I think he acknowledged that point. His role on the team seems to be case law research and interpretation and he’s just pointing out the arguments they (the other lawyers) are going to make at trial IF the judge does not dismiss these particular charges. Giving the judge “something to chew on” and he considers their motions to dismiss.
