      Exactly. I find in unlikely that everything added up in these emissions systems from the mining to production of them and the Def fluid combined with the decreased mileage and degradation of the engine is better for the environment than a proper tune and free flowing exhaust with today's technology. Someone really needs to do a study on this and prove one way or the other.

      The above statement/reply is true & unfortunately I am speaking from experience. He will be sent to a federal prison camp to serve his sentence, which is also considered a minimum security facility. If your charge is non violent and under or less than 10 years you will more than likely go to a camp, especially if it’s your first offense. You will be given a job like mowing the grass, landscaping, food warehouse, laundry, etc.. There were even guys that left every day and worked for the park service. Most the people there were there for “white collar” crimes such as money laundering, tax evasion etc., which included doctors, lawyers, accountants, bankers & money managers or Wall Street executives. There really wasn’t many “hardened criminals” in the camps. He’s also correct that your not really behind a wall or fence and there’s nothing keeping you from leaving other than the fact that you’ll get an escape charge if/when caught & probably get another 5 years added to your sentence and be transferred to a low or medium facility federal prison. Going to a prison camp isn’t like going to prison at all and is more like going to military basic training except without the guns and training.

    The inconsistency in prosecution is probably due to the political slant in geographical areas. There are areas in our country where a jury would never convict this man and there are areas where the EPA can win such cases. The feds know which areas are worth their time to go after shops. After enough wins in those cases, they will spread out into less obvious cases until they are coming after the small guy.

      @@beefman62they are both one in the same. There is large investments into new green energies and reduced carbon due to the government because the EPA is a department of the government. This is a political mindset transferred into a strong arm on companies. The problem is mutually exclusive

    • @MrPeacekeeper44
      @MrPeacekeeper44 Рік тому

      @sirseven3 I believe it would be overall in the best interest of oil companies to assist in the defense of these companies as the aftermarket is geared towards prolonging the use of oil. The government and specifically the EPA do not have limitless money and have to operate within their budget parameters. They can not fight everyone in a year or they would. However, if shops band together in a class action towards the EPA's overreach, even preemptively, then the EPA can be made to submit. The burden of proof has always been on the EPA to show direct links of harm or damages, not generalized science. Most vehicles are in EPA emissions compliance, and going after the small percentage of vehicles and companies in violation of noncompliance is a waste of the EPA'S time and does little to improve the environment as a whole.

    • @nolanwillis9812
      @nolanwillis9812 Рік тому

      ...or just reign it in with proper boundaries. The EPA should only be involved when interstate issues are in play. If there is an air quality problem that adversely affects multiple states, it's an interstate issue. If some farm boy is goofing off and rolling coal from a deleted truck, it's a state/local issue because there is no way that is going to affect multiple states. Seeing that the parts do not pollute at all until they are installed on a vehicle, it's none of the Feral Government's business at all, even if the parts are sold across state lines. If we kept the Federal Agencies within Constitutional bounds, we wouldn't be having these problems. Heck, Federal Law could even require all vehicles that are imported and/or sold across state lines to be equipped with compliant emissions equipment, but as soon as those vehicles are owned by private citizens and consumers, it's none of the Feral Government's blankety-blank business!
      The US Feral Government needs to leave the American people alone and focus on real problems that actually fall under the authority of the Federal Government--things like border security, foreign policy, monetary policy, international trade policy, and so forth. These are all legitimate Federal issues that our government needs to stop neglecting or performing poorly. We the People need to demand this too and quit letting our wannabe overloards run amok with their power trips. They do not have the legitimate Constitutional authority to do this period.

      The real problem is yes it can be argued that pollutant vehicles cause environmental and health issues but the burden of proof is to prove unequivocally that any of the vehicles this poor shop owner worked on directly effected any one person's health or destroyed the environment. The EPA is not a legislative body in and of itself. If they want to impose their will, it has to be specifically spelled out and specifically proven on a case by case basis after being approved by congress through all the checks and balances. The EPA has no rights to seize property or devalue a vehicle by deeming it unsaleable either. Everyone who has been affected by these unconstitutional rules should band together in a class action suit.

If I did not have a relationship with Jesus, I wouldn't want anything to do with Christianity because of what it did to my family and me. The way so many mainstream Christians got on board with mandatory masking and vaccination and the ways in which so many of them judged others who disagreed with their approaches speaks volumes.

    So let's break down what emissions equipment does.
    All it does literally is capture the fumes from your fuel tank and pumps those vapors into the manifold when the pressure builds in the tank. When the tank isn't under pressure, or your engine isn't under load the evap valve opens and dumps the fumes into the air. So the only difference between today and cars in the 60s which didn't have any of it is this. They released the pressure when you opened your cap on the tank.
    There is absolutely no way for a engine after combustion diesel, or gas that it can separate un burnt fuel from the exhaust gas. The whole thing is a scam .

    • @jeffs2809
      @jeffs2809 Рік тому +1

      You’re picking part of one system (evap) out of several different emissions controls. Evap is only used on gas powered vehicles for one. Also, if it purges when the engine is not running, it does so through the charcoal canister.
      I’m not really sure what you’re trying to say in the last paragraph. If it’s something regarding EGR, I’m thinking you might not understand the purpose of EGR.

My understanding is it appears to be the only thing you can do to your vehicle is repair with stock vehicle parts or upgrade with CARB approved parts and tuners, correct?

    The EPA came down hard in California on the Smog Shops doing illegal testing and illegal modifications to gas powered vehicles and dozens of shops got jail time. It's because of flagrant violations of EPA laws on a vehicle is a felony. This means that each modification is a felony and shops in California had dozens to hundreds of violations because they were literally making millions per year from installing illegal turbos, injectors, cam shafts, illegally tuned ECMs, removing CAT converters etc. and then passing these vehicles in a Smog test. The owners of the vehicles would pay the Smog Shop thousands of dollars for each illegal set of modifications and a passed Smog Test, like $10,000 per car. These shops were working 24 hour a day-7 days a week., especially in LA. The EPA is a brutal agency and I, as a 30+ year ASE certified Master Technician with both Smog Licenses and about 100 factory certifications did not want to lose my way of making a living, so I obeyed the all the laws. Now this more than a decade long crack down in the gas vehicles market is happening to the diesel market.

    usc 42 7522 does in fact, prevent manufacturers and shops from defeating emissions controls in any way shape or form, by law.
    might be kind of crap, but that is in law.
    a person (re: private citizen, on their own) can mod their own vehicle if state laws do not otherwise require the emissions systems to remain intact (I.A.N.A.L., etc), but you can't offer services or parts to intentionally get around emissions systems in road legal vehicles.
    and if you get caught doing it, they're going to try and slam you for as much as they can, even if its not valid items for prosecution. and you have to fight every last bit.
    for minor infractions, up to 2500/incident in fines. for higher level infractions, up to 25k/day per violation in fines (this ones mostly limited to stationary pollution sources, i think?).
    as for the jail aspect; 42 U.S.C. 7413(c)(1) allows up to 5 years if there's a second or added conviction of violations by companies/manufacturers defeating emissions control devices/methods.
    now, this said.. there is some iffy language in 7413 that may give the EPA wiggle room to tag regular citizens if a given case is before a judge that tends to side with the establishment.
    so really, you're kind of risking a hefty fine even messing with this stuff as a private citizen messing with your own vehicle.
    which is really crap. if congress wanted to actually include private citizens, 7522 would include a section specifically mentioning private citizens being prohibited from the same modifications.
    especially since they're now going after people converting street cars to race cars for track use only. even regular people doing it for giggles.
    to me, it sounds like the EPA is trying to corner the market on its authority in every way it can, while working around the WV v EPA ruling. in some instances, they're within statutory limitations. in others, they're verrrry much not. but they seem to be trying, and hoping the court in each instance sides with them, instead of the letter or even spirit of the law. and some judges will defer to chevron without any thought on the matter.
    question becomes; do you want to be a test case and potentially have your life ruined?
    again, N.A.L. T.I.N.L.A. its your ass in court if you get tagged for a violation, don't be a bone head.

    So I would agree that some of the emissions devices are problematic. But no one can think that these idiots out there blowing black smoke didn't cause all this. Shops that do the work or provide parts and equipment that promote this should be responsible. Black smoke equals un burnt fuel and solid particulates in the exhaust. There are ways to increase horse power without the dirty emissions. The shops that are getting caught knew what they were doing.
