    CLIP DESCRIPTION:
    Libby (Ashley Judd) finally holds Nick (Bruce Greenwood) at gunpoint after six years of being falsely imprisoned.
    FILM DESCRIPTION:
    In this thriller, Ashley Judd plays Elizabeth Parsons, who is convicted of murdering her husband and sentenced to a long stretch in prison. After Elizabeth has spent six years behind bars, it turns out that her husband is still alive: he faked his own death as part of an insurance scam, and Elizabeth is soon released. However, Elizabeth's feelings for her husband can hardly be described as warm, and she wants custody of her son. Elizabeth's parole officer (Tommy Lee Jones) wonders if she might try to make his murder a real thing after all, especially since the law states a person cannot be convicted of the same crime twice. Double Jeopardy was directed by Bruce Beresford, from a screenplay by Douglas S. Cook and David Weisberg.

      True, but since Nick is not supposed to be alive to make that recording, provide a baseline or sample, for the alteration, it's definitely very persuasive in this case.

    Ashley Judd is a very talented, well-educated and well-spoken, and beautiful actress. She has gone through some terrible personal tragedies these past few years.
    Tommy Lee Jones, what is there to say, he could make reading out of a Ford Repair Manual an academy award nominated performance.
    Bruce Greenwood is an elite solid character actor and always gives a top-notch performance.

    I don't understand why you could go to jail for murdering your spouse when he or she is still standing

      If I recall from this movie, he faked his death. She went to jail because the court believed she did it. With flimsy evidence and being a mother who might have been persuaded to kill him because of his debt he owed, she didn’t get life.
      After he died all his debt wasn’t transferred to her due to reasons. But anyway it was only later in prison she learned he was still amongst the living. And was given the the idea to kill him when she gets out. Because she had been sentenced for his murder and having servers the time, she technically could kill him and not be given any extra time. Since you can’t be convicted of a crime that the court had already sentenced you for. Double Jeopardy, name of the movie.
      Not only that but having the dead body of your husband who was suppose to have died years before, might make the court reconsider that maybe he didn’t die on the boat 6 years ago.

    This movie is great but also legally dubious
    She technically committed two different crimes in two different states
    She technically murdered that man, but he conspired to kill her and therefore she can kill him right now in self-defense

    She would definitely go to prison .
    Every crime is tied to a time and place. She was convicted of killing her husband during a trip. Once the knowledge that her husband is alive comes to light the previous conviction is vacated. Because of separate sovereign (she was tried in Washington then killed her husband in Louisiana. ) Makes it a separate crime. She's also a felon in possession of a firearm. She can be tried on the state and federal level. Double jeopardy doesn't work how you think it works.

      Are we watching the same movie? Didn’t Libby killed Nick in self-defense on this scene? Nick shot her parole officer as well, when he was shooting to kill Libby here. So how can she get charged with murder, again for that matter? I’m kinda confused.

      Which is why Lehman (her parole officer) promised her he’d ask for a full pardon and to clear her name.
      Plus, she never should have been convicted and on parole, and Lehman had found the evidence to prove it; her husband’s real identity, proof he was a fraud.

    "as an ex law professor" Travis Lehman (played by Tommy Lee Jones) should know that double jeopardy would not be applicable here. the first (alleged) murder took place in the state of New York, the second (self defense) in Louisiana. The Double Jeopardy Clause has no bearing on separate crimes of the same nature.

      Double jeopardy is a procedural defence that prevents an accused person from being tried again on the same (or similar) charges following a valid acquittal or conviction.
      Her previous charge was killing her husband, whom is alive and well. So time and place don't necessarily matter here because it is more about the people involved.
      She already did the time for her crime so she can actually kill him and walk away.

      @@luvstagrind no the first comment is right. these would be considered 2 separate crimes as they take place at different times. the different states things doesn't matter, simple the different time
      for that matter look at it from the point of view of a different crime. say robbery. if a person is convicted of robbing a story which they didn't do, who would argue they could go back and rob it again after getting out of prison?
      they are different crimes.
      the act of murder being...well finite doesn't change that. every other crime would apply as well. you can't shoot a person twice. etc etc

How can she be charged with killing a 'dead' man? I don't understand how this is even possible. Robbery I get, because you can rob the same store twice but that would still constitute two separate offences, as you pointed out, because of the different dates and times. But it is not physically possible to kill the same person twice, regardless of time or location. I don't get it. How can a woman be convicted of killing her husband in one state, then years later be convicted of killing her husband (the same man) again in another state? Makes no sense to me. How can you kill the same person twice?...

    Actually, this would NOT be double jeopardy. If she killed him, that's still murder. Different date, different place, different time. Those are all "elements" of the crime and as long as just one of those elements is different....it is a totally different crime and can be prosecuted as such.

      @@maddieb6598 Because it's a movie. Double jeopardy only prevents one from being charged twice for the SAME crime. Again, if just one element of the crime (for example, the DATE of the crime) is different, then it is a different crime.

      It was a ruse. Libby and Travis knew full well that double jeopardy wasn't applicable here. They were lying to Nick in order to scare him. They state in this scene that they don't intend to kill him all, but could if they wanted to. They never were going to kill him and mentioned double jeopardy as part of the ruse.

      No. Double Jeopardy is written into the 5th Amendment that you can't be accused and charged with the same crime twice. Some one can't be accused for murdering the same person twice.
      Take OJ Simpson for example. Everybody know he committed murder, but since he already had his day in court and aquitted, he could make a full confession if he want to and the police can't touch him now.
      In this movie, she was already arrested, accused of murdering her husband, had a day in court, found guilty, sent to prison. By Double Jeopardy, she can't be charged for murdering the same person twice. This movie is actually accurate.

      @@Adam-lw9xp What people are trying to say is that if you went and killed that person for real if he turned out to still be alive, it would be considered a separate crime. This is because, not only is the crime listed as the murder of a person, it is also listed with the date, location, and time of the murder as well. So, let's say that OJ's wife turned out to still be alive all this time, and OJ then went and killed her for real. This would be considered a separate crime, because the previous one was listed as a specific date and time. "OJ killed his wife on this date" is crime 1, "OJ killed his wife on the other date" is crime 2. Crime 1 would be considered invalid, but it would not invalidate Crime 2, unless nobody saw OJ's wife walking around alive, meaning OJ would get away with it because everybody thought his wife was already dead. In the context of this scene in the movie though, the Double Jeopardy argument is just a ruse on the parts of the characters to scare the villain. They were lying to him. So the movie still stays consistent. Earlier in the movie, Libby's plan is to kill him and get away with it because of Double Jeopardy, but at that point in the movie she thought that her husband had been hiding for all those years and nobody had seen him alive, so she thought she would kill him and nobody would ever know because he was "already dead." That plan went out the window the second she figured out he had changed his identity, but the movie still remains consistent.
