Entitled Drunk Man Threatens Officers Life After Officer Refuses To Let Him Go

- NMSP Sergeant Toby Lafave’s Report:
On Monday November 6, 2023, at approximately 0328 hours, I, Sergeant Lafave, was on duty in full uniform displaying my badge of office, and in a marked NMSP patrol vehicle within the County of Valencia, State of New Mexico. At this time, I was parked stationary in the median of Interstate 25 near milepost 206, facing north, monitoring traffic in this area. I observed a southbound vehicle that appeared to be traveling faster than the posted speed limit of 75 mph. I engaged my radars front antenna which displayed approximately 96 mph. I caught up and pulled behind this vehicle a black Chevrolet truck bearing NM registration AMHK72, activated my emergency equipment to conduct a traffic stop. The driver was slow to bring this vehicle to a complete stop (40 seconds). I exited my patrol car and contacted the male driver and sole occupant, later identified as Anthony Aragon (Defendant) and asked him to provide me his Driver’s License, registration, and insurance. Defendant provided me his NM OLN and current registration. While speaking with Defendant, I smelled the strong odor of an alcoholic beverage emitting from Defendant and/or this vehicle, had blood shot watery eyes and spoke with a slur. Defendant thought he was catching up to me as I was traveling even though I was stationary in the median. I had Defendant exit this vehicle where I explained the reason for this traffic stop. Defendants balance appeared impaired as he walked and stood straight up. While speaking with Defendant I continued to smell the strong odor of an alcoholic beverage from his breath as he spoke and his eyes were bloodshot and watery. I asked Defendant how much he had been drinking and he admitted to consuming one alcoholic beverage 45 minutes prior to this traffic stop at a friend’s house in Los Lunas. Defendant denied being north of Los Lunas. Based on my observations, I had Defendant submit to a series of Standardized Field Sobriety Tests (SFST's). Due to Defendant stating he was nervous and not having good balance I administered 2 alternative tests: H to R and 58 to 43. Upon completion of all SFST’s and based on my training and experience, I observed Defendant displayed signs of impairment and determined Defendant was unable to continue to operate a motor vehicle safely.
At 0346 hours Defendant was arrested for driving while under the influence of intoxicating liquor, placed in steel handcuffs that were fitted and locked for his safety. Defendant was read the New Mexico Implied Consent Advisory and refused to be tested. I checked the interior of his mouth which was clear of any foreign matter. He was then transported to the Los Lunas Police Department in Los Lunas and after a 20-minute deprivation period (0346-0446 hours), Defendant failed to provide any valid breath samples into the IR8000 instrument resulting in the instrument to display, “No Sample Introduced.”
A check of Defendant's driving history in NCIC returned valid with no prior DWI convictions making this a first offense. During the inventory I located several open alcoholic beverage containers. Defendant was transported and released to the Valencia County Detention Center without incident.

Exactly. People who state “I hate the Cops” or “I don’t trust the Police” have problems with anyone in a position of authority. All you hear from them is how the system is screwing them. It’s never because of their bad behavior. This guy was tanked. He was an absolute threat to every motorist on the same stretch of road as him.

Last year my son was hit head on by a drunk driver, less than a mile from home..Six surgeries…Fractured pelvis, broken hip, and cracked ribs…6 months of rehab and he’s just getting his life back .
Zero tolerance or sympathy for these asshats.

She had a wonderful, giving career, a loving husband, and 11 year old son. The drunk had several priors and received 24 years. Rene's family, friends, and potential patients got 0 Rene for the rest of their lives.

In my lifetime, I’m 67 now, I have grieved so many people killed by drunk drivers. When I hear the excuses, the “I only live down the road”, “Ive done nothing wrong” and then blaming the cops, my blood boils. You think the message would be out there, but clearly people think they are entitled to risk the lives of others when they could have so easily used another method of going home. So bloody selfish.

But since he is so entitled and drunk he doesn't see that at all which is pathetic. Now if only there weren't any plea deals for these cases in court so that they face the full weight of their charges to really teach them a lesson.

Based on experience with my kids’ friends, parents think nothing of paying a lawyer to get the charges reduced, teaching their kids they don’t have to be accountable for their behavior. Maybe there wouldn’t be so many young repeaters if that first one forced them off the football team and they had to get a job to pay it off!

I have a very good friend/ex co-worker. About 20 years ago she was out drinking with her girlfriends and got stopped for drunk driving. She took complete responsibility for it, took the required classes, lost her license for a few months, and from then forward her group of friends rotated who would be designated driver and never drove drunk again.

Well, having integrity takes a lot of courage. Other police officers, emergency or medical personnel, politicians, or relatives expect the leniency from the officer making the contact. Everyone deserves to be treated equal and not expecting favors.

Which is why I’m sooo grateful that the only time so far in my life (knock on wood) that I have ever been investigated for a DUI was before body cameras came into existence! And the BAC legal limit was still .10% back then too (it was around 2007).
I know for a fact that I aced the FSTs, but obviously I don’t know how my eyes looked, and I refused the roadside PBT because I know they aren’t accurate/reliable (which is exactly what I told the cops too as my reason for not blowing - I told them that I would do however many more FSTs they wanted me to do, but they would have to take me in to the station if they wanted me to blow into a breathalyzer).
I knew I might be borderline near the legal limit, even though I felt completely safe to drive, so that was my chess move (I’d had some wine with food with a friend approximately 45 mins before being pulled over for speeding on my long drive home). At the very least, I was buying myself time for my body to process the wine before blowing into the more accurate machine.
With the way things are today, borderline cases like mine would have resulted with an arrest because of body cams. Their only “clues” for PC were my speeding, a smell of alcohol (which I admitted to, but that isn’t illegal by itself), and _POSSIBLY_ nystagmus (as I obviously don’t know what they saw in my eyes). I’ve never seen a video in modern times where a cop gives the benefit of the doubt to the driver and lets them go if the only clue of impairment is the smell of alcohol on their breath.
I was let go with just a warning for speeding after they failed in trying to relentlessly pressure me to take the PBT for probable cause.
Cop haters wanted the cameras, now they got em. Discretion went out the window, enjoy.

And to answer your question if there's a plea - no they won't view it If there's a trial I'd say the likelihood a prosecutor would put that into evidence is very very high. So if there's a bench trial or jury trial it would be seen. All that is way too much for you to "process" I'm sure.

Despite all the requisite processes that depend on such things as plea deals, guilty or not guilty please etc... they can only "throw the books" that the legislators give them. Judges aren't law makers, they judge people guilty or not, and apply the law as made by others.

This man is not just drunk, but he’s absolutely hammered and yet it’s this very polite police officer’s fault. Another selfish driver who needs to spend some time in an A&E Dept / morgue to see what we have to contend with every day.

The kind where you can see the dirt rising along the road as someone goes by. There’s no phone service. My Mother slashes her hand, badly. We can’t stop the bleeding. I’ve had a couple, nowhere near drunk, but feeling a bit warm. I drive her to the edge of cell phone coverage. It also happens to be next to the ambulance station and the RCMP detachment, both of which are so small that they don’t have anyone there at night. I call 911 from my cell, the ambulance driver wakes up and meets me there, along with a cop who can help him drive to the nearest hospital an hour away. Should the cops arrest me?
@@karenneill9109 I would say that you are missing the point, though there was not really any decent point made to begin with. A vast majority of drunk drivers are neither nearly intelligent enough, nor do they have the same level of common sense and competence, to drive after drinking. Most of them couldn't care less who or what they may run into on their way there, because they are drunk and thinking "wahh yeah gotta get home and sleep." Some of them don't even realize it when they do hit and run someone.
Drunk driving as we know it, and driving "feeling a bit warm" for a valid reason, knowing your responsibilities, with exigent circumstances. It's a pretty considerable difference.
I also believe that there is no real excuse for drunk driving, by the definition that most of us know it. It is by all accounts selfish, and serves no purpose other than to save the drunk a little bit of time.
@@hazel-vf7on I was responding to commenters who said that there was ‘no excuse to drink and drive’. I thought of a plausible scenario. One drawn from real life. That doesn’t excuse drinking and driving except in extraordinary circumstances. I happen to think that there’s no excuse to plan to drink and drive, there’s no excuse to drink and drive unless it’s an emergency, etc etc. I just think that making blanket statements is simplistic. I don’t believe in black and white, right or wrong. Everything is shades of grey, and depends on circumstances and situations.

This is one of the best exchanges between an officer and drunk driver that I have heard, even a bit comical at times. There is no use trying to reaason with a drunk person, but Sgt. Lafave's nonchalant attitude and professionalism during the entire stop should be the standard by which all law enforcement are trained involving traffic stops. Thanks for getting this guy off the road. Sgt. Lafave is my new fave!

Such a shame that this outstanding hardworking man's life has to be ruined. He mentions that he had an interview in the morning that is probably now ruined.....he works full time at the railroad when asked what kind of work he does...and he states that he puts in 12 hours everyday at Amazon. How he found time to have that one beer 45 minutes ago is beyond me...but I guess as he said: "this is just the cake on the icing". Anthony...you might want to learn how to take responsibility for your own stupidity.

He does need to slow down and enunciate. I'm totally sober and about 20% of the time I can barely understand what he's saying. It's not going to help the prosecutors any if the defense can show that he wasn't making his instructions clear. Maybe not in THIS case since the guy is clearly wasted but it's not doing him any favors.

This is the first time I've heard this officer. I think he talks too fast, particularly during his instructions.
I have read so many stories of innocent people being killed by drunk drivers and it makes me sick! The one that sticks in my head the most is the poor Simmons siblings over in the US I think it was Louisiana, absolutely heartbreaking and he sits there saying “you cops ruin people’s lives” no sir that would be people like YOU!
I’m actually surprised how many people ask for the officer to follow them home, it’s 2024 people, you’re not getting a pass on drunk driving.
Our guy really knows how to mess up first class. Felony speeding at night, drunk, with open containers. Amazingly, he also projects his errors on others. It’s as though he learned from TV news that laws don’t apply to him because he’s special. He sounds like he’s being treated horribly even though he’s done nothing wrong: It’s a disgrace, what they’re doing!
