According to the dash cam video, this person continued to cross the yellow line, which I would think intoxicated, so now we have a possible intoxicated, who refuses to comply with lawful commands. He is a convicted felon in possession of a firearm. He shoots both officers, taking the life of one and wounding the other and then flees the scene and it’s all done in front of a camera. What could possibly be his defense?

You see there is this thing called driving under the influence and it’s illegal in this country. That swerve was enough probably cause to get him out of the car for a field sobriety test. In my way of thinking, there's not too much more that can come out at trial. We have two dash cam videos and audio which pretty clearly show what happened. I haven't seen if there is any body cam footage, but doesn't seem that necessary. Even a question of pre-meditation was brought up. Personally, I don't think he was thinking 'I'm gonna kill this cop and any other cop that shows up' when the female office first pulled him over and approached his car, so, nah, not pre-meditated. But come on! This trial shouldn't take long at all. Make it make sense.

It is capital murder in TN. Which has 3 outcomes. Death penalty, life in prison and life without parole. It's bee bound over to a grand jury april 5th.
First degree murder generally means killing with premeditated intent. How the penalty is applied depends on the circumstances in the different states. In Tennessee killing a police officer is a death penalty qualifier, and yes, the Judge did say he found PC for all the charges.

Sending love and prayers to Deputy McCowans’ family. I watched the full video captured from all four cameras a couple of nights ago and Deputy Eggers’ poise and professionalism throughout the traffic stop, the subsequent shooting, and while testifying in court is to be commended. You can tell it isn’t easy for her-she’s tapping to remain focused-but I sincerely hope this doesn’t have a permanent negative effect on her ability to continue serving her community. It must have been horrible to watch back the videos and see her colleague die while she fought as hard as she could to get to him and render aid. It was heartbreaking to see.
As a side note, I think it’s ridiculous when a defense attorney makes a witness retell parts of the testimony they just gave as if they hadn’t. It makes them seem incompetent. I get his explanation for not being able to see the video well, but she did run through it before the video and there was audio with the video. And, did the other defense attorney essentially tell him to stop and sit down?
He's not going anywhere. It is reasonable to continue the prelim for a defendant to get his own counsel. The arguments of the prosecutor are correct, but usually, courts will grant a continuance for that reason. Come the next court date, then you would go ahead if he could not hire anybody. He can also wave the right to have a prelim done in a specific time period. By asking for a continuance, he is doing just that. All that a prelim does is to show that there is probable cause to believe a felony was committed and that the defendant is somehow involved with the crime. Believe it or not, that's it.
Judge denied that motion to continue. Now for Eggers, this has to be hard for her. It would be hard for anybody, but she answered the first question correctly. She gave her name, not a position AND her name. So many officers make that mistake.
The prosecutor is going a little too in depth for a prelim, but oh well. A prelim is supposed to zero in on the crime and the defendant's involvement and not necessarily be a trial with all evidence introduced.

According to the dash cam video, this person continued to cross the yellow line, which I would think intoxicated, so now we have a possible intoxicated, who refuses to comply with lawful commands. He is a convicted felon in possession of a firearm. He shoots both officers, taking the life of one and wounding the other and then flees the scene and it’s all done in front of a camera. What could possibly be his defense?

He also referred to something on the video which made me think he could make out some of it. Also, he’s no doubt used special devices to view the videos prior to this hearing. In my way of thinking, there's not too much more that can come out at trial. We have two dash cam videos and audio which pretty clearly show what happened. I haven't seen if there is any body cam footage, but doesn't seem that necessary. Even a question of pre-meditation was brought up. Personally, I don't think he was thinking 'I'm gonna kill this cop and any other cop that shows up' when the female office first pulled him over and approached his car, so, nah, not pre-meditated. But come on! This trial shouldn't take long at all. Make it make sense.

That’s such a huge issue in todays society. People feel as though they don’t have to listen to the police whether the stop is justified or not which obviously escalates the situation very quickly. If you’re truly not in the wrong, you take it to court, but even if you’re in the right, you’re not allowed to resist arrest or detainment. I think some people want to become a martyr for their community

It is capital murder in TN. Which has 3 outcomes. Death penalty, life in prison and life without parole. It's bee bound over to a grand jury april 5th.
First degree murder generally means killing with premeditated intent. How the penalty is applied depends on the circumstances in the different states. In Tennessee killing a police officer is a death penalty qualifier, and yes, the Judge did say he found PC for all the charges.

I watched the full video captured from all four cameras a couple of nights ago and Deputy Eggers’ poise and professionalism throughout the traffic stop, the subsequent shooting, and while testifying in court is to be commended. You can tell it isn’t easy for her-she’s tapping to remain focused-but I sincerely hope this doesn’t have a permanent negative effect on her ability to continue serving her community. It must have been horrible to watch back the videos and see her colleague die while she fought as hard as she could to get to him and render aid. It was heartbreaking to see.
As a side note, I think it’s ridiculous when a defense attorney makes a witness retell parts of the testimony they just gave as if they hadn’t. It makes them seem incompetent. I get his explanation for not being able to see the video well, but she did run through it before the video and there was audio with the video. And, did the other defense attorney essentially tell him to stop and sit down?
He's not going anywhere. It is reasonable to continue the prelim for a defendant to get his own counsel. The arguments of the prosecutor are correct, but usually, courts will grant a continuance for that reason. Come the next court date, then you would go ahead if he could not hire anybody. He can also wave the right to have a prelim done in a specific time period. By asking for a continuance, he is doing just that. All that a prelim does is to show that there is probable cause to believe a felony was committed and that the defendant is somehow involved with the crime. Believe it or not, that's it.
Judge denied that motion to continue. Now for Eggers, this has to be hard for her. It would be hard for anybody, but she answered the first question correctly. She gave her name, not a position AND her name. So many officers make that mistake.
The prosecutor is going a little too in depth for a prelim, but oh well. A prelim is supposed to zero in on the crime and the defendant's involvement and not necessarily be a trial with all evidence introduced.

It seems the 13% have a problem with taking basic orders in this country. When an officer tells you to get out of the car it's not up for negotiation, he is not asking you, he is telling you. Whether the officer is right or wrong is not up to you, it's up to a court of law. They should have had their service weapons out immediately instead of trying to be politically correct.

This looks to be a preliminary hearing to gather the evidence first to build a case for trial. He must've pleaded not guilty.
