Do the math! The answer is good trademark attorneys make $400-$500 an hour and there is 10 hours of work in getting a trademark, while the $69 - $200 filing ONLY companies are totally negligent because they are giving the guise of professional help, without the ethics of informing people they NEED a COMPREHENSIVE SEARCH before ever filing a trademark because the USPTO does not check beyond it's own database of 2 million marks in the USA, NOT any research of the 14 million State trademark and common law uses out there that can simply oppose your mark, immediately or up to 6 years after you start use. Those companies are ready to sell you more "packages" for USPTO refusals - 39%, or cease & desist orders - because they were too busy selling you a bill of goods that should never had been sold. They should know better, but they care so much more for their immediate sales, rather than all the $ you are going to lose in changing the name of your service or product. A great way to save $ is to hire a trademark attorney to file your trademark AFTER using a specialty firm like us to do the needed $400 COMPREHENSIVE SEARCH that takes 5-6 hours to catch if a proposed trade name may be infringing on anyone else's prior trademark at the USPTO or any of the 50 States or under Common Law where companies have rights if they are using the same or LIKE name in sound, appearance or meaning even just 1 day before you in commerce. This is a very specialized task and needs a trademark attorney to analyze any resulting conflicts or similarities. IF clear, and you have the funds - get the trademark - as you should if advertising on Amazon. Own the name. No surprises later. What you build you keep. IF you do not have the $275 to file a trademark application, then wait. Test the market. If all goes well, THEN trademark. If not, you spent $400. Cheap.

I have designed about 60 tartan designs over the course of 12 years. Those designs have technical data attached to them, thread count and color pallet, etc.. I'm torn on the proper protection for each pattern. Do I use a copywrite, a trademark or a patent? I want to weave each of my original tartans.

If a small business does not have a trademark, can I use a name similar to theirs? Like I've been planning this business for a year and I got the email and social media names but have been trying to make money to get it started.

If the logo contains only the name (no images, icons etc), just stylized fonts, would trademarking just the business name protect the logo as well since it's all encompassing (for lack of better words)?
Yes! That’s exactly right. It’s still ideal to register the logo to protect the design as well but the name is usually top priority.

I have a question. If i am starting 2 different businesses can they both be under 1 LLC or do i have to have 2 LLC's??? I currently have a handyman business and i also have a music studio.
You certainly do not HAVE to form two LLCs (you don't HAVE to form one in the first place) but it may be a good idea to operate the two businesses in separate entities for liability purposes. If you operate both under one LLC they will share each other's liability.
Sharing liability is a big risk I personally would never feel comfortable with. In business, you never know what can happen. That's why you see a lot of the bigger companies with a huge legal entity structure with many LLC's and Inc.'s, etc. For tax and accounting purposes it's easy to use intercompany accounting to lessen the burden from an accounting standpoint, but that separation is a smart business practice.

Hi I’m starting a online clothing line which will eventually become my store. I have two questions.Should a get the name of the story llc or copyright, also I will be using a name for the clothes; example Gucci is the name of the clothing but also the store name. Regarding design elements, if I include a specific font AND a custom icon within the logo, is the custom icon protected by itself as well? For example, if you have the name UA-cam and the UA-cam logo in the same design, are the name and logo protected individually? Or, if they are created separately, can they be used together, or will that need a third trademark?

IF you filed an intent-to-use trademark, then you can cancel the one class you no longer want, when you do your statement-of-use for your other classes. IF you have a live application, then you'd have to provide a specimen of use, when applying for a trademark. So, if you are not in business yet, for that class, then you won't be filing anyway.
Okay what if you get a standard/text trademark and then find out there’s another business using the name with other words ? Like say your trademark name is Byght an there’s a business with the name Byght Art .... what do you do in that case?

Thank you for your video on the difference between TM, ©️and patent I viewed in another video. What would you apply to an IPhone app you created? An app seems like an invention so I’m leaning towards the patent but I wanted to know know your view because the app has a name that needs protection and the app has a function it provides that also need protection so I’m not sure if it needs one form of protection or two. What do you think?
All of them could apply. You could potentially patent the app itself, trademark the name/logo of the app, and copyright some of the visual design of the app. Each one serves a different function and protects different elements and they are not mutually exclusive.

It depends!! It's better than if they're in the same field, but it doesn't mean you're in the clear.
