Sarah Boone's defense gets another week thanks to Hurricane Milton! And she rejected a plea deal that would have had her serve 15 years.
Where did you get the information on the plea deal?
@aguynamedkevin8469 it was right before they almost started jury selection. They shut down the court right after that, so it won't be in written records for a bit.
The good Lord works in mysterious ways. In my experience, people like Sarah aren't helped by having a little extra time. The actual case against her is too strong, and now she'll have even less of an excuse to win an appeal after a conviction. We all knew that's what they were planning when Owens kept maneuvering for another continuance.
I have faith in providence. Sarah is long overdue for a good humbling.
They knew she wouldn't take it. Might be a strategy to get her more time.

It never ceases to amaze me how Sarah Boone fails to show any measure of remorse or guilt over this merciless murder. She only continues to dig her grave deeper and deeper by her own actions and attitude. It’s just sad to see her sink into more depravity instead of using this situation to bring her character into proper alignment.
I really enjoy the way you go through the case law and explain the principles. Thank you. It really helps get my legal brain going. I think the former statements include evidence of her character that otherwise would not be heard by the jury(?)as well as evidence that she was, in fact, drunk, which could affect her self-defence claim. Also, I'm curious to see how the self-defence claim will be presented, given that the interrogation shows that she doesn’t admit to killing him intentionally. If she admits to killing him intentionally, ( for the self-defence claim) she's not credible (because on the day, she said it was an accident) but if she sticks to it being unitentional, then it's more of an accident. Her defence is incongruous. She's damned if she does and damned if she doesn’t. It'll be a fascinating trial. I'm completely obsessed.😊❤🇬🇧

Court TV disclosed Sarah just rejected a 15 year plea deal for manslaughter and she would only serve 10 year’s as she’s been jailed almost 5 years.
Big mistake on Boone’s part.

thank you for your analysis! Agree, he didn’t provide any type of legal opinion. He was stating facts already discussed during the interview, so I think context matters, like he’s saying “he’s dead because of your actions” just like she admitted to during the interview, when said it was unintentional
She had been preaching that he died at her hands (just accidentally). He was just saying, accident or not you’re it. That was never disputable.
It also wasn't testimony. Owens says that officers can't give testimony like that.
And saying that he's l he died because of her actions doesn't necessarily mean that she's guilty of a crime. The defense is now saying that she had to do what she did to save her own life.
I am absolutely DISGUSTED with the state for basically offering her 8 years. Do they think they don't have a good case? We now know she DID hit him with the bat. And we have the videos. We have the interrogation. I mean, what the heck?

@kylehanna4885 it hasn't, OP is speculating. There was a bat found in home but it's well known they DONT think that is what was used. All his contusions came from the suitcase being flipped and thrown down stairs. OP is clueless.

If the toilet turmoil is excluded, they jury may wonder what was excluded and why, thus creating reasonable doubt. I think Mr. Ownes is counting on the judge removing that part without thinking it's trivial. But the actual removal and splice of th video without explanation could cause reasonable doubt concerns.

The detective didn't offer an opinion, he was reciting what sarah said to him and was asking her to confirm it. And he didn't make a statement of law.

At the scene SB said Jorge's unaliving wasn't intentional which would be an admission of her guilt prior to interrogation. She also claimed she wasn't drunk yet out of the other side of her mouth she said she was drunk when leo arrived.
How much longer can he make arguments? Seems unfair.
Owens seems to fluff up motions with personal wording & opinions. The appellate court didn’t say “causation” anywhere. He’s using the word, but the Odeh appeal did not.
Maybe the word is in the 2nd citation, but otherwise Owens is fluffing with the word “causation”.
My goodness, Sarah rejected a plea to manslaughter. She was facing something like 15 years, minus 4.5 years time served, possibility for parole, etc etc. Now she faces a more severe charge with minimum of 21 years... all the way up to life. I simply can not even 😭

The detectives make the statement that Jorge died because of Sarah's actions. I don't see how that is making a legal opinion. Sarah replies, "I understand that." That answer isn't great for Sarah.
SB has a problem with her defense… she claims it’s an accident, it’s self-defense, it’s unintentional, it was because she feared for her life… which is it?
Is it possible for them to withdraw the self defense/battered wife defense now that they've been unsuccessful at supressing her interrogation?

The State has a very recent filing regards the Defence expert witness deposition, and it's dynamite.
I think the defense is really reaching on this one. The detective's comments are just a summary of the facts.

Brother, didn’t they want to remove the portion of the police call about the bathroom bc Sara told the cops her neighbor was illegal bc he wouldn’t let her use his bathroom? Isnt that to avoid painting her as vindictive or vengeful?
What bugs me is that if Sarah wants this Battered Spouse defense, then the cop saying "you killed him" isn't an opinion anymore - it's a fact based on Sarah's own admission. She DID kill him, *but* she's not guilty *because* she was in imminent fear for her life. The cop wasn't opinning about the law.

It doesn't matter that the detective does not say it's self defense. He uses the word "absolve". He clearly implies that Boone is not to be "absolved". Absolution has nothing to do with facts, but with culpability. And so, pace the opinion you referenced, the officer was offering an opinion about Boone's legal status (absolved / not absolved), and that should be stricken.

Detectives didn't give testimony during interrogations. Owens claims that it was testimony.
He was offering an opinion about her MORAL culpability, seems to me. Not about her legal culpability. The detectives seemed to be upset that Sarah wasn't grief-stricken that her boyfriend was dead, and that Sarah seemed to be merely annoyed that the detectives were too obtuse to understand her repeated claim that it "wasn't intentional". If you watch the interrogations Sarah really seems to be almost unaware or uncaring that someone is actually deceased here.
I'm no expert, but of seems like the business day that jury selection starts is too late to introduce motions like this.
The first chunk of information didn't seem particularly relevant to the case.
The second part they want suppressed doesn't include any testimony from the detectives. Even if it did, the defense is now claiming that Jorge died as a result of her actions, and that she knows that she did it. So they're trying to suppress the part where a detective agrees with the defendant.
Owens is a very powerful person because he managed to get a hurricane named after his hometown of milton to hit florida so that now he gets an extra week to prove how much of a fufus he is. Lol

As someone on another channel said last night about the first part, it made Sara sound like a snitch when she mentioned to the cops that one of the neighbors who wouldnt let her use their bathroom was trying to get a green card. Presumeably, that person was an illegal. Yeah, snitching!
