As for the non-compete, that is usually to stop you poaching customers or staff, it doesn't usually apply to speaking to family members who happen to work at the same company. That is insanity.
When I worked for Cold Stone Creamery in high school, they had me sign an agreement that I wouldn't work for any of their competitors (guessing they meant "Basket Robbins") for 3 years after my employment ended with them. I guess having that in a contract isn't that unheard of. However, having it state you can no longer talk to friends & family still associated with the company is truly unhinged.
I've heard of similar things but that seems nuts. Were you going to share ice cream secrets? I guess I should look at what my job has. I'm a scientist and I work for a government agency so anything that I create or write during my time with them belongs to them. I don't create or do any research at this point in time so that's neither here nor there. I can't remember if there is a limitation to my working for a particular company or industry if I were to leave them.

Can’t believe I missed this one! I’m a lawyer and agree with your reaction to these completely! I read both the complaint and cc, and these counterclaims just read like retaliation. And despite being “almost indicted,” they hired him anyway?? Did they want an almost felon? If he was doing some of the things they allege, they would’ve fired him (which they apparently did but they somehow kept him on anyway to be nice?). Both sides are clowns and it’s hard to even determine who is the…clowniest? 🤦♀️ If the family delegated like everything to the almost felon, then I don’t feel sorry for them (and wouldn’t regardless)

FYI - The Federal Trade Commission recently issued a ruling banning noncompetes.
Per the Ruling: “Existing noncompetes for senior executives - who represent less than 0.75% of workers - can remain in force under the FTC’s final rule, but employers are banned from entering into or attempting to enforce any new noncompetes, even if they involve senior executives. Employers will be required to provide notice to workers other than senior executives who are bound by an existing noncompete that they will not be enforcing any noncompetes against them.”
Stubert would be at the level where the non compete would still be enforceable. Unfortunately

The conmissions structure has definately changed. Jay (toni v's husband) said it last week. They used to pay out "50c to the dollar", but when he asked corporate at a high level meeting they told him that "hasn't happened for years". They now pay out in the "high 40's (%)".
All easily debunked with a few minutes of checking documentation.

@@nony_mation Yeah, they do. There are many factors to consider when deciding whether or not to settle. Ongoing legal fees are a big one. Going to trial is hella expensive and there isn’t a guarantee it will go your way. So the question becomes, do I take/pay this guaranteed amount of money and be done with the whole thing, or do I take the chance that I’ll lose in court? Mediators and lawyers can be very compelling.
Had this man quite literally running their company but somehow also believed he was sabotaging them for several years?? Talking about we gave him second chances. Now how does that make sense 😐

a couple things i find really interesting about stuart’s lawsuit:
- he has to inevitably tell on himself and he probably weighed the risk of having his name and work dragged through the mud and some of his own alleged mishandling of things (if true) brought to light. he could have quietly moved on with his life but i think it’s really telling that he risked all of this to sue and bring this to light.
- he is asking for trial by jury which i am told is hard to win without hard and fast evidence
- stuart knows firsthand about MONAT’s legal team and he has watched MONAT win defamation suits against other people so he has got to be pretty sure that he can win this.
- his lawyer is crazy expensive
all that to say, he had to weigh a lot and probably thinks he has a shot against the MONAT. cheers to MONAT hopefully getting justice (and also can’t wait for toni’s lawsuit to drop)

My sister works in HR for a tech company and had to sign a non compete for two years after quitting to not work for another tech Co. Noncompetes are wild. I get it if you're in manufacturing or actually working with tech. But HR in tech? Nahhhh. 😂
