      Yeah, I think it’s in the defense attorney playbook. I’ve heard them say, in other cases, to ignore the prosecution sentence recommendation because it’s excessive punishment for the defendant. I guess that could be considered a win if successful.

      Normally when a defense lawyer says that, it is because a client chose to go to trial rather than accept a plea, and usually the sentence is much harsher than said plea. In that case it is a bit like punishing a defendent for exercising their right to trial. However, in this case, I don't think he was ever offered a plea.

      The role of a defense lawyer is to work to provide the best defense as requested by the defendant, constrained by the requirement of truthfulness to the court. You can't prove there isn't a reasonable doubt if the complaint isn't questioned.

    I learned something today. That when a defendant testifies in the "narrative" it is usually because the defendants attorneys request that because they do not want to commit perjury on behalf of their client. That speaks volumes now for when I see or hear a defendant testifying in the narrative.
