I am excited because I recently reached out to your firm. I have a 2023 Grand Jeep Cherokee 4Xe. It’s been in the service department for transmission issues for over 30 days and Stellantis denied my buy back request. Prior to the 30 days it’s been to the shop 3 times for screen freezing.
Please help me.. I’m paying for an expensive car that I’m not even driving.

We would love to! And always feel free to connect with us by calling 818-784-0100. There are some new rules on civil penalties as of 2025, but we are quite familiar with them.

Can’t find a straight forward answer to this, maybe you can help. In a buy back settlement, do I get taxed on the amount they send a check for ? Or what do I get taxed on if I get taxed ? I appreciate you help

@@andrewmistone2461 great question that really only a CPA or tax professional can answer. The reason you’re likely not finding a clear answer is our ethical rules prevent us from giving advice outside of our competency/specialty. I do know that FCA (Dodge, Chrysler, etc.) like to claim the settlement is taxable.

How do you find out if your attorney got the civil penalties but did not tell you, I was told that I get the Downstream payment and payments only

Well the amount you recover in your case should help to understand if CPs were recovered. We usually first calculate for our client's how much their "straight" repurchase is worth (meaning, with all the applicable deductions and without CPs), and any amount in excess of that is by definition a civil penalty.

are we entitled of civil penalty if the manufacturer is offering a buy back?

@@iammcmags6557 the answer will depend on your state, but if the offer was made in a timely manner and calculated correctly, then most likely not. I think of the cell penalties as a punishment for when the manufacturer does not do the right thing or takes too long.

    Do you practice in Texas?

Unfortunately only in California for now. But there should be some attorneys out there with decent reviews! Get a couple consultations to find the best fit.
