Learner FAILS for following Highway Codes advice to give way to pedestrians at junctions?!?!

    With the new rules in the Highway Code saying to give way to pedestrians at junctions, you might be surprised to hear you can FAIL your test for doing just that!
    This video gives an example of this, and also four other serious faults from UK driving tests, so you know what to do so you can drive safely and PASS.

    Thank you for uploading the one with the pedestrian on the scooter. Classic example of why that Highway Code rule needs to be clarified.

      Yes, agreed highway code is not very clear.
      Tricky to put it all into words though, but still DVSA have done that poorly.
      Something like:
      "Approaching junctions with caution and aware of pedestrians, being prepared to give way, as the pedestrians might not look"
      Not perfect English, but better than what the DVSA came up with.

      Learner was past the stop line. This was not "response to traffic lights". 'Pedestrian' had no lit crossing, was in the road first before the driver took the junction and, therefore, was at risk. The learner came to a safe, slow and gradual stop and was completely correct to stop as they cannot assume what the 'pedestrian' will do. Had the 'pedestrian' been on the other side of the road and in a similar situation, it is obvious that a stop was required. I would have complained about this examiner with that footage. Their decision goes completely against H1 (hierarchy of road users) and H2 (give way to pedestrians crossing or waiting to cross a road into which or from which you are turning). If these rules do not need to be followed, you are correct: the DVSA must clarify.

    Prohibition (a.k.a. MUST NOT) overrides the optional SHOULD.
    238: Double yellow lines indicate a PROHIBITION of waiting at any time even if there are no upright signs.
    H2: At a junction you SHOULD give way to pedestrians crossing or waiting to cross a road into which or from which you are turning.

      It's not considered waiting as it was due to circumstances outside the driver's control.

    Would mind explaining how the learner failed for following the highway code please? I thought the examiner said it wasn't safe to stop there. From the video, I would agree.

      Highway code says:
      "At a junction you should give way to pedestrians crossing or waiting to cross a road into which or from which you are turning."
      Mentioned NOTHING about making sure it is safe or what to consider, just GIVE WAY, that's what the learner did.
      This new 'rule' in the Highway Code is very poorly worded and can easily be misinterpreted.

      Isn't it our job as trainers to help pupils understand the rules set out in the HWC?

    7:22 I’m sure the Highway Code states that you must give way to pedestrians who are crossing a road into which you are turning into and also turning out from though?

    2:20 you haven't explained he was told to turn right on the second roundabout but which exit??? Like usually its been to turn right on the roundabout 3rd exit or 4th exit etc but you only saying turn right????

    What's the point in a theory test? I have failed 9 times and it has knocked my confidence greatly. Every time I do a mock test I pass, then I go to the test centre and get 40 out of 50. It should be changed so that the next time you sit it, you don't have to do the full test again. Just concentrate on the part you failed. To me it is just a money making scam. It should be reverted back to years ago when the examiner asked you questions from the highway code. I am sick and tired of this rigmarole. What can I do to get through this and pass. Its soul destroying

      It should be called the common sense test instead lol if you can't pass it then you shouldn't be on the road. It isn't hard

      To be blunt, if you fail the theory test it means you should not be on the road because you lack the basic knowledge of the Highway Code. I think it’s reasonable to expect people to get close to 100% correct as most of it is common sense.

    Very unfair of the examiner. Say it had been a right turn and the pupil was waiting for traffic. Would the examiner say it was unsafe to wait in the centre of the junction because the traffic lights was on green?

      It's a tricky call.
      If turning right at a traffic light I would say it's unsafe to wait in the middle to give way to a pedestrian.
      At lights I would only stop for a pedestrian if they walked directly in front of my car, would not stop if they were moving slowly on the other side of the road and making eye contact, as per this clip.

      @@UKDrivingTest I see, I did my test a long time ago so it's not something I was taught, but for me it's only a serious hazard to wait for pedestrians unnecessarily on roundabouts and fast dual carriageways. That being said, I think the pupil could have cleared, but it showed good observation to stop. Still say it was harsh to fail someone for a subjective incident, if I were an examiner I would always give the benefit of doubt, it's a damn shame they have to pay again now.

      Problem with stopping to give way at traffic lights is it will throw off the whole light phase, so you could end up being 'stuck' in the middle then your light changes to red, then the other traffic gets green and starts to cause an issue.

      @@UKDrivingTest Take your point. Like I say, it's not something that I was taught, so it's just the bits I've managed to pick up from YT. I'm sure the DVLA would give more in depth guidance to instructors as yourself so I ain't gonna question that lol.

      DVSA (who do the tests, Driver and Vehicle Standards Agency, DVLA do licence (Driver & Vehicle Licensing Agency)) don't give any information to instructors, they are kind like that, they just check up on you ever few years..
      Knowledge is from:
      - Study from first becoming an instructor.
      - Ongoing study due to dealing with all aspect every day of the week, including questions from learners that you need to know the correct answer and not just give it your best guess.
      - Networking with other instructors via social media.

    Id have failed that for winding my window down and throwing my shoe at the doughnut. Other than that he was on the path and he has to be treated as a pedestrian and given way to the moment he steps onto the crossing. I personally dont care which way he was going the driver doesn't have slow motion and rewind he waltzed out onto a busy road and the driver stopped. sorry but the doughnut's life is more important than a rear bumper.

      Tricky call isn't it.
      Probably a 50/50 split on opinions if you should stop or proceed (with caution).

      @@UKDrivingTest i dont think its tricky the highway code is clear on this. how is it less safe to stop there than any other junction? i think its madness these crossings are even at the exits of roundabouts let alone being instructed to stop for them. and i think this could be contested as the stop was not abrupt or sudden.

      it's unsafe to stop as you are on a green light, people expect you to go on green, not stop, so high risk of being rear ended.
      Stopping can also mess up the light sequence, if you stop on green and let the pedestrian go your light might then changed to red, then other traffic gets green and you are causing a problem, especially if other traffic, now on green, is not paying attention and expecting you to still be sat there.

      Human laziness means the unofficial crossings NEED to be at the junctions (lights or roundabouts, all types of junctions)
      If the crossing was put further down the road the people would just ignore it and cross where the junction is to save the effort of walking down the road, crossing, then walking back up. I am sure you have seen this may times before, even do it yourself, I know I do sometimes (if it is quiet and safe).
      Even if you put up metal railings to stop pedestrians for crossing at the busy junction / road they will just ignore it and jump the fence. Again i am sure you have seen this before. Got a 50mph dual carriageway near me where on side is Sainsburys, on central reservation is a tall metal fence, pedestrians just ignore it, chuck their bag over and climb it, or look for a gap that someone created one way by bending bars. There is a perfectly fine footbridge and pedestrian crossing nearby, but takes an extra 2 minutes to use it.

      @@UKDrivingTest see this every time i go to my local supermarket, traffic always backs up at the junction meaning people are sat in the middle on a red and ontop of the cross walks iv been beeped at few times for waiting for the area to clear before going on green but what else can i do. but this is what i mean when i say the exam expects people to drive like robots. it makes zero account for the unpredictable nature of other road users and pedestrians which causes unsafe driving and i think far too much responsibility is placed on the shoulders of a Learner to account for the potential idiocy of drivers behind. TBF these are people who get to drive once every week and often 2 weeks you cant expect them to drive for the person behind as well and the horrendous backlog and fail rate only supports this in my opinion. But ask yourself has the "fail" taught the learner anything? has their driving changed other than to second guess themself when a pedestrian walks infront? how is that safer? and even if your 100% correct that alone prioritises traffic flow or damage over injury or death. sorry for the wall of text btw lol
