Those who were naturalized after the effectivity of RA 9225 or after 2003 were deemed to have kept their Philippine citizenship, in other words can retain it. However, to retain or re-acquire one’s Philippine citizenship one still has to undergo the same procedure regardless. As explained in the primer for dual
    citizenship issued by the Commission on Filipinos Overseas, dual citizenship means that you have two citizenships at the same time as a result of the interaction of the laws between two countries. A person can be a dual citizen by choice or by birth. An individual can be considered a Philippine dual citizen by choice through the process of RA 9225 while a Philippine dual citizen by birth is a natural-born Filipino who does not have to perform any action to acquire the citizenships. Persons who were naturalized Filipinos before acquiring the citizenship of another country are not eligible for Philippine dual citizenship. Those who are not natural born Filipinos are not eligible to apply under this Act. RA 9225 provides for the re-acquisition of Philippine citizenship which has been lost through naturalization only. Other forms or ways by which the citizenship was lost cannot be re-acquired through RA 9225. Jus soli (right of soil) is the legal principle that a person’s nationality at birth is determined by the place of birth (i.e., the territory of a given state). For example, US follows jus soli, so children born in the US are automatically considered American citizens regardless of the nationality of their parents. Jus sanguinis (right of blood) is the legal principle that, at birth, an individual acquires the nationality of his/ her natural parent/s. For example, the Philippines follows jus sanguinis so any child born to Filipino parent/s, regardless of their location, is automatically considered a Philippine citizen.     Hello po I’m so thankful for your channel sir…may tanong po ako Atty…I’m natural born Filipino tapos buntis po ako nung nag oath taking as US Citizen and 3 months after pinanganak ko yung daughter ko.     Hi po! Pwede po pasagot if ito po 'yung scenario, "Belerick's father is French (France) while her mother is African (South African). Both countries are 'Jus Sanguinis nations yet she was born in Canada, a country of Jus Soli jurisdiction. The question is, how many citizenships can he claim and why?"

    Thanks for a very informative video. I have a question, a child born in the USA in 1984 before the mother became a naturalized US citizen is considered a dual citizen, correct? What if the child’s birth was not registered with the Phil. Consulate at the time of birth? Can that child, who is now an adult, still be considered a dual citizen? Or did they lose that distinction/status? Can it be reinstated?

      The child’s Philippine citizenship is not lost. There are 2 remedies that I can see - either late registration or report of birth or application for recognition as Philippine citizen - whichever may apply to him.

    Paano po yung mga bata na pinanganak sa Pilipinas at parehong magulang ay Pilipino. Nagpunta sa Amerika at naging US Citizen ang magulang. Dahil menor de edad pa, US Citizen na rin ang bata. Paano po nya makukuha ang dual citizenship?

    Hello po. I am a dual citizenship by birth but some government agency here in the Philippines such as the PhilHealth don't understand the law and require me to get a retention or re-acquisition of Philippine citizenship with Philippine immigration.     What if a whole family acquired a citizenship of a foreign country but were all of them used to be a filipino born citizen? Which law of the Philippines applied to them? Please let me know. Thank you in advance😊

      If they intend to retain or re-acquire their Philippine citizenship, they can take advantage of the provisions of RA 9225. Just make sure po that you are well aware of the rules regarding dual citizenship in the other country, if it is allowed. There are countries that do not allow dual citizenship.     Hello attorney, may concern Po Ako..My son was born in France and at that time of his birth, am a Filipino citizen Po. And now I applied for late registration of my son's birth attorney as Embassy of Paris said my son is dual citizen by birth and need to submit Report of Birth , and now I had Report of birth yet, and to process for Phil Passport for my son.. and my question attorney, do we need for dual documents ,son and approval of commissioner attorney for my son? Sna Po matulungan njo Po aq attorney..sapat na Po na attorney after ma report of birth and now I have my son's PSA birth need pa Po ba namen mag apply for dual documents pa for my son as he's 7years old na.. or no need na Po attorney only report of birth the.     Hello po, I am a Filipina by personal appearance/ethnicity but Canadian born. My mother was born in the Philippines and naturalized as a Canadian citizen before I was born. She re-acquired her Philippine citizenship and is now a dual citizen in Canada.
    I would also like to apply to become a dual citizen. And by the principle of jus saguinis, I am considered automatically a Filipino citizen correct? However, my mother and father were already a Canadian citizen at the time of my birth in 1975. Does it make a difference what citizenship status my mother was at the time of my birth? Or can I go ahead and apply for a passport if I am considered a filipino by birth on the principle of jus sanguini? Again, my mother only just recently acquired her filipino citizenship in 2021. I would like any advice on what my next steps are either to apply for dual citizenship of go ahead and apply for a passport. Thank you!

I registered her (report of birth) to the Philippine Embassy in Bonn and she got her Philippine passport my question is valid pa din ba ang Philippine passport nya?       As long as you have submitted a Report of Birth by which her Philippine citizenship is recognized by Philippines, you shouldn’t have a problem getting a passport again. The photo shouldn’t be a problem, too.

Ask ko lang po I am married to an Irishman and we have two children who are both born in the Philippines but automatically got their Irish passport and live here in Ireland but they go back to the Philippines most likely every year. Can my children get a Philippine passport or dual citizenship as well? Thank you..

      If you were still a Filipino when you gave birth to them, they are dual citizens by birth. If your children were registered in the Philippines and they have PSA issued birth certificate, they can apply for a Philippine passport.

      I learned that It is difficult to lose an Australian citizenship because the country has the policy of avoiding a person becoming stateless. This is what I found online on how Australian citizenship is lost. It might help you.
      According to section 32A of the Australian Citizenship Act 2007, there are 5 ways you can lose your Australian citizenship
      1. You may renounce your Australian citizenship
      Interestingly, just because you want to it does not mean that you have an automatic right to do it.
      The Minister still has to make a decision and he cannot allow you to renounce your citizenship if that means that you are left stateless. So basically you have to prove that you are a dual citizen and that you will keep the other citizenship in order to be allowed to renounce the Australian citizenship.
      2. Circumstances involving offences or fraud
      If you did not automatically become an Australian citizen, (for instance if you applied for Australian citizenship as a migrant), the Minister can revoke your citizenship in circumstances involving offences or fraud, and those offences are related to giving false and misleading information or fraudulent activity around your citizenship application.
      According to the DHA spokesperson, these circumstances may include occurrences where the person has acquired Australian citizenship and has been convicted of making false claims in their application, or failed to disclose a serious criminal conviction.
      In other words, you haven't given the Government the full material to be able to make a proper, informed decision on your citizenship.
      3. Failure to comply with special residence requirements
      If you did not automatically become an Australian citizen the Minister can revoke your citizenship in circumstances involving your failure to comply with special residence requirements.
      The special residence requirements are those conditions under which someone is given Australian citizenship for special services provided to Australia.
      An example of a citizenship given under those special circumstances was Pakistan-born cricket player Fawad Ahmed, whose fast-tracked citizenship allowed him to play for the Australian test cricket team.
      4. Conduct inconsistent with allegiance to Australia
      Under section 35 of the Australian Citizenship Act 2007 (the Act), a dual national’s Australian citizenship will automatically cease if they act contrary to their allegiance to Australia, by engaging in terrorism-related conduct, or if they fight for, or are in the service of, a declared terrorist organisation overseas, according to the DHA.
      The notion of "conduct inconsistent with allegiance to Australia" comprises terrorism activity overseas but the terminology can imply a much broader interpretation.
      "There is also a new provision that is called 'conviction for terrorism offences and certain other offences'. So if you are a person who is in Australia and you are convicted in Australia for terrorism offences under the Australian Criminal Code, then the Minister has the power in those situations to strip you of your citizenship ", Professor Rubenstein said.
      According to Professor Rubenstein, the capacity for Parliament then to think beyond terrorism as a marker of allegiance gives to the government much more power than before in determining the activities that can be punished with the loss of citizenship.
      "This is the broad new area where you engage in various conducts which the Parliament has referred to broadly as being inconsistent with your allegiance to Australia. The Parliament decides what activities are included".
      "What is it to stop a government in the future from choosing other things to identify as not reflecting one's allegiance to Australia?", Professor Rubenstein said.
      One example could be a behaviour we find unacceptable in Australia, like paedophilia, which is currently dealt with through criminal law. According to Professor Rubenstein, in the future, a government could decide that any dual citizen convicted for that crime is in a way reflecting a lack of allegiance to Australian values.
      "I am concerned about the boundary between criminal law and citizenship law being blurred here. What I would prefer is that these sort of activities that are clearly unacceptable in our liberal democratic society should be dealt with through the criminal law system rather than using citizenship law as a form of punishment.", Professor Rubenstein said.
      5. If you are the child of a responsible parent who ceases to be an Australian citizen
      If you are the child of a responsible parent who ceases to be an Australian citizen, the Minister can revoke your citizenship in some situations.
      These are the cases in which a dual citizen can lose their Australian citizenship.
      But for those who are still applying for an Australian citizenship, there are various cases in which their application can be refused.

    You didn't mention anything about if this pertains to those born to a Filipino mother and foreign father. Doesn't this make a person ineligible for Philippine citizenship based on their year of birth per the 1935 Philippine Constitution, Article IV? What you are referring to only applies to those born after January 17, 1973.

      Yes. You are correct. Qualification must be made with respect to those born of Filipino mothers under the 1935 Philippine Constitution (before the 1973 Philippine Constitution) because they can be considered Filipino citizens only if they elected Philippine citizenship upon reaching the age of majority.     Question po. 2010. My cousins arrived Philippines using foreign passport (US). Pinanganak sila dito sa Philippines. They both have PSA birth certificate and Philippines passport. Kasama nila yung foreign dad nila nung umuwi dahil patay na yung mother nila na Filipino citizen din(my tita) And they are legally adopted sa RTC ng tita ko, meron na ding adoption decree. Proven din sa death certificate na FIlipino pa din nung mamatay mother nila. About to go back sila sa US. Just wondring if magkaka problem ba sila sa immigration kasi na issuehan silang alien certificate o card ba un....so temporary visa nakalagay dun sa old US passport. You mentioned na kung tutuusin Filipno sila by birth, so dual citizen sila...may dapat po ba ayusin sa immigration? baka mahold sila sa airport.

      The possible problem that you may anticipate there is that they might be fined for overstaying if they have overstayed in the Philippines. I wonder why they were issued an ACR if they have Philippine passport and PSA-issued Birth Certificate. Did they present their Philippine passport to the Philippine Immigration Officer when they arrived? Were their Philippine passports still valid, meaning unexpired?

      @@YourLawyer When they enter Philippines (2010) they use US passport. Minors pa kasi sila at di aware yung US citizen father nila. So naiprocess din eventually yung ACR. Wala pa sila Philippines passport upon arrival. However year 2012, narelease yung certificate of finality from RTC, and pamangkins was legally adopted(by a Filipina). Hence, PSA was amended, no annotation na once we get it from PSA. At nakakuha na din ng Philippines passport.

      Yes. Those born of Filipino man parent/s after 1973 are considered Filipino citizens, regardless of the place of birth. Those born of Filipino mothers before 1973 are considered Filipino citizens if they so elected to be Filipino citizens upon reaching the age of majority.

I was born in the US in 1966 to parents who were Filipino Citizens at the time of my birth. Am I eligible to apply for Filipino citzenship and have dual citizenship (i.e., US and Philippines)?
