- They live among the locals. Yet they’re not recognised as citizens of the country. And although they’ve been living in the country all their lives, they don’t exist legally as a people at the place they were born. At the moment, there’re over a million non-Malaysians living in Sabah today. And they include - undocumented, stateless migrants who’ve made Sabah their new home.
Being stateless, many of them have been denied their basic rights that other citizens currently enjoy, including the rights to education, healthcare and employment. Who are these marginalised and unrecognised citizens otherwise known as Malaysia’s invisible people? Is there really a future for them living at a home away from home?

sabahan here, I am ashamed about this daily; nobody in the world deserves to live under such conditions and it is utterly repulsive how our people and government have been mistreating them for decades..

Filipino here, the comments section seems tense and fired up. But to our Malaysian brothers; just hearing our countries (Ma Phil Indo) call our children “Anak” reminds me how much we are still related by blood and ancestors. You know why most of them sail to sabah, it's actually simple, they want stability in life, peace from war and money. Why would they cross an ocean? For holiday? No, because of nothing is available at the Sulu island. The Philippines government did not provide much on the southern part of the Philippines due to different political and religious beliefs. The fact that most of them come fleeing from the south Philippines to Sabah due to war in the Moro region is a clear indication these people flee for safety. Sabah at this time accepts them as war refuges. The influx of migration of the people to Sabah is uncontrolled and not through proper immigration channels. Some don't have passports, thus deporting back to the Philippines is next to impossible. Yes this people need the basic necessity and human right, in which the government had allowed them to have access to health care and education before 2015, where they only need to pay as little as 40cent (roughly in US Dollar currency) for healthcare in clinics, maternal care, FREE CHILD VACCINATION, YES READ IT. With little thought of mind, just how much does the previous Philippine government have done to help their people in Sabah? Does the government of the Philippines even consider these people their citizens? Don't just type, act.
Exactly, I hate that the pinoy keyboard warriors have flooded the comments saying Malaysia oppressed these people. These people ran away from THEIR country. Sabahans have treated these people to the best of their ability. The Malaysian Government can’t just willy nilly accept the millions of Moros into Sabah. Malaysia isn’t anywhere near that rich. And the native Sabahans might revolt due to resource scarcity. Also, shame on the BN and UMNO party for giving these people IDs in place for votes instead of building facilities to naturalise and educate them securely.
@@FF-ch9nr I don't think they should stay in Sabah. They should either go back to the Philippines (their original villages, or a different part of the Philippines) or be moved to West Malaysia and eventually settled and come citizens. Both countries should work together to provide free transport and help them settle. But not in Sabah. We don't want to encourage further uncontrolled immigration. And it would upset the demographic balance, possibly leading to eventual ethnic/religious strive like has happened in so many other places.
If there was open borders with the southern Philippines, Sabah will soon fill up with people from there, who will outnumber the local Sabahans, and then push for the area to secede from both Malaysia and the Philippines, along with Mindanao to create a Moro country. Then what happens to the Sabahans?

Don't get confused between the stateless and the illegal immigrant.
Stateless definition; a person who is not considered as a national by any State under the operation of its law.
Illegal immigrant definition; Illegal immigration to Malaysia is the cross-border movement of people to Malaysia under conditions where official authorization is lacking, breached, expired, fraudulent, or irregular.
Everything is recorded by the government those who are not in the system are mostly illegal immigrants.
Those who have refugees status that come to the state are recorded by the gov of Sabah and their legal kids have state identity cards but those born out of wedlock no citizenship.
And mostly, not all of them but mostly, the people living near the shores are generational of illegal immigrants that have came and lived there for a veeeery loong time. The illegals there have learn to assimilate their ways and follow the culture of the native that lives from the shore they can fool the poeple but not the system.

The Malaysian government is in doubt of granting them a Malaysian citizenship because they know that they are Filipinos, and they are born in Sabah, Philippines. Definitely not in Malaysia. Dec 16, 2021 from the First President of the Paris Court of Appeal suspending the effects of the Exequatur Order in France and barring the claimants from relying on it.
Stampa upheld the claimants' request in disregard of the suspension of the effects of the Exequatur Order.
"Therefore, it follows that the final award rendered by Stampa on Feb 28, 2022 not only violates Malaysia's sovereign immunity but was also rendered in disregard of the Madrid and Paris court decisions.
The Spanish Public Prosecutor has filed a criminal complaint against Stampa for serious contempt of court and professional intrusiveness, it said.
It added that the Criminal Court N.40 of Madrid has subsequently started a criminal investigation in connection with the illegal actions of Stampa.
"The Malaysian government will continue to take all necessary actions including legal actions to put an end to the claim and to ensure that Malaysia's interests, sovereign immunity and sovereignty are protected and preserved at all times,"
Did you know that the case is not a territorial claim to be named? It's a propietary claim, you are just renters, an abusive renter. Not even contented with the fixed rate and that wasn't even ascending through decades, and went on claiming the land as their own. Back in 90s when Mahathir was still the PM , Project IC was launched to grant citizenship to many people like these, and it encouraged more illegal immigrants to cross the border.
This is a farcical argument, people leave because Its difficult for them to survive where they are leaving. regardless what a govt do, when you need to move to survive you go wherever you can for survival. The least Malaysia govt can do is give then temporary legal status, so they don't live in terror or fall prey to terror groups.

It's outrageous how this country's in-charge have ignored their existence, or even attempted to try helping to resolve the glaring issues in an otherwise beautiful state of the country in Sabah. I saw first hand when on a trip to Sabah and Keningau some years ago, and a local pointed out to me who these people are and where they lived - many of their slums were actually very visible from the stretch of pristine beaches as they mostly live by the sea. How hard is it for the state or federal administration to at least acknowledge these are human lives fighting to survive; to offer the children basic education, and families with proper lodgings - at least to the existing population, For a Start?? It is shameful how corrupted officials even have the cheek to extort money from these vulnerable people. It's infuriating to see that such state of affairs still exist in 2022. For the benefit of these Filipinos in Sabah, Philippines and Malaysian officials should negotiate so that proper documentation should be established to everyone immediately.

The situation has now changed. These stateless people are suddenly the legal residents of Sabah. Sabah is owned by the Sultan of Sulu after all. So all Filipinos living there are the rightful residents of Sabah. The Malaysians are the illegal occupants of Sabah. Time is nearing for the return of Sabah to Philippines' jurisdiction.

People tend to choose a safe and comfortable place, North Koreans who flee to South Korea will automatically be granted South Korean citizenship. Timor Leste people who fled to NTT were also given Indonesian citizenship, why don't Malaysia and the Philippines consider them ..but fighting over territory only?
Once the sulu sultanate of Philippines take over the Sabah this stateless people will automatically be Filipino citizens . You just wait.

the reason is Malaysian knows from the start that sabah is by laws, a property of Philippines from the history before and now and in the future. the only thing that ties between SAbah and Malaysia is the leased contract of malaysian government to the Sultan of Sulu.
if they give them rights to live there, more and more Filipinos will come, occupying the entire area, making it easier for the Philippines to reclaim its own land.. Malaysia is only leasing Sabah from sultan of Sulu. now they are facing their karma for what their doing to all `stateless filipinos there`. the malaysian government needs to pay US$14.9B to the sultanate of Sulu, and they have to return the control of Sabah to the Philippines.

Thanks, the fundamental issue is human rights including the rights to livelihood, security and healthcare. It’s sad that the plight of thes undocumented Filipino migrants has been complicated by the Sabah dispute between Malaysia, the Sultanate of Sulu’s heirs, and the Philippines. This dispute can be traced back to an 1878 treaty between the British North Borneo Company and the Sultan of Sulu.
The Filipinos in Sabah must be given the right to live in Sabah because Sabah is part of the Philippines.
The Malaysian government should continue paying rent to the Sultanate of Sulu. It's obvious that Sabah belongs to Sulu, Philippines after it was given as a gift by the Sultan of Borneo to the Sultan of Sulu a few hundred years ago.
And the Malaysian government can just accept a few hundred or thousand Philippine immigrants per year and give them residence certificate. Any excess can be controlled via strengthening border control.
Why do this? The Malaysian government needs to remember that Sabah technically belongs to the Philippines.

It's not only happen in malaysia. It also happen in Brunei where no media speaks about it so much. Most of this stateless was born generally passed to next generation and never have any option since they are born.
It also happen in Singapore, Thailand, Vietnam, the Philippines and the worse Myanmar where the even kick their own people out.

Philippines claims on North Borneo based solely on historical and legal rights is very dubious without any evidence.
British North Borneo Company (BNBC) signed 2 agreements with the Sultan of Brunei and Sultan of Sulu on 29 December 1877 and 22 January 1878 over the territory of North Borneo respectively. Thus, Sulu claims on North Borneo was given by Brunei as a gift is unfounded.
On 22nd July 1878, Sultan Sulu relinquished his sovereignty on Sulu Archipelago and its dependencies thereof to Spain in Bases of Peace and Capitulation Agreement. The agreement by Sulu with BNBC on 22 January 1878 is null and void based on his majesty termination letters also dated 22 July 1878 to the Governor of Sulu and Governor General of Philippines who later forwarded it to BNBC (24/7/1878) and Spanish government (20/8/1878) in Madrid respectively. Later this whole episode is override by the Madrid Protocol 1885 that North Borneo belongs to the British.
Regarding the rent, it is ludicrous to be considered as there is nonexistence of any agreement between Sulu/Philippines with Malaysia on the matter. Even when Malaysia stops giving money to Sulu since 2013, no legal process been taken to court in Philippines, Malaysia or ICJ until now. It is only a gift as the amount is ridiculously small. One dollar (Mexican gold dollar) has a weight of 1.7 grams of gold. For 5300 dollars have a weight of 9.01 kg of gold. Compare the value of 5300 Malaysia dollars to 9 kg of gold. Furthermore, rent you pay in full.

They literally control all fishing activities. Their fishing boats are parked at the KK waterfront in the evening. Their houses line the shores of Gaya Island.. a stone's throw away from KK shoreline. They control the boating business taking people visiting nearby Islands too.
The entire Wet Market, Night Market and Food Market along the KK seaside are all commerced by them...at least 80% of them. Local Sabahans' business have been ripped away from them bcos these so-called stateless people sell their stuff cheaper than local vendors.

My question is why ..? Malaysian loves to claim the teritory of other nation, culture and heritages. But refuse to recognise their ethnic. Look they speak Melayu. If they claim the land is part of their teritory so do the people is part of their citizen.

Any pro Sulu or PH claims on North Borneo, their primal source of reference will be the Sulu and British North Borneo Company (BNBC) agreement dated 22 January 1878. In this agreement, Sulu “lease” North Borneo to BNBC (Tausug version) while the English version is “grant and cede”. This information will easily be cherry picked in any of their discussion or debate.
But what they will not revealed are those that can refute their claim. The followings are few of the information that had been kept secret:
Firstly, the agreement between Sultan Brunei and BNBC on 29 December 1877 over North Borneo which is 3 weeks earlier than the agreement between Sultan Sulu and BNBC (22 January 1878). This will deny that North Borneo was a gift to Sulu from Brunei.
Secondly, on 22nd July 1878, Sultan Sulu relinquished his sovereignty on Sulu Archipelago and its dependencies thereof to Spain (Bases of Peace and Capitulation agreement).
Thirdly, on the same day, 22 July 1878, Sultan Sulu wrote to Governor General of Philippines and Governor of Sulu terminating the 22/1/1878 agreement between Sulu Sultanate and BNBC. Thus, the agreement is null and void.
Fourthly, on 24th July 1878, Governor of Sulu wrote to BNBC concerning the Spanish sovereignty on Sulu and its dependencies including North Borneo and the termination of the 1878 agreement.
Fifthly, Governor General of Philippines wrote a letter on the same matter dated 20th August 1878 to the Spanish Government in Madrid.
Sixthly, Finally, the issues on the agreement between Sultan Sulu and BNBC and the status of North Borneo was settled through the Madrid Protocol (7th March 1885). North Borneo belongs to the British under this Protocol.
The above documents are kept either in Public Record Office in London or General Archives in Madrid. It can also be accessible from the Philippines official website with Spanish to English translation.
In addition, during the US colonization of PH, 2 agreements (Bates 1899 and Carpenter 1915) were signed by the Sultanate of Sulu which relinquished its temporal sovereignty of Sulu and its dependencies. Later the 1930 Anglo-US border agreement acknowledge North Borneo belongs to the British.

That is a false narrative by Sulu. North Borneo (Sabah) previously belonged to Brunei before they ceded the entire territory to the British under the 1877 agreement, in the agreement it clearly states that North Borneo will be ceded to the British North Borneo Company (BNBC). However the Sultan of Sulu came along and falsely claims that North Borneo belongs to them, and to avoid a possible war in the region the British enter the 1878 agreement with the Sulu Sultanate which states that Sulu will grant and cede North Borneo to the BNBC which was the original meaning of “pajak”, however the Sultan of Sulu then twisted the original meaning and claims that the word pajak actually means “lease and rent”. The British then pays 5,000 Mexican gold coins to the Sultan of Sulu as cession money for North Borneo but the Sultan of Sulu twisted the narrative yet again and claims that the payment is “rent money”.

Two wrongs don't make a right. Even if Malaysia don't want to give them citizenship. At least give them an ID card with temporary status so the can work, get medical care, pay taxes and Kids can go to school. It would benefit everyone and reduce exploitation and poverty. Some may even save enough money to get a lawyer to get citizenship in their home country to leave or find a way to naturalize and become Malaysian the proper way. Shame on the govt.

People in Sabbah are there already, but Malaysia claimed it thier own and did not recognize the original settlers there. Sabbah must be a dependent state not under Malaysia nor the Philippines.
There are many other stateless citizen, not just this one. If the land Sabah is rented, how do you recognize the citizen? If the parents don't have the proper documents to citizenship, how could the child have one? And how do you differentiate between the native people there and those coming from Philippines?

Sabah is in fact, part of the Philippines. Malaysia has been paying rent to administer the island, only stopped the payment when moro rebels from the mainland Mindanao, attacked the Malaysian military outposts. Earlier this month, the Sultanate of Sulu, the righteous owner of Sabah has finally won the arbitration. Sabahanians will now be given Filipino citizenship in the near future, once all this gets settled down.

The stateless issues came from the fact that Sabah is a borrowed land, and Malaysia has tacitly been expressing that by not recognizing the locals as citizens despite them being born in Sabah. That is, even when the parents are not recognized as citizens of any country, Malaysia still refuses to acknowledge the Sabah-born children as citizens.

One of the reason why is hard to give them citizenship despite the existent of support from some political party in Sabah dan the fed gov in kl..is because of the opposition from the natives people of Sabah who are mainly christian while the descendant of refugees are of Muslim background..if they are given citizenship it will ultimately change the social demographic of the state.
