    General PSA to anyone who's had issues with AMI Hearts Beauty and damaged/incomplete palettes/shades/orders:
    This is a breach of the Federal Uniform Commercial Code and serves as a breaking of the implied warrenty as well as a breach of contract on the side of the seller and you are entitled to a full refund without returning the goods if the seller fails to repair/replace adequately in an agreed upon, timely manner - if return of the defective goods is strongly desired by the merchant, it is at their cost and expense to retrieve them and you still legally have the right to refuse.
    A.M.I. Hearts Beauty is also operating in Virginia which also has state law, specifically the Consumer Protection Act 1977 which states it is prohibited/illegal to sell defective merchandise and it is this state level law that reinforces the Uniform Commercial Code further.
    If you are U.S. based, I would make a complaint to your local Better Bureau and see if they can help reinforce any complaint.
    Finally, to all international customers, if you have your shipping box still, check the customs declaration to see if she falsely labelled the value at $10 USD (or some value below the actual value), because if she did, this is extremely illegal and she risks serious jail time and fines, particularly if this is a consistent business practise which in her own words to me "why would I change the way I package anything to you and not to my other customers".
    If you paid using anything involving Visa or Mastercard, you can raise a dispute under Schedule 2 rules and if you offer to cooperate with A.M.I. Hearts Beauty in that you "make the goods available for collection" (in other words, you offer to send the goods back if you are sent a prepaid return envelope) then you will be able to retrieve a refund that way too.
    I know in America there's a general positive attitude to if a shade arrives broken you just repress it (if it's not completely shattered...) but in the UK (where I'm based) this isn't considered generally acceptable as if you paid for a complete undamaged product, that's what you should get.

      A lot of the shades in my palette were not even half full. I understand pressing and all. I had to pay $5 for one new pan because it was the shade I wanted the most (Roman). I waited a month and a half before I used my palette in case she needed pics or needed me to send it back. When I finally got Roman in the mail it was also lacking about half the eyeshadow. I was so excited to finally use it and several shades were so patchy that I literally haven't touched it again. I hate it so much because I was so so so excited for this palette because it is the most beautiful color story 😍 💜💙💗💙💜

One thing I have learned that you mention is that you should always recognize your own worth and value. What you contribute to the beauty community and indie industry is highly valuable.       I couldn't agree more. Amy I have bought sooooo many things because of you, and I love every single one. You are worth more to this community than I think you know. The whole indie yt girl gang (i won't list them all, but you know who they are ), are LIFE on yt now. I can't be bothered with mainstream brands. I have watched some of your videos 3/4 times when I am trying to research what my next purchase might be. Don't be disheartened. We all know it wasn't you. I am glad you did this video. It'll alert subscribers, and you can put this brand in the trash where it belongs. There will be many more in the future I'm sure 😘💜💜💜

    They can’t claim slander if it’s true. They wanted to scare you.
    That’s so fd up. Threatening a small youtuber with a lawsuit that has no teeth. They hoped you’d believe their bs. Legally, they can’t come after you. Don’t spend the money on a lawyer. They have no case against you. This must have been so gut wrenching. I’ve seen debt collectors trying to do this too. They send paperwork that looks like it’s from a court, but it’s just some jerk with a photocopier.

      I think this video was so well done and classy. Truly. I dont k ow everything but being a brand owner of and indie makeup company i hear things. I love that you told them to get a contract. No matter how small what they and you are getting MUST be lined out and agreed upon. I also do nda's but its to not leak products before release or share with other companies. It safe guards my brand and protects the artist as well. I did slightly disagree with you when you said brands are not your friends. From your eyes I felt why you said that. However, from my own personal perspective I feel differently. Daily interaction with my supporters, reaching out when they dissapear, knowing things they are going through and being able to help when i can means more to me than any dollar i make. I dont do this for money thankfully my husbands job allows me to do this because i LOVE makeup. I was a bullied influencer, ii had a brand do similar things to me and even threatened my child. That is why i created lele posh. I wanted to create a safe space and a family and we truly are one. I have a business degree but what it all boils down to is being a decent human being. I hope to be the change i want to see in this community. You are a gift to us indies and we lysm!💙

    I'm a bit appalled that an indie brand would do this to a smaller influencer. I feel like a smaller brand should understand better and have more empathy?? Looks like they just wanted a quick buck and now it's gonna bite them back.

    One of the things that really really shows their colors is sending you the legal threats when they were/are completely in the wrong. So gross!

    All I can think is how well you're handling this, but it must actually break your heart - to be an influencer and finally secure a collab, only to have it go so wrong. But I'm glad you shared the lessons you've learned with us, because that's a true sign of maturity and empathy: "A bad thing happened to me, and I'm going to try and prevent it happening to anyone else." Lately it seems like more and more people only care about themselves and what directly affects them, so it's good to know that's not always the case.

    I think the best thing that could've come from all of this is you being able to share with others who might need this advice and honestly it's good advice whether a person's experience is a good one or a negative one. It stinks that you had to go through it, but I think you've handled it pretty well publicly. :)

    After constantly emailing customer service, I only received my palette after I opened a case with PayPal. The palette is really pretty, but most of the pans came extremely underfilled. You're the sweetest person ever and deserved better. I'm sorry.

      @paola I had the exact same problem. I had to pay to get my favorite shade sent to me and it was also underfilled! But, there were so many that were almost empty!

    You made SUCH a stunning palette, i was gonna get it when it went on sale but saw the drama and the reviews from regular customers and i was so sad for you (and disappointed cos i wanted it SO bad.     I’m here to see what happened.. I actually was wondering why you hadn’t mentioned that collab since it first came out. I wanted to ask about it, but figured when you were ready, you would say what you needed too! (I did see a comment on another video saying there were issues with the company) I hope you’ll get another opportunity soon! I loved the shades you chose, and the palettes that were good seemed really lovely! Ps, I’m very proud of you and the way you handled yourself under these circumstances.. you are so very mature, and decent! I’m glad you haven’t let this change you.. (and this comment is coming from a mom of 3 kids who are pretty close to your age!)

    This is such a mature response to what has happened to you. As you mentioned, it's so easy to get emotional and say things you'll regret later, but you handled this with true elegance and tact.     This negative incident reminds me of what happened to Marlena of MUG by not having a contract with Jaclyn Hill. Obviously, different particulars but both had detrimental/damaging outcomes. Sorry this happened to you ( I was so psyched for you about having a collab) but am glad to see that you're applying lessons learned to your life and sharing your experience. Lemons to lemonade ❤

      Alya Sl. Also I think they payed her a fixed amount instead of a fixed amount + commissions and a percentage of her sales. So they paid her life a small fraction for a palette that made them millions...probably tens of millions..

    When you talked about passive aggression to avoid conflict, that was amazing. You are so mature for your age. I so agree passive aggression can often come from people who avoid conflict like the plague. Many associate it with just being a manipulative person when the reality is that’s not always necessarily the case. Conflict is apart of life and we need to learn how to deal with it head on even though it can make us uncomfortable. It’s taken me years to master this as I myself hate conflict.
    To also touch on “the only seeing the good in people” I’ve struggled with that as well and it can potentially be very dangerous. I used to see nothing wrong with having that mindset and it definitely has its positives but it can come with just as many if not more negatives. I learned the hard way that I can no longer only assess situations from “only seeing the good” my life and mental health has greatly improved and transformed completely from changing that belief and viewpoint. Learning to look at a person or situation in totality with both the positives and negatives will save you from so much potential suffering in the end.

      @@amberwings17 really? After I had my terrible experience last year I decided too do some research and I couldn't find anything! I was like I can't be the only one. It probably all got put out around the same time I was having issues. She is so shady and unprofessional. And her website is such a mess. So is her makeup. Amy's palette was the best thing she had but I couldn't bring myself to purchase it after the trouble I had with my 1st and only order with them.

      I doubt anyone is going to want to buy from them with the poor reputation they created for themselves, so maybe they don’t need a website anymore. I know I’ll never support them or any other business with this type of poor ethics and a lack of morals. I know Amy will eventually get more opportunities with respectable brands and I’ll likely be interested in supporting those releases.

      @@southerngrown our experiences are so similar. I did check around, but couldn't find any negative reviews. I'm guessing that those that had any never voiced it out like us. I did feel bad thinking negatively of her at that time because she posted about her abusive personal life which is why I never pushed for a refund, but the annoyance was still there because I just wanted to have my one and only order completed as she had promised in multiple messages. If a small brand like Vanessa's Vanity could deliver topnotch products and service, why couldn't she also?

      i placed an order with them a long time ago, after hearing such great things from some influencers, including amy (not to put blame on anyone!), and i had a very odd experience. i ordered 12 singles and when i got them in the mail so many looked absolutely identical when they were VERY different online. almost made me think they just named the same item different names :/ anyway, i just never forgot that and hearing what they did to amy is just heartbreaking. shes so sweet and truly didnt/doesn’t deserve this sort of trouble.

    That moment when you realize “not everyone has a good heart” truly sucks. Especially when you get legal advice and find out that you were the one in the right after all, and they were just trying to take advantage of you. After something like that, trusting people in general becomes so hard or impossible (maybe that’s a good thing). I’m sorry you had to go through this, but I’m glad you got that legal advice and will always protect yourself going forward, because you DO have a good heart and good intentions.

I remembered hearing about your palette but luckily the site has been down for a while so I wasn’t able to make any impulse buys. If you can, could you please build a dupe of your palette using your single shadows from brands you support? I would love that since it’s not available anymore. 💜💜💜

    I remember when the palette came out and I was so in love with the color story and how it looked when you showed it off. I was determined to buy it even though I don’t have a lot of money but I really wanted to support you and everything about the palette seemed special. I remember I sent you an Instagram DM about how proud I am of you and how inspiring you are to me as a prior victim of ab*se (my @ is @mayamcall btw in case you recognize me). I ended up buying the palette in January for my birthday and I was so excited to get it, more excited than I was for any other palette I had because you’re one of my favorite youtubers. When it came in, the palette did not look like how yours or other influencers like Annette’s or Julia’s looked. Pans are half filled or over filled and broken. Obviously I never faulted you because you’re not the one making it. I was just kinda disappointed in the experience but I used the palette and it wasn’t that bad. But then when it came out about the single I felt really weird about it, like how are they going to sell a single called Roman and not pay you for it? I’m disappointed in the brand but I assure you I enjoy your content as much as ever and if you ever do another collab, I will be more than happy to buy it.

      My pans were half filled too! I was wondering if I was the only one with that issue and I never sent a complaint to the brand because I kinda knew they weren’t going to send me a replacement since the palette wasn’t damaged.

    I'm sorry this happened to you. I was so disappointed with this brand when I heard what had happened earlier in the year. I bought your palette with them and I was one of the few who didn't have a bad experience. I think you did make a very beautiful color story with your palette. I did like some of this company's products, but they are not consistent. This whole issue you had with them and hearing so many other people's horrible experiences with them has left a really sour taste in my mouth towards this brand. You did a great job with the video and handled this situation well.

Especially as women we’re taught not to rock the boat, but it’s so important for us to protect and fight for ourselves.

    I think this is a huge lesson for that brand too, I was going to support you but wasn’t down with shipping at point, so glad I didn’t put money into this if that is what ended up happening. I would’ve loved for them to release the pallette because your colour selection was on point really!

    I had an odd experience with them - received my order but one wasn't the correct shade, emailed them and didn't hear anything back. So I thought I would check with others through twitter and instagram if I was seeing things or if it was a different shade to what they shared on their website. They left a comment on the instagram post saying they had emailed and that they'd send a replacement. Thing is, I didn't receive any emails from them and I ended up not caring after finding more about them, I just wanted to leave it as that and have no more to do with them. But that is when I found your channel, so I'm happy something came out of it, haha! You are such a breath of fresh air and I love watching anything that you upload (even my husband enjoys watching you!)💜

    I’m so sorry this happened to you, Amy. Given my experience with Ami hearts beauty, ordering the Alma palette, I’m not surprised. When I received my palette, which took forever to get, four shades were completely shattered. I contacted the brand and thought they would be sending me a new palette. They only sent the four broken shades, which also arrived broken, by the way. I mean, how was I supposed to get the new shades, had they been unbroken, into the palette. I certainly didn’t pay to press eyeshadows & figure out how to pry the broken ones out of the palette. Regardless, I never pursued the issue, but that was out of respect for you, Amy. I can tell you though, that I will never order anything from Ami hearts beauty again. Good luck to you in the future. You have the right attitude- everything is an opportunity to learn & grow.     Ugh, I don't know what to say about this. :( I audibly gasped when you said they threatened you with a lawsuit. The f'ing nerve, when all of the issues were on THEIR end. You deserve so much better, and I'm so sorry this happened to you. I get anxious about conflict and confrontation, so I understand. I honestly don't know how you have handled it so well, because I'd be a flipping mess 24/7. That's so low of them.     I am so sorry to hear that you you ended up in this situation but I appreciate that you took a step back to collect your thoughts for this video. In a way it brings me back to the age old advice to never go into business with your best friend (not saying that she was your bff, but its the idea behind it) as something is bound to go wrong. Contracts are important, as you have pointed out, to protect both parties. As is understanding your own value and self worth, yet so hard at times. I truly hope that going forward you get another chance to have a brand collaboration, and that it works out better than this one did

    Wow. It really goes to show you that not every experience is the same when purchasing from a brand. I was so excited for my Alma palette, it was the first proper influencer x indie collab palette I've ever bought. The color story was just perfect for me. (We have very similar taste heh).
    My palette did come w/ the 4 of the shimmer shades smashed. I was devastated by this & contacted the brand to let them know. They did send me replacement shades for the ones I lost, replying quickly & even shipped them quickly. So I was like, 'alright, that's so awesome for them to be so swift & accommodating!'
    I read that many ppl had gotten shattered pans as well, so I chalked it up to it being a very fragile formula. I had no idea ppl were being ignored or whatever other issues there were.
    I was very confused when I saw your Insta story & couldn't believe they had the nerve to send YOU a C&D. Like...lol for what?? Idk, that definitely made me think twice about ordering from them again. I def wont be now.
    I'm so sorry you dealt w/ all this, this whole time & are still dealing w/ it. It's unfair. & if it's true that they planned on releasing singles w/out any intentions to pay you for any sales...that's lower than low. They should be ashamed for intimidating a smaller influencer, as passive as you. I hate conflict, myself.
    I hate when ppl I'm close to or respect are mad at me, even if I did nothing wrong. When it comes to family, I'll literally let them walk all over me because it's less painful than standing up to them, just to be shouted back down or dismissed, as if my feelings have no validation.
    So I'm proud of you for how you've carried yourself through all this. Simply classy & not at all how I would have managed it.😅 Hang in there, & I hope this doesn't deter you from making beautiful palettes or whatever products w/ another brand in the future.

    For some reason this came up on my feed and I watched it again, I bought the Alma palette strictly to give you the love you deserve then I thought well Amy loves her so much, so I went ahead and bought both the ingredients palettes, I really loved your color story but in the end I gave the two palettes to a shelter and I lovingly took a Big Ole Hammer to the other one and it felt great LMAO, it was NEVER about the Money at all I really want you to know this, She did you dirty and I honestly don't know if she's going to recover from this, Well Karma is a Beautiful Bad Bitch and she's on your side, I love the content you put out and just the way you make me feel like I get excited when I see a new upload from you, I Trust You, Half my collection has come at your recommendation and I've never been dissapointed.     I'm so sorry this happened to you. Your palette was stunning and so unique, I'm sad that it didn't go perfectly and I couldn't buy it! You did such an amazing job designing a gorgeous color story unlike any other palette, I have literally been WAITING for a periwinkle palette 😭😭 I can't believe AHB did you like this when you have been so supportive of them even before the collab and your collab and recommendations have sent them so much business. They should have treated you so well. At least you know you are saving others from a bad experience by speaking out on your platform. I did purchase the palette; half of the shades arrived shattered, but I did eventually receive replacements for all of them. This was not your fault. I know it wasn't easy to do, especially because you're a respectful person who tries to avoid any kind of drama or negativity on your channel. But this was an important lesson for you, and for us as your subscribers, too. The only reason I ever tried Ami Hearts Beauty was because of you - your recommendations of their singles is why I purchased a few of them myself. Unfortunately, my experience with Ami Hearts Beauty was TERRIBLE, and even before all of this went down with the Alma palette, I already swore I'd never shop from them again. I was tempted to give them another chance when I saw your palette collab release video because I loved the color story so much (the periwinkles made my heart race, it's my favorite color and very hard to find in makeup typically), but I talked myself out of if in the end because, again, they were so horrible to me in my previous purchases from them. You speaking out about your atrocious experience in working with them really lends more credibility to all of us consumers who have spoken out about our own sh*tty experiences where we had been mistreated and f-ed over by them too. Thank you, Amy. I'm sorry you went through that, that they did that to you - especially their scare tactics on top of everything else they'd already done. You don't deserve to be treated that way. Business is business, and protecting yourself isn’t cynical. Good partners will understand and share the desire to establish clear parameters for everyone.

    I was so disappointed that I was unable to get your collaboration because it had sold out, but now knowing what I do and with you putting information that you did out there, I'm so glad I didn't!     I'm so sorry about the way this has turned out for you. You did such a beautiful job on that palette. Good on you for speaking up, standing up for yourself and for prioritizing your own health first and foremost. Shame on them for not only being so shady with you and their customers but for using those kind of manipulative tactics. You didn't deserve any of this.     I had an interaction with the owner of this brand about an order a year exactly before your palette release. Long story short it was unpleasant enough that rather than having my products replaced I ended up getting a refund ( when they still offered that). I was always worried that I read too much into it. That maybe I misunderstood her tone, or that it was growing pains and I should give them another chance (especially since I really wanted to support you) but I just never felt right about it. I can say now that I was right to trust my gut. Thank you for being open and honest. I know this took a lot of courage.
