I've been with State Farm for almost 50 years with no claims. On the way to get my wife's car service a lady on her cell phone rear-ended me She too had State Farm. I thought, "this is gonna be quick and easy." WRONG, I had to fight them to take care of this situation and finally out of frustration I contacted a lawyer. With all of these companies, your nothing but a policy number.
I had a State Farm insured driver pass out and, then, crossed the medium and bounce off a Jeep's bumper and, then, smashed into my grill. Now, they will NOT fix my car and only want to pay half the value of the vehicle - my total loss is 10K, but they want to pay 4K - if I go to a civil lawyer, would that be an option given it's only 10K and no personal injury.
I bet one reason they were dragging their feet is because now that insurance is at a total loss and they can't go after the other person. I once had a brand new Subaru in L.A. and for some reasons I got rear-ended every month (even the lady at the body shop was like I'm not sure if we should put you on the payroll). Anyways, I was with AAA at the time and they were great during the process. They actually were interested in fighting back instead of automatically claiming I was at fault. One was a lady parking in a zone with posted no parking because it was an entirely one way exit to the underground parking, but thankfully AAA did even get onto Google Maps and said oh yeah the other party is at fault and of course we collided because it's literally a tunnel. When I was with GEICO - they just don't fight and will tell the other party that I was responsible. The person was driving on the shoulder and literally hit my tail end and somehow GEICO said I was at fault. Because of that is when I decided to get myself a dashcam. So my last accident thankfully I had that dashcam because I'd imagine they for sure would have loved to make me 100% liable as the other party in the end had no insurance. Tons of people carry the card showing proof of insurance but it was a canceled policy (I hear it's extremely common that people on get it to register their car and then they immediately cancel the policy). I was told that State Farm really wasn't all that good - you know as in getting your car fixed.
you don't have to be a lawyer to file the case. there is online form, you just click and in put the information and print and take to your Circuit Court Clerks office, pay the filing fees, get a case number issued. pay the cost for your local sheriff department to do the service. Do not use certified mail, this can be challenged. once service is made, the case has started. Then you go on line and do your on line demand letter. add your cost, pain and suffering, future medical cost. and in the letter, you set a dead line date for the insurance to respond. if the insurance miss that deadline date to respond, then move the court to put the matter on docket for a jury trail. Always demand a jury trail not a bench trail. let the members of the jury set your awards
When asking a insurance for a statement or declaration policy limits, here in Tennessee, they always say " Attorney work product", so just take the case to a jury trial. let the jury award you your settlements amount. Insurance companies are to protect their insured. and if they roll the dice and put their insured at risk, take your jury settlement award, have the court issue an execution of judement, and file the judgement as a lien on all bank accounts, houses, anything that is held in that insured name. File it with the bank first, this will freeze all funds from leaving the account, and the balance in those accounts are then issued to you in check form.
I'm ex-Progressive. The statements are only transcribed if the claim goes to discovery, ARB, etc. In my experience in the New England pd and injury units, they won't even give the insured their own statement. The standard answer is "it's our business record".

I let them know that Tape Recording calls is a two way street, and what's good for the goose is good for the gander. I'm in Texas and am currently dealing with an insurance company on my own. It shows their agents are Progressive but that's not the name of the insurance company. They know they're insured was at fault because they've already sent an estimate which is over $1,000.00 less than the two estimates I'd sent them. The problem I'm having is they have listed all CAPA replacement parts. My car is a 2017 Nissan, 46,000 miles and still under an excellent Extended Manufacturer Warranty I purchased when buying my first brand new car. I'm having to argue that my car should be restored to pre accident condition and after market parts can void my warranty. They're hateful and when I told the adjuster I expected Diminished value she told me once it was repaired it wouldn't have Diminished value. Of course it will. It's now a wrecked vehicle. I'm being told by the Auto Collision shop I can pay the difference in Manufacturer parts if they refuse. I shouldn't have to pay anything. You've given me some good ideas but I also want to know if I end up paying the difference for the parts can I file a small claims suit against the insured to be reimbursed? I'm considering sending a certified letter to the insurance company listing the parts and why they're not just cosmetic and telling them I'll file a small claims suit against their insured for my out of pocket expenses. Most insurance companies Progresso being one don't accept estimates from body shops. That's why they pay damage Adjusters. Even if their estimate is low doesn't mean your car won't get fixed. Insurance have rates and that's what negotiated between the adjuster and body shop. As for diminish value that determined once the car is complete because the price to fix the car is how its determined. They can't tell you how much the vehicle has diminished without knowing hiw much the damages are. Then they wait until the end just in case supplements come up while the vehicle is being repaired. Look at it like this. If they say your estimate is $1000 and pay out diminish value and your car gets to the shop and they start work and $2000 more in damages are found then your diminish value was short because it was actually more damages that took away from the value. Hope that helps. Also a lot of people think let me file a claim with my insurance and they'll do everything for me in regards to the other insurance company. The way it works is if you want your insurance company to fix your car you file with them if not you file on the other person's policy. If your insurance fix your car they send it to subrogation for reimbursement and that department deals with getting reimbursed or going to court or arbitration. Hopefully this helps

Immediately take photos of car accident don't move car until after photos have been taken! I can't stress this enough. Call police. Get a witness if possible phone number. Take photo of person who hit you. Write down on pad exactly what and how it happened date, time. It's not to pricey get a camera for your vehicle, absolutely use it always when driving. Someone will call you more than once asking same questions. A person will say they are trying to figure out who's to blame and record your conversation. Record your own conversation with them. Listen to video, for his ideas. Save every text, Save every call made to you. Report Insurance who won't pay claim,to State Insurance Commission. Check to see if there is a camera on light pole. If there is, have your attorney subpoena the camera recordings. Person will ask about your seat belt and who else was in car with you.
I'm not sure that Delay is accurate. When I was an adjuster we were taught that the longer a claims goes on the more we would end up paying out. This increase would be due to additional treatment on the injury and additional rental car days or storage fees on the PD side. Also, the more delays there are, the greater the risk of a 93A. Also, if claims are turned over quickly it keeps loss reserves healthy so that the business side knows exactly how much cash is available to deploy into investments.

Many states have statutes designating proper service on insurance companies. Check your state's statutes. Look at whatever agency oversees insurance companies.

Sorry you are dealing with this Hector. That doesn't sound right at all. We don't practice in Rhode Island, but we suggest consulting with a lawyer in your area who will be able to guide you in the right direction. That should not be happening to you.
I'm ex-Progressive. They do this all the time. If someone not on the policy drives your car once, they will add them. You can usually get the person off the policy by providing proof the person has a different address than you. Also you can ask them for proof of "frequency". They have to prove the person is a regular user of the car. Another recourse is the RI Department of. Insurance. Sorry to hear that happened to you.
That happened to me at GEICO, I sent them a certified demand Notice that they must remove the name off of my policy or I will cancel their insurance. They immediately complied and removed the name. IMO, Insurance Company's have their policy and I have my policy; It goes like this, I pay for a service, and insurance Co. provides the service, they do not have the authority to dictate to me, they may ask or request only. Simply put, Insurance co.'s are public servants that are compensated for their service and I as the policy holder am the only one who makes decisions as to who is added to my policy and who is to be removed from my policy. If you do not take control of the business aspect of your insurance, the insurance Co. will walk all over you.
I'm going on 112 days fighting Progressive who sent their attorneys after me ASAP knowing im an investigator. No-fault accident in Texas as we were moving to Pennsylvania. A semi-hit the new toy hauler that we have to stay in until we can buy a home. Very unsafe toy hauler with my children. Completely horrific living conditions in our toy hauler. 2 demand letters were ignored. In 4 days our appointment at a Keystone Certified Collision Professional Services is expecting the unit. We are living in it. Black mold, water is leaking inside due to the major damages. Power isn't working correctly which could cause a fire. No lawyer will help because we were not injured. I recorded all conversations while in WV a half hour away to use the one-party content. The trucking company has $1000000 policy yet Progressive is leaving us sitting while im dealing with a huge law firm on my own. Help please, advice. Be blessed.
I don't work for progressive, but another large insurance company. A lot of people think insurance companies will do the work and that's not the case. If it's insured they will fix it and then go after the at fault insurance company for what they paid. This is called subrogation. If you have insurance on it let your insurance fix it and if they're successful at getting reimbursed they will reimburse you your deductible. Other than that you will be doing it on your own, and trust me it's not just progressive that's this way.

It's emotionally and mentally draining trying to get what you deserve. I'm sure your aware. It doesn't help that attorneys are only interested in injury cases. You do have the small claims court but your damage may exceed $20,000.00. I hope you get this settled soon and to your satisfaction.

Adjuster send me straight to investigator .. when i ask , im going to btake my car to a shop i want . She said yes .. kniwing she sending me straight to investigate. Now my car is in the shop , progressive went out to the shop and total my car. Now its taken apart so its owed fees and labor so on . I cannot believe this company .cheap insurance and cheap worker .
My Vehicle was stolen so I reported it. My Claim agent request my Phone and tex Records and Finical records And ask me on a recorded statement about how my day went in Detail ! They make me feel like suspect .WTF .Have been with Progressive 5+years now with no claims and this is how I get treated.

Progressive drug their feet and never went and got my car so the dealership got it and put me down as a repo never paid the claim

This guy is so wrong about everything it becomes incredibly obvious that he just wants to take your money. Do not trust these types of attorneys. They want to help themselves NOT you.
