    My home CCTV covers my property in conjunction with public space outside my property boundary. Why you ask. If an incident was to occur on my property, it's very useful to know what happened before and afterwards in public space to get the complete picture.

    Could you do a video on laws of photography in public places the UK many police and security guards seem completely ignorant of the law assuming everyone is a terrorist.

      It's not only Security Guards who seem completely ignorant of the law, most Police don't respect Public Photography is a legal activity, I'm a Disabled British War Pensioner and I have had a brain injury that can affect my short term memory and therefore I have and use a body camera to remind myself what has been said or what I've agreed to, I'm also physically disabled with damage to both of my arms and therefore the body camera is in a case attached to the strap of a bag that I carry. I have been questioned by the Police on a number of occasions and threatened with arrest for Breach of the Peace. This is ridiculous as I used to use the video function on my mobile telephone without ever being questioned or threatened, the problem being that I kept damaging or corrupting the memory card. There's practically no expectation of privacy in public in the United Kingdom. So anything that can be seen, even with a telephoto or zoom lens, can be photographed or videotaped. There's more laws regarding audio recording someone without their permission than there are video recording someone without their permission!

      @Simon Horwell, yes and no. If you're in public, then there's no expectation of privacy and you can audio and video everything, but once you go onto private property, the law is very different. An example of this is when I see my solicitor, I have to explain why I would like to record the advice that they give me, each and every time that I see them and get their permission on the audio, because the solicitors office is obviously private property and therefore I require the other parties consent. There's some exceptions to this law. An example of this is when a vehicles dashboard camera records damage to the vehicle, on private property, this can be used as evidence in Court. It's a mine field of the law but the general rule is that if you are in your own property, you can audio and video everything except the bedrooms and bathrooms. You can audio record your own telephone conversations and in public, you can record everything that you want. On other people's property, you need their permission to record. There's also the difference between overt and covert recording. If you're obviously taking out your own phone and audio or video recording, then the other person understands that you're you are making a recording of the interaction. If you have a pinhole camera that is recording without the other person/people knowing that they're being recorded, it's not as "cut and dried!" and probably cannot be used in Court. It all boils down to expectations of privacy. If you're in public, a Public road, a Public park, a building that is open to the Public such as a town hall or museum then the public has no expectations of privacy but on private property then the public can argue that they have an expectation of privacy and in Court, its weighted against you to prove that the audio or video evidence should be allowed.

      You have a riight to photograph or video any thing and any one, in or from a public place. This includes, police officers, solders and children! Go on the Met Police website. They have an item on this. Copy it and carry it with you.

    Very good overview, many thanks. The only other thing I would like to know is whether common areas are treated as part of my "own home". I live in a terrace house that has been divided up into 6 flats and I would like to monitor the rather dodgy visitors (one of them treatened a neighbour) to one of the flats by placing a camera to cover the front door. I do understand that you cannot give me a definitive answer but if you could tell me what laws I need to bear in mind it would be very helpful.

    Interesting subject. I was a P.I. for 22 years. In that time I have tracked quite a few vehicle using tracking devices. There is a grey area here, in that ( and I argued this in court ) you are tracking the vehicle, not the person. You could not know who was driving the vehicle at any one time with and accuracy , unless you had the vehicle under surveillance. However, putting a tracker on the vehicle, tracks where the vehicle has gone/been and at what time. Not any particular person. We worked a lot in Barbados, and regularly tracked vehicles. Those trackers were left on the vehicles in Barbados so we could monitor the movements of those vehicle while we were back in the UK. Many of the reports with locations and times of those vehicles, stopped any insurance claims we were working on. Thanks again, looking forward to Part 2.

    I always advise any attending a PIP or DWP appointment to covertly record, any duty of care is owed by the professional to you, not the other way around. As it is an aide memoire GDPR isn't relevant.
    You can submit it at any DWP appeal, if it is in the interests of justice (which it will be).

    As a union rep I had a case where a manager tried to discipline one of his staff based on tracking the location of his work phone. The remote device management software, used to install patches and to remote lock stolen devices, had the ability to have the phone report it’s location. This was pitched as a personal safety feature, if someone went missing the employer could track where they had been. The manager showed that according to the location tracking on the device the staff member had been into a building that contained a Headshop and an Adult ‘bookstore’ during the working day. I got the case thrown out on three grounds: The reasons given in the policy for tracking work mobiles was personal safety and prevention of crime by locating stolen devices and locking them; Whilst it was during the working day the staff member had clocked out for lunch just before entering the building as they finished up a call near by; I had taken a photograph of the frontage if the building and whilst it did contain an Adult ‘bookstore’ and a Headshop between the two was a convenience store (Select and Save, or similar) and what the staff member had actually done was go there to buy a sandwich, drink, snack and a couple of magazines, and had the card receipt to prove it. I also pointed out that as he wasn’t in a uniform and was on lunch then so long as his ID badge wasn’t on show and he wasn’t carrying anything with the employer’s insignia on then, as both were legal businesses, there should be no problem with him entering either.
    My member was in the clear and his manager had an uncomfortable conversation with his own manager.

      Another great video! I am a practicing professional investigator in the private sector. I do conduct survellence ops too for a variety of reasons. There are a few exceptions to the rules. Be interested to see any video you do covering survellence and PIs.

    Figures obtained through freedom of information requests by Ironmongery Direct show there were 99 cameras controlled by Oxfordshire County Council in summer this year - up from 63 in 2019.
    Data from local authorities that provided figures for both years shows the number of cameras used across the UK has increased 15 per cent over three years, from 79,022 to 91,081.
    Councils were asked how many CCTV cameras they had in operation as of July 2022, and how many they operated in 2019.
    Of the 384 local authorities across the UK, 311 were able to provide data for both years, and a further 31 provided figures for 2022 alone.

    I used to work for a major retailer as security in a internal theft and fraud department. It was written into the company had book. I installed covert cameras above till points and stockrooms. The amount of staff we caught was mind boggling. On one Saturday in question with staff and shoplifters we filled up the twelve cell spaces in our local police station.

    Thank you for taking the time to set up this UA-cam Channel.
    I have recently joined your channel and so am not familiar with the correct method of posing a question. However I go ahead like this:
    I have moved into a house last year in London that has 8 apartments that share a common front door and separate front doors on each flat. There is a management company. Recently one of the owners of the flats on the ground floor got the CCTV cameras which where on the property when I moved in up graded from a simple VGA resolution to a very High Resolution and added several additional cameras. During conversations with the owner in the common areas it has become apparent that they are a little fixated on being able to see everything . I get the feeling that they revel in the idea of watching me or other tenants in the common areas.
    I have a general question: who is able to look at this footage. As a resident I would prefer to know who is asking to watch footage of me and why. Is this reasonable and how do I find out if this is the case.

      Loop holes is all it is finde them and you can do what you want GDPR and your work contract mmm if you look at or sum of the aspects of the GDPR thy say in almost all of the articals must have permission to do something but your work contract saying " sorry old chum" by sinig this contract you wave those rights. You have to sign as you want your job so what loophole can,I jo plod cum up whit to have those rights or protection back? Black belt that

      You can record the police, but if you capture evidence of an indictable offence in your footage, police can seize it under section 19 PACE.
      @M3sterX You can be done for swearing at a police officer, but the courts will expect more tolerance for a police officer than a member of the public. An example would be racially aggravated public order. Also you can harass the police, but it would be more of a missuse of the 999 service or causing a public nuisance than an actual offence of harassment

      I think you have misunderstood Justice Bean. In the case Harvey v DPP (2011) With regards to words such as f*#k and "f*#king", Mr Justice Bean highlighted the fact that police officers hear such words regularly as part of their job and, as such, the use of such words could not automatically be held to mean the officers were likely to have been caused harassment, alarm or distress. He repeated that which was stated in DPP v Orum [1988] 3 All ER 449 about swear words being "wearisomely familiar". That is not to say that police officers can never be harassed, alarmed or distressed, as some commentators have incorrectly suggested, merely that it is less likely for them then a layperson who is not used to hearing such words. Fact - as you put it.
      In regards to Harassment of a public service, my point was that harassment of that service would fall under the definition of public nuisance or waisting police time, such as repeated hoax calls to 999. I wasn't referring the public order definition of harassment.

    This is very interesting. I used to live in Finland and the police can access the position of any mobile phone which is switched on - but, and this is a big but - it is used to save lives. A student of mine had his car stolen and his phone was in it. However, the police would not help as life was not at stake. For example, his partner may have borrowed his car for an 'assignation' and he may simply have been trying to track her (this wasn't the case, but you can see where I'm going with this). It certainly is not police work to track down stray partners.
    When my son was around 10 years old he was with a friend out in the neighbourhood and an elderly person suffered a collapse in a car park, so they called for an ambulance. Being 10, they couldn't exactly position this car park, so the mobile phone positioner was utilised to locate them. Three units were sent, helicopter, ambulance and rescue. The helicopter landed between the 'other cars' and the elderly lady was transferred to hospital and survived. This is great use of surveillance.

    I'm employed by a company as a contract cleaner in the industrial area not domestic, one of my contracts I've been cleaning for, for about over 2 years, they've been satisfied with my cleaning as far as I'm aware they haven't complained untill this week. Beginning or end of last week they installed cameras/CCTV for security reasons they have very important equipment to protect. They haven't displayed signs or informed, been transparent with me and since they installed their cameras they have been monitoring what time I come in and leave bare in mind I don't have a clock in and out system they never provided me or my company one for the cleaners, they have complained to my company I haven't been doing my full time and I admit I have sometimes left 5, 10 or sometimes 20 minutes early as I have finished up cleaning and I don't want to stand around not doing anything but I make sure I do what I have to but all of a sudden the're not happy with my cleaning since they found out I haven't been doing my time from exact minute to minute. Have the breached data protection or invasion of my privacy? Thanks

    Firstly thank you god all your hard works and great information that you are giving here on this format if make a bog difference being advised by somebody that know the law.
    Cam I ask a question please. Can you please advise if I can just ignore a police officer if the fail to clearly identify to ms their shoulder number etc. Maybe you could do 3 mins advisory video on this subject matter and clear advice on ths rules for identifying to a member of the public. Please keep up the great information you provide.

    I’m a street photographer and regularly get stopped and questioned by the police and security guards even though I am photographing from a public space. I’m accused of being a terrorist or a paedophilie. The police don’t seem to know the laws regarding photography.

    When you have a high definition CCTV camera with automatic tracking, vehicle recognition, face recognition with a zoom, and there's an incident in the road, the police are very happy to get a disc with the video as evidence from you. BTW, I not only protect my property but the property of other people in the area where I live in the road, and they know it's an automatic tracking camera, not me purposely training the camera on them when they walk about.

    housing group muir man says we not allowed to monitor the entrance road coming past our property.but our camper van is parked by entrance road people drive past it so we only safeguarding out property and the camper van and protecting ourselves from the threading abusive neighbour

    BBB - I would like to hear about rights to use cameras / CCTV in your own home, and whether you are breaching anyones reasonable expectation of privacy if they have come to work in your home.
    Particularly, for example, you have a parent who requires carer to enter their home, be it on a part time or a full time 24/7 basis under live-in care. Can you if you have POA for your parent, or can your parent, have a camera in their home to monitor and support any instances that might occur as a result of the Carer working there?
    The CQC doesn't have any policy of guidance on this for CQC registered care companies (I've already checked). It seems that customers are at the mercy of the care company own policy, if they have one, and/or whether the carer coming into the home is comfortable with the camera. Note that I'm referring to cameras that are on display and the company has been made aware of their presence and why. Not hidden or covert cameras, and certainly not any located in places where the Carer has expectation to privacy, such as their bedroom and bathroom.
    This will be a subject affecting many people, as well as there being many news items of carers abusing or stealing from customers. Indeed, perhaps a video like this could even work for someone employing a dog sitter to come into their home whilst on holiday, for example.

    in the UK, can you covert record someone if you think they are trying to defraud you in some way, or renege on an agreement you had verbally made? to advantage themselves and disadvantage you.

    I work for buses.
    I was moving off to crossover box jn. A car cut in. I approached my employers for assistance/help. I requested cctv to back my appeal, should i get a PCN.
    In return instead of supplying me with front n side footage, in-cab (drivers/mine) footage was downloaded and multiple actions of mine were noted including audio n subjected me to disciplene procedure. All like prior to incident....during the incident...beeping horn...shouting from window....
    And note on GDE (garage disciplinary enq) or whatevr that mean, red bold note stating '........may lead to dismissal? YES.
    looks very much like constructive dismissal.
    No consent for voice recording was sought, surprised to hear voice on previous cyclist complaint hearing.
    There is no public complaint or official reporting. I m the one who requested for help & in return, instead of helping.....i m in this trouble.

    I live in cul de sac both houses at the entrance of the road have cameras trained on the footpaths on each side of the road and part of the road itself.Neither of the houses have gardens adjacent to the street. Therefore it is possible for the owners to collect information about the comings and goings of residents and can track people entering the road and some of the houses in the road. Is this lawful? I understand that they want a certain amount of security but it is starting to make me feel 'watched'.

    this is an interesting video and i was wondering where i would stand on a small situation involving my local shop basically rear cam pointing in my rear garden and back door as well as shop premisses and road and displaying on a tv screen in shop for all to see ,the only reason i ask is that when i go into said shop they can switch that cam of is this right ??? there is no sign to say cctv in operation and its been going on for years .. any feedback would be great many thanks

      I would say the camera shouldn’t be capturing your private property or even your door - as a business, they should know better and a complaint to the ICO may go some way to resolving it

    Great advice thanks. Can I ask about the use of Blink cameras and Ring doorbells on a private communal car park? Blink cameras & Ring doorbells detect and record short burst of footage and send it to digital cloud storage using WiFi. We've had many problems with fly tipping, vehicles damaged and a motorcycle stolen but the area being recorded would also pickup communal movement habits. Thanks in advance.

    My neighbours have admitted taking video footage of me inside my own home (in my bedroom) from their property. Is this an offence in the UK? I understand this has something to do with demonstrating anti-social behaviour, harassment or intimidation.

    What if my car parked on my property with a dash cam recording the surrounding street and houses, or parked on my street doing the same? Is it subject to GDPR or not? What if I remove dash cam and install on a house window? If it is not strictly CCTV, would this be subject to GDPR?

    You said that you can't track what someones doing on a computer that doesn't belong to you that of course makes sense in most cases but what about if a child has bought their own laptop from their allowance is it illegal to keep track of what they're doing online if they don't want you to?

    Great video. Here's a scenario.
    Say you live in a ground floor flat and the neighbour above throws litter on your property.
    You've politely approached them about this, they deny it and still continues.
    You report it to the council but can't take action since there's no convincing evidence it came from them. However they do send a warning letter.
    For a few months, you setup a hidden camera in your home, aim it at their window (seeing the frame and their ceiling) then catch them littering.
    Will the you be punished even though the evidence proves the 3rd party are at fault?

      If I may offer an opinion it would be that you could most definately find yourself in trouble. Even at a distance where it may be difficult to distinguish what is happening, it is advised that a privacy mask/screen be used to block any views that include windows, or doors. I would imagine that even a cellphone or video camera trained for any serious length of time at somebody elses window is breaching any normal expectation of privacy.
      I may be crossing my wires here with respect to commercial vs domestic, but I would avoid doing that one. :-)

      But according to the ICO,
      - The hidden camera will be used for a short time (2 months)
      - It's being used to investigate the source of the rubbish.
      - Any unnecessary footage is deleted
      - A CCTV warning sticker is placed on the window.
      Moreover, you've caught them with the hidden camera. If it wasn't them all along, they never knew about the camera, and you got rid of the camera, what harm is done?
      It's the same arguement with dashcams. If you've done no wrong and find out the driver behind you is filming you, what harm is done?
      Sometimes the law can be unfair. Innocent people fear punishment for retaliating or proving their innocence.

      @@riacharda BBB can obviously give you a more definite answer but I think i'm right on this one.
      That said if you suspect the source of the rubbish it would be difficult for anybody to complain if you were recording the wall below the window :-) unless they tend to climb in and out their 1st floor window you could be in the clear lol

    I had a "security" style pan and tilt camera because there was a lot of crack dealing and consumption outside my home. However my camera didn't record all the time, only when I opened an app on my phone and pressed record. The data was then on my phone. From what I read on the government site about security cameras this is fine. I could be in bed and if there was a disturbance I could see what was going on and even record audio. The police were more than happy to receive footage of crack deals going on and the audio even caught one dealer giving out his phone number. Some time later the police did ask me to take it down, which I already had, but they were more than happy to use the video with audio to bust the dealer. It should be noted that security cameras in public places shouldn't record audio for privacy law compliance. However I did catch a very large man on his phone leaving a drug dealers home saying he had come to do a murder but the guy wasn't home. I have thought about putting these videos up on youtube because they are riveting, but it will give my address away.

    I have found issues with "some" of the info in UA-cam, being lawyers some err on the side of caution making some of the advice questionable. Like most badly written laws in the UK issues arise with area's (Scotland, Wales, England) and I understand that in court some smart ass can make a case spin on a comma vs a full stop (no offence meant) however half truths are worse than inaccurate info. as I have had police confused and pissed off with the issue here. Thankfully the officer that was dealing with me gave me a card that sent me to a Police website that proved he was in error, (Red face anyone) to be fair the laws are changeable (see the infamous terrorist laws) often abused by certain officers, anyway keep up the good work

    Hi thanks for your advice but my question I have a camera protecting rear and side of my property my campervan is parked at side of bungalow .recently our aggressive threatening neighbour has sent Police around to our place plus the housing association.police say we legal but housing association says we can’t have camera pointing at side of property
    As there is a shared driveway cul de sac where others drive by .well the threatening neighbour actually drives past me and nearly always spits at me or makes spit sound when driving past he knows what he can get away with but will look silly on camera .what’s laws on thjs please .Steve

    Very interesting, however, how does this impact something like cell phone apps and/or equipment that records or monitors private conversation and activate camara's. Several examples spring to mind: first now that the Covid restriction are easing in the UK I was chatting with a friend about a museum I'd like to visit stating that I had not been there since childhood. We were in a private house with only my cell phone close by. Later that day I began seeing ads on facebook for that very museum, I had not searched nor made any online attempt to check opening times etc. That conversation was the only reference made, yet adds were there. Now this has happened multiple times with other friends. Something else is when Samsung were found to be recording conversation via their smart TV, this also extends to laptops and other computers. MyAntivirus software has the ability to block attempts by websites to turn on my webcam, this includes UA-cam, and Ebay. Why is this not an invasion of expected privacy?

    Hi... some advise on cctv monitoring Communal properties (block of 4 flats/gardens... following a disputed where i stopped my neighbour using my wifi my upstairs neighbour installed 3 cameras -front of the property on his balcony monitoring his vehicle on a public road and pavement... one on the side of the building for access to the rear garden and rear entrance to my home
    the third one above my bedroom window pointing along the rear of the building observing my and next door neighbours back door and access path....
    Is it legal to install the cameras in these locations...
    Should I reasonably expect privacy entering and leaving my home and whilst in the garden...
    2. Having had discussions with his landlord Riverside Housing they informed me he can install them and the intimidation, harrassment and some noise retaliation by myself and the escalating rift my neighbour made a maliscious call involving the emergency services showing concern for my safety as an eldetly person with heart problems to access my property ad I had inadvertently left music playing we discussed mediation...
    Then yesterday I was asked to be interviewed by the police regarding allegation of racist comments I have not spoken with my neighbour since the dispute began 6 months ago... can recording of me in my home be used as evidence.... any advice will be helpful

    My motorcycle is locked to the railings of a local council owned gardens on the opposite side of the road from my house. The gardens are permanently closed, and there is no issue with the council.
    Question: May I have a security camera mounted on the wall of my house approximately 12 feet above pavement level to watch my motorcycle, bearing in mind that it will inevitably capture anybody walking across in front of the motorbike on that side of the road?
    Is there a difference between the laws on watching via a security camera, and recording?

    I live in a group of houses that share a private road, but it is also a public footpath with many regular walkers.
    We park our cars on this road, which have commonly been vandalised, as it is unlit.
    Is it legal to install motion sensing lighting, and set up CCTV on it?

    A question if I may? What if you are video recording in a public place, such as a high street or supermarket and a member of the public asks you 'please don't film me' or 'edit my face out of your video'? That seems like a reasonable request to me BUT there are so many youtube videos where many members of the public are incidentally filmed without their actual consent. Where does the law stand on this in the UK?

      High street is likely to be a public place and filming is generally not restricted but a supermarket will likely have rules about it and be entitled to prevent/prohibit you from doing so.

      If you are in or on private property and photograph or video and are told to stop, you stop, but are not required to delete what you have already captured, I believe only a court can rule that it be deleted.

      @@BlackBeltBarrister Could you please reinforce this point. Many "auditors" believe if a place has public access then their actions are unlimited. I believe the landowner can restrict their actions in almost any way they choose. And trespass if the fail to comply.
      After all people are routinely escorted out of hospitals, pubs, shops and many other "public" places.

    My neighbour has a spyhole camera adjacent to the communal door I have to enter and exit to get into my home. Surely this is against the law and invasion into my privacy. This is not cctv for crime prevention its harassment and I really want to rectify this situation

    My property is one of seven sited within a shared communal area and I would like to install CCTV/ on the outside of my own home for security purposes.
    The communal area faces a public highway.
    Is there any implications in doing so.

      You can cover as much as is reasonably necessary to protect your home but if you do catch passers by, you are likely to be caught by GDPR although you won't have to register as it is just for your own use.

    Can you help? I live in the UK and a new neighbour has move into my road and as put up two cctv cameras after his car was damaged in the street. one of his cameras is pointing at my flat! I live in a converted terraced house and from my living room i can see the camera lens so i know it is pointing at my home! the flat below me has their bedroom at the front of the house! so their bedroom is under my living room and the lens must be looking into their bed room? i have notify the police and my local council what else can i do?? please help

    How would the tracking laws be applied to someone who can't necessarily give consent. Would putting a tracker on an elderly relative with dementia be legal? Would the intent of putting it there to find them if they get lost even make a difference?

      I would think that if someone is suffering from dementia, they don't count as being legally competent.
      The consent would fall to the person who is legally responsible for caring for them (the same person in control of their finances).
      It would depend on a medical assessment of the elderly relatives mental faculties.
      I could be wrong, I don't practice law.

      It would come under the Deprivation of Liberty Standards. The least restrictive action is desirable. Tracking is certainly less restrictive than locking the door. You could get this formally assessed with their social worker.
      Unless they are paranoid no one would complain anyway.

      CCTV cameras DO NOT stop criminals from stealing. In fact, a lot of the time the police cannot even be ar5ed to follow up and check footage for violent assaults before it gets deleted by businesses etc.
