Thomas saw Scalia as a mentor and friend, and he was friends with Alito so they aren't going to touch the Second Amendment and how it reflects on the NFA.
So they used administrative law to slap BATFE/DOJ around, without touching on the NFA.

This isn't a "Pro Gun" ruling; it's a "Pro Congress" ruling, telling ATF that only Congress can change statutory definitions.
The second amendment clearly says that congress shall pass no laws restricting firearms.

What's the difference between a bump stock and a modification to make the gun full auto? Full auto = full auto, and full auto is illegal.
If I built a motorized attachment that goes to town on a trigger, I just make a full auto gun, but now we have to wait for Congress to rule that my triggerparty3000 device is illegal.

There is a mechanism in place to change the Constitution if we all decide there needs to be an exception. Until that happens anti-gunnery laws are unconstitutional. The 13A makes slavery unconstitutional. It’s cool if some appointed official you didn’t elect decides we can have an exception to that because reasons? I don’t think so. The words “shall not be infringed” aren’t unclear in their meaning

Supreme court should just go after every law that is unconstitutional, violating the 2nd ammendment (which is pretty much all of them).
Remember, it is a two way street. If we have the right to bear arms, bears have the right to human arms.
You would think that if Scotus judges are impartially interpreting law and the constitution, their verdicts would usually be nearly unanimous. Isnt it weird that they always vote along party lines? Its almost as if they arent impartial arbiters, but rather political activists. Very strange.

Well since the President nominates a judge (and then senate confirms- though usually accepts them anyway) you’re going to get party bias. Which is a terrible way to elect “ *impartial* “ justices. Especially ever since Bork was denied (to be fair he was actually pretty extreme and biased) it sort of sparked a race of who controls the supreme court- which entirely defeats the purpose of it. (Some of the justices on there, from both sides, are heavily heavily biased one way or another).

This IS NOT a second amendment case (as they eventually got right). It is a case of an agency making rules outside of the written law. It’s a government over reach case and legally has nothing to do with the 2nd amendment! It involves the same type of legal issue as some of the EPA cases where they make rules outside of their legal authority.
This type of judgement is exactly what the judiciary is supposed to do, protect the citizens from the executive branch exceeding the limits put upon them by either the constitution or in this case the congress/senate.
So if we Put a Bump Stock on a Broom that makes. Makes it a Full Auto Broom. ATF GO BACK TO SCHOOL.
