contract Admin called the Employer’s Agent under NEC? You said project manager

      Contract Administrator and Employer’s Agent are similar roles but for differing forms of contract. Under JCT Design and Build Contracts, the Employer’s Agent is the term used for an individual or organisation in which the employer has vested their authority. In other JCT contracts they are known as the Contract Administrator. Under the NEC they are known as the Project Manager.

      @@Metroun ahh thanks for that clarification. I was getting confused because when I hear NEC, I automatically think Design and Build.. and when I think Design and Build, I think Employers Agent!
