To those who say "they should have been court martialled!", you should look into the shady process that was used to kick these members out.
They were kicked out using "administrative measures", which are arbitrary, hidden from public view, and a huge breach of due process and procedural fairness.
They framed the reason for the dismissals as "disobeying a lawful order" under the NDA and yet they didn't have the guts to lay charges. Why?
Because court martials are public and the defendant is entitled to defend himself with a lawyer. The MND and CDS knew they were violating these soldier's rights and knew the order was illegal, so they used backdoor methods instead.
Now they are going to get a dose of the karma they so richly deserve...

It seems as though a big part of the class action lawsuit stems around the fact that the Prime Minister directed the A/CDS to implement the mandate despite contrary recommendations from the CFs legal branch. While the military gets its funding approved by Parliament, the CDS is answerable to the Governor General and only indirectly to the Prime Minister. If the assertions of the lawsuit are true, the A/CDS (later CDS) was breaking Canadian law by taking direction from Trudeau instead of his legal staff.
Answerable to the Governor General? That's a new one on me.

Now that we know it wasn't tested against and never protected against transmission or contraction, only PERSONAL SEVERE OUTCOMES, how is this a personal health decision that effects others and is therefore justified in being mandated? It literally only effects the severity of the outcome.

Sure they were. And no, very few Canadian rights were at all violated. Numerous lawsuits (to be fair more were just right wing grifts) came out and most were out right dismissed because they lacked any grounds.

The Charter does not make exceptions based on military status. "If" the mandates were a Charter breach against military Canadians, it is true for every Canadian who was mandated.

This is not true. The Charter makes exceptions for the military. For example Section 11 of the Charter specifically states that exceptions are to be made for military law.
@@ingetout Don't know what Canada you live in, but the one I live in has Section 11 covers rights concerning legal and penal matters; right to be informed of the crime for which you are being arrested/charged, right to trial within a reasonable time, presumed innocence, not to be denied reasonable bail, etc... Has nothing at all to do with the military specifically.
@@Astraeus..please read paragraph f of section 11. It says that the military operates under different laws for offences. The military is different in that we are also under the NDA and CSD.
