I mean the damage is quite a lot, not to mention it implies that their talent break their contract because of this.
It would be a different thing if they actually didn't want to sue her, because by suing her, they would have to launch investigation and give proof that she was lying, and if the proof actually sided with her, it will be a bigger problem for AC and Luca.

I haven't looked into the alleged shady stuff Raziel is being accused of, so I can't comment on that. _Regardless_ of that though... they have provided credible proof of Luca breaking his contract repeatedly, seemingly with no negative effect to him. So the C&D feels kind of sus and like it's legitimising _something_ about Raziel's claims.
Also people seem to forget that you don't need to be a saint to do the right thing at one point or another, bad people do good things all the time too, so... yeah.

cease and disist just says "stop or we will sue you" you can sue for literally anything, but most things will get thrown out of the court during initial discovery with no cost to the sued party.
Niji can do a cease and desist, if the statement is true she can simply ignore the cease and desist, calling niji's bluff. If they sue her, and she is not defaming, then Niji looses big if they do so (could even get fined via anti slapp if USA jurisdiction applys)

From my research, it’s when someone thinks you’re engaging in a harmful behavior (towards you or someone who works with you) and are actively trying to get you to stop. Although I think it doesn’t mean that Luca is innocent, it doesn’t show that everything is proven. It just doesn’t help the issue or the public perception, dumb move tbh

They really shot themselves in the foot with this. Sending a C&D now is totally pointless. Raziel already said everything she wanted to say and everyone willing to listen has already listened. They gain nothing out of this and acting this late only makes them look incompetent. Additionally, trying to silence Raziel only gives her statements more credibility. Once again, the better move would have been to do nothing, but Nijisanji just can't stop making things worse for themselves.
Even if Raziel was making up everything in the document, now it all looks validated by the C&D. And as someone who did believe it, this just makes me want the company to burn further. Especially if the part of Aster harassing the girls is right, and he’s been targeting Scarle.

@@CenturianTale_Halo it’s part of Raziel’s document that Aster has been harassing the talents and when brought to Elira, she tried to get management to do something but management refused to do anything.
It's a Streisand Effect for sure, and it especially looks bad when you put it next to the fact that they changed Luca's signature for the newer merch drop, which had been the signature that Raz claims to have drawn for Luca. It definitely raises a lot of questions and makes me think the C&D could've either been for her leaking the stuff that Luca leaked to her or as a bluff, knowing that they have way more money to spend on legal fees than she does if she chooses to fight back. That, and as pointed out in another comment, this shows they know the doc exists and thus have likely seen the evidence she posted of Luca violating the contract, but they still won't graduate him.
Let's see if NIJISANJI is all bark but no bite, because they will certainly come after you and FalseEyeD. Hence, I dare you and False to ignore their cease and desist order thrown at you and keep this drama going.

I would say though given they sent her a C&D rather than a defamation suit makes it more likely than not what she shared in the document is factual which in any civilised country would throw out a defamation suit. Even if it is just a scare tactic she should really consult her lawyer on her options.
The situation between Raziel and Luca just leaves really sour taste in my mouth. Both of them are so immature and in the wrong imo. Luca trusted Raziel a lot so he shared stuff with someone he probably considers as a friend and broke his contract by asking her for favors and Raziel used his trust and practically stabbed him in the back with it. Like, if she hated it so much before, why didnt she not do the favours he asked? It's not like she was bounded by him at his place, no? so I couldn't make out her motive so I don't understand her nor Luca. It's like something happened behind the scene between them which made Raziel so fed up so Raziel just went out and did this whole thing about Luca being manipulative? Note, a Cease and Desist holds no legal weight in the US, and even "fake" Cease and Desists are protected under the first amendment (so long as you aren't impersonating a lawyer or something,) but that isn't necessarily the case in Japan, which might be why it took Niji so long to figure out what to do.

All the C&D means is that Niji does not want that document circulating around. It doesn't really matter wether it's true or not, the information in it is bad PR for Niji regardless. I would imagine that the proof that the document is real would be all of the proof that was provided before the C&D.

The best thing they could have done to that document is either directly sue her back when she released it if it was false, send a C&D back when it was released if it was true, or completely ignored it entirely. Just a reminder that kurosanji is a Japanese company, and, under Japanese law, libel and slander include things that might be true but ultimately negatively affect a company's public appearance. So it could well be that Niji sent the C&D because Raziel's documentation, true or otherwise, was having, let's say, a "negligible" impact on Niji's image.

Cease and desist is not able to remove events from the past. I can't even remember what number of "who thought this was a good idea" we're at. To be honest, I would think it would be best if the public left this alone. People are assuming things even though we don't technically know stuff as fact. We don't know everything that happened behind the scenes, and we won't for at least a long time to come. That C&D means nothing. It states that she’s in violation of their NDA for releasing private information, however that NDA expired in December 2023. This literally holds no weight. It’s not even an order, but a request she stops talking about them. Meaning, it’s a suggestion. It’s not an order, her NDA with the company expired months ago, so it was useless to send this in the first place. I like that the situation with Luca is back in the spotlight. It made me uncomfortable how everyone forgot about it like he and other Kurosanji Vtubers aren’t bad people.
