What good officer are you talking about? The one in the lobby that was texting behind Shawn's back (probably other officers or boss about what the auditor was stating) that same officer kept the next two people that came in in-between the first and second doors and didn't allow them to enter to his desk where you were filming, he got up and stopped them and had them sit on the bench appeared to ask them questions and took notes then went in the authorized only area. Or are you talking about the last guy who came out to speak to Shawn? Because he looked like a scared school child that brought papers in his hands to look busy or have something to fiddle with. I didn't find him to be sincere about your rights but just saying what he thought would come across as being a good cop. But I don't feel he really gave a crap. To top it off they put the lobby officer's desk so close to the door as if to say this is where you have to stop. I know that's now a very small public lobby but you can tell by the set up it's done that way to keep people in less than half of the lobby. Don't anybody go to the left and up four feet and look through the glass. So glad you can film now. Everyone needs to show up at the same time as a group to audit there and all go as one and get their permissions one by one from the court. Then others go and then more till they allow everyone their constitutional rights. If it's constitutional for one then it must be for all. They are desperately trying to cover their bad deeds. By making that lobby now so small and not allowing everyone their rights. And should they ever have been able to have a policy to keep everyone's cell phones when arrested when it's not part of a crime. And should they still legally be doing that without lying about why. I would definitely think it was fine if it was known to have been used in a crime. I would think if they are violating other amendments what is really going to keep them from cloning your phone, accessing your phone without a warrant. I can see them doing that. I mean why else would they take everyone's phone. Could they think it's some kind of determent? Or are they going through your phone to get info on other people. Even their family to see who they talk to and where they go. To come up with other charges or warrants for a later date. I just don't feel that there is just no reason and officers just say we do it to everyone. There's a reason we just don't know what it is. Some people who get their phones back need to immediately access the cloud to see if at any time the phone was in their custody was it activated,was it turned on, how often did it happen and what times it happened and through the cloud see what they were accessing. Because I absolutely don't believe that it's just something they do. What is the reason? What law allows them to take your phone if you're arrested rather than leave it in your vehicle or someone who's with you. Sorry it got long. This comment is only my opinions and thoughts and questions.

Sean is the only one complaining. And in case he is in the right, they don't want to have him file a claim for his irreparable harm. Hence why they suspended the applicability to him. And when they finally come to their senses that those policies are indeed wrong, they will get lifted. But the tirants will probably figure some other reason to put those signs back up after a while.

Everyone is innocent until proven guilty... including the police and their signs. The court basically said "until we make a decision we are not going to force all police to do the thing just because we might decide to make them do the thing in the future, but we will protect the person making the complaint". Perfectly reasonable to a reasonable person.
@jobelche This is a civil matter, there is no presumption of innocence. The court made a determination that police policy is causing imminent harm to Sean by violating his first amendment right to record. Logically, the same determination applies to everyone.
Correct! Simply copy the ruling which should apply to everyone. Much like a "case law" decision. They can't capriciously dispense rulings for one American and not another.

If one member of the People is allowed to record in public places inside the NYPD then all members of the People should be allowed to record in public places inside the NYPD.
You would have to take that up with the judge(s) who gave the order. That's what happens when you're professional, get creative by thinking outside the box and do things the right way. Besides, one is better than none and it's only until the other case is decided.

So, despite there being a law in NYC that says specifically the public can record inside the building, the court says only YOU can record because you won the suit. The law only applies to one person! What has to happen next to give the law to everyone?

A class action civil suit
Sean didn't win the suit. It's still ongoing. Only the appeal was partially ruled. It's still 'prohibited to film' by their policy. But the court didn't want to risk his harm that they suspended it on him.
The problem is the cops want to conduct all the business with the public in the tiny space that they designated a public space.
Behind the doors there's enough room to do cartwheels.

This unfortunately happens all the time. The "reason" is because Sean is the one filing the suit. And the suit is not settled, so he's the only one thats mentioned in the injunction.

It seems very strange that the court singled you out to have a right that is denied to others. The order will not stand long.
It does seem strange but the public is not part of the lawsuit. But LIA is, so the judge only need to consider him, for now.
Sgt. Medina seems unaware that it only applies to LIA. Or they really have changed the policy for everyone regardless of the outcome of the lawsuit.

@@TheBooban This is correct. The court chose a minimal path of only addressing the plaintiffs issue in the stay. This leaves the wider public implementation of the Circuit ruling to be fully briefed and deliberated by the appellate court.
It leads me to believe they are leaning towards removing the stay after a hearing of the case.It obviously can't stay this way once the Circuit rout hears the case. and why I think it won';t stand for long.
This may occur more often but we just don't hear about it.
@@CSmania1991 TheBooban is correct. This is a peculiarity of the appeals process that grants relief only to the petitioner, not a final decision. The final decision will apply to everyone. (Grants relief means is a legal phrase to mean give a petitioner what he wants)

I have watched several auditors that all they do is lip service to filing complaints and do not have the courage to file those legitimate complaints Sean will take it to them with hopes to change things. Not just trying to look like a hero he is one.
