It was not a random call, it was called in by his ex-girlfriend. By the time this happened, he and his ex-wife had been divorced since February 2023. The dogs name is Hulk and he's fine. He was picked up by a relative.
At 11:00, the officers are discussing the tip and I think they were wondering the same thing. If they do doubt the tip, or even if a reasonable person would doubt it's validity, Navarette v. California shouldn't apply. Especially if they later say in court as much. That being said, the dog thing was probably legit though. If he didn't have cocaine and the meth pipe, and assuming NM dogs don't alert to cannabis, and also if he stepped out of the car when he was supposed to, the weed might have been thrown out.

This cop messed up. While he DID have the authority to order the driver out of the car (see Pennsylvania v Mims) but he repeatedly said "I'm ASKING you to exit the vehicle". This language is important from a legal perspective. If the cop ASKS you to exit the vehicle, that is NOT a lawful command. Had the cop said "I'm ORDERING you to exit the vehicle" that is a lawful order.

Not following an officers order, as well as resisting detention IS resisting arrest, and can be arrested for. It is almost5 like, arguing with police and making everything as difficult as possible lands you in handcuffs, because it does. You can actually get in trouble for resisting a lawful command, which when you are commanded by a law enforcement officer to exit your vehicle you actually are required by law to exit your vehicle and then can be considered resisting at that point.

They asked him to get out of the car; Pennsylvania vs. Mimms; according to the law, it is a lawful command if the traffic stop was lawful to begin with. There was no traffic violation, and you can't pull someone over without reasonable suspicion; anonymous tips are not enough.

I could be wrong but I'm pretty sure if a 911 call is received and an officer can reasonably ascertain that someone is the subject of that call then that emergency call acts as the Reasonable Articulable Suspicion necessary to initiate an investigation. How many requests for understanding are you allowed to ask before it becomes resisting? Or is it a time limit? For one. A cop can’t pull you out for a traffic stop in many states. A traffic violation is a ticket. 2 they didn’t have a warrant. 3 cops can’t extend a traffic stop longer than a normally stop.

They asked him to get out of the car; Pennsylvania vs. Mimms; according to the law, it is a lawful command if the traffic stop was lawful to begin with. There was no traffic violation, and you can't pull someone over without reasonable suspicion; anonymous tips are not enough.

For one. A cop can’t pull you out for a traffic stop in many states. A traffic violation is a ticket. 2 they didn’t have a warrant. 3 cops can’t extend a traffic stop longer than a normally stop.
