      Her argument is moot because the act violated fundamental rights. she is trying to argue on behalf of a certain groups rights being infringed upon (people of faith having difficulties getting exemptions based on their religious beliefs), when the entirety of the mandates were unlawful, making the argument moot.
      shes arguing that certain Canadians had a difficult time getting an exemption for an illegal mandate which she believes is an infringement on their rights.
      Its not an infringement, it was illegal all together, which makes her argument a waste of time.
      Moot.

      What was even more disgusting as a country is, they discarded Canadian citizens stranded elsewhere in yhe world to suffer without any help to get them back, even third world countries had the regard for their citizens ti bring them back home. On top of it they forced people to pay $1200+ to self - jail themselves in a 3/4 star hotel @ 4 times the regular prices. Yakk about Communism, this is another level.

Look at how easily all citizens around the world gave up their freedoms and got in line, not once ,not twice but 3 or more times because they were told too.     I refused vaccine and ended up being trapped in NewBrunswick during mandates. Not only was my Prime Minister spewing hate at me , making my fellow citizens against me...i was also living with a very angry soul. I am trting to get tgrough the hatred i feel for tgose who condemed free will. 😢😢😢

      I am now convinced that we need to have two “societies.” One for people who like big government & believe it’s the government’s job to look after them & the other who believes in small or minimal government & believes in the free market. Some people are perfectly OK with their rights being trampled because they fully trust the government & believe they must be doing for a reason. That’s MESSED UP IMO but I truly believe that as long as we live in a free country (LOL) they should have that right but so should we have the right to NOT have our rights trampled as long as we are not breaking the law. Of course I see the attempts to change the law so that “trampling” our rights IS the government’s right. MESSED UP!!!

    “ Moot due to the Emergency act is no longer in effect”??? Any violation of our rights and freedoms supposedly guaranteed in our Charter should NEVER be considered “moot”! Whether or not the circumstances have changed! When I first that some court had declared a violation of rights was declared”moot” and dismissed in another province, I thought that was wrong and was a further violation of our rights and freedoms. I still think so and that some our judges are compromised by their political ideals, just as our government has been for the last 9+ years by Justin Trudeau’s activistic ideology. A violation of our rights and freedoms should ALWAYS take precedence, no matter what the circumstances on the political scene, and never be dismissed out of hand by ANY judge.

    I hate when judges argue that something has ended, so to litigate over it is pointless, aka moot.
    Can I use that defence in a criminal trial and argue the crime has already been committed, so to jail me is a moot action?

      The Notwithstanding clause says different. In fact Section 1 of the Charter, the very first section, states the government can revoke any right it so chooses as long as it can justify it. To whom it must be justified is unclear.

      Restored? Nothing changed. Section 1 was there from day one and it is necessary to deal with conflicting rights.
      Despite all the belly aching, no rights were removed or permanently modified. There were temporary restrictions due to a pandemic. Nothing more, nothing less.

      BC borders may have been open, all
      Except the airports...I couldn't return home for not months, but years, literally, because no-one could enter or leave BC without having the vx. My doctor strongly advised me not ​to get the vx, due to specific health conditions,
      and to sit it out instead. It took a very long time - nearly 3 years, before entry was again possible.

      I was trapped in NB 😢 I moved there oct 2019 to start a new adventure after raising kids. Sold everything and drove across Canada 🇨🇦 4 months later covid hit . I refused vaccine which trapped me. At least that's how I feel 😢

    I really hope this is won. I cannot believe how easily our populous fell in line and asked zero questions after these awful measures. Okay, give freedom to authority in scary times, unwise, but I can understand. However, where is the pressure to look back with critical, humility and demand answers so we don’t repeat this. Over half of Canada completely complicit with corporate greed and government corruption like we’ve never seen.

    As a Canadian, I can honestly say, "JUST TRY AND STOP ME FROM TRAVELLING ANYWHERE I WANT TO WITHIN THE CANADIAN BORDERS!" Canada is the most free country in the world. Try pushing your own political views onto me and see where that gets you. Our forefathers fought, and some died, so that we could be free. If you disagree, go back to whatever close-minded country you came from. This is OUR country. We will remain free, even if we have to take back the country and run it ourselves. Who needs a corrupt government anyway? We can run a much better democratic government ran by people, not politicians. They seem to only be interested in what the country can do for THEM instead of the other way around. Time for change I guess!

That's why I decided that if Pierre P cannot, or does not, make the necessary changes to our political, judicial and education systems, I will form a new party with people like you and I who believe that Canada doesn't need a politicial-ran government, it needs a people/citizen ran government. One ran by the people, for the people, representing only the people and not the individual politician's best interests. We have a political system only because it was handed down to us. That doesn't mean we have to endure a painfully bad and outdated system - we have the ability to change it accordingly, and change is absolutely necessary. The one thing Trudeau has done good was prove just how bad our system is, how easily corrupted it is, and how power can be abused. We must make changes, no, scrap the old one altogether and create a new one. One that fits our modern time. There is no reason why, in this modern day and age, we cannot create a system where all citizens get to cast their vote and let their voices and opinions be heard DIRECTLY through secure polls done on a newly developed political platform, which would be created with the best encryption and safety protocols on the planet. Right now the government does have a safe system, so safe in fact, that once you forget your password you can never get back in... That's another issue altogether... This system would allow us to cut the number of MPs on the citizens' dime to a minimal number of crucial Minister positions to run the country, however they would be acting according to the majority of Canadians' wishes, not whatever the "party" decided. There will be many opposed to "electronic" voting, claiming it can be tampered with, but I say no, if it is properly programmed and monitored, independently checked and verified to be uncrackable, then it is far safer than paper voting, and especially more accurate than electing MPs who only vote according to their leader's wishes, not the people they are representing! If 80% of Canadians want an election now, why are 60% of MPs voting against a motion of non-confidence? Because they are listening to and voting according to the PM, not those that elected them. Why do you think they are being replaced in byelections? Because if you won't represent us, we will replace you But this is slow and antiquated. We should be able to have immediate responses and action, which would happen with the new E-Politics system I would have developed. Hopefully there are enough ticked off Canadians who agree and woud love to join this new party, should it become necessary. Go Pierre, do us good!     I watched as my Constitutional Rights of security of person, right of assembly, right to travel, right to religious freedom, right to safety and security of person all considered "moot" by our Federal government. Not a single word from our politicians, police, medical officers, lawyers, judges, attorney generals. They all stood by and watched, complied, and continued to get a paycheck.
    How many Canadians lost their jobs ? Their livelihood? Corporations all remained opened. Mom and pop shops were decimated. How many Canadians "coerced" into taking the jab by all levels of government and businesses. Where were the feminists screeching "My body: My choice" ? Their collective silence was defeaning.
    How many Canadians were denied access to health care because of "jab status". Father's who couldn't be there to see the birth of their children. Husbands and wives sitting in parking lots as their loved ones were alone, many dying in hospitals. How many of those suffering demetia only got worse as they were held hostage by "the system". Our children in school are still suffering silently. Another hostage taken by "the system"
    I watched in shock and awe as 1/3 of Canadians, watched, another 1/3 of Canadians, go full arthoritarian on the remaining 1/3. Pure Cult of Personality and Psychosis in action.
    I had no idea how many of my countrymen preferred their chains to freedom. I had no idea how many Canadians sold their freedoms for "travel-vacations", "going to restaurants", etc.
    The Trucker Convoy: not a single policitian stood in line against the police on that final day. Not one. Not a judge. Not a lawyer. Not a doctor. Not a teacher. Not a professor. Not a single member of the damned "elites". Not single attempt at negotiation.
    A great crime was committed in this country. I will never forget. I will never forgive.

    Mobility simpliciter can be inferred from the absence of the need for any travel documents within Canada and the existence of a Canadian passport, rather than a provincial one. Canada is a country, not an EU and a single nation not a Shengen zone. I agree with your reading of the French version, the use of deplacer vs demenager is relevant and correct. I would also argue that it would be reasonable to require mitigating actions in cases of an epidemic or other emergency but not an outright ban on travel, unless the emergency is something like a forest fire. Even in that case is the restraint of a damn fool reasonable?

    This case is very important to me. During the pandemic, I had ongoing litigation in Ontario, but was unable to travel there from Nova Scotia. As it turned out, my lawyer has worked so unbelievably slowly, that my case has made little progress 😢. During the pandemic, a friend of mine in Nova Scotia was prevented from being with her disabled son in New Brunswick when he underwent a serious surgery. Fortunately it turned out well, but she suffered a lot of worry and still feels guilty that she could not be there for him. Thank you for your efforts in challenging government over reach.

    That's funny because the workers compensation board of British Columbia had no problem sending me to medical appointments in the Lower Mainland and Kelowna... During lockdown... there was sometimes on Highway 97 where I was the only one driving for 100 km.. yeah just me and the RC...

    This case highlights why I have lost all respect for our judges. Every time we needed them to stand up for OUR RIGHTS during covid, what did we see? They deferred to the gov'ts wish. Absolutely disgusting, either we have democratic Rights and Freedoms as per our constitution or we don't.

    I was stranded in the Phillippines for 2 years during covid because the govt wanted me to quarantine in hotel at the cost of $300 to $400 a day for 14 days which I didn't want to pay this since my brother lived 1 kilometer from the Vancouver airport, where I could quarintine for free. It cost me at least $1500 a month to stay. in the Philippines. This is when I learned to hate my govt, I don't want to hate my country. What is so stupid about this is they were telling people traveling to return to Canada. Also both me and my brother had all our covid shots plus the booster shots.

    In July 2021 I wanted to visit my 2 grandchildren in Ottawa. I could not fly without vax proof, so decided to drive, Van - Ottawa, but Manitoba had closed it's borders and driving into the US would not be an option. Very reluctantly I did get the 2 jabs, bought a ticket to fly but when I boarded, no one asked to see any vax proof either in Van or Ottawa. It was clear to me that this was control and had nothing to do with health

    When i traveled to PEI during that time, i was AGAST that i needed a 'travel passport' to enter the province. I had to apply online and reveived it from the Provincial government.
    I then needed a nose swab before being let past the checkpoint. To add insult to injury, we were free to go after the test, without knowing the results, they said they would call me if I was positive to ask me to self quarantine.
    I asked the medic, ok, lets just say i am positive and i go right from here to a busy public place and interact with people.... you've essentially allowed me to leave a testimg area and possibly infect an unknown number of people before you phone me.
    Just absolutely clown world.

    I guess the supreme court will rule if the charter rights are rights or just privileges. We are only as free as we think we are. Think of it as we are in a cage which is really a vice. As our rights are whittled away or new laws enacted is another turn of the vice. Years down the road as the cage or vice gets smaller you are crushed. Thankyou for keeping up the good fight.

    French Canadian here with a little background in Law ( two years and 61 credits done in Montreal university) I can say easily that ´´se déplacer et déménager ´ are not the same at all as Christine said it with her nice English accent 😊. Deplorable or déplorable have the same meaning in both languages and what have done the province of Terre-Neuve is disgusting as the others provinces too.
    Ok we have the law but if we cannot count on judges anymore I predict to you that there will be blood!
