Excellent video, straight to the point and I appreciate how you broke down the different ffl numbers. Living in California, I am looking into trying to apply for a ffl because of how tedious it has become to purchase ammo, not to mention expensive and with no ffl dealers nearby, I figured why not try and learn the process and save money on some fees as well. Based on the video, in order to obtain ammo/firearms for myself, I'd want a ffl 1, but the ffl 3 you mentioned about being a collector is intriguing so I'll look into that as well since I am mainly interested in doing it for myself and not selling to others including friends or family in order to keep my life simple.
Yeah, it would definitely make your life easier, but do keep in mind that by having an FFL the government wants you to be in the business of firearms for the given FFL (selling/buying). They don't like to give FFLs for personal use. Although they are pretty lose on how much business you are doing on an annual basis. Also I am sure they are TONs of other restrictions in CA, so make sure to follow all local laws, or move. Good luck!
Start an LLC if you’re required to have a business, it’s really simple and only costs like 100 bucks. Don’t even need a store front just a licensed business as an entity.
Glad to finally know what this is about. I just wanted to sell an old gun I bought from a gun store in California in 1996. Been in my safe for years. Never used. Of course the dealer is now gone. Stupidly I sent it to a gun dealer in Florida. They offered $406. When they received gun, they changed offer to $106 - minus shipping, stating that the cylinder yoke was bent. I asked for it back or I would have had to PAY them to keep the gun. I am elderly and on Hospice, so unable to leave the house. Was really worried about how I was going to get this FFL license to be able to get the Florida dealer to send the gun back or to whoever has the FFL license or to get the gun fixed or to sell it... or even keep it. I guess I'm supposed to send the Florida Dealer A COPY of the FFL license from here before they will send the GUN TO whoever has the license here. I'm totally confused. So I'm a woman who who does not to want to try to figure this out. I don't want an FFL license.
You don't need an FFL yourself, but they will have to ship it to an FFL near you. You can find an FFL near you that does transfers using this link: www.gunbroker.com/ffl/index However after looking real quick it looks like the FFLs in CA charge a TON for transfers. Here in Utah/Idaho it is typically $10-20 for an FFL transfer, but there in CA it looks to be ~$100. Good luck. I hope you get it figured all out. I’m interested in getting an 06 FFL. I’m afraid my work may lay me off with all this vaccine mandate stuff up in the air. So, if I do it, it’ll be a major source of income. Wondering how that’d work... I also heard the ATF inspects your house or address of the FFL. I don’t have anything to hide, but having an agent in my house gives me an uneasy feeling...
If you live in a free state then it is pretty easy to get. But yes you will have an agent come to your house and talk to you in person. When they came to mine they didn't really do an "inspection" it was more just to talk to me to see if I was competent and make sure I don't accidently break any laws down the road. You will also have to make sure your city is cool with you being an ammo "manufacturer." The small city where I live was super chill. Also keep in mind once you have your FFL the ATF reserves the right to come inspect your facility/home whenever the heck they want. They don't have the man power to do regular inspections especially of 06 FFLs. But that may be a deal breaker for some.
An 01 is for selling firearms. If you want to make them you will need an 02. And if you are doing business with the federal government and full auto stuff you will need a Class 02 SOT to go with it. All of which is a pain to get. But good luck.

Mine was shorter, only like 45min. But if you are getting an 01 or 07 it is longer. In that case they go over a TON of laws, regulations, and how to do your stuff so you don't end up in prison.
After the Jan 1st 2024 our only two FFL:s in the county called it quits. Newsom created more rules and regulations that make it a total nightmare. So now we have to make a 4 hour round trip for deposit then come back 10 days later for pickup. If they don't have the firearm in stock tack on a 3rd trip. Between the taxes, fuel and time it makes it almost as expensive as the purchase sometimes.. It really sucks..

Thanks for putting this out. I have a simple question. I am shopping for a long gun and would like to buy from whoever gives me the best deal, so that means shopping on the net. If I choose an unknown FFL dealer nearby, is there a chance that I won't get my gun? Or scammed out of my purchase? Is that a consideration? Or will the ATF crack down on them if they don't give me my gun? Or do I just go to small claims court? Wondering how often FFL dealers scam consumers, if at all. Thanks
The ATF doesn't take kindly to lost guns. And those who have FFLs have under gone some background checks. Not to say you couldn't get screwed, but It is un-likely. However if it is a small home based FFL I would call or even visit in person first to let them know you are shipping a firearm to them.
Hi there I’m from Texas I live in my parent house can I stillhave a ffl type 01 base home I have a little room that’s were I store my safe. I am a huge colt fan guy. I have buy a few guns from Colt new model to my collection but now I start it to sell it and buy old colts. For investment but some time it’s get hard I have to pay bills and sell one and in four give months I save little cash to buy the same model. But when I sell I go to gun shop to do ffl transfer. So long as you parents are OK with you having the FFL, it shouldn't be an issue. Although you must be older then 21. If you are older then 21, and your parents are OK with it then you are good to go. Just make sure you follow all local laws.
As far as I know there have been no major changes to the FFL process, however they do have a zero tolerance policy so if you make a mistake in your records they can pull your FFL. They also are likely more subjectively strict when considering applications. But I don't have any data for that. They have also made a few updates to the 4473.
You can get an FFL without being a gun owner, however I would recommend getting some firearms and leaning a lot about them before getting an FFL. As for a CFLC, do you mean a California Firearms License, you should be able to get one so long as you can pass a background check and fill out all the paper work.

I actually already have a business license but it’s for a construction business. So you’re telling me for New York State I don’t even need to have a business license to have a type 01 ? Wither or not you need a business licenses is more of a local thing, so I can't give you a 100% for sure answer. But you will very likely need a business license for it. If you can some how make it a part of your current business then great. Although you may want to separate them for liability and legal purposes.
Then you need 3 FFLS Firearms: 01 Ammo: 06 Explosives (destructive devices): 09 (Expensive) Although it depends on the types of explosives you want to sell. If it is just Tannerite I don't think you even need an FFL, although there may be another license you need for it.

No, there isn't anything specific. Most of the "interview" will be teaching you how not to end up in jail and how to obey all the laws. They may ask about storage and security, and local laws may vary.
So if youre wanting to get your FFL to eventually start a business but its kind of a pipe dream and something that would take several years to actually get started. Do you just need a business name and/or LLC? Or do you have to have an address and be able to prove the actual business.
You don't even need a business to get started, although many localities will require it if you are doing a significant number of transactions. My FFL is just in my name and not under a business because I don't actually do many FFL activities very often.
For the FFL side it won't matter and I don't imagine that the military would really have any issues with it but you may need to double check. The only issue you may have is that if you move around the government is pretty strict about having accurate addresses and it is a pain to have to move your FFL address.

Storage requirements are mostly state level rather than federal. They just have to be secured. Although they do recommend a safe and if you didn't have one it would likely be a red flag when they come chat with you about your FFL. Background checks are done through the DOJ. There are TONs of different local laws if you live in a blue state so you will want to look that up. You have to have a bound book for acquisitions and dispositions and they will walk you through the whole process when you get your FFL. Wholesaler difficulty varies depending on the wholesaler, some have minimum purchase reqs that are kind of high.

I’d like to start a home based class 7 but I’m worried about the home based part. I don’t want people showing up unannounced picking up firearms that they randomly had sent to me. Co workers have suggested building a shop and making it a half address but that’s $$$$$. My garage would be perfect (that’s where my lathe and most tooling is) but again, hesitant to make that my “office”. Any suggestions?
I would go ahead and get it based out of your home as that is the cheapest. The average person won't know you have an FFL and therefor won't know to send stuff to you. Even if you advertise as a firearms dealer you are not obligated to do firearms transfers. If somebody ships something to you without your consent you can send it back, or charge them a small fee for the transfer. My local FFL charges $20 for the first item and $5 for each after that in addition to any background check fees. Great question!

I checked the ATF forms they have up as of today: it's just a 2x2 photo. You can get these done at Costco and other stores. This was also done for my CFP. There is no passport exclusive photo style per se; just that 2x2 are far more often used for passports and the term is common. EZ PZ.
How do I find out who the chief law enforcement officer is in my area. You have to give them a copy of the application when you mail everything in? Did you do that? You didn’t mention that in video.
Honestly there are lot of CLEOs over your specific area. For example you could reach out to a state level officer or local officer. What I did is a local police chief because he is my local CLEO, and he is more familiar with the city, it's people, and the laws. So search your city, state and the chief of police. It should come right up. If you live in a small town without its own police force, then search for you county sheriff.
To become a manufacturer, from scratch, and a tester, that's 2 different types of ffl right. Then what.... Are we supposed to destroy said item? Or do we need another ffl IF we were to do anything with item/s?
Manufacture is 07, not sure what you mean by tester. If you manufacture firearms you are more then welcome to test what you manufacture. Firearms are supposed to be tested.
You can do it from your home, mine is a home based FFL, and I don't even have an LLC. Granted I don't really sell much at all it is mostly for family and friends. If you wanted to sell stuff you should set up a business even if the business is based out off your home.
Like an 03 SOT for full auto stuff? They don't really have a "collector" version for full automatic guns. The Collector FFL (03) is only good for "curios and relics" (ua-cam.com/video/8bO6knp--mA/v-deo.htmlsi=NcM07SsI9VZZ2I1M) essentially guns that are 50+ years old. So essentially it won't include any post 1986 machine guns anyway. So in any case just get a transferable machine gun and don't worry about getting an FFL and a SOT because they don't make them for collectors anyway. To just buy and sell ammo that you DON'T manufacture you don't need an FFL. Although there are federal laws preventing the sale ammo to minors, and there may be other state laws. But if you manufacture and sell the ammo then you need on 06 FFL.

It was quite a while ago and I only got the 06 so I could sell my cast bullets. The ATF agent didn't ask me any technical questions. But she did say that if I was getting an 07 the interview would have been a lot more instruction on how to document everything and the laws that FFLs have to follow.
Yes it can, but you have to do it exactly correct and if you mess it up, or if a fingerprint is not acceptable then your application will get denied and you have to start all over again. I am not sure where you live, but almost every police station will offer a cheap fingerprinting service that are often electronic and help you avoid getting your fingers messy and make sure everything is done well.

Depending on the FFL it is anywhere from $30 to $300, but you HAVE TO be engaged in the business of selling firearms. The ATF won't approve an FFL for personal use. So for hobbyists the drawbacks almost always outweigh the benefits.
Are there any annual renewal rules/regulations or trainings/applications? I was a small arms/artillery repair in the Army and I've always considered getting my FFL. If i plan to make transfers and "deal' firearms, but also gunsmith, would a type 01 work for both or would i need two separate? And as another question, what is the difference between FFL and FDLC? Would I need both? Or are they the same thing?
Yes the 01 is good for transferring/dealing firearms as well as gunsmithing. An FFL is the federal level license and required for all firearms dealers in the country. An FDLC is a state level license only required in Illinois as far as I am aware. isp.illinois.gov/Foid/FDLC

The vast majority of the interview is more of a education session on firearms laws that you will have to comply with and how to do all the documentation properly so you don't end up in jail. However they will ask about security measures that you have on your property and so on. If they find anything suspicious they will take note of it, but mostly they will leave that up to the background check. That one is a pain because you would have to establish communications/relationship with a foreign firearms manufacturer. And there is all the documentation on the FFL side as well to deal with also foreign parts are a pain to get and you have to deal with 922r etc. Unless there is a reason you want to import foreign firearms I would recommend an 01 or an 07 FFL.
There are so many regulations for FFLs with an 02 SOT to follow you will have to fill out the paperwork and go through the hour+ long interview/information session with the ATF individual. I also have a LOT more videos discussing the FFL/SOT paperwork, downsides of an FFL, and the different types.

Well if you live in a free state you don't need an FFL to buy ammo at an auction, so step one for the ammo would be to get yourself to a free state. As far as the collectors FFL that is an 03 and lets you skip shipping the firearm to another FFL. It is also super cheep ($30) every 3 years. But in order for a firearm to be considered a "collectable" it must fall into one of the following 3 categories. 1: Any gun which is at least 50 years old; 2: A gun which has been certified by the curator of a government museum as of museum interest; or 3: A gun whose value is substantially derived from its novelty, rarity, oddity, or historical attribution. Other then those you would still have to go through a traditional 01 FFL to get your regular firearms.
Haha, no, they don't color the barrel, not even a little. Although sometimes I have found mashed up bullets that I shot that still have a fare amount of their coating on them.

Yep, an FFL combined with a SOT. And it is a real pain in the butt. That or get a fully transferable full auto. You can google it and they will pop up. But they will run you ~30K.
Mags are regulated on a state level not federally. It would depend on your state. And if you live in a state with mag restrictions I think the best investment is to vote with your feet and go to a friendly 2A state.
Yes you can sell your manufactured ammo with an 06 FFL. You can make your own ammo for yourself without an 06 FFL, you just can't sell it. I got an 06 and it was because I cast and sell projectiles. I don't have an 01 or 07 so I can't transfer firearms, although I probably will get one one day.

Yes, BUT you must be engaged in the business of selling/transferring firearms. You will get your FFL pulled from you very quickly if you are just using it for yourself.
I want to get a FFL7 to manufacture firearms and sell them. Question I have is to manufacture them, does that mean getting raw material and say milling the parts or can i purchase parts from a supplier, assemble them? Or both? And then i understand need another ffl to sell them, correct? Then need a local business license from the city you live in? Can you do these things from your garage and sell online? As long as you live in a firearm friendly state you shouldn't have an issue getting a home based FFL/business license. As for manufacturing your own typically that means you are milling out lowers, serializing them, and selling them, but you can also sell them. So I think the 07 is the way to go. This website has a table (rocketffl.com/ffl-license-types/, scroll down a bit) that shows what each FFL can do.
For the dealer's FFL, you need to have fingerprints taken. Can you take your own prints (I have done other times and know how to do it). Does it have to be a police department? Other than online, any suggestion on where to get the print cards?
As long as it is on an official finger print card you can do them yourself (as of now, but it could change). Where I am from the police department gives you two cards for 10 bucks, and you avoid all the nasty ink so it was easier.
What if I want to make destructive devices and use/sell them but also make exotic ammunitions because if I just have a license for something more destructive could I just make anything below it?
Once you start getting into the destructive device categories it is well outside of my expertise. I know those licenses are expensive and harder to get.

Yes, you can apply for both at the same time on the same form. You will just have to understand the laws for both FFLs. Well if you live in a free state then you can already ship ammo to your home. But as far as firearms goes the short answer is yes you can ship them to your home. BUT once you get your FFL you have to keep a strong distinction between YOUR firearms and your FFL's firearms. You will also have to record everything in your A&D (Accusations and Dispositions) book and hang onto the records for 20 years. Also you must intend to do business with firearms because if the ATF finds out you are only using it for personal use then you will get your license revoked and face fines. Also they can show up to your FFL address at any time (typically annually) to inspect your FFL and all the firearms you have. So unless you are serious about getting into the firearms business it is probably worth paying the $20 back ground check fee to another FFL. Great question though!

Thanks man, I have probably gotten more comments about that statement then any other portion of any other video I have ever made. I really need to make a video just about that statement to clarify it. Because yes the local field agent really does want to keep you out of jail. And without firearms they wouldn't have a job. But... the ATF in general is pretty much out to get you.
As far as records go they aren't any different then what you need to do for a regular business (transaction records, receipts, etc.) The only other thing is you can't sell pistol ammo to minors, and armor penetratingly pistol ammo is also a no-go. There are a few other things, but the ATF will cover those in your interview. As far as costs go... that is where things get depressing right now. Primers and powder are almost impossible to come by and when you do find them they cost lots of $$. Also unless you are an experienced reloader and understand the intricacies of reloading I would start off by just reloading for personal use and then go the business route. There is a LOT to learn to jump full throttle into the business side of reloading.
The infamous class 3. I'll make a whole video on that. But for now here is what you need. First off the proper term is an NFA weapon specifically a "machine gun" there are two ways to get one legally. The easiest is to buy a fully automatic that is pre 1986. That is when the ban went into effect unfortunately these will cost you lots of money I was looking at an M16 the other day it was going for $35,000. Also you have to fill out a form 4, send in photos and fingerprints, and wait 6-12 months for the government to process everything. Then you will have a fully transferable machine gun. But to transfer (sell) the buyer has to go through the same form 4 process you just did. The other way is to get an 01 or 04 and pair it with an 03 or 02 SOT respectively (Special Occupation Tax) the 03 SOT is what is typically referred to as the "class 3." The process that you would take is to first get your regular FFL which costs $150 every three years. After getting that you would apply for the class 03 SOT which costs 1K every year. Once you have that you can purchase NFA machine guns. BUT here is the catch with the FFL option: 1st you have to be engaged in the business of firearms dealing or else they will take away your FFL. 2nd once you get rid of your FFL you can no longer be in position of your NFA item.
What happens if you’re an FFL holder and you die? Is your wife responsible for turning over all the records or keeping the records for a certain period of time?
If there are multiple people listed on the FFL then nothing happens. But if there was only one holder then a non prohibited possessor can take over the license by reaching out to the ATF within 30 days. If that doesn't work the ATF or local PD will take possession of the firearms which is obviously not optimal. Here is the long version straight from the ATF: FFLC reminds all licensees of the requirement to report deceased responsible persons (RP) to the FFLC within 30 days, so the RP can be deactivated in FFLC’s system. The deactivation of a deceased RP may lead to the right of business succession. Certain persons other than the licensee may secure the right to continue business with the license at the same address on, and for the remainder of the term of, the current license. Upon expiration of the license, the successor would be required to apply for a new license if they wish to continue operating. (A successor cannot renew the existing license.) The guidance for Right of Succession (27 CFR 478.56) is also located on the face of the license. In the case of a Corporation, only a legal corporate entity may continue to be licensed. If after the death of an individual the Corporation is dissolved under State law, the entity no longer exists and may no longer be licensed. For further information or clarification on how the deactivation of a deceased RP may affect your license, please contact ATF Customer Service at 1-866-662-2750. § 478.56 Right of succession by certain persons. (a) Certain persons other than the licensee may secure the right to carry on the same firearms or ammunition business at the same address shown on, and for the remainder of the term of, a current license. Such persons are: (1) The surviving spouse or child, or executor, administrator, or other legal representative of a deceased licensee; and (2) A receiver or trustee in bankruptcy, or an assignee for benefit of creditors. (b) In order to secure the right provided by this section, the person or persons continuing the business shall furnish the license for that business for endorsement of such succession to the Chief, Federal Firearms Licensing Center, within 30 days from the date on which the successor begins to carry on the business.
Can a type 08 FFL sell the weapons he imports like an FFL type 01? Or do they have to separately be acquired in order to import and sell at a storefront?

I believe that is correct, that to import ammunition it would be the 08. But if you are just buying and selling ammunition manufactured in the US (NOT by you) then in most states this doesn't require an FFL (Check your local laws). But yes if you want to import ammo to sell then you need an 08.
Yes, you have to be a U.S. Citizen. 21 years or older, legally allowed to posses firearms and ammunition, and have a physical address. However, they don't care if you are an immigrant as long as you have gotten your U.S. citizenship. Which I understand is a huge pain in the butt... that is a discussion for a different day.
Yeah, it is. But there aren't questions like "recite your ABC's backwards" or anything. But the interviewer does get a say in if you get your FFL or not, so if the applicant isn't all there, or seemed sketchy, then I am sure they would get denied.
No, FFLs are on the Federal level so they transfer from state to state, BUT sometimes there are different local laws you have to follow. And you have to notify the ATF that you are moving and tell them your new address within a given timeframe.
If it is for your FFL, then just send it with your application to the address specified on the application. If you just want to send it to the DOJ I suppose you could just call them up and get yourself finger printed, although I wouldn't get fingerprinted unless you have a reason. Local police departments will usually offer public finger printing for cheep. Where I live it is $10 for two cards.
I didn't have to send a copy of my FFL to the chief law enforcement officer, but there is a step where you have to notify them that you are applying for your FFL. I had the contact info for the ATF interviewer at that point so I just emailed the chief law enforcement officer and CC'd the ATF agent in the email, and that was good enough for where I live.

I do have my 03 and tried to get an 07, but ATF played a last day game claiming my zoning was wrong. That was just as covid started and my local government was unavailable to talk to. A little more time, and I am going for it again.

Excellent video, straight to the point and I appreciate how you broke down the different ffl numbers. Living in California, I am looking into trying to apply for a ffl because of how tedious it has become to purchase ammo, not to mention expensive and with no ffl dealers nearby, I figured why not try and learn the process and save money on some fees as well.
Based on the video, in order to obtain ammo/firearms for myself, I'd want a ffl 1, but the ffl 3 you mentioned about being a collector is intriguing so I'll look into that as well since I am mainly interested in doing it for myself and not selling to others including friends or family in order to keep my life simple.
Yeah, it would definitely make your life easier, but do keep in mind that by having an FFL the government wants you to be in the business of firearms for the given FFL (selling/buying). They don't like to give FFLs for personal use. Although they are pretty lose on how much business you are doing on an annual basis. Also I am sure they are TONs of other restrictions in CA, so make sure to follow all local laws, or move. Good luck!

Glad to finally know what this is about. I just wanted to sell an old gun I bought from a gun store in California in 1996. Been in my safe for years. Never used. Of course the dealer is now gone. Stupidly I sent it to a gun dealer in Florida. They offered $406. When they received gun, they changed offer to $106 - minus shipping, stating that the cylinder yoke was bent. I asked for it back or I would have had to PAY them to keep the gun. I am elderly and on Hospice, so unable to leave the house. Was really worried about how I was going to get this FFL license to be able to get the Florida dealer to send the gun back or to whoever has the FFL license or to get the gun fixed or to sell it... or even keep it. I guess I'm supposed to send the Florida Dealer A COPY of the FFL license from here before they will send the GUN TO whoever has the license here. I'm totally confused. So I'm a woman who who does not to want to try to figure this out. I don't want an FFL license.
You don't need an FFL yourself, but they will have to ship it to an FFL near you.

However after looking real quick it looks like the FFLs in CA charge a TON for transfers. Here in Utah/Idaho it is typically $10-20 for an FFL transfer, but there in CA it looks to be ~$100.

I’m interested in getting an 06 FFL. I’m afraid my work may lay me off with all this vaccine mandate stuff up in the air. So, if I do it, it’ll be a major source of income. Wondering how that’d work... I also heard the ATF inspects your house or address of the FFL. I don’t have anything to hide, but having an agent in my house gives me an uneasy feeling...
If you live in a free state then it is pretty easy to get. But yes you will have an agent come to your house and talk to you in person. When they came to mine they didn't really do an "inspection" it was more just to talk to me to see if I was competent and make sure I don't accidently break any laws down the road.
You will also have to make sure your city is cool with you being an ammo "manufacturer." The small city where I live was super chill.
Also keep in mind once you have your FFL the ATF reserves the right to come inspect your facility/home whenever the heck they want. They don't have the man power to do regular inspections especially of 06 FFLs. But that may be a deal breaker for some.

An 01 is for selling firearms. If you want to make them you will need an 02. And if you are doing business with the federal government and full auto stuff you will need a Class 02 SOT to go with it. All of which is a pain to get. But good luck.

Yep, the 01 is what you need. And yes the ATF would interview you/explain the rules to you likely in person or over video call.

Mine was shorter, only like 45min. But if you are getting an 01 or 07 it is longer. In that case they go over a TON of laws, regulations, and how to do your stuff so you don't end up in prison.

After the Jan 1st 2024 our only two FFL:s in the county called it quits. Newsom created more rules and regulations that make it a total nightmare. So now we have to make a 4 hour round trip for deposit then come back 10 days later for pickup. If they don't have the firearm in stock tack on a 3rd trip. Between the taxes, fuel and time it makes it almost as expensive as the purchase sometimes.. It really sucks..

If I choose an unknown FFL dealer nearby, is there a chance that I won't get my gun? Or scammed out of my purchase? Is that a consideration? The ATF doesn't take kindly to lost guns. And those who have FFLs have under gone some background checks. Not to say you couldn't get screwed, but It is un-likely. However if it is a small home based FFL I would call or even visit in person first to let them know you are shipping a firearm to them.

So long as you parents are OK with you having the FFL, it shouldn't be an issue. Although you must be older then 21. If you are older then 21, and your parents are OK with it then you are good to go. Just make sure you follow all local laws.

As far as I know there have been no major changes to the FFL process, however they do have a zero tolerance policy so if you make a mistake in your records they can pull your FFL. They also are likely more subjectively strict when considering applications. But I don't have any data for that. They have also made a few updates to the 4473.

You can get an FFL without being a gun owner, however I would recommend getting some firearms and leaning a lot about them before getting an FFL.
As for a CFLC, do you mean a California Firearms License, you should be able to get one so long as you can pass a background check and fill out all the paper work.

Wither or not you need a business licenses is more of a local thing, so I can't give you a 100% for sure answer. But you will very likely need a business license for it. If you can some how make it a part of your current business then great. Although you may want to separate them for liability and legal purposes.

No, there isn't anything specific. Most of the "interview" will be teaching you how not to end up in jail and how to obey all the laws. They may ask about storage and security, and local laws may vary.
So if youre wanting to get your FFL to eventually start a business but its kind of a pipe dream and something that would take several years to actually get started. Do you just need a business name and/or LLC? Or do you have to have an address and be able to prove the actual business.
You don't even need a business to get started, although many localities will require it if you are doing a significant number of transactions. My FFL is just in my name and not under a business because I don't actually do many FFL activities very often.
Do you know anything about being Active Duty Military and getting an FFL? Is that not allowed?
For the FFL side it won't matter and I don't imagine that the military would really have any issues with it but you may need to double check. The only issue you may have is that if you move around the government is pretty strict about having accurate addresses and it is a pain to have to move your FFL address.

Are background checks checks done directly through the fbi? State ? How does that aspect work practically?

Storage requirements are mostly state level rather than federal. They just have to be secured. Although they do recommend a safe and if you didn't have one it would likely be a red flag when they come chat with you about your FFL. Background checks are done through the DOJ. There are TONs of different local laws if you live in a blue state so you will want to look that up. You have to have a bound book for acquisitions and dispositions and they will walk you through the whole process when you get your FFL. Wholesaler difficulty varies depending on the wholesaler, some have minimum purchase reqs that are kind of high.

I’d like to start a home based class 7 but I’m worried about the home based part. I don’t want people showing up unannounced picking up firearms that they randomly had sent to me. Co workers have suggested building a shop and making it a half address but that’s $$$$$. My garage would be perfect (that’s where my lathe and most tooling is) but again, hesitant to make that my “office”. Any suggestions?
I would go ahead and get it based out of your home as that is the cheapest. The average person won't know you have an FFL and therefor won't know to send stuff to you. Even if you advertise as a firearms dealer you are not obligated to do firearms transfers. If somebody ships something to you without your consent you can send it back, or charge them a small fee for the transfer. My local FFL charges $20 for the first item and $5 for each after that in addition to any background check fees. Great question!

Just passport photos (or equivalant), I don't remember needing a passport.
I checked the ATF forms they have up as of today: it's just a 2x2 photo. You can get these done at Costco and other stores. This was also done for my CFP. There is no passport exclusive photo style per se; just that 2x2 are far more often used for passports and the term is common. EZ PZ.
How do I find out who the chief law enforcement officer is in my area. You have to give them a copy of the application when you mail everything in? Did you do that? You didn’t mention that in video.
Honestly there are lot of CLEOs over your specific area. For example you could reach out to a state level officer or local officer. What I did is a local police chief because he is my local CLEO, and he is more familiar with the city, it's people, and the laws. So search your city, state and the chief of police. It should come right up. If you live in a small town without its own police force, then search for you county sheriff.

Manufacture is 07, not sure what you mean by tester. If you manufacture firearms you are more then welcome to test what you manufacture. Firearms are supposed to be tested.

You can do it from your home, mine is a home based FFL, and I don't even have an LLC. Granted I don't really sell much at all it is mostly for family and friends. If you wanted to sell stuff you should set up a business even if the business is based out off your home.

If you want to ONLY gunsmith for yourself you don't need an FFL. However once you start to gunsmith for even friends/family you will want an 07 FFL.

Like an 03 SOT for full auto stuff? They don't really have a "collector" version for full automatic guns. So essentially it won't include any post 1986 machine guns anyway. So in any case just get a transferable machine gun and don't worry about getting an FFL and a SOT because they don't make them for collectors anyway.

To just buy and sell ammo that you DON'T manufacture you don't need an FFL. Although there are federal laws preventing the sale ammo to minors, and there may be other state laws. But if you manufacture and sell the ammo then you need on 06 FFL.

It was quite a while ago and I only got the 06 so I could sell my cast bullets. The ATF agent didn't ask me any technical questions. But she did say that if I was getting an 07 the interview would have been a lot more instruction on how to document everything and the laws that FFLs have to follow.

No, but often times people don't like purchasing firearms from home based FFLs so take that into account before you get yours.
Can the fingerprinting be done at home? I’ve heard from multiple sources that you can send others saying you can’t?
Yes it can, but you have to do it exactly correct and if you mess it up, or if a fingerprint is not acceptable then your application will get denied and you have to start all over again. I am not sure where you live, but almost every police station will offer a cheap fingerprinting service that are often electronic and help you avoid getting your fingers messy and make sure everything is done well.

Depending on the FFL it is anywhere from $30 to $300, but you HAVE TO be engaged in the business of selling firearms. The ATF won't approve an FFL for personal use. So for hobbyists the drawbacks almost always outweigh the benefits.

Yes the 01 is good for transferring/dealing firearms as well as gunsmithing. An FFL is the federal level license and required for all firearms dealers in the country. An FDLC is a state level license only required in Illinois as far as I am aware.

What questions do you think thy would ask on the interview?
The vast majority of the interview is more of a education session on firearms laws that you will have to comply with and how to do all the documentation properly so you don't end up in jail. However they will ask about security measures that you have on your property and so on. If they find anything suspicious they will take note of it, but mostly they will leave that up to the background check.

That one is a pain because you would have to establish communications/relationship with a foreign firearms manufacturer. And there is all the documentation on the FFL side as well to deal with also foreign parts are a pain to get and you have to deal with 922r etc. Unless there is a reason you want to import foreign firearms I would recommend an 01 or an 07 FFL.
So, how does home based vs commercial address work getting an FFL? Do you know of any regulations for 07 FFL/ 02 SOT?
There are so many regulations for FFLs with an 02 SOT to follow you will have to fill out the paperwork and go through the hour+ long interview/information session with the ATF individual. I also have a LOT more videos discussing the FFL/SOT paperwork, downsides of an FFL, and the different types.

Well if you live in a free state you don't need an FFL to buy ammo at an auction, so step one for the ammo would be to get yourself to a free state. As far as the collectors FFL that is an 03 and lets you skip shipping the firearm to another FFL. It is also super cheep ($30) every 3 years. But in order for a firearm to be considered a "collectable" it must fall into one of the following 3 categories.
1: Any gun which is at least 50 years old;
2: A gun which has been certified by the curator of a government museum as of museum interest; or
3: A gun whose value is substantially derived from its novelty, rarity, oddity, or historical attribution.
Other then those you would still have to go through a traditional 01 FFL to get your regular firearms.

Haha, no, they don't color the barrel, not even a little. Although sometimes I have found mashed up bullets that I shot that still have a fare amount of their coating on them.

Yep, an FFL combined with a SOT. And it is a real pain in the butt. That or get a fully transferable full auto. You can google it and they will pop up. But they will run you ~30K.

Mags are regulated on a state level not federally. It would depend on your state. And if you live in a state with mag restrictions I think the best investment is to vote with your feet and go to a friendly 2A state.

Yes you can sell your manufactured ammo with an 06 FFL. You can make your own ammo for yourself without an 06 FFL, you just can't sell it. Similar to how you can make your own firearms (depending on your state), you just can't sell them to others without an 07 FFL.

I got an 06 and it was because I cast and sell projectiles. I don't have an 01 or 07 so I can't transfer firearms, although I probably will get one one day.

That is a great question! I know once you have the interview they will leave you with a business card and they tell you specifically to ask all the questions you want and to NOT go to your buddy who had an FFL 10 years ago.

I want to get a FFL7 to manufacture firearms and sell them. Question I have is to manufacture them, does that mean getting raw material and say milling the parts or can i purchase parts from a supplier, assemble them? Or both? And then i understand need another ffl to sell them, correct? Then need a local business license from the city you live in? Can you do these things from your garage and sell online? Is this up to your city what they say?
What should I do first? Ffl, i would hate to go through this whole process and fees just for my city to say no or do i try to obtain a business license first from my city?
As long as you live in a firearm friendly state you shouldn't have an issue getting a home based FFL/business license. As for manufacturing your own typically that means you are milling out lowers, serializing them, and selling them, but you can also sell them. So I think the 07 is the way to go. For the dealer's FFL, you need to have fingerprints taken. Can you take your own prints (I have done other times and know how to do it). Does it have to be a police department? Other than online, any suggestion on where to get the print cards?
As long as it is on an official finger print card you can do them yourself (as of now, but it could change). Where I am from the police department gives you two cards for 10 bucks, and you avoid all the nasty ink so it was easier.

What if I want to make destructive devices and use/sell them but also make exotic ammunitions because if I just have a license for something more destructive could I just make anything below it?
Once you start getting into the destructive device categories it is well outside of my expertise. I know those licenses are expensive and harder to get.

If you get your FFL and purchase ammo or a firearm out of state will it be delivered to your home?
Well if you live in a free state then you can already ship ammo to your home. But as far as firearms goes the short answer is yes you can ship them to your home. BUT once you get your FFL you have to keep a strong distinction between YOUR firearms and your FFL's firearms. You will also have to record everything in your A&D (Accusations and Dispositions) book and hang onto the records for 20 years. Also you must intend to do business with firearms because if the ATF finds out you are only using it for personal use then you will get your license revoked and face fines. Also they can show up to your FFL address at any time (typically annually) to inspect your FFL and all the firearms you have. So unless you are serious about getting into the firearms business it is probably worth paying the $20 back ground check fee to another FFL. Great question though!

As far as I know you can also sell with an 07. That is why for firearm enthusiasts it is typically preferred over the 01.

Thanks man, I have probably gotten more comments about that statement then any other portion of any other video I have ever made. I really need to make a video just about that statement to clarify it. Because yes the local field agent really does want to keep you out of jail. And without firearms they wouldn't have a job. But... the ATF in general is pretty much out to get you.

As far as records go they aren't any different then what you need to do for a regular business (transaction records, receipts, etc.) The only other thing is you can't sell pistol ammo to minors, and armor penetratingly pistol ammo is also a no-go. There are a few other things, but the ATF will cover those in your interview.
As far as costs go... that is where things get depressing right now. Primers and powder are almost impossible to come by and when you do find them they cost lots of $$. Also unless you are an experienced reloader and understand the intricacies of reloading I would start off by just reloading for personal use and then go the business route. There is a LOT to learn to jump full throttle into the business side of reloading.

what do you need to have class 3 weapons?
The infamous class 3. I'll make a whole video on that. But for now here is what you need.
First off the proper term is an NFA weapon specifically a "machine gun" there are two ways to get one legally. The easiest is to buy a fully automatic that is pre 1986. That is when the ban went into effect unfortunately these will cost you lots of money I was looking at an M16 the other day it was going for $35,000. Also you have to fill out a form 4, send in photos and fingerprints, and wait 6-12 months for the government to process everything. Then you will have a fully transferable machine gun. But to transfer (sell) the buyer has to go through the same form 4 process you just did.
The other way is to get an 01 or 04 and pair it with an 03 or 02 SOT respectively (Special Occupation Tax) the 03 SOT is what is typically referred to as the "class 3." The process that you would take is to first get your regular FFL which costs $150 every three years. After getting that you would apply for the class 03 SOT which costs 1K every year. Once you have that you can purchase NFA machine guns.
BUT here is the catch with the FFL option: 1st you have to be engaged in the business of firearms dealing or else they will take away your FFL. 2nd once you get rid of your FFL you can no longer be in position of your NFA item.

What happens if you’re an FFL holder and you die? Is your wife responsible for turning over all the records or keeping the records for a certain period of time?
If there are multiple people listed on the FFL then nothing happens. But if there was only one holder then a non prohibited possessor can take over the license by reaching out to the ATF within 30 days. If that doesn't work the ATF or local PD will take possession of the firearms which is obviously not optimal.
Here is the long version straight from the ATF:
FFLC reminds all licensees of the requirement to
report deceased responsible persons (RP) to the
FFLC within 30 days, so the RP can be deactivated
in FFLC’s system. The deactivation of a deceased
RP may lead to the right of business succession.
Certain persons other than the licensee may secure
the right to continue business with the license at
the same address on, and for the remainder of the
term of, the current license. Upon expiration of the
license, the successor would be required to apply
for a new license if they wish to continue operating.
(A successor cannot renew the existing license.) The
guidance for Right of Succession (27 CFR 478.56)
is also located on the face of the license. In the case
of a Corporation, only a legal corporate entity may
continue to be licensed. If after the death of an
individual the Corporation is dissolved under State
law, the entity no longer exists and may no longer
be licensed. For further information or clarification
on how the deactivation of a deceased RP may
affect your license, please contact ATF Customer
Service at 1-866-662-2750.
§ 478.56 Right of succession by certain persons.
(a) Certain persons other than the licensee may secure the right to carry on the same firearms or ammunition business at the same address shown on, and for the remainder of the term of, a current license. Such persons are:
(1) The surviving spouse or child, or executor, administrator, or other legal representative of a deceased licensee; and
(2) A receiver or trustee in bankruptcy, or an assignee for benefit of creditors.
(b) In order to secure the right provided by this section, the person or persons continuing the business shall furnish the license for that business for endorsement of such succession to the Chief, Federal Firearms Licensing Center, within 30 days from the date on which the successor begins to carry on the business.
Can a type 08 FFL sell the weapons he imports like an FFL type 01? Or do they have to separately be acquired in order to import and sell at a storefront?

I believe that is correct, that to import ammunition it would be the 08. But if you are just buying and selling ammunition manufactured in the US (NOT by you) then in most states this doesn't require an FFL (Check your local laws). But yes if you want to import ammo to sell then you need an 08.

Yes, you have to be a U.S. Citizen. 21 years or older, legally allowed to posses firearms and ammunition, and have a physical address. However, they don't care if you are an immigrant as long as you have gotten your U.S. citizenship. Which I understand is a huge pain in the butt... that is a discussion for a different day.

Yeah, it is. But there aren't questions like "recite your ABC's backwards" or anything. But the interviewer does get a say in if you get your FFL or not, so if the applicant isn't all there, or seemed sketchy, then I am sure they would get denied.

No, FFLs are on the Federal level so they transfer from state to state, BUT sometimes there are different local laws you have to follow. And you have to notify the ATF that you are moving and tell them your new address within a given timeframe.

If it is for your FFL, then just send it with your application to the address specified on the application. If you just want to send it to the DOJ I suppose you could just call them up and get yourself finger printed, although I wouldn't get fingerprinted unless you have a reason. Local police departments will usually offer public finger printing for cheep. Where I live it is $10 for two cards.

I didn't have to send a copy of my FFL to the chief law enforcement officer, but there is a step where you have to notify them that you are applying for your FFL. I had the contact info for the ATF interviewer at that point so I just emailed the chief law enforcement officer and CC'd the ATF agent in the email, and that was good enough for where I live.
