My HOA has several complaints. They complain about my vehicles which have been shown as operable to Code Compliance already. Yet I see at least 2 vehicles that OBVIOUSLY have NO MOTOR! They complain about ground cover and when I asked about the ground cover you said they don't want to argue about it that they just need me to maintain ground coverage but they won't tell me where there is a situation where there is no ground coverage. Is a vague BS charge they WILL NOT be specific about! They complain about my trash cans being left out on non trash days, but they are behind shrubs which are more out of sight than most people's in the neighborhood you cannot even look at my trash cans without seeing my neighbors trash can less than 20bfeet away which has been sitting out there for more than 3 years now collecting mosquitoes all the time. I have over 200 photographs of other people with their trash cans in more obvious plain sight than mine. They sent a letter asking about it... Are you going to bring the trash can in? No. Wht not? I'm having the city swap it for a smaller unit and they said to leave it at the curb. Well don't you think you should let us know? Do I need to let you know every time I fart??? Ever since I am THE ONLY HOUSE PEOPLE LOOK AT EVIDENTLY! I've also had to remove all but 1 room of Bamboo flooring due to leaks & water damage happening consecutively for several different things... I had construction supplies (tile) and other things. They cited verbatim about construction materials until the 2nd part of the sentence which states unless it's for an ongoing or immenent project... But that part is put in the charge as ... Leaving out the exception directly applying to me! Is this not altering the covenant to make me guilty? Is this legal? They left out another charge replaced by ..... What can I do about that? 5S the attorney to address it but he ignores it. I also asked him to address selective enforcement and your attorney says you're being treated like everybody else which is complete BS! A former board member who works with the board still on social events communicating with them daily I've been with any messages to me and told me to put the supplies in the backyard. So even though it was a major inconvenience I went ahead and did it and they were happy with the front yard at this point. Give me my neighbor or board members took pictures of my backyard after that and declined an agreement and $2000 check! I was SET UP!! Before even having knowledge of the declination they immediately sent code compliance to complain about A PEICE OF CARDBOARD IN BETWEEN VEHICLES!;NO NOTICE TO REMOVE IT, JUST CALLING CC! Is this NOT maintaining civil communication and allowing me to rectify??? I think the rules that govern HOAs abuse are great...but if I can't afford a lawyer I can't do anything about it evidently! Also this lawyer took my documents to copy and return .. but he will not return them! To top all of these atrocities...my home is in a family trust (FOR SUPPOSED PROTECTION) and he has ALL CONTROL! YET MY RIGHTS ARE BEING STOMPED TO DEATH! But I can't even bring my evidence! The attorney I FOUND FOR MY DAD & I (HE'S 1500 MILES AWAY) HAS NOW CONVINCED DAD TO EVICT ME! Is this not a conflict of interest? My lady , who is handicapped, and I have both poured our situation to him and he files eviction against us! I'm ABSOLUTELY LIVID!! PLEASE HELP! ANYBODY! PLEEEAAASE!😢🙏
So, our HOA is in the process of obtaining fines for each violation. We have a neighbor who refuses to change out a mailbox to one made of stone or brick. There once was a community mailbox, but the neighborhood has grown so much that it's no longer feasible, safety-wise. He bought the home, and the previous owner left him $3000.00 to replace it. He said he would have to be buried six feet under before he changed it out. So, he was asked in person by the board last October and he said no. Do we still have to go through the process of three warnings?
Yes you might have to go through that three warning process. I'd have the board look at their fine notice schedule to verify what the rule would be for that. Or you could also call your management company to ask what this enforcement process will look like.
The best way to avoid any HOA nonsense is to tell your realtor that you will not even consider a property that is in an HOA neighborhood. A neighborhood that I lived in tried to form an HOA after I had bought a house there and told me that I had no choice but to be in it. WRONG. Read your civil codes . In my state, if you purchase a house where there is no existing HOA your property is exempt from joining if you choose not to.
Definitely let your realtor know that being in an HOA is a deal breaker for you and they can omit those homes from your searches. Thanks for your comment!
What about HOA payment for condos. My payment didn't go through because of bank error. Its been 10 days and I've contacted them several times they have restricted my ability to make a payment. Is this legal?

That sounds very odd that your management company won't take your payment? I'd reach out to them and speak to a manager to get this cleared up fast!
So if the HOA foreclose on a home purchaser that means the HOA is taking over that mortgage being they wasn't in first position on that loan?
That's a great question that I'm not sure I know the answer to. I hope it doesn't ever get to that point for a homeowner.
