    This pretend cop claimed to be a law enforcement officer and then started quoting criminal law, sure sounds like a police impersonator to me. They can ASK for details but can’t demand them.

If these clowns are misrepresenting themselves and their legal power they can open the council up to a legal and financial exposure, something I’m sure their legal department would be 100% aware of.

      technically he is law enforcement. If he is authorised by the local council, he will be enforcing the environmental protection act of 1990 which is a law and breaching it can result in prosecution and a criminal record. He can demand the details under section 88 of that same act. the local authority can delegate powers to certain companies and people.

      @@peterbuckley3877 they normally don't have powers to detain and arrest but they do have powers to get your details. Failing to provide them is another offence. A police officer can and will assist by detaining people who refuse details to the enforcement officer.
      Section 88 of the environmental protection act 1990.
      Littering = a fixed penalty notice (max £500 by any council) or up to £2.5k in court
      Failing details = up to £1k in court in addition to the above. (So max £3.5k if both offences are committed although it's rare for a fine to go to the maximum in court)

      not true. the council are literally called "the local authority" and have many many powers to enforce a lot of laws such as trading standards, environmental, public safety, food hygiene and so on. A lot of the times, the police will use council powers to do certain things and vice versa.

      @@carsandstuff365 they can't detain or arrest you, but legally you must identify yourself to them. Failing to do so is a criminal offence in of itself (section 88 environmental protection act 1990). So what can happen if you refuse to identify yourself is they can get a police officer to detain you. If that happens, you can be subject to a court summons for 2 offences and a fine of up to £3.5k for both offences if found guilty. If they have no police then you are lucky, they can't do much but if a police officer is nearby then you can be in a lot of trouble

      @@Auditingtheauditors99 if this was true how comes in all theses videos that the guys tell the victims their rights and they walk away nothing happens. I've seen video of one of the inforcement officers flaging down a police car. The inforcement officers talked to the police. They then just drove off. Another one where an inforcement officer was trying to take another victims details and the man told the victim his rights. The police turned up and he never gave the inforcement officer his details. The police didn't do anything and the guy that was telling the victim his rights wasn't arrested by the police for what you would call preventing the course of Justice right in front of the police.

      ironically, the councils make money from these officers. well i guess it depends how you measure it, it costs Birmingham City Council upwards of £20 million a year to clean the city, the money made from the penalty notices will go towards that cost. I would be surprised if they made £20 million from this department though.

    The enforcement officers are committing a public order offence. They surely didn't do their homework. I see many of these bully boy tactics quite a lot. Quoting a law that's irrelevant to the circumstances. They're butt hurt because they didn't rip off those people. I think one of them should get tested for NPD. Why don't they get a job that's worth while.

      @@EzWil if the enforcement officer is registered with the council and authorised to enforce the environmental protection act of 1990, he isn't committing any offences. Ironically, the guy who is filming and getting involved is committing an offence by obstructing an officer (or obstructing the course of justice) which in of itself is a rather serious offence.
      If I remember correctly, as a result of this incident, bare Britain audits was sent a letter informing him the council are now investigating him due to his actions. I've no idea if anything came of it, but hey ho.

      @@XSPAWNX23 there is a difference between law enforcement and a police officer.
      Another example would be hygiene inspectors for restaurants. They are not police officers, but they can issue penalties to restaurants who break the law.
      Enforcement officers will enforce very specific parts of legislation, police enforce many. Enforcement officers are often used to help reduce the work load on police. Littering is a good example. Is littering a big issue? Yes. Big enough to make laws to punish those who do it? Yes. (Environment protection act 1990, it was a big enough issue 34 years ago for parliament to pass laws to help combat it)
      Now, is it an effective use of time to have police officers enforcing littering offences? Not really, there are more serious things they can be doing. So, councils have the powers to enforce the EPA of 1990. Only if people are defiant to enforcement officers does it then involve the police.

      @@djvixlyrical There isn't much of a "spanking" here at all. It is classed as a criminal offence to litter in the UK (section 87 of the Environmental Protection act 1990) it is also an offence to not provide details to an authorised officer or a police officer (section 88 of the same act) if you are deemed to have committed the littering offence. This type of offence is often enforced by the local authority (In this case Birmingham City Council).
      Now, Enforcement officers such as this one are of course not a police officer however, he does have a legal right to obtain details as long as he is authorised by the Council to do so. Failing to provide details to him would mean he would be forced to get a police officer to do so as Enforcement officers don't usually have the powers to detain and arrest. Police Officers are public servants as they take the oath (to serve and protect etc etc) Enforcement Officers are not public servants in the same regard. That being said, they do have SOME powers that the police do, but no where near as many. This Enforcement officer will act under 2 or 3 bits of legislation, Police operate under many many more with the point being that these enforcement officers take some of the work off of the police so the police can focus on far more serious stuff.
      Sadly, all this video did was encourage the crappy behaviour of littering. I find it odd how people attack the enforcement officers who are just doing their duties as opposed to the people littering. Simple, put it in a bin and no one will talk to you in this regard.

      @@YahuahLegit they don't issue fines, they issue fixed penalty notices (very different, only judges can issue a fine) the FPN gives the offender the chance to stop the case going to court. Of course they could choose to go to court but if they lose, they will then be issued a fine by a judge

      Private property is probably the reason why. For example, I don't give anyone permission to film/photograph inside my house but I can have security cameras up as its my property and i only need my own permission.

    Technically they are required to give their details if they dropped litter and *"left it"*, But if they just pick up the litter then they are no longer required to give their details because they didn't leave it. A lot of these goons seem to think that as soon as you take a few steps away from any litter you dropped then you have left it and you must give them your details but this is not true because there is no set amount of steps or distance set out in the legislation so as long as you pick it up and throw it in the bin then no offence has been committed.

    The guy filming this chap at his work is imposing and intimidating. Rather hypocritical to preach about harassment when he has a reason to follow those people and the other guy doesn't.
    The enforcement officer is entitled to request details in order to issue the FPN for the offence. If the person refuses then they commit a separate, additional offence.
    As the random guy pokes his beak in and starts giving legal advice to a stranger, the officer becomes limited in his remaining options to identify the offender. He makes a judgement call to keep a safe, proportionate, respectful distance from the offender to exploit any opportunities to glean his identity at a later date.
    The offence of littering does NOT require the offender to be first given the opportunity to pick it up. On occasions when the littering may appear negligent or accidental then there is a DEFRA RECOMENDATION that they're asked to pick it up only in order to confirm intent. If the original offence is cleary intentional, or if the officer opts not to impose the discretionary opportunity then the offence of littering exists.
    Littering is similar to most other offences in that it is not affected by "Christmas" and can be enforced against all year round.
    The crime of attempt to pervert does exisit against civil offences.
    In the absence of any footage containing the littering offence it is not reasonable to challenge the actions of the officer in respect of the actions he himself is challenging 👍🏼

    I hope he gets sacked for his behaviour, very unprofesional, why are they so keen to fine people? are they paid for performance?
    I see this going on in my city, about 14 years ago a friend was acused of dropping a ciggarette butt, he told them he didnt even smoke, and he didnt.
    He refused to give them his details and they called the police on him, only they didnt, they pretended to call them to try and frighten him, they didnt follow him and harrass him though, they just gave up.

    --Section 88 states
    [F3(8A)If an authorised officer of a litter authority proposes to give a person a notice under this section, the officer may require the person to give him his name and address.
    (8B)A person commits an offence if-
    (a)he fails to give his name and address when required to do so under subsection (8A) above, or
    (b)he gives a false or inaccurate name or address in response to a requirement under that subsection.
    --And Section 87 refers, as Pinaci states in the comments…”leaves it”.
    A person is guilty of an offence if he throws down, drops or otherwise deposits any litter in any place to which this section applies and leaves it.
