They literally treat the user like a child and they don't care to even check these claim on your videos. You are essentially guilty until proven innocent. UA-cam doesn't even explain how you can fight claims on your videos or ways you can get your channel back. Oh and fair use? Yea that doesn't exist on youtube. You can claim a video under fair use but that doesn't get rid of the issue of them flagging more of your videos or flagging he same video again or for other reasons.
The video follows the mindset of guilty until we decide otherwise. It treats the user like a child as you mentioned. And it's a poor use of Happy Tree Friends. I say that's three strikes right there

What ticks me off here is that it says near the end it's fine to create your own original content but you can't use any copyrighted material even in your own way or you'll get strikes and a possible ban.

They probably don't want people to point out the things that they missed. The things that they missed that people think they can do, which is leading to a new high of copyright strikes. Honestly, if UA-cam is going to make us watch this, they should at least cover as much as they can. Not saying it has to be over 10 minutes, just that it should cover most, if not all the ways you can get in copyright infringement, how you can avoid it, and what ACTUALLY makes UA-cam interesting: fair use.
And yet it's one of the videos that has more dislikes than likes.

One day a large provider will have their video taken down by youtube's automatic copyright bot, or have it monetized by youtube or another company without permission. Most likely mistaking this poster for a small time account or not knowing of the poster's company, they will ignore the counter-claim like they usually do and get sued.

I believe that copyright holders should also have to follow a three-strike system. If a copyright holder makes three false claims, then they lose their ability to claim videos.

As was mentioned in the video, anyone can claim to own the rights to your video despite not owning it. They don't need to show proof either. In fact, Goolge took Viacom to court for many years because they were doing exactly that. I think they settled the case, but nothing has been fixed obviously.

Copyright laws are meant to fuck you over. So are the user-end license agreement. Hell, if you ever read an UELA, you'll realize that you do not own what you paid for, they can take it away from you for any reason and at any time without having to give you a reason, they don't have to refund your money, and if what you paid for fucks up your stuff (like a computer) they are not responsible even if it was their fault.

In regards to a copyright strike, it doesn't matter how long it's up, it can still be claimed or taken down a few hours after it is uploaded, or 2 decades afterwards. Community guidelines on the other hand, I think there should be a period where after which, reports of community violations are to be disregarded.

A company that can flag a video review by a person, then that person dispute the claim, win, and then have the same video flagged again by the same company, AND then that company receive ad revenue from the video without the users consent doesn't just sound like bullshit, it sounds like it should be fucking illegal. How is it possible for something like that to happen without any type of public internet uproar? On what legality can a company get ad revenue from a video without the creators consent or compensation?

This is implying that the remixes mentioned before aren't original content. Just because they're caught up in copyright disputes doesn't mean they aren't valuable creative contributions. Almost nothing is made out of whole cloth, and the true power of creativity is in building on each other's ideas. The moment you release an idea into the public sphere, it's the public's. If someone else can use the idea better than you can, then the entirety of society benefits when that person is allowed to improve on your idea.
And even then, the "original" content could still get attacked.

I hate that stupid video - I had to watch it when my channel got hit with a copyright strike because I reviewed some dude's "real ghost video" and pointed out all the reasons it was CLEARLY fake (it was actually a rather convincing video and it took some real probing to pick out the flaws), but of course it got hit because why would he want anyone knowing it was fake? Even though his entire channel is a spam channel. It has like eight "real ghost" videos, but they're just two varieties of the same four videos (clearly a sign of fakes). So now I don't get to post videos over 15 minutes until April (my priority is creepypasta narrations and a lot of those are longer than 15 minutes). It's really frustrating, but I didn't want to appeal to UA-cam because I'm afraid of getting in legal trouble even though I used to video under intentions of review purposes. I hate people that try to trick others into believing their lies then get made when they're called out on the bullshit. I sent the dude an email asking him to remove the strike, but he ignored me because... why not. Ugh.

I understand being worried about fighting it, but it's a pretty cut and dry case of fair use, so it would never get far enough to go to court. NO! 2 things need to happen soon before a vlogging market crash happens and no one wants to create content as a career anymore, (even though living off the content uploaded to a website that's quickly finding new ways to crash itself into the ground is completely humanly illogical, no one should have to depend on a market for human survival) a website should be created that directly employs content creators, and videos can't be flagged in any way unless the copyright claimer goes out of their way to directly contact the website to claim their copyrighted material was infringed upon. Trust me, someone claiming copyright that's serious will do what's necessary to get the content removed, this removes any doubt that a false copyright claimer is otherwise being a dick and claiming it for no reason just to be malicious.
This brings me to my second thing that needs to happen, complete revision or abolition of copyright, which sole purpose to exist is that a creation can still generate revenue, even if the creator has otherwise no use for it. (because, you know, they're dead or whatever) Restriction to modify copyrighted material reduces the ability for talented people to take a work of art and make it whatever they see fit, either better or worse off, even without financial generation or incentive. AM2R was taken down by Nintendo, even though it was generating absolutely no profit, copyright still held it in intellectual prison because market share trumps human ingenuity. If you want people to make better creations for us all to enjoy, best remove copyright as it's a huge roadblock that only makes select few people profit of of someone else's labour and time, and eventually when everything is owned and nothing is publically accessible, maybe then people will wake up and see it for the monster it is. Everything you think you own, you owe to nature first, you're just borrowing it for the short measly time you have on the planet.

Almost a decade later, these problems are still there.
My channel doesn't qualify for Ad Sense, but at the same time my "claimed" and "reported" videos do have ads.
Some videos are private/unlisted (and are only viewable with a link), some are brief clips (these are claimed by a company that doesn't own it), some are livestreams (that are claimed for minutes of music). Ironically, the only music claim I was unable to dispute was being claimed for the original song when I was playing a parody that I had permission to use.
So does that remind me that all the unlisted MyMusic News videos have been private?

Understandable. I make videos because I want it to be my job. That way I can work hard and have fun doing it. When it comes to let's players videos, they actually get taken down because of the game's music and not so much the game footage itself. So you just have to be careful about talking over the music and you'll be fine. The first video I uploaded was a test video for my first let's play, I didn't have any commentary on it so it got hit. The strike I got was for the game music (it does the courtesy of telling you instead of forcing you to figure out what you did). I took the video down myself because it was a test to see how it looked. When I uploaded the video with commentary I didn't get a strike.

Eventually I wanted to upload gameplay videos of retro games but I saw not only was that topic being done to death but that many videos were being claimed by copyright because of in-game music and decided I'd stay with my original intention.

Honestly, UA-cam should just have an option to decline earnings. If you don't claim to own it, and you can't make any money from it, there is no infringement. You are just giving them free advertising.

I would argue that ad revenue or not, the uploader stole content, and posted it for people to watch for free and thus the original artist and associates would lose profit more than anything else. Simply being exposed to a song should not be enough reason to file a complaint for monetary losses, and certainly would be embarrassing for those that did. Unless you are talking about people downloading the music from UA-cam, in which case I highly doubt that the uploader is responsible for what other people do to their video using external programs, so long as the uploader did not provide or endorse those programs.
In case of people using repeat for exposure to the song, it is often low quality with sound effects or speaking over it. It can be edited out with certain software outside of UA-cam, but again the uploader is not responsible for that behavior.
People can use that content for free if it is a critique, and other conditions do exist where permission does not need to be asked where they can make money. You could release a video lambasting a song for its horrible quality, make money on that video, and not have to pay a dime for use of the song. Yet using the song as background for something else would be piracy even nobody makes any money off of it with full disclosure? I mean, maybe I am just naive and that is something that the law has not yet rectified, but to me the latter seems far more just.
101jir I am talking aboot people uploading full soundtracks, movies, episodes, and song albums unedited, completely stolen so everyone can listen or watch for free. Most are just fine in quality, and even if they lose a bit of quality, why pay $15 dollars for an album, why pay $30 for a movie or support the makers in any way when this random guy posted it so I could watch it for free, and screw anyone in the business that is trying to make money for their work.
I think your original comment was vague enough that we were talking aboot two slightly different things. But the same thing still applies to your comment. If someone was to put a Justin Beiber song or whatever in the background of some animal abuse video, and that went viral, Justin didn't give that person permission to use his song in that context. That is an extreme example, but some artists and distribution companies don't want their products in the background of some video they gave no permission for.
