  • Danielle Brissett sat in jail for six days in August of 2023 after being arrested in front of her children. It happened after Enterprise Rent-A-Car reported the Kia Sedona she rented in 2016 was stolen.

    Not only do they NOT acknowledge their clear mistake, Enterprise DOUBLES-DOWN with the accusation.

      I don't know why people rent from Enterprise. I rent/car share a lot of cars, and I never liked Enterprise. They charge a $400 deposit even if you use a credit card where I am. No other rental company does that.

      No question that Enterprise dropped the ball but what's with the arrest all these years later. You stole a car in 2016. No I didn't and I have an email confirmation somewhere that I dropped it off. Well I'm sorry but until you can find that email you're presumed guilty until proven innocent.

      It’s just so unacceptable that police KNOW that rental companies have been wrongfully sending people to jail over and over again and instead of making this a civil case, they arrest people. It’s time they stop giving so much power to CORPORATIONS. Because when my phone gets stolen and I have proof of who took it, the cops do NOTHING. Here I am paying taxes so that they can protect other people and leave me hanging!

      Seriously though, big corporations have teams of in-house and big firm, outside counsel who can continue a lawsuit until a plaintiff's attorney won't make the money they put into the case. And any settlement or judgment will likely be reduced by the plaintiff's attorney fees increasing as time goes on (unless the corporation is ordered to pay the plaintiff's attorney fees). So, the plaintiff is likely to get less money, the longer the case drags on. And most people just want to get compensated for the harm caused and move on with their life. They don't want to spend years on a lawsuit.

      Exactly! That’s absolutely ridiculous! They found body parts in this guy’s home in NYC and he was out in less than 24 hours! I guess it depends on the state and the man was bLK also sooo 🤷‍♂️

    I rented a car with Hertz, whwn I returned it, they inspected it, said everything was good, and asked for the keys.
    They said they would email the receipt. My ride was delayed, so i sat there for an hour and no receipt came via email. Before i left i asked for a paper receipt, they couldn't find the keys, they hadn't even finalized my rental.
    They are playing with people's lives and taking it very lightly.
    If the managers could be arrested for submitting erroneous paperwork, i think their procedures would change

We misplaced keys all the time😂 we rarely ever blamed the renter because you know security cameras existed back in **squints** 2017 .... enterprise should really be ashamed for how they handled their own mishap.

      The problem with saying its false is that needs to be proven by demonstrating the intent of the filer. You can file a police report and be wrong. As long as you didn't maliciously do it and knew it was wrong.

      I totally agree. Enterprise needs to pay her a minimum of $10 million. Are you kidding me and the prosecutor needs fired as well I can’t believe they actually filed charges with zero evidence I mean literally zero evidence it’s absurd like the American justice system when they say you can invite a ham sandwich and a ham sandwich that’s where the same came from. It doesn’t take much to get someonearrested

    How do they charge her for stealing a vehicle 2 MONTHS before they knew she was going to rent that particular vehicle?! This story is outrageous on many different levels. I hope that this horrible experience turns into a wonderful one for her when she sues them and wins a seven figure settlement. From this Kentucky grandmother to that sweet woman, I am so sorry for what you and your children have been through. May GOD give you guidance and steadfastness during this difficult time. ❤

    Hertz has been doing this for years and causing fols to be arrested and lose their job for cars that have been returned and rented to other's. I won't eff with them either.

      Back in January 1979 I returned my 30 day rental car to Hertz at Chicago O'Hare Airport. The clerk took the mileage, processed the paperwork, and told me to leave it right where I stopped in the lane in front of their office. I got to my plane, then headed to JFK, flew to London Heathrow, then to Manama, Bahrain in the Persian Gulf. During the 2 month job in Bahrain, my company harassed me saying that I didn't return the rental car. Somehow Hertz lost the car and tried to pin it on me. They said I would be arrested as soon as I got back to the USA. I told them jam it in their azzes. In my carry on bag was my finalized receipt from the day I turned the car back in. 6 months later I gave a copy to my boss and told him to deal with it. That was 45 years ago and Hertz is still up to their tricks?

    What I don't understand is what is the point of sending return confirmation emails if they don't use that as evidence of a return? Someone must've registered the car as returned, ESPECIALLY since they now accuse her damaging the car...WHAT CAR?! The car that you claim she never returned???
    Edit: Then you compound this with the fact that the dates they accuse her of stealing are PRIOR to the dates she rented the car....this is more than incompetence, as others have commented below, something nefarious must be going on.

    The exact same thing happened to me in Vegas. I rented from the Hyatt, the only reason I didn't take them to court after weeks of this BS was because they refunded my account. It was very stressful and just shows a terrible lack of competence. Thankfully, I was never arrested or thrown into jail like this poor woman. I hope she gets a good lawyer.

In a sane and fair legal system the CEO would face charges, as they are the head of the company and responsible for the actions of everyone within it. The reality is that the more money and power you have the more the law is actually there to protect you from consequences for your crimes.

    That's insane, this woman should have been out within 24 hours.
    I'm surprised they didn't charge her with child neglect after they tore her away from her kids for the ridiculous car theft arrest.
    You know, they'll catch a pack of 19-20 year olds carjacking an old woman, but won't charge them, but this woman gets falsely accused and does a week for nothing.
    I'm disgusted with law enforcement and the judicial system in this country, I really am.

      ​@@byrd7633 I dunno.... I think Hertz is the world record holder. It is notorious for this sort of thing and has falsely accused _thousands_ of its customers of stealing its cars.
      Hertz also thinks it is above the law and can freely ignore court orders. In one case, Hertz's refusal to provide a receipt as evidence in a criminal case (even though ordered to do so by a judge) resulted in an innocent man being imprisoned for five years.
      Hertz is despicable.

      I've only rented once from Enterprise, but it went fine. They can all be a pain... false damage, reservation not held... Sometimes it's just the luck of the draw and the location of the rental place.

    I worked for both hertz and enterprise. They do a very bad job of updating dnd maintaining their inventory. They report the vehicle stolen instead of checking the inventory that’s in the lot outside. They have the police doing their jobs. It’s a crazy place to work if you’re at the customer level. It’s unbelievable.

      You are absolutely correct about companies using the Police, and this happens in many instances where civil action is the proper course of action and yet the companies make it into a criminal issue.

    Always get a receipt and take pictures. Enterprise is NOTORIOUS for this. Renting from the airport is a bit more expensive, but there is always someone there when you drop off the vehicle.

      In this case a receipt wouldn’t matter because police and DA’s just took Enterprise at their word without looking at evidence first before going to get an arrest warrant from a judge. Government corruption here.

      Always get a paper copy of the rental agreement when picking up the car and always return it hein business hours and do a circle check with an agent and get a paper receipt showing no damage etc. Wrote down the agents name and make sure this is done in view of their security cameras. Not blaming this lady at all. It’s just sad that I’m this day and age this is what we have to do, because computers are taking over and more and more automation means police just blindly act upon what their screens tell them and it’s a recipe for disaster.

    First Hertz now Enterprise. ENOUGH IS ENOUGH! There need to be criminal charges filed against the employees that are not properly inventorying that the rental car was returned. Filing a false police report is a crime. And for bonus in Ms. Brissett's case was the fact that they filed the police report for TWO MONTHS before she even rented the car. She deserves a 7 figure settlement from Enterprise and the employee that messed up needs to be charged and convicted of filing a false police report and they need to spend a few months in jail for it. That is the only way that these rental companies will start to take accountability. The way it is now they can just go "Oops sorry we messed up and you had to spend days in jail for a crime you did not commit."

      You can safely bet every last employee that was working there when she rented the car is LONG gone. They probably were paid minimum wage and doubtful they gave a rats ass about any part of their job accept quitting time.

    A friend of mine rented a car to drive to Hayward to pick up his car that was there. When we went to return the car they told us to just put the keys in the floor and leave it. I refused and they had to send an agent to write out, date, and sign a receipt that he had accepted the car back. That stuff has been going on for ages out here.

    This problem of believing any low level corporate crony and not investigating in the least is bad police work, filing false charges for a warrant for a prosecutor, and dereliction of a judge’s duty to HOLD PROSECUTORS AND POLICE ACCOUNTABLE. Literally, the JUDGE issuing an arrest warrant is the LAST person in a very long chain that is supposed to assure PROBABLE CAUSE. These people all KNOW how police treat suspected car thieves, they all should be accountable!

    Thrifty lied on us about damages trying to extort money from us. And a local medical supply store tried to charge us $5000 for a "late" wheelchair. We had kept the faded out tiny little receipt. Turned out their own bad employee was selling stuff out the back door. Shameful.

      Budget did the same years ago at Palm Springs Air Port. Returned it and they "found" a huge ding in it sometime down the line and tried to charge us a couple grand for it. We had pictures before and after (always take pictures when your rent) to back us up. It's the shitty employees who did something, didn't want to get fired, and put it on their customers. That was a larger cost one. Different rental companies had tried to do the same since then for smaller things.
      The one in the video probably did something on paper because their computers were down (this happens A LOT in rental car companies), employee(s) lost the paper work, and assumed it was stolen; probably because everyone's so high on the job (that isn't a quip, couple of my friends who worked at SFO for example were baked 24/7) they couldn't remember what they rented 30 min ago, much less a week.

    This is a reflection of when a company is too big and FAILS to have a comprehensive Quality Assurance system in place. An employee taking the time to cross reference and follow up would've made the difference. These rental car companies have a fast-paced culture to meet its profit goals at the expense of common sense and quality assurance. 😤

    Wow, after this story that I saw, i'm never going to rent from Enterprise ever again. I had a situation with Hertz about a missing vehicle but I kept all my documents and receipts, vehicle status report when returned, pictures of the car that was returned to their lot.

      She had an email. Proof of the return. Your hot take on what to do, would have still resulted in being arrested. Note, it was also 7 years later. She was lucky she still had the email. But there is no reason for a U.S. citizen to spend more time in jail for an accused non-violent offense, than it takes to process their information. Two biggest offenses by cops is that they treat you guilty until proven innocent and they don't understand the constitution is the ultimate law in this country.

    Hertz has also had this problem as well. Consumers and the state attorney general need to sue these rental care companies. These charges seem to stem from shady employees who are most likely involved in criminal activity related to these cars being stolen or sold for profit after the customer returns it. The employees can change the information in the computer to make it appear the customer never returned it.

    I went to an enterprise in San Diego a few months back. I was supposed to get a Chevy suburban, I showed up they didn’t have a Chevy suburban. They only had a Tahoe. It had out of state plates, and it was clapped out. HUGE dents and scratches all over, the rubber trim around the door was falling off, the rear door trim was missing so there was water all on the inside. I didn’t care too much as long as it was noted. The enterprise employee said they noted it. I got the email before I left and checked. They noted “no damage” I marched back in there and demanded they refund me and take their car back. I left and walked down the street to a budget rent a car. Enterprise sucks.

      Most of us take protective and preventative steps. Lock doors, watch our kids in public, don't pick up hitchers, and keep important receipts.

    I have been blessed with my rentals in and out of state, and I am so sorry she has been victimized in this situation. Don't give up. You can always 1, take pictures of the vehicle upon receipt, including the location of the pick-up 2, photograph the drop-off location and condition of the vehicle 3, copy of all communications and names of persons you have communication with just to cover your steps.

    I can relate I came close to renting a car from them for a day at Circus Circus. The representative at the desk tells me that she would have to charge $260 until the day I leave the hotel.
    I told her if I'm only renting the car for one day for a few hours why keep charging me. I told her no thanks she can keep it.

    This is happening a TON to people nationwide. There is 1 common denominator I've noticed in these stories & that is they all extended the time of use. Something breaks when they extend the rental. That's the rental car companies issue that they need to fix but they pass the buck. It's criminal, vicious and disgusting.       I've worked for one of these companies. If the card declines the rental doesn't get extended in the system. Inexperienced employees will say it's extended before running the card or after it fails. Sometimes customers leave a voicemail and think everything is fine but no dollars no days.
      In the end it's just a service intensive business. Stuff happens we all understand an order coming out of a kitchen wrong at a restaurant, people get food poisoning every day from businesses.
      People who want to see criminal charges from this simply don't understand what a crime is. There's no malice, no criminal intent. One person screws up the paperwork and another has the job of reporting things to the police. It happens frequently in a large market where people keep the cars long after paying for them. These reports are made in good conscience to the best of the ability of the employees, they just screw up sometimes like employees at every other job.

    This happened to me with U-Haul. I rented a moving truck with a car dolly. The truck broke down and they had to come get it and the dolly. A year later, they said I didn't return the car dolly. They tried to threaten me with legal action or pay them $1800. As soon as they were informed that I hired a lawyer, they never contacted me again.

    I remember similar stories about Hertz from last year and the year before.
    This looks more like organized crime on the part of these companies than an "honest mistake". They know they got the car back, they confirmed it. This case should have already been thrown out with an apology and compensation. The fact that they're STILL intentionally attacking this woman through deliberate attempts to further victimize her is evidence of malicious intent.
    I hope she sues them and wins millions in damages, their determination to further abuse her should work in her favor in court and show intent which might lead to considerable punitive damages awarded.
    And I hope anyone else who has been a victim of this company does the same. I guarantee you this story is going to reveal more cases of this. I very much doubt she is the only one being attacked by this disgusting corporation.

    Omg this happened to me with a RV rental ! The person accepting my return actually had someone else grab the RV. Fortunately because it was a work rental I did have the receipt plus I took photos of her taking the keys from me on the day I returned it. Fortunately for me that last photo had the woman’s face in it and they went after her.

DO NOT RENT A CAR EVER. hertz has destroyed many peoples lives this exact same way. enterprise tried to claim my mother had not returned a car, WHILE WE WERE IN THE DRIVEWAY WITH THE AGENT CHECKING IT IN!! i was like, we are standing in the driveway AS WE SPEAK (theyd called her cell phone and said oh, we are going to have to charge you a fee for not returning it on time.) i grabbed the phone and yelled, its not due for another 6 hours, we are in the driveway NOW... hung up and called the cops because id seen this happen on the news repeatedly at the time.... i refused to leave until the cops came and witnessed us hand them the keys. i took video and we still sit in fear that years later this could happen to her, even with evidence.

      The power of running a fictional corporation is the Agents never get punished. There is no Enterprise, a man or a woman filed a false complaint and that man or woman should be charged with a crime but the law we use allows for the man or woman to claim Enterprise told them to do it.       @@fireflames-ue2gm If you even watched the video, she sat in jail for 6 days over a completely false accusation. So, you're telling me it takes nearly an entire week after putting her in jail on top of the time they should have taken to figure out that she was accused of stealing the vehicle 2 months before she even rented it? Sounds like sheer incompetence on their end. The truth was able to be summed up by a single email sent from Enterprise itself confirming the return of the vehicle. Yea... let's not pretend like law enforcement handled this situation well. They jumped the gun on arresting her instead of investigating even the most basic facts properly.

      @@wfvqrvta The law and law enforcement are two very different things in practice. Should be pretty obvious with all the rampant corruption and incompetence displayed by law enforcement on a daily basis. Quite often, they don't even follow the very laws they're meant to enforce. We need better minimum training and education requirements. These donut munching neanderthals make a bad name for law enforcement, and it's a real shame, especially since law enforcement is a necessary foundation for any civilized society.

    Notice that the News Company doesn't show who the Plaintiff is. The Plaintiff should be charged with filing a false report. The CEO of enterprise rent a car should face charges.

      You do know most of these Enterprise's are franchises. It's shady ass franchise owners doing this crap.
      You'd never have this issue at an airport where they are almost always corporate locations.

      The CEO and all of the corporate officers are generally shielded from criminal prosecution and civil liability by the corporation. You can sue the corporation, but you can't put the corporation in prison. Also, a lot of companies have customers sign agreements that disputes will be handled by an arbitrator (of the company's choosing) instead through litigation. Regular people are typically no match for big corporations, their ridiculous amounts of money, their teams of high-priced attorneys, and their servants in the government.

    The absolute worst place I’ve ever tried to rent a car from is at the New Orleans airport. We had booked a car before our trip, got there and they had no cars and then this woman, an Enterprise agent, tried to get us to hire her brother’s car for cash!
