  • Earlier this week, Dua Lipa was hit with a copyright infringement lawsuit for her 2020 hit “Levitating.” Florida reggae band Artikal Sound System sued the British pop star, claiming that the Future Nostalgia track is a rip of their 2017 song “Live Your Life.” With cases like The Hollies vs. Radiohead and Marvin Gaye vs. “Blurred Lines” to songwriting credits being updated on tracks like Olivia Rodrigo’s “Good 4 U,” the world of copyright infringement is vast and ever-changing. In the latest episode of Rolling Stone News, three musicologists break down a few of the musical elements of “Levitating” and “Live Your Life” and discuss the complexities of copyright law.

    A weak intent to calm down the waters. Chords can be coincidental? Obviously, but we are facing a exact same way of using them, the same way in which the lyrics are sang, and a same pattern of percussion. I'm a copyright lawyer, and I would definitely sue for this. Sometimes, people's capacity to analize things is underestimated.

      yeah this is a shill video for sure. sad that they are putting this out. there is simply no way that you can have same chord sequence, same key, same pedalling on the E over said chord sequence for pretty much same length, similar words sung at the same time and an ending melodic phrase that is almost identical melodically and rhythmically (ie: "Live Your Life For Real" & "Come On Dance With Me") and it NOT be intentional. i would grant one or maybe two elements happening at same time over even the same chord progression but to have all five happening at same time with a similar timbre and beachy throwback disco vibe is obviously too much to ignore. it's not rocket science. sad rolling stone has uploaded what is essentially a diversion, misinformation tactic vid.

    The similarities in these two songs stand out more than Robin Thicke's plagiarism of Marvin Gaye' s song.

      This is what I was thinking exactly. There are more similarities between Dua Lipa and Artikal than between Robin Thicke and Marvin Gaye, and they made Mr. Thicke pay a lot of money for a non existent plagiarism.

    Let's be honest. For those eight bars, these aren't two songs. They are the same song. I'm not saying its deliberately plagiarised, or even that isn't a coincidence. Astonishing coincidences DO happen. When writing diatonically (as with both these songs), you only have a total of seven unique notes from which to build not only your melody but your entire harmonic content. Add the limitations inherent in writing within a genre, and you're painting from a surprisingly limited palette. But coincidence or not, let's not bullshit about how similar the two songs are. They are at least as similar as the two songs at issue in any other plagiarism lawsuit you can name. Any songwriter in the world who had written "Live your Life" would be googling a lawyer the moment they heard "Levitating". These guys absolutely have a case. A very strong one.

    I think it’s pretty suspicious that this song was only uploaded to UA-cam a few days ago and the only version available that’s actually from 2017 is on SoundCloud, a site where you can swap out the audio and title at anytime. All of the comments on the SoundCloud version are from a few days ago.
    The song is just too similar, to the point where if it was plagiarized Dua’s team would have to know it would be obvious and just clear it as a sample. Artists clear inspiration as samples to cover their ass all the time. The whole thing just seems fishy.

    • @fredblogs3308
      @fredblogs3308 2 роки тому +14

      If it wasn't available in 2017, that would be a simple thing to prove, and no lawyer would have touched this with a barge pole. It never would have got this far. It's possible its a coincidence (as the guy in the video said - they do happen), but its also possible that one of the four songwriters had heard the original song and was influenced by it, but was not conscious of it. Unconscious plagiarism is very common.

      Spotify, Amazon Music, AllMusic all have listings for this song and the EP it was on in 2017, albeit they were removed (likely by the distributor, CD Baby for a failure to continue to pay to keep them up) the EP it was on, Smoke and Mirrors, charted in the Reggae Album Charts for the week of April 22nd, 2017, the tracklist can be found on Spotify as other peripheral sites, and while the SoundCloud version was clearly made private and then public again,their other releases on SoundCloud for the most part get about 20-30 plays each and very little engagement. Nothing about this is abnormal for a small band. Additionally, this EP was released physically on CD.
      What worries me is why you assume that because a song is not easy to find online in 2022 it was also not easy to find in 2017 and 2018 when there is clear evidence that it very much was widely available in 2017 and likely 2018 (when Levitating was written) and also why you assume that bands don't play music live.

    • @austinz9310
      @austinz9310 2 роки тому +6

      @@krjeff well I’m very curious to see what’s on that CD! I think there’s a good chance the song called Live Your Life that came out in 2017 is a different song entirely than what they are claiming the song is today.
      If their songs usually get 20-30 plays it would quite a find for the writers of levitating to come across that song and steal it note for note. It seems highly unlikely that they could have heard it. Even if they had, I don’t know why they wouldn’t just clear the sample.
      It just doesn’t make a lot of sense. I think skepticism is the best approach here.

      @@austinz9310 It''s not a sample though... More like a straight copy of the music, note for note, chord for chord, plus the rhythm is exactly the same. They re-wrote it, sped it up a notch and had Dua Lipa sing over it. It's not like they sampled from the recording onto a Sampler. The original sounds more organic as they appear to be more of a real band. Wouldn't you need to clear the whole body of the music? Maybe they thought that it was enough of a grey area to get away with it given the changes that were made. I for one never heard the original before recently, but that's not saying much. Regardless, it wouldn't surprise me that they thought enough people wouldn't notice.

    Edit: after watching some analysis from some independent music theorists and people i admire I no longer really agree with my statements below (Rick Beato and mainly Adam Neely) I'm still going to leave them up but I don't think that Dua Lipa steam copy. There's also voice memos that kind of documented her entire process of writing the song and you can see in real-time that they didn't know anything about this band and they really did come up with these Melodies They actually were inspired directly by Outkast. Also other songs like Don't Blame It on the Boogie and Evil Woman have the same chord progression as well. So I do think that Dua Lipa and her songwriting team are not guilty of plagiarism here. I'm going to take about a plagiarism it's just difficult to prove unless you have like direct proof.
    How much did Dua Lipas team pay yall to make this video?
    The Artikal Soundsystem song was number 2 on the reggae chart apparently... having a forensic musicologist with one opinion is one thing but then but then there's the part of the actual lawyer that has to determine probability of someone Dua Lipa's writing team being exposed to it... and it's one thing to have the harmonic pattern the same but the vocal Melody is the same as well. One-time is a coincidence, 2 times is suspicious. It almost sounds as if they sampled the song. And the beginning instrumentation sounds the same to not just the chorus Its not like it was completely unknown to any of the writers and producers or those in the industry. And if it sends up to a jury trial if they choose not to settle the average person thinks that those song. Sound the exact same and the expert even admits this when he tries to explain why people think they sound the same. They're screwed if they don't settle because the Marvin Gaye suits against Robin Thicke Pharrell Williams and Ed Sheeran sounded far less alike yet Marvin Gaye's Estate still won
    And you got the lady who examined the most BS copyright suit that most people with basic listening skills would disagree with saying saying THESE TWO DONT SOUND SIMILAR?? And then she has the audacity to talk about protecting creativity when the Marvin Gaye State lawsuits against Blurred Lines and Ed Sheeran have pretty much ruined any sort of protection than an artist may have in terms of its inspiration when it comes to music copyright. This is a joke right?
    And here's the thing though. I don't like the idea that if you're inspired by something that you have to pay royalties because everyone is inspired by something and there's there's nothing new Under the Sun. There's a difference between being inspired by something and completely copying something and there are coincidences and people can't arrive at the same thing completely unrelated to each other but this one really doesn't seem like it
    This video really seems like it was made to defend Dua Lipa, like they purchased this video because here's the thing, we know Dua Lipa isn't guilty. We know she didn't write this song, at least not mostly. She probably did something to get a writing credit but I highly doubt she had ever heard of this band or song. But she's the artist so it's going to fall back on her because she's the biggest name

    Ughh, shame on Rolling Stone!!! This is a BS video with almost junk science justifications on why it’s not the same song. Their forensic music “expert” literally glazed over the most impart part of this argument. He said that the chords are just a very short part of the song……I’m pretty sure the chords go through the entire song. Also, they say Dua Lipa is using the same chords, Bm, F#m, and Em, but I’m reality these songs both play the chords with a 7th added. Bm7, F#7, and Em7 is pretty different and rarely used. The Radio head Creep copy didn’t use 7s. Rolling Stone also didn’t say that the sounds of the instruments are the same, because “same vibe,” isn’t a legal term. Vibe is what non-musicians sometimes use because through no fault of their own, unable to explain those sounds, ie, compression, distortion, echo reverb, etc. Shame on Rolling Stone. Artikal Sound System is REGGAE band, not a pop band, so to say they pop songs sound the same, is a slap in the face to those hard working instrument playing musicians that wrote and perform that song. I hope that Dua Lipa can get to the bottom of why her song rips off a smaller band’s song, and she holds her “song writers” responsible.

The major differences are in the quality of the recordings, which has nothing to do with the songwriting.
    If producers can have entire albums shelved because of tiny samples, like a single snare or piano stab not being cleared, then how the hell is this okay?

    BS. Music industry sponsored Berkley old boy is wrong. That song is a pure rip. Cant argue chord progression in Bm7. Its a reggae groove sped up into pop. Phrasing is the same, Bm7 F#m7 Em7 (2) are not a pop song chords two people would put together independently. One has heard the other. It may be unintentional (sometimes we hear something in the background, later it comes up and we think its ours), or it was intentional, pressure on writers to write a hit.

    yeah this is a shill video for sure. sad that they are putting this out. there is simply no way that you can have same chord sequence, same key, same pedalling on the E over said chord sequence for pretty much same length, similar words sung at the same time and an ending melodic phrase that is almost identical melodically and rhythmically (ie: "Live Your Life For Real" & "Come On Dance With Me") and it NOT be intentional. i would grant one or maybe two elements happening at same time over even the same chord progression but to have all five happening at same time with a similar timbre and beachy throwback disco vibe is obviously too much to ignore. it's not rocket science. sad rolling stone has uploaded what is essentially a diversion, misinformation tactic vid.

    I think it’s a coincidence. Anyone who writes music knows how malleable simple structures (like pop music) can be. 4 chords with a 3 note melody that uses a simple/catchy rhythm pattern should not be copyrightable. The bass lines are different. The instrumentation is different. The chord progression is different. The tempo is different. The lyrics are different. The melody is different. The only thing that is the same is the key and partially the melodic rhythm. Idk. It’s honestly all about money. This wouldn’t be an issue if the Dua Lipa song didn’t make money.

    I hate how these "forensic musicologists" look down their noses at the rest of us and insist our ears are deceiving us. If you're Artikal Sound System, almost everyone is going to think you're stealing from Dua Lipa when you play your own song because they sound identical, and that IS a problem.
    Sure, no one owns chords, but when the chord progression, key, vocal melody, vocal rhythm, lyrical rhyme structure, instrumentation and vibe are all almost identical, don't tell us we're only hearing a subjective similarity. The more similarities there are, the less chance it was accidental, and there are a LOT of similarities.

    I don't know why people have this idea that it's all about melody and lyrics and harmonic context doesn't count. Melody, rhythm and harmony are all part of the same thing, made of the same stuff. They are intrinsically connected and are not divisible from each other. Determining whether plagiarism has occurred is about the totality of the sound, and the more elements that are the same, the smaller the chance of it being coincidence. At the end of the day, though, it is never, ever going to be something that can be determined scientifically, despite what musicologists angling for a lucrative courtroom gig might like you to believe. Between utter dissimilarity, and literal cover versions, is a continuum of similarity. Placing an arbitrary line at some point on that spectrum and declaring that coincidence is possible on one side of it and impossible on the other is always going to a subjective act. It all comes down to what the jury or judge thinks they hear.
