To the best of my knowledge, Indian government has never violated the treaty and everything it’s doing is within its rights. India cannot just wait forever for development to happen across the border. It’s just that India is regulating the water for its optimal use within its boundary and in compliance to the terms.
Even if it's nessesary india should not hesitate to make this agreement null and void because India is a democratic country and the agreement was signed by non democratically selected PM (Nehru)

Just see the under water train in Hooghly River at Calcutta which flows through Bangladesh eventually flows to the Bay of Bengal.
