Danny Tijero sued Harvey Adelson, a retired dentist, and one of his corporations in late February 2024, alleging violations of the Fair Labor Standards Act. The original complaint was amended, so Adelson, through his lawyer Gary Cohen, filed another Motion to Dismiss the Amended Complaint.
Harvey Adelson's son Charlie Adelson was convicted and sentenced to life in prison last year for the July 2014 murder of FSU law professor Dan Markel. Markel was previously married to Harvey Adelson's daughter Wendi Adelson, and the two had joint custody of their sons. A week after Charlie was convicted in November 2023, Donna Adelson (Harvey's wife) was arrested and charged with the same crimes as she tried to board a plane to Dubai with the final destination being Vietnam. She and Harvey Adelson had one-way tickets. Law enforcement seized both Adelsons' cellphone and Harvey Adelson's iPad. Harvey and Wendi Adelson are under a cloud of suspicion, and Wendi was named by the State as a co-conspirator in Markel's murder in 2022, but she has not been charged with any crimes thus far. The State has posited that Dan Markel's murder was Harvey Adelson's 70th "birthday gift" and that the family used the code words "birthday gift" and "TV" to refer to the murder among themselves.

Just another frivolous Plaintiff's lawsuit by yet another Plaintiff attorney looking for a buck. It should be dismissed before summary judgment. The Adelsons are simply sitting ducks right now.

I think it should be dismissed. I would think that the plaintiff would have pled with more specificity. The Adelsons are sitting ducks.

Only the voice is artificial. I typed up what I wanted to say and used one of those websites to read it out.
Wrong. Adelson has to prove that he dis paid for he paid overtime Tajero is claiming he worked, regardless of Tajero not having documentation. The burden is on the employer who paid the employee cash. Adelson’s word against the employer that he did not pay cash.
In civil cases though, it is the plaintiff's burden to prove all the elements of his claim. I'll keep following this case too & see how the judge rules.
