Sa tagal ko na dito sa ibang bansa kahit gaano man ito kaganda na realized ko maganda parin tumira sa bansang pinanggalingan mo.

Permanent residence is only good for 5 years. You can get the benefits if you are US citizen like Medicare, Medicaid, SSS. you will have to apply for US citizenship if you want your benefits that Americans reap when they retire.

I was born in Manila, on November1945, with an American father and Filipina Mother; now retired and single, I intend to stay in the Philippines. I grew up and schooled in Bulacan and Manila, still a Filipino in every way. I went to the bureau of immigration in Manila and asked to be recognized as a former Filipino citizen, a pre-requisite to become a dual citizen. During my interview with the BI attorney, I was informed that because of the year I was born, I am subject to the 1935 Philippine constitution definition of a Filipino citizen and therefor I could not be recognized as a former Filipino, and I cannot apply for dual citizenship. Bewildered, I exited my interview but surprised the BI attorney followed me down the hallway and whispered to me other means of enjoying dual citizen benefits. I am only seeking means of re-acquiring my Filipino birthrights as a descendant of a mother who shared with me life's values.

Thou I was born in the Phil in 1959, I was born US citizen. My Mother is white and my father is filipino, my Mom registered us (my brothers and sisters and I) in the US embassy. Hi. If she is 70 yrs old now, then it means she was born before 1973. Those born before 1973 to a foreign father + Filipino mother can take only the citizenship of their father. Thus, if her father was Chinese, then she was a Chinese citizen only (not dual). The law changed in 1973 (1973 constitution) in that the kids born to foreign fathers + Filipino mothers can be dual citizens. The PH embassy/ consulate is correct. Your partner is not considered as a natural born Filipino and thus cannot apply for reacquisition of Filipino citizen (as she was never a Filipino citizen at birth).

Hi Attorney! I am a natural-born Filipino, pero na recognize as a Japan Citizen by my father. Since 2013 may Japan passport na po ako, and according to my Koseki-Tohon (Japan Birth Ceryificate) nachoose ko na daw po and Japan CItizen last 2017 pa (Pero wala po akong naaalala na nag oath of allegiance ako dun). Question Atty. Both father and mother are now naturalized Americans but former Filipinos by birth. I work so hard to get my US citizenship not willing to give it up...anyway as balikbayan I can stay for one year in PI and come back to the US...being dual citizen if there's calamities or war for example you are in the PI at that time....US won't help you but if you are not dual meaning still US citizen more likely US gov't will pick you up.....
Not necessarily the US that you have to go back to after one year. You just need to get out of Philippines after one year, that means you can go to Hong Kong or Taiwan, or any countries much closer than US, stay 24 hours or more, then come back to Philippines.

You can buy land as a former Filipino citizen but within limits. You'll also be required to submit an Affidavit as a former Filipino - the real estate agent should know about it.

Because even if your mother was married to your Chinese father, she did not lose her Philippine citizenship. Article III of the 1973 Constitution says: “SEC. 2. A female citizen of the Philippines who marries an alien shall retain her Philippine citizenship, unless by her act or omission she is deemed, under the law, to have renounced her citizenship.” Article IV of the 1987 Constitution states: “Section 4. Citizens of the Philippines who marry aliens shall retain their citizenship, unless by their act or omission, they are deemed, under the law, to have renounced it.” Since you were born to a Filipino mother, you were a Philippine citizen until you were naturalized as an American citizen.

What if its the 3rd country i applied as a citizen. For example in my case, im born as Filipino then went to UK and eventually became a citizen. Then moved to Australia and applied for citizenship and eventually became one too. So what does that make me?
You are considered a dual citizen coz you have the privilege to live/work/vote/run for office in two countries (UK and OZ). However, when you acquired the British one and If you renounced your Filipino citizenship during the oath taking/pledge of allegiance as part of the naturalization process you effectively lost your Filipino one and hence need to re-acquire it by filing the paperwork.

I don't have Philippine Passport because my previous passport bears my married name. The birth certificate i got from PSA is still in my biological parents name. I was adopted by my aunt, older sister of my biological mother, when i was 2 years old. Unfortunately, the documents were burned during the fire that gutted the old QC City Hall which housed the courts then.

Another fund raising..it is the most expensive way to get back as a Filipino....1, will have to pay tax every year to the embassy otherwise passport will not be renewed. That was my problem....2..everytime to go to Philippines will have to get a letter from the embassy to be able to pay another tax in the Philippines.(pOEA, not sure of this now if this us still going)..before it was Dept of Labor. Yes you can. Gaya ng sabi ni atty. sa video mag apply ka ulit sa Philippines embassy kung saan ka man banda nakatira ngayon. May downloadable/printable forms sa Philippine Embassy or consulate na malapit sa yo. You fill out that form and send it to the nearest Philippines consulate in your area. You will then get an email from them after they receive your application. After they review your application they either call or email you when can you go in person for your oath taking para maging Filipino citizen ka ulit.

I am in the same boat as you. Due to our previous status as naturalized citizens of the Philippines, we cannot apply for dual citizenship. Only for those born in the Philippines to Filipino parents (Jus Sanguinis). I actually felt betrayed by the country that raised me. I talk and think like a Filipino but, because of Jus Sanguinis, I cannot be counted as one anymore.

As long as you are a former natural born Filipino citizen and you lost your Philippine citizenship by naturalization in a foreign country, you can reacquire your Philippine citizenship.

Hi Atty, just wanted to know if tama po pagkakaintindi ko. Di kailangan kumuha ng dual citizenship certificate kapag ang bata ay anak ng Filipino na nanay at Australian na tatay. The Child is born in the Philippines but acquired Australian citizenship by Descent dahil sa father. Di po nirenounce un Philippine citizenship. Tama po ba na di need ng dual citizenship certificate kasi ito po ay only for those that have renounced their citizenship,tama po ba? Ang bata ay by birth Filipino and by Descent Australian.

Permanent residence is only good for 5 years. You can get the benefits if you are US citizen like Medicare, Medicaid, SSS. you will have to apply for US citizenship if you want your benefits that Americans reap when they retire.

I was born in Manila, on November1945, with an American father and Filipina Mother; now retired and single, I intend to stay in the Philippines. I grew up and schooled in Bulacan and Manila, still a Filipino in every way.
I went to the bureau of immigration in Manila and asked to be recognized as a former Filipino citizen, a pre-requisite to become a dual citizen. During my interview with the BI attorney, I was informed that because of the year I was born, I am subject to the 1935 Philippine constitution definition of a Filipino citizen and therefor I could not be recognized as a former Filipino, and I cannot apply for dual citizenship. Bewildered, I exited my interview but surprised the BI attorney followed me down the hallway and whispered to me other means of enjoying dual citizen benefits.
I am only seeking means of re-acquiring my Filipino birthrights as a descendant of a mother who shared with me life's values.
I too was told the same way by the BI when I visited in 2018. I wondered what the BI attorney whispered to you? Is there really any other way? I was born in 1968.

Thou I was born in the Phil in 1959, I was born US citizen. My Mother is white and my father is filipino, my Mom registered us (my brothers and sisters and I) in the US embassy.
I grew up here in California, USA. I tried to apply for dual citizenship but got rejected coz they said I was never a pilipino citizen. My brothers and sister got the same responds.

All seems very confusing in some scenarios. My partner aged 70 British Citizen and born in Manila has just been told by the PH embassy in London that she is infact Chinese by birth.?? as her father was, but her mother was born in Manila and was 50% chinese and naturalized as a PH. She has been referred back the the B.I. in Manila to clear up the matter as her mother was classified as chinese in error on birth certificates some 85 yrs ago.
Hi. If she is 70 yrs old now, then it means she was born before 1973. Those born before 1973 to a foreign father + Filipino mother can take only the citizenship of their father. Thus, if her father was Chinese, then she was a Chinese citizen only (not dual).
The law changed in 1973 (1973 constitution) in that the kids born to foreign fathers + Filipino mothers can be dual citizens.
The PH embassy/ consulate is correct. Your partner is not considered as a natural born Filipino and thus cannot apply for reacquisition of Filipino citizen (as she was never a Filipino citizen at birth).

Good news. Lalo na sa ating mga pinoy. Dahil bansa tayo ng overseas worker. Hindi maiiawasan ung situation na sa kagustuhan natin magstay ng matagal for different legit reasons, mapipiltan tayo to acquire their citizenship. Then pag mag retire tyo, or gusto na natin umuwi or any personal reason, makakabalik tayo sa citizenship natin. Mgandang batas yan dahil bansa tayo na nagttrabaho abroad.

Hi Attorney! I am a natural-born Filipino, pero na recognize as a Japan Citizen by my father. Since 2013 may Japan passport na po ako, and according to my Koseki-Tohon (Japan Birth Ceryificate) nachoose ko na daw po and Japan CItizen last 2017 pa (Pero wala po akong naaalala na nag oath of allegiance ako dun). Ang problem po is ever since nasa Ph lang po ako. I have Ph passport also which is bawal po dapat and pinaparenounce po ng Japan Embassy. All of my school files is Ph po ang pinapalagay ng nanay ko. Graduate na po ako and now na I'm planning to go abroad sobrang laking problem po ang finaface ko dahil sa confusion ko sa citizenship. Updated po both ang passport ko sa Ph and Japan. And hindi rin po ako naka "dual citizenship" Filipino lang po naka lagay sa Ph Birth Certificate ko. What to do po, sobrang dami na po naming napag tanungan and sobrang gulo daw po ng case ko. Iba iba rin po ang advice samin. Am I still required to "renounce my ph citizen"? Automatic na po bang nawala un nung nagka japan citizen ako? Ano pong mangyayare sa school files ko, can I still use them abroad or study abroad? Magbabayad po ba kami ng tax for over staying here? Dual citizenship is allowed by Canada, and if any foreign government asks Canada if a person is a Canadian citizen or not, Canada authorities will neither confirm nor deny, unless it is part of a criminal investigation.
Question Atty. Both father and mother are now naturalized Americans but former Filipinos by birth. Their son was born when father was already naturalized American but mother was still US immigrant and still a Filipino citizen. The birth was not registered with Philippine consulate. Now the kid is 19 years old and American citizen by birth. Can he apply for dual (US) Filipino Citizenship considering that his mother was Filipina at the time of his birth?

I work so hard to get my US citizenship not willing to give it up...anyway as balikbayan I can stay for one year in PI and come back to the US...being dual citizen if there's calamities or war for example you are in the PI at that time....US won't help you but if you are not dual meaning still US citizen more likely US gov't will pick you up.....

Not necessarily the US that you have to go back to after one year. You just need to get out of Philippines after one year, that means you can go to Hong Kong or Taiwan, or any countries much closer than US, stay 24 hours or more, then come back to Philippines.
It’s the only reason why I didn’t get a Dual Citizenship.

You can buy land as a former Filipino citizen but within limits. You'll also be required to submit an Affidavit as a former Filipino - the real estate agent should know about it.

Hi Attorney,I was born in the Philippines out of wedlock from a Chinese and a Filipina.I studied in the Philippines and passed my nurse licensed in the Philippines carried A Philippine Passport when I worked in Saudi Arabia and migrated in USA. I am a naturalized US citizen now. I was denied dual Filipino citizenship just because in my birth certificate it was erroneously reported that my mother and father married, but they were not. They were married 20+ years after I was born. I provided the Philippine consulate here in Maryland Certificate of No Marriage between my father and mother from the time I was born and certificate of Marriage as well 20+ after I was born. I also submitted my Philippine passport as well as my Philippine Nurse License.All of these did not suffice. The person who attended on me said I am a Chinese citizen. When I mentioned the RA 9225. They advised me to apply my dual citizenship in the Philippines.please comment and advised please.
That, to me, is quite strange. Did they explain to you why they’re insisting that you’re a Chinese citizen?
Because even if your mother was married to your Chinese father, she did not lose her Philippine citizenship.
Article III of the 1973 Constitution says:
“SEC. 2. A female citizen of the Philippines who marries an alien shall retain her Philippine citizenship, unless by her act or omission she is deemed, under the law, to have renounced her citizenship.”
Article IV of the 1987 Constitution states:
“Section 4. Citizens of the Philippines who marry aliens shall retain their citizenship, unless by their act or omission, they are deemed, under the law, to have renounced it.”
Since you were born to a Filipino mother, you were a Philippine citizen until you were naturalized as an American citizen.

Just to clarify, one of your parents is a Philippine citizen and the other is a US citizen. And you were born in the Philippines. And your birth was reported to the US Embassy/Consular Office?

Hi attorney! I was born in Spain po but raised here in the Philippines, so before Spanish citizen po ako pero back in 2015 nag petition po si mama na ma re-acquire yung Filipino citizenship po namin. Ngayon ang problema po is yung pagkuha ko po ng birth certificate sa PSA, hindi po kasi namin alam kung paano yung process. Baka po may idea kayo kung ano po ang mga dapat gawin and documents to submit. Hoping for your kind response.

What if its the 3rd country i applied as a citizen. For example in my case, im born as Filipino then went to UK and eventually became a citizen. Then moved to Australia and applied for citizenship and eventually became one too. So what does that make me?
You are considered a dual citizen coz you have the privilege to live/work/vote/run for office in two countries (UK and OZ). However, when you acquired the British one and If you renounced your Filipino citizenship during the oath taking/pledge of allegiance as part of the naturalization process you effectively lost your Filipino one and hence need to re-acquire it by filing the paperwork.

I don't have Philippine Passport because my previous passport bears my married name. The birth certificate i got from PSA is still in my biological parents name. I was adopted by my aunt, older sister of my biological mother, when i was 2 years old. Unfortunately, the documents were burned during the fire that gutted the old QC City Hall which housed the courts then.

May itatanong po ako, bali namatay ang tatay ko dito sa US noong August 22, 2021 dahil sa na-contaminate ang dugo nya ng masamang bacteria after kaka opera nya sa kidney noong May 2021. Ang gusto ko po malaman na sagot po ay, naging US citizen ang tatay ko po noong 2014, at bago po sya mamatay, binili nya po sa amin na ilibing sya sa tabi ng puntod ng nanay nya o ang lola ko na nakalibing sa bayan ng Bauan sa Batangas bilang habilin sa amin. Another fund raising..it is the most expensive way to get back as a Filipino....1, will have to pay tax every year to the embassy otherwise passport will not be renewed. That was my problem....2..everytime to go to Philippines will have to get a letter from the embassy to be able to pay another tax in the Philippines.(pOEA, not sure of this now if this us still going)..before it was Dept of Labor. Too much hassle for a passport that is only use when going to Philippines.

My father was a Chinese Citizen born in the Philippines and married my Filipina mother. My father became a naturalized Filipino citizen in 1969, only one year after I was born in 1968. Since I was still young when this happened I was not aware of the election requirements before I became a US citizen. Can I still reacquire my Philippine citizenship?
Yes you can. Gaya ng sabi ni atty. sa video mag apply ka ulit sa Philippines embassy kung saan ka man banda nakatira ngayon. May downloadable/printable forms sa Philippine Embassy or consulate na malapit sa yo. You fill out that form and send it to the nearest Philippines consulate in your area. You will then get an email from them after they receive your application. After they review your application they either call or email you when can you go in person for your oath taking para maging Filipino citizen ka ulit.

Did you ever get a response? I'm in the same boat as you, I was naturalized Filipino around 1975. I was born in the Philippines in 1970 with Chinese parents who were also both born in the Philippines but still have Chinese citizenship at the time I was born.

I am in the same boat as you. Due to our previous status as naturalized citizens of the Philippines, we cannot apply for dual citizenship. Only for those born in the Philippines to Filipino parents (Jus Sanguinis). I actually felt betrayed by the country that raised me. I talk and think like a Filipino but, because of Jus Sanguinis, I cannot be counted as one anymore.

I don’t think marrying alone in the Philippines would constitute a ground for losing one’s citizenship.

Much easier if you apply your dual citizenship in the United States consular offices. I applied at the San Francisco consulate and only took half a day. In the Philippines I am sure will take longer ☺️

As long as you are a former natural born Filipino citizen and you lost your Philippine citizenship by naturalization in a foreign country, you can reacquire your Philippine citizenship.

hello po, dual citizen po ako ng Pilipinas at USA. kukuha po ako ng PH passport dito sa Pilipinas, ang tanong ko po is considered as a NEW/FIRST TIME APPLICANT po ba ako or need ko nalang po I-RENEW yung old Philippine non-ePassport ko (in which may "CANCELLED" stamp na po sya galing sa PH consulate sa LA.) May mga videos po kasi dito na nagpaparenew lang sila ng passport after nila ma-reacquire yung dual citizenship nila. nalilito po ako kung anong category po ako lalagay hehe. sana po masagot ninyo.

Hi Atty, just wanted to know if tama po pagkakaintindi ko. Di kailangan kumuha ng dual citizenship certificate kapag ang bata ay anak ng Filipino na nanay at Australian na tatay. The Child is born in the Philippines but acquired Australian citizenship by Descent dahil sa father. Di po nirenounce un Philippine citizenship. Tama po ba na di need ng dual citizenship certificate kasi ito po ay only for those that have renounced their citizenship,tama po ba? Ang bata ay by birth Filipino and by Descent Australian.
