Depositions of Jacksonville Sheriff's Office in Police Brutality Case: Academy Trainer Gabriel Rose

  • At about 2 PM on April 27, 2016, Jacksonville, Florida resident, Mayra Martinez reported to her first day of work at Scores Bar after recently moving from Orlando. She was reportedly fired after being served alcohol (or something else) by fellow Scores employees. Scores called the police and reported her as “trespassing.” She was kicked out without her purse, social security card and other belongings. Police arrived quickly. The events thereafter can only be described as a disturbing series of violations of her civil rights and human rights. This deposition was taken in that civil case.
    I. UNNECESSARY USE OF FORCE (PARKING LOT)
    Rookie police officer Akinyeme Borisade of the Jacksonville Sheriff’s Office reported to the scene. He and a fellow officer pinned Ms. Martinez on the ground and used “ground and pound” techniques on her. It appears the officers also hit or shoved her head into the asphalt. She can be heard screaming from a good Samaritan’s dashcam, “I didn’t do anything.” The arrest report differs from the dashcam, as these officers where not aware of being recorded using unnecessary force.
    II. UNNECESSARY USE OF FORCE (JAIL)
    Ms. Martinez was then transported to the sally port (intake corridor) of the Pre-Trial Detention Facility of Jacksonville Sheriff’s Office by the same officer. Footage depicts her handcuffed and standing around being largely ignored for some time awaiting processing into the jail. At some point she says or does something officer Borisade disagrees with. He approaches her and shoves her into the wall. She reflectively kicks back and he pummels her in the stomach, chest and face, knocking her completely unconscious.
    III. FAILURE OF OFFICERS TO INTERVENE
    Officers have a duty to protect individuals from constitutional violations by fellow officers. Therefore, an officer who witnesses a fellow officer violating an individual’s constitutional rights may be liable to the victim for failing to intervene. You can clearly see this in the above video- apathy, lack of concern, repeatedly failing to intervene or taking over for the officer who clearly had lost his composure. The Blue Line was protected despite clear abuses of power.
    No supervisor ever stepped in or controlled this probationary officer. Sure they terminated him after the incidents, but it was too little, too late.
    IV. FAILURE TO PROVIDE ANY CARE OR CONCERN FOR UNCONSCIOUS VICTIM FOR 15 MINUTES
    Detention and correctional facilities have an obligation to provide adequate medical care to detainees and prisoners. They are in the care, custody and control of the institution, and are unable to seek their medical care elsewhere, as free persons may. As such, considerable time, effort, and expense must be devoted to protecting injured or sick inmates. What you see in the above video is beyond disturbing. Ms. Martinez was left to potentially sustain serious neurological injury, or die, without one person checking her pulse, breathing, whether she would choke or aspirate on her own vomit, etc. She did not move for nearly 15 minutes and no one showed any care or concern about it.
    V. REFUSAL OF HOSPITALIZATION RECOMMENDED BY EMTS BY OFFICER BORISADE
    Once Jacksonville Fire and Rescue were finally called by JSO and arrived, they were given false or a fundamental lack of information. The EMT report indicates officer Borisade only admitted hitting her in the stomach and claims that pain in the stomach was all she complained of. She is clearly unconscious at the time of the incident. The report makes no mention of any head trauma. Making matters worse, the EMT report indicates EMTs repeatedly urged Jacksonville Sheriff’s Office to allow them to take her to a hospital in the ambulance located only a few feet away. However, the very same officer who harmed her was authorized to refuse her further medical treatment or hospitalization “against (the EMT’s) medical advice.” He had no business being in her presence at this point, much less making medical decision on her behalf after committing multiple crimes of battery against her.

    This is one of the most disgusting individuals I've come across in the last 66-plus years. He made it clear that the goal of a cop is to make sure he goes home at the end of his shift when the goal should be to make sure each person he contacts is treated righteously, fairly with their rights honored. This professional thug is teaching other uniformed thugs to use the most extreme force available at hand without going to jail. He doesn't care if he injurs or abuses individuals as long as he doesn't get caught and go to jail. Each cop should SHOULD use the very least amount of force for every person to go home healthy. These uniformed criminals don't have any empathy for the people they meet. This is why they yell, scream, and intimidate everyone they see. Cops are egotistical, sociopathic, and self-centered. They care not about serving or protecting. If they want to be a hero, they would have become a Coast Guard rescue swimmer or a fireman. Cops are a blight upon humanity. It's been proven time, and again, they aren't here to save or serve... not even our kids... not if a cop might get hurt.

    Just because of a trespass from a property, this kind of violence is not justified, the officers should have made every effort to explain the law and the options and in this case she was waiting for a ride, therefore the violent attack by law enforcement was not justified

    She was beaten in:
    1. Parking Lot (by two Male Officers)
    2. Sally Port (by one Male Officer)
    3. Dress Down Room (by a one female officer and SEVERAL MALE OFFICERS).
    Amazing she SURVIVED AT ALL!!!!

    I find the testimony by this training officer disturbing, but explains why we see these actions play out regularly by the rank and file on the news and on personal phones. They are trained that way.......and think it's okay. When they get caught.......look no further than this training officer. He agreed, much of what saw was within policy. There you go.......never dawns on them, its flawed.......they're creating problems where there doesn't need to be one.

      This guy thinks it's ok to use a taser or a baton on a handcuffed individual who's in a highly controlled facility surrounded by dozens of cops, is half his size, because she's kicking at his legs.     This cop is a joke and needs to be fired for trying to cover up clear abuse of power after having time to think about it. Nothing he said in his first interview is consistent. I hate this cop just by his full lack of compassion. I would love to see his view if that was his mom or daughter.

This was horrible from start to finish! just say it and other officers will know they will not be supported in bad, illegal and disgusting behavior. No wonder there are so many bad cops...rarely do they see justice when in a seemingly corrupt department such as this one.

    Wow..... am I watching an officer of the law or a gang member? All of these police affiliates act like they are in some kind of a gang and God forbid if they point a finger or tell the truth. All bold face lairs. Its Unbelievable what they did to that poor woman, it's all right there in front of them on video, and like cowards one after another these officers of LAW came and defended those actions. Utter disgust! I thought we lived in America and upholding law and honor and basic human decency was our core values. Smh.

    So, basically...JSO's training protocol is that... if the subject lays down, places their own hands behind their back, and the officer does not have to exert himself..... then no use of force is needed. Also, when the kick happened....is it reasonable to back away to alienate this act of aggression towards the officer? Or does it GIVE his ego a chance for another strike on this "subject"? Thanks for sharing this. It shows the extent that the Union will go to "cover up" and use Qualified Immunity.

    You know how you can tell when the police are lying when their mouths move.     So it’s the training system that is messed up. They train them to be animals. They get them wild and let them lose among the public. What could have been reasonable was for the officer to walk away from the handcuffed suspect instead of striking them.

    There was no proper technique used here‼️ JSO fired himfor some reason. This is the reason why police officers overstepped her boundaries and brutalize citizens because of training instructors like this man here. And the reason why the city is always being sued. Also, This man is straddling the fence between his JSO and the lawsuit. And I watched the video several times in the sallyport and I did not see her kick his groaning. Why was he that close to her in the the beginning in the sallyport. Also why can't the police officer be the better person and just back away from her when she tried to kick him. How about the police officer reframing from getting angry himself?? How about some humanity and compassionate towards her because she just lost her job and just move there. It is true, it's surprising that she even survived. And he said it doesn't matter if it male or female..that's a bunch of BS and needs to change. Did it take five men and one woman in the dressing room to contain her. What was your 110 lb. Guess what buddy she won the lawsuit so something was wrong here and not done correctly. Police officers are nothing but legalized City gangs. And qualified immunity needs to be abolished immediately ‼️‼️

I think the cop has it in his head that when they say you are under arrest, even a heavy breath from you can be resisting. I would guess that the training officer has reinforced the fact that the officers can do ANY thing they think they need to do so that they don’t get hurt

    It seems a bit fishy, when all the depositions given in this case are sort of none committal and all keep looking at their lawyer as though seeking an answer to see just how far they can go with their lies to protect one of their own. This trainer is admitting that a combat trained officer is incapable of controlling one irate, pissed up, skinny woman without the need to physically abuse her. I've not got to the part yet about when Borisade lost the plot at the sally point, and struck this woman in the face several times, full force with a closed fist, but I've an idea that this trainer will be full of bullshit with his answers and claim the beating was justified. Despicable, the lot of them. They obviously have no shame and should not be serving the public in any capacity. It's strange that the comments on here all agree that the evidence given in all depositions has been full of lies in an attempt to protect one of their own. How can the public see what really happened and the police cronies can't. How many bad apples does it take before the barrel starts to stink to high heaven and has to be discarded ?.

    I wonder how 'right' it would be to beat a person into submission because they resisted in the slightest degree if the person being beaten was his mother, father, wife, daughter. Would it be perfectly okay to put someone in the hospital if it was HIS family. Or would he expect there to be understanding... we're talking about these trained thugs beating free Americans, not enemy combatants

    Strikes never are used to put people in cuffs. Subduing and manipulating arms help to cuff an individual. These strikes are punishment which are equivalent to assault.

    25:40 It appears the lawyer makes a mistake where he asks the detective what the totality of circumstanses were for Borasadi to allow him to strike the plaantif 14 times.
    The detective replies she was kicking, and struggling. When she finally was put in cuffs all punches stopped. Sounds good for the defense. However, whn the woman is at the Jail waiting to be processes, Borasadi punches her while she is in cuffs. GOTCHA

      I disagree. If that were true, would that mean he could punch her 30 times and the handcuff her? 50? He didn’t need to punch her at all in order to get the cuffs on. Just because he decided to stop punching at 14 before applying the cuffs does not mean he needed to punch her 14 times to get the cuffs on. Two men should be able to subdue a small woman and place her in cuffs without punching her at ALL, never mind 14 times. Just because he was able to stop her resistance by beating her doesn’t mean that was the only way to do it. The prevaricator being deposed actually states that himself when referring to the sally port assault.

And i read policy about moment in waiting area there is no rule that states she couldnt move freely around no line nothing she was in her every right to move around PERIOD.

    So officer, is it considered by the training you yourself provide....that after having an Officer attempt or in fact does slam a suspects head onto concretel....if the person having their head slammed into the concrete, attempts to protect their head by using their own hands to cover up....is that considered resisting?
    Is the person having their head slammed into concrete resisting because they will not allow a use of force that you have already stated was not within policy or training?
    Is any actions or movements by a Citizen who is trying g to prevent unnecessary and unlawful force against them by the officers you trained considered resisting?
    Do you train officers what is the difference between a subject trying to prevent unlawful, unnecessary or excessive force used against them, and what is resisting the officers attempt to legally put handcuffs on?
    If punching a handcuffed subject 3 times is not within training or policy, are the punches not in compliance with such training or policy, considered an assault or is it considered a workplace violation?
    When does an use of force, not in compliance with policy or training become more then a workplace violation?
    If while off duty a citizen punches you or another officer, is that considered assault, or can the citizens employer just consider it a workplace violation?
    While in your capacity as an instructor who is looking into an use of force incident by the request of internal affairs, you are unbiased, correct?
    How many uses of force have you given an opinion on for internal affairs? All unbiased, correct?
    How many use of force incidents have you found the Officer did infact use excessive force?
    What percentage of incidents have you found the officers did use excessive force?
    Are you finding in 10 percent or in 90 percent of incidents the officers use of force was excessive?
    While training officers in the use of force, are these classes hands on? Is force used against the trainee?
    How many trainees had their head slammed into the ground?
    How many were punched in the head between 12 and 14 times?
    How many had a baton used against them while handcuffed or not handcuffed?
    How many trainees in your class have needed to go to the hospital for injuries sustained in your class?
    How many broken noses?
    How many broken bones?
    So infact, during the classes you trained , it's a rarity that an Officer is infact injured?
    How can that be?
    Are all the trainees not using the same force to get their training partner to comply, as they use on citizens?
    In short go after the fact that if during training....this PIG did any of this....he would be immediately fired.

    Let's get one thing straight. When this guy is talking about the assault on the woman in the sally port as being reasonable to get her into handcuffS, SHE WAS ALREADY IN HANDCUFFS WHEN SHE GOT DRAGGED OUT OF THE POLICE CAR,. AND BORESADE SLAMMED HER UP AGAINST THE CAR, THREW HER TO THE GROUND, KNELT ON HER BACK AND PUNCHED HER UNCONCIOUS. BORESADE IS AN RABID ANIMAL AND NEEDS TO BE GIVEN A TASTE OF WHAT HE DISHED OUT. HE NEEDS TO BE PUT IN A CAGE.

    In the parking lot video we never hear the officers tell the suspect to place her hands behind her back. Yes, they might've told her to comply before the video began. Yet they hit and slammed her head so many times, her body went into pain avoidance mode. All she knew was to deflect the pain in any way possible...

    Why has nobody asked...If he knew her arm was under her face, then why would she comply when, 'but for her arm' her head wpuld've been pushed to the ground had she complied.
    That's one of the main types of things maby complain about. They really beating your ass when swarmed because yhey know all cam angles are blocked...so they yell anything to excuse away any strike when not warented.
    Screaming stop resisting to some who were unconcious and only still moving because of strikes from other cops.
    1 ofc on each arm. Ofc. 1 Yelling give me your arm
    2nd Ofc yelling.
    Give him your arm.
    Subj. Is getting pummelled by other officers who dogpile yelling.

    Like all teachers in teaching have to be taught through books, it's very disturbing to know that a dog catcher can't display abuse in catching animals which is taught through their books, but it appears to be ok for a human to be treated in a inhumane manner in being arrested ‼️‼️ WTH ⁉️
