Damn right! They say we are private contractor and yet they treat us like employees with out the benefits! Wtf!
Just think if other states files a law suit against Uber and Lyft for this same thing. I have a strong feeling these 2 rideshare companies will become bankrupt and extinct and they brought it on themselves.

They can't allow themselves to go bankrupt.
They would instead, adjust their apps with filters that let drivers set their own rates based on time and distance. This will make them independent. Then charge the drivers whatever commission percent they need to be profitable. They would be allowed then legally to take 50% of the fare. Therefore, nothing will change for them.
Then they would invest heavily in autonomous rides and phase drivers out of the market. Drivers would become the completion. Drivers would have to invest in autonomous cars to continue in rideshare, taking the expense of these autonomous cars off these companies and onto the drivers. They will still win.
When I was a cab driver the city imposed the rates ,the dress code, the licenses. Best part we created our own client list. That's what a REAL INDEPENDENT CONTRACT DRIVER IS.
If they want to classifie us ad employees that's OK but they better supply us with a car and pay the maintenance on it
This is how I convince people they are screwing us. Imagine the cost for them to do business. Would not happen. They are in business because the large portion of the cost of business is on the backs of the ones who don’t realize it, us the drivers.
The real issue is that boggy 30 percent they take for external fees on on top of their 20 percent of the fare

That was my immediate response too. W-2 employees don't have the tax benefits that 1099 employees do. More minimum pay but more taxes in the end.
Who has $ for taxes ?
It would be nice for those of us who carry our own commercial insurance to be able to work thru Uber or Lyft and get 90% of the fair. This would be a good "hybrid" type of idea. Also, when you as a driver are punished for declining rides, ie. at the airport, (I dont move for less than $10) I have received messages I would be moved to the back of the que if I decline another ride- that right there is in violation of the def of working as an independent contractor- WHEN that happens, you are then an employee
The companies log drivers offline unless that driver accepts a ride this alone is clear violation of their own TOS and AGAINST an independent contractor type relationship.

I do wonder if Uber drivers would actually want to be considered employees. This could give a lot more control to Uber, and drivers would be much more under the microscope. I’m good with being an independent contractor, but the pay simply needs to be better and more consistent.
They do not get what they are sacrificing for uber an lyfts wallet, its not up to drivers who are ignorant.

lol I’m starting to feel like if they just paid everyone fairly in the long run it would cost them less than sitting in court for all these law suites 😂. They are so petty they’re walking themselves into bankruptcy with these lawsuits piling up.
They want drivers classified as employees so that they can force Uber/Lyft to pay into the Workers Comp fund. Drivers will be classified as a higher risk job, and the pay-in rates will be substantial.
We should be able to set our own rates, schedule and who we want to pick up if we have to pay for our car, maintenance etc

I would rather be a contractor than an employee but it makes no sense that Uber and Lyft can ban us from the app when we pay them. To connect us with drivers. They don’t get paid per a ride, we pay them to connect us with passengers. They are actually our employees. So it doesn’t make sense for them to penalize drivers for small issues
This will shut Uber and Lyft down. No one wants to work as an employee using thier own resources to get the job done. Uber and Lyft just going to have to pay up on the law suit and shut down being that they don't want to treat drivers right. I will never use my own resources for work and turn around to only be able to file a W2 wage form.
When I was able to Set My Own Rates with Uber, I made Great money. And do did Uber.

Voters need to understand how badly drivers are being abused. They will not do this in their work environment. So don't do this to others

I use to be a union steward. Trust me Uber and Lyft being unionized would be a major mistake. Unions don’t have employees back. They’re sleeping with the enemy.

What Uber and Lyft can do is to let the drivers set their own rate, have their own business insurance and pay for using the app ongoing.

What really gets me is these people talk about the taxi industries as if they are employees, they are IC’s and they are more controlled than Uber and Lyft drivers are.

What states should do to help drivers is to lower the TCP fees and provide state wide controlled commercial insurance that most can afford. But again, wishful thinking
Independent contractors have to maintain their own insurance. Once uber/lyft provide it with no option to opt out, it makes them more like employees. In addition, if uber/lyft claim the drivers are business owners, why dont they each have business licenses?
In CA used prop 22 to pay drivers LESS than Federal minimum wage after expenses.

So if they would accept driver baseline ride criteria: $x per mile and & $y per minute trip duration not to exceed z miles then rides that pop up driver can accept without all the stressing. Drivers could freely offer their services on the marketplace. But the companies make much more by sophisticated manipulation.
If you want to protect the citizens, regulate what they charge the passengers.
Uber announced they are paying us less well that confirms we are being regulated and the term independent is now subjective
I don't think anyone would really care much about the classification if the pay was halfway reasonable. But with Uber squeezing drivers so hard they are looking for any possible avenue to relieve the pain.
The federal guidance for independent contractors is same as Massachusetts and California. And you know what happened in California after they classified drivers as employees. Prop 22

The flexibility the companies refer to is technically their flexibility to be able to screw drivers and riders. Employees can still have flexibility since there is nothing in the law that says they can’t have it. But I still favor a hybrid model.
Each driver needs to sue for misclassification. The TOS will not allow Class action but can't stop individual suits. With 5 million drivers, there will be 5 million lawsuits, and that will crowd the courts forcing the government to address the issue ASAP! Uber/Lyft feels the drivers have very little leverage and can't come together enough to file. Plus, no law firm will back them because they are in bed with them. But small claims can open their eyes when millions of small claims add up to bankrupting UBER/Lyft and will create all the leverage drivers need. If the driver cant control the fare charged to the customer, then they are not independent of being employed by Uber/Lyft. If Uber/Lyft leaves a city, then drivers were never independent of them and were employees and are owed back benefits!
MA has a history of siding with workers, but we’ll see.
This really isn’t about MA supporting the workers. They want their cut of the money, Uber and Lyft are doing a work around and MA is trying to stop it.

Lyft and uber are using 1099 to skirt the law and its about time it stops. Let them pay for a fleet of cars and pay me an you and lets see how cheap their rides really are for the filthy animals that need rides.

The problem here with these rideshare and delivery companies, they want to call you an independent contractor while excerpting control over the drivers with limitations in their contracts, as if you work for them. They do not pay you availibility or call time nor do you get paid while going to pick up an order or for waiting for an order at the pickup location. If you take an offer they do not want you to deliver another offer from another delivery company while that order is still open.This makes you an employee for them. A true independent contractor delivery driver would not tolerate these restrictions forced by these companies.

This might become a blueprint for the rest of the country. I don't mind being classified as an employee as long as we still get to pick and choose what rides that we take and decline, and to kick out troublesome passengers if we want to do so. Also, I don't care about having a 4.9 rating, and if we don't have a 4.8 and above that shouldn't be held against us either. I think that ratings should be removed and that if you have something that you feel strongly about a driver or a passenger then you can contact Uber/Lyft, but remove the ratings. As long as the driver is generally driving safely and getting the passengers from point a to point b without a lot of problems, then that is good enough - that is all that we are responsible for. Another thing, we shouldn't have to pick up passengers and have to carry their cargo either. I don't want to have to pick up a passenger who has seven grocery bags or to pick someone up from Home Depot and carry items that they bought from that store - we are not Uhaul. I am fine with being an Employee - but without the company getting a lot of control. Getting health insurance covered along with gas should be standard if you are a full time driver though.

As a result of underhand, unreasonable and unfair work practices, Uber were taken to court in the U.K. in order to provide drivers with basic protections against unfair deactivation, sick pay and annual holiday pay. Uber fought the case all the way to the U.K Supreme Court and lost the case, drivers are now legally defined in the U.K as workers. Uber in the U.K. are being perused by the U.K. government for up to £100 million pounds in back taxes. Uber fucked about, Uber found out. All they needed to do was be reasonable, quid acting shady and treat drivers fairly and they choose not to.
They need to classify me as HUMAN ! UBER AND LYFT DO NOT PAY ME ! They only pay the overhead of my vehicle and expenses. I get nothing
