    As many times as this has happened now, I'm almost not even worried about it. They backed down once before and based on the current hoopla, they'll (probably) do it again. Either way, I have no intention of signing up for any of it. I'll take my chances with the content ID, which has only matched 3 of my 27 Link Between Worlds videos. I'm not saying we shouldn't be concerned, we definitely should be, and we should voice our concerns as much. But at the same time, I don't know, I just get the feeling that we'll be okay. We've made it this far after all!

      They might have backed down once before, but the fact that they are trying again means that they are pretty serious about it. I don't know if this one will last (probably not), but it clearly shows that they are out of touch. I'm just getting worried about the way they are handling online videos of their content.

      Well Said Tim, I honestly im going to just be starting as a Lets Player but if nintendo is going to do this then im proably going to hold on makeing Nintendo Videos, I don,t know if your aware but when the 2013 outbreak hit on my old chennal i was doing a LP of Super mario 3D Land and it scared me up to the point that i deleted all my videos.....now looking back at it that wasn,t the smartest thing ive done and wish i have just made them privte. Still looks like im waiting alittle longer now, maybe ill do some Halo or Kingdom Hearts while this is all going on, but first i need a capture card and ill be getting one soon

    Also, even though the comments are abundantly supportive and positive, I want to make something clear: Nintendo has the right to do this. They can do whatever they want. I feel extremely grateful to do what I do, and I enjoy it immensely. And though I wish Nintendo would shift their stance, they are still within their rights to move forward with this program. However...
    I can't help but feel this largely stems from Nintendo of Japan and huge cultural/business differences. It seems believable that Nintendo of America understands that this is all very crazy and hates dealing with the backlash it receives from the west. You have to remember that Nintendo is extremely old-fashioned. Remember when Iwata claimed that "gamers don't want online play"? With that in mind, the idea of Nintendo taking longer than everyone else to alter their position is almost expected at this point.

      It's like you said, they are in their position to make this happen, and go foward with it. It just makes NO sense from a financial standpoint and in public relations. Nintendo, at least for me, always had the best image out of the "big three" but that's fading fast. Let's just hope, like Tim said, that they realize the hole they're digging themselves and back out of this nonsense, or at the very least make this extremely reasonable.

      I agree with that. Nintendo of America very well knows how much UA-cam is probably helping their videos, and I believe some of their employees have even said they are working to be as fair to the content creators as they can be.

      Thethunderstriker The way I see it, the program should't be in place regardless of how well NoA handles it. Other than the occasional crazy moments (Lookin' at you, Sega) no other company does this. Me and the folks on my channel don't have the viewer base to reasonably start monetizing, but with how uneasy this system is I'd honestly rather not get revenue for the few of videos that match than be censored.

      The Taradiddlers That being said, I know there's not much we can do other than speak our opinions with politeness and clarity. Nintendo does have the legal right to do with their intellectual property as they see fit; I just hope they'll back off a bit.

    The problem with this is that if this Nintendo Creators Program takes off, all the other companies that supported Let's Plays before are going to start their own similar services. Within like 3 years, they'll all be taking huge cuts from us.

    A lot of people are saying they are starting to hate Nintendo because of this program. Sure Nintendo makes bad decisions, and are terrible to content creators. But not every video game company is perfect. Xbox and Sony have had their fair shares of bad decisions. Just because Nintendo is really bad with content creators doesn't mean they are a bad company In all. Nintendo are the ones who brought video gaming back after the video game crash, and all their games are fantastic. I'm not saying I'm okay with Nintendo's program. I'm just saying this incident isn't a reason why you should stop playing Nintendo games.

    There are seriously no words. I love Nintendo with a burning passion; all of my heart really does care about their amazing video game products, and my childhood was basically crafted around the worlds of Hyrule, the Mushroom Kingdom, the Lylat System, etc. Part of who I am today is because of Nintendo. That all being said, however, this news is extremely, truly, terribly and utterly sad. No one's going to benefit from this in the end. I agree completely with Stephen: the negative PR is going to destroy Nintendo with backlash from, as you said, the most loyal fan base in the industry. I can't believe how Nintendo must think stealing money and censoring/halting the production of content from the people who play their games is a good thing. We have to hope that they'll wise up again, but this time all the way like all the other companies getting free advertising. And if they don't, all of us Nintendo fans will have to speak out or else Nintendo may seriously come to an end on UA-cam and maybe overall. This is sad, and it makes me especially sadder that we might not see anymore Nintendo content on StephenPlays...

    Let's not forget that UA-cam gets a percentage of the pie as well, which means it's probably less than 60%.

    What's even more crazy about this is the fact that it cost them money to set all of this up, just to earn that small percentage. I think the whole channel is their main goal, because they can make money out of people playing other companies games - which they allow. This fact might lead some other companies to change their minds, just because Nintendo will make money out of people reviewing their games..

    Stephen, you forgot about that in order to make a profit, you can only do select games on a list! That is bad already, but the fact that they leave out games like SSB4 and many other games Nintendo has MADE aren't on there completely killed it. Nintendo is officially the new Viacom. We always knew Nintendo was behind compared to other gaming companies, but they really screwed up this time.

    UA-camrs: Hey Nintendo we would like to advertise your games absolutely free!
    Nintendo: Whats the catch?
    UA-camrs: The catch is that we get to keep any money we get from putting our hard time and effort into making a video to advertise your game and your company.
    Nintendo: How does that benefit us?
    UA-camrs: Well it will give your games a ton of positive attention which encourages people to buy the games earning you more money. It will also show you how people like the games, what people like about them through the comments of our videos; This allows you to create analytics to show you what the consumers want, track trends, and overall make the games faster, better and cheaper, and lastly you don't have to pay us a dime for all this. We are already paying you anyways for the game itself.
    Nintendo: Hmmm, I still don't see how this benefits us. I'll tell you what, you can do this if you pay us for the ability to do this
    UA-camrs: Wait, you want us to pay you to spend our time and money to make videos advertising your games? Not only is that illogical but on top of that why would we do that?
    Nintendo: Hey if you want to advertise our game then you will have to pay us to do it!

    Stephen i've got a big question i feel you'd be the best at answering. I've been wanting to make LP's for so long after watching you, chugga and everyone, it looks so fun sharing your laughs with a fan base who like your commentary. I really wanted to start doing it myself but just for fun, i have no plans for making money out of it, just the experience of it. I got my setup finally ready, was so excited but that was the day nintendo went psychotic with all this stuff. Though i wont be claiming money for anything, nintendo being as draconian as it is i'm terrified they'll shut down my channel on an utter whim if i do anything. Can you please explain whats generally "safe" these days? Like does all this stuff only apply to people claiming ad money, are those who dont generally ignored and left alone? Would i still get claims regardless and would that jepodise my channel having claims? I've asked many other LPers but i never get a straight answer, any help or advise you could give would be awesome ^_^

      Gamez X Nintendo wants you to make videos. They've even went on the record as saying that! I've also never heard of a single instance where Nintendo took a video down, they only monetize it for themselves. For you and any other up-and-comers out there: don't let this situation frighten you. Nintendo isn't going to take your stuff down. They're interested in your free advertisements, and they'd love you to create them.

Thats good but i'm expecting then they'll claim the ad money for themselves, is it ok to have loads of them claims just lying on your account? I mean even if they're not doing anything to you, would being claimed 100 times or so hurt the standing or credibility of a persons account or is it seen as just standard and nothing bad? =3

    This has one of two outcomes I can see. First is that it fails, and Nintendo finally just lets us do what every other company does. Second, it succeeds, and the other companies start doing this, and the gaming part of UA-cam becomes a heavily censored area of the site. For all Nintendo seemed to have done right recently, this misstep is rather surprising, and disturbing to say the least.

    Honestly, almost every Nintendo LP I watch, I end up getting the game. I love Nintendo to pieces, and I always will, but UA-cam is a whole different animal

      Same here I have gotten so many Nintendo games and other games because of the LPs. They need to notice that. Stephen's LP on Donkey Kong Country Returns made me get it and if it wasn't for Chugga's Xenoblade LP I wouldn't even be thinking of getting the 3DS game or the new one later this year. Heck I wouldn't have gotten a 3DS or Wii U if it was't for the LPs I watch.

    When developers and publishers discovered their games being uploaded to UA-cam, back at the start, they were frightened. They were afraid that people would watch the game instead of buying it and that UA-cam content creators were taking money out of their pockets.
    Then they did research and things changed. They realized that there were hundreds of people willing to promote their game for free and that sales would increase because of the promotion. I remember reading a tweet from one developer to TotalBiscuit where it was said that after TB's video was released there was a notable spike in sales. 99% (random number pulled out of my butt) of the publishers and developers support content creators. The content creator wins because of the ad revenue and the publisher/developer wins because of the spike in sales. I know for a fact that I've bought games just because I saw an LP of it and sometimes I hadn't even heard of the game before that point.
    To see a company fight so hard to squeeze money out of people who promote their games is a little depressing. If I was a content creator I would choose not to do any Nintendo games until things changed.

      Considering the fact that they literally have over $10 billion in Yen's worth in the bank, this is NOTHING but greed. They don't need this money AT ALL and they're hurting one of their worst aspects (that the UA-camrs are FIXING with their videos), and that is advertising.

      It doesn't matter what percent they get, they have NO need for that money. Literally, remember that big loss they took last year? Had they kept that loss going consistently, they would have enough money to last 37 years. THIRTY SEVEN YEARS! That's just over AS LONG as they've even been in the video game industry!

    Seeing as my work is not something I make money for, I haven't had content ID issues..often. The one time I did is when a certain song was playing in a mall...and I was clearly talking over it.

    I feel like Nintendo's kind of like an average grandfather. You still enjoy the activities you do with them, and are glad they're still around to spend time with, but they still think society is living in the same culture they grew up in, and they become quite confused when things turn out to have changed.
    I hope that public opinion can place Nintendo back on the right track, but it will likely be a long, drawn-out process.

    The weird thing is... Nintendo is probably one of the last companies in video games who even needs this money... I know they are making some losses recently but they have so much money from last generation with the Wii and DS... Maybe someone should start a petition for change?

    Well it seems history is doomed to repeat itself. This sort of media regulation is several steps too far, and honestly I couldn't agree more with you Stephen. You've pretty much hit the nail on the head as to why people are saying Nintendo are falling behind. This is the sort of thing that people, especially youtube creators, need to stand up against, boycott, petition against. A lot of things can be tolerated but this isn't one of them. I would even be prepared to stop buying their games until this scheme is abolished.

    You forgot to mention that at some point in Nintendo related videos, that if you want to monetise the video, you have to mention the Nintendo revenue cut incantation either through voice or captions at some point in the video.

    Another thing about registering entire youtube channels. In Stephen's example, if someone uploads a video of Halo (a game not owned by Nintendo in any way shape or form) that means Nintendo is profiting off work that does not belong to them. That is quite possibly a lawsuit waiting to happen.

    The idea of censorship is the scariest thing to me, luckily if it happens too much I feel like UA-camrs will start to boycott Nintendo. Maybe a Nintendo boycott is the only way to get all this through their heads...

    Very unfortunate circumstances, and yet they can do this. My channel has Nintendo content dating back to 2008, and if I can't make ad revenue off of those playthroughs...I guess I'm done with Nintendo videos. Not the game, certainly, but the videos will stop coming.
    They need to seriously consider the impact this has on the future.

    First, for people asking about Chugga, I think he's okay considering he's already part of a network that handles that sort of legal thing. It's still kinda spitting in his face, considering he's really good at highlighting lesser known games.
    Second, Stephen hits the nail on the head when he says that this is only a huge kick in the nads because other companies don't do this. In a way it makes sense for some sorts of content like Lets Plays which essentially put the entirety of a game on UA-cam. I agree that it's a bit of a gray area when it comes to copyright and you could argue its morality either way. But the fact of the matter is the precedent is for companies to allow this. I often think it's unfair to judge Nintendo alongside Microsoft, Sony, and the like, but here it is because it's not about content. If Nintendo was the first one to come out and say something about Lets Playing, then I could see it, but as other companies don't do it, it looks really bad on Nintendo.
    In a way, though, I think it's them loosening their claws a tiiiiiny bit because before they weren't trying to split revenue at all. I think they'll change their minds eventually. I think that the very system they're trying to integrate with is going to reject this idea because of people like Stephen and Totalbiscuit who are getting the word out that this is bad. I think that, quite simply, the only way people are going to hear about this is through outlets like this, and thus they're going to hear why it's bad and not participate. And then it'll fail and they'll try something else...which I hope will be staying away from all these ID shenanigans completely. But I think this is kiiind of a step in the right direction compared to before, but it's a tiny, tiny step and could easily be a lot better. But the people this affects will talk, and they'll talk badly, and that'll make or break the program.
    But for most people out there, all the fledgling, upstart Lets Play channels with a few subscribers looking for attention wherever they can get it: Don't worry about it. Lets Play for fun. If it's fun, it's worth it. Don't start doing LPs because you want to make money. Do it because you want to have fun, show people a game, and entertain others. Yeah, it's not fair what Nintendo is doing, but if you're just starting out you probably aren't making revenue anyway. Most LPers probably aren't. So yeah, do it for the funsies.

    I honestly feel like if they tweaked the terms so that it was more fair to the content creators, and greatly expanded the list of eligible games, this program would almost be fine.

    I have no experience as a content creator, so this is coming from the point of view of a somewhat unbiased third party.
    Honestly, aside from the possible censorship issue, Nintendo has every right to do this. To put this bluntly, when you upload gameplay from a Nintendo game to youtube, you're using something Nintendo made to make money, while not giving anything back to the company who made that game, aside from the obvious cost of the game. And granted, them taking %40 is a bit much, but that's the way Business works. Nintendo makes so much money that they can afford to lose a few customers from this, because the money that they will make will easily outweigh the money that they lost from those customers not buying their games. Just because other companies don't have a problem with you using their games in a video, doesn't mean Nintendo has to follow suit. Nintendo owns the rights to these games, so they can pretty much say "You're going to do things our way, or you're not going to do them at all."

    I'll be honest, can't say I didn't expect this response. I agree with what you said at the end. Nintendo fans (me included) are SO loyal. I've from a young age grew up on gaming from Nintendo, and even wanted to work for them in localization since High School. But every time they do something as illogical as what they have done with youtube, it just frustrates me. It frustrates me when they make stupid decisions when they can make such great games. There's this youtube fiasco, there's the understocking of amiibo and their new systems heavily, etc. And I think it frustrates me even more, when they've begun to interact with their fans through Nintendo Directs and other pr stunts, and yet they still don't get it. They need to seriously educate themselves.

    You make a great point about the censorship I didn't even consider. It's like a breach in trust. If someone reviews a Nintendo game, and they're part of the Nintendo program, would they then have to make sure the audience knows that they're in the Nintendo program? Is it technically then like a sponsored review? And how much would we be able to trust that review knowing Nintendo gave it the a-okay?

    I feel like Nintendo hasn't quite grasped the concept that youtube will boost their sales through free advertising. But I also think they're taking steps in the right direction to solve that. True, this current programme isn't helping much but at least it's better than them just putting content id on everything.
    However, I do feel that Nintendo will eventually let UA-camrs keep all of their revenue and accept the free advertising and support it. All they need is a push in the right direction. And if they keep seeing that the youtube community isn't happy with their current systems then they'll change it. Things like this just take time so that we can get the best situation for everyone.

    You know, I would be scared, but I feel this won't last long due to fan backlash. They will see and hear what the fans are saying eventually and hopefully change or just stop all this, at least I feel this will most likely happen not saying it 100% will

    Thanks for the explanation, Stephen. I couldn't agree with you more with everything you said. It's just... Why, Nintendo? After all the years us fans have been loyal to you, and we just want to be creative and make entertainment by playing your game that WE buy with OUR OWN money, this is how you repay us? This is why I don't plan to do any Nintendo content on my channel in the future, and I've been a Nintendo fan for life.

    Considering this is still in beta, I hope Nintendo changes their policies. If this program fails and UA-camrs refuse to join the program and continue doing what they're doing, they will have to drop the 60% thing. I mean Nintendo had to back down before because so many people called them out on it. They'll have to do it again if all those people also refuses this program and file complaints. There is strength in numbers, and other developers can back us up. I love Nintendo, and they're on of the few companies that I actually respect due to their high quality games, but the way they handle dealing with the internet is god awful. It seemed like they were making a come around with E3 but then this happens.
