SO MUCH DISINFORMATION FROM A LAWYER!!!!!!! - THUMBS DOWN !!! Your music IS NOT automatically copyrighted when you "digitalize" it for the sole reason you did it in the US! It ONLY gets automatically copyrighted when you UPLOAD it to a SERVICE like Soundcloud or CD Baby. Also, using copyrighted music in your UA-cam videos will NOT result in your video being deleted! The only effect it has, is that the ad revenue will go entirely to the copyright holder of the music. So I’m making a “TIKTOK compilation” on my channel, but the tiktoks are remade by me. I’m trying to test to see if any of the audio I use is copyrighted, so I saved the videos to be unlisted so UA-cam can check the audio. Will this still put me in risk of getting a copyright STRIKE if the audio’s are copyrighted, or will it just give me a normal copyright claim?
Wanted to know if you can help me out. Received my first strike today and it was a wrongful one i am 100 percent certain about this. I need legal help. How can I reach you best
Would love an update on fair use for 2021. I've watched your older videos on it, but have things changed in the US since then? Would be interested to know.
Hi! I have heard some rules about it being okay to use 10 seconds or so of copyrighted music. Is this true? For example, using only one sentence, would that be okay? I am also wondering if it's okay when people use copyright music in the background for less than 30 seconds and they are singing to it in a vlog. How are the rules regarding this when they are louder than the actual music itself? 🙂
I have gotten copyright claims for music I was license to use. Even though I won the outcome, it affected my entire channel. I now only use music supplied by UA-cam. Many creators will license their music through several companies. and whatever company you're not with can still put a copyright claim against you.
@@iancorzine I actually know people that create video and photo assets and sell them on many platforms. I respect that and I respect the right to make money that way. My beef is getting a copyright notice and having my channel messed up without checking with me first to see if I have the right to use it. I don't think these big creators with content ID should automatically be able to mess your channel up. I think they should have to reach out to you and you be given seven days to respond and prove that you have the right to use it before UA-cam dings your channel. That seems like a more reasonable approach.

Hi, I’m trying to use ac dc songs for a fortnite montage and it completely blocks the video everywhere when I upload it is there anything I can do so it can be viewed without be blocked?
In the background of this video is a tree that very closely resembles the tree that I have in my backyard. I made a video with this tree in it in 2019, a full 2 years before this video was posted and filed a copyright on the video and all things in it. I am pretty sure (but not 100%) that this was not intentional and there are extremely rare cases where due to a genetic freak or a mutation a tree can closely resemble another tree, so we will just say, for the time being, that this was unintentional. But nevertheless, I do feel like I should file a copyright claim against this video just to protect my work as an artist and preserve the integrity and uniqueness of my tree (well, aside from your tree) . You do however, seem like a fine you tuber and an asset to the youtube community so I will provide an alternate solution that I think will be for the best for all parties involved. This will also help us both avoid spending huge amounts of money on our lawyer teams in case it goes to court. (Just for full disclosure I have already given a layer a $50,000 retainer just in case our negotiations break down.) So this is my solution, if you would agree to put a black square around the tree and censor it from the video we can just drop the issue. I think we can both agree that I am being more than fair and look forward to watching this video again with the black box blocking out the tree. Sounds like a win-win to me so lets draw up a contract and do this! Also just so you know, my friend was over watching this with me so I could point out the tree that is a blatant copy of mine and used without permission when he said that the red car in the background looks exactly like his, except that his is a converted school bus and painted blue. So he might be getting ahold of you as well but I have nothing to do with that and I am only interested in the tree. Ty you for your time, but I have to run now, I am about 3 hours late for my heart surgery because I had to get ahold of attorneys and share this video with them but I am sure the hospital will understand why when I point out to them what a serious issue this was that had to be dealt with asap. I also have an issue with the orange hat but we can discuss this another day.

When you upload, list the video as "Unlisted" first, right? Then YT will tell if there is a copyright claim. I sometimes use music from a trance music label, and it will give me a copyright claim almost immediately and I am fine with that. I only have 77 subs, I mean, really, and "if" it ever gets monetized, I am totally fine with the artists making the money.
I dont mind the fact that coyright laws exist but it is absolute nonsense that the ENTIRE amount of money goes to original creator regardless of if you used 2 Seconds or two minutes of the content. It's also absolute nonsense how wishy washy fair use is.

I just got a copy write claim on royalty free music I used in a recent video. I posted and credited the artist as required and still got the claim and video demonitized. Why would that happen?
I know this video was mostly about music and this is very specific, but I was wondering if I am allowed to use models from video game mods made on the Steam Workshop. They are free to download, but most of them say something to the effect of, "You are not allowed to re-upload or edit any of these models. If you like the model and want to use it, please feel free to add this addon to your collection." I'm not sure if they mean re-upload in steam workshop, or just in general. Also, I see many people make mod showcases and seem to have no issues. If anyone knows the answer, please let me know. Thanks!
Hi Ian. I’m a guitar teacher and I need to use famous songs for my lessons but I’ve been afraid for years to use them to avoid losing my channel. How come there’s a channel called Marty Music where the guy plays the whole song on each video and, he uses the name of the song in the title, has millions and millions of views ??? And is still running ??? I opened the description and there’s not even a license reference. How is this possible for him and many many other guitar teachers ???
Hello Ian, Would please, explain to me the different licenses (example: Attribution 4.0 International (CC BY 4.0), CC0 1.0 Universal (CC0 1.0) Public Domain Dedication, Attribution 3.0 Unported (CC BY 3.0)) that CreativeCommons.org lists on their website and if it is You Tube safe and You Tube videos that are monetized safe? What I am reading on the website sounds to good to be true to use songs as intro music and background music for my videos on You Tube and for trade shows for a client. PS: I think this might be a large video idea, would please make a video on the different licenses that are found on CreativeCommons.org (including what the different symbols represents on the license) to help educate other content creators that are struggling to understand the website?
okay... so if i were to post smth with a copyrighted song in the background all that would likley happen is that i just give the artist the money from thay video?
this is one of the first videos I see, sorry if this is already solved. What about videogame music like GTA radio stations, I guess uploaded video-gameplays will be demonetized but could they be definitely muted or taken down? I mean is it worth uploading these videos knowing well risking being deleted? (for making follower purposes)
Many times, you are allowed to stream video game background music. The best way to find out is to search the terms of service for the video game that you want to stream.
I had a copyright claim on a 1800's piece of music that I performed. My video was not viewable until UA-cam had contacted some other performer of the same titled song. I guess they reviewed my video and saw that it was not the same and then my video was reinstated. Though I do not make money on UA-cam anymore, it would have been a real pain to lose that revenue when I was making money. I am concerned that should I make more videos like this that I will get more copyright claims against my videos.

I'm thinking about making cooking videos on UA-cam. The kitchen has a lot of different brands and logos on various products and appliances. Is it legal to monetize these types of videos? Thank you!
Hi Ian, I need legal advice. Somebody (or some people) is falsely claiming my videos through false copyright claims. I need your legal help and advice filing counter-notification against them. I need legal consultation. Please get back to me. Thanks
i got one video that has copyright music but it is on game but it was one my first video i uploaed it getting close to 1mil views . Hasbro has it monetized it was manual detected and it been ok since i uploaded it that is only video i got copyright on if i want to use music it from youtube audio Library . but games are hit and miss
you deserve more subscribers man thx for your work and advise was only able to get 2 claims thx soo much man i wonder tho if the things ye have said does also apply both in the British law (ye im British) and same aswell for the Japanese law and which one should i follow since im a British citizen meanwhile working here in japan anyways cheers man greetings from kobe japan 🍻 i know this is a rubbish question but it just bothers me or maybe im just scared loosing this channel since it holds some things that lets say im proud off
Ian thank you for reminders here. What if you are doing a vlog and music is played in the street or a restaurant, mall or an event? Love the snow and sunlight in the background, reminds me of crispy winter in Russia ;)
Ha! Thank you. Under American law, background music is often considered incidental, and therefore, no copyright violation. However, often YT AI picks up background music and generates a claim. Have to be careful when you're blogging.
I filmed our National Flag and so many youtuber are using the full video without my consent, it is my artwork and it is hard filming it in the hottest hour of the day it was noon. They don't asked permission and they don't even give a like or subscribe.
OMG you are in Mammoth i'm so jealous LOL I had such great times there when i lived in CAL is that your dog in the background? Golden tips as always Ian and thank you ;-)
I have a lot of tribute bands & concerts I wish to make public. YT says it's a copyright claim all revenue will be paid to the copyright holder & I'm ok with that. I just don't want a copyright strike. Am I legally allowed to make these concerts public?
I made a video and YT literally blocked🚫my video bc of the music in the background. I haven't even made it public but they already blocked it I don't get it🤔can I still use it
Lawmakers, licensing companies, certain people that work in certain fields... Unless it's someone or two or more that do something good, positive, reasonable, relevant, respectful... I will have ZERO respect for them simply due to crap like this. It's why my ORG based membership website business plans are set as they are. There will be people that will have absolutely no access to any savings if/when I'm ever able to register/launch my LLC/ORG and get business started.
Today i just found out about the UA-cam studio and checked it out. While looking through my videos i realized that almost half my videos have been copyright claimed (i have 20 all together and 8 claimed) i was shocked when i found out and i dont know what to do as some of my best videos (videos i have spent hours editing) have also been claimed. My channel isnt big at all but i dont want to loose it. Is it possible to put these videos on private until i get this sorted?
so how have we strayed so far ? first amendment freedom of speech freedom of press , what about the fact UA-cam is a private business subject to the united states constitution vs a publisher where its a completely private business not subject to the constitution (acting a private entity) i remember in the early 2010s they had a huge lawsuit or court case about this
Let's say I shoot a music video for somebody are those visuals mine? Just not the music but can somebody take my visuals and use them? I have a artist I worked with the deal was I put his videos on my page now the label wants my page, but I own the visuals what happens next lol
Suppose you get a UA-cam copyright warning, but you do not want the revenue generated by your video? I created a Ukraine War video where I used If You Could Read My Mind, by Gordon Lightfoot playing in the background with Ukraine war photos. Now, I do not care who gets any revenue generated by this video. But when I received the UA-cam copyright notice I immediately deleted the my video from UA-cam. Is there a way I can leave the video up with the understanding any revenue goes to whoever, to include the copyright holder. LDC
I have two copyright claims on two of my videos and they both not only say my channel is not effected but they both are in reference to royalty free music I’ve pulled short clips from. Is this a glitch in the AI algorithm looking for similar content and should I consider editing those videos with other music or do as the CR-claim says and do nothing as no action is required. Plus, does UA-cam enforce CR-Strikes on creators who use UA-cam logos within their video such as a like, subscribe, notification bell button click animation reminders to the current viewer?
So...we had graduation, there is copyright music during the slide show. It's more than 1 song so probably can't let the artitsts get any money since they can't split it up. Do I just cut out the sound? Idk if I can with my limited editing capabilities. I can probably cut out the entire slide show part...
For YT people are going to need a social media lawyer? I just want to know if I could use snippets of a fan made remixed of a Madonna. Since I assume using any original track is not allowed. Life is complicated enough. I’ll settle for music from google.
How about if it's not music whatsoever and you're doing a live stream and your listeners are listening to a documentary or a fiction story that you are playing for them to listen, can your get a copy right?
I recently got pinged with a UA-cam Copyright Claim for using my own voice narration in a video. If interested, see this video where I explain what happened: ua-cam.com/video/-5erqQIya4o/v-deo.html
I don't use UA-cam to make money anyways because I don't trust them with my bank account but I do use other people's music So as long as you tell people who the song belongs to either in the discription or the video you can dodge the copyright?
Say if I upload Baseball video that another channel uploaded and I upload it with little changes and don't get copyright does it still go against copyright guidelines?
so if at the end of a youtube video i can’t have a song- oh no oh no this really ruins some of my plans. i don’t care about ads i just don’t want the video to be taken down
Copyright Claimer Under Section 107 of the Copyright Act 1976, a ''fair use'' consideration is made for the non permissable reproduction of someone elses personal intellectual property as long as that use is for non profit purposes such as criticism, teaching, scholarship or research. However, I'm not doing any of those things. If I was donating proceeds to starving kids with the bat virus in africa, maybe, but I'm buying a BMW and putting a down payment on a beach condo instead. COPYRIGHT INFRINGEMENT IS NOT ONLY INTENDED BUT REQUIRED. All rights may belong to the respective owners but I don't care, I'll steal it anyway if it means a regular paycheck from UA-cam.
Although everything he says is indeed true, I just always feel so dirty after watching or listening to an attorney, because there is ALWAYS multiple ways to look at things and attorney's usually fail to show us the whole picture. First of all, there is a reason why nobody really wants to use "copyright free or creative commons music"....uuhhmmmm...because it's crap! I don't know anybody who hears a creative commons clip and goes "wow...cool song". No they don't! It's canned, boring, un-talented crap. Secondly, there is such a thing as "Fair Use", you just must learn how navigate the fair use laws and use a checklist to make sure you overwhelming feel fair use applies in your situation. If Louise made just the smallest changes to the style of her video's, she might have qualified. If she had turned the video into more of an instructional video, then she could have possibly fell under "Fair Use". Did she use an entire song? I bet she probably did. You can't use an entire song and expect that to grant you "fair use". Use ONLY what is minimally necessary to get your point across and then cut it off. If she had used 30 seconds or less, she might have been ok. So many different angles to come at this from, so it's not quite so cut and dry there Mr. Social Media attorney.
Technically, the song "Lucid Dreams" is largely a sample of Sting's "Shape of my Heart". Maybe she should just ask for permission from Sting and use that song instead. Just saying.
One thing that is annoying is when a comedian uses royalty free music in their videos then file a copyright claim on my video that was posted years before. I’m just sick and tired of it and they don’t respond so I am to the point where I put no music at all now. I filed the appeal and have to wait the 30 days - they’ve not responded so I’m sure I’ll get my monetization back. But how many thousands of people are they stealing revenue from?
I have a question, in 2004 I signed a song with with a music publisher and for 17 years has never contacted me or called me. This song is copy righted in the library of congress plus the music publisher. I have never received a single penny for this song, even though it has been recorded many times. Now it is on a TikTok challenge with more than 15,000 videos and millions of shares and views. What can I do to claim royalties or get my song back and sign with another music publisher.
The best way to do this is to delete the video. Piss off UA-cam. Don't use VEVO music. This way VEVO makes less money. No one uses their songs. I usually delete copyright calms. don't want ads show my channel and profit something out of nothing.
Lot of rambling about music but not much about videos. Can I use other people's video? Movie clips? I don't know what other people are liking this video for waste of my time. Disclaimer: I did not dislike your video.
hello Ian Corzine, is there a copyright violation when we use motivational speeches then making a video for it. The video has a unique visual and background music but the same audio voice from the motivational speech.
I don't get youtube copyright if films/music or clips of film/music are not allowed on youtube why is so many thousands on youtube. Eg South Park loads of people put clips or even full episodes on youtube and they are done by normal people. Why don't they get stopped. Or people who use music videos they are still on youtube.
What if I am perfectly fine with the person who owns it making the money? Or I do not monetize? I couldn't even make, say, a lyric video? Even if I don't attempt to make money off it? They would just take this video down?

I just got a copy write claim on royalty free music I used in a recent video. I posted and credited the artist as required and still got the claim and video demonitized. Why would that happen?
Please appeal. This is b-ll sh-t. You deserve better.
Always giving useful information. Thank you. ( "Who rules the world" ... A.I.). There's a template for that.
Ha! Yes, you’re right. Long live humanity!
Thank you for this clear explanation. Love the surrounding too, looks so beautiful.

Awesome review! Thanks! #SimTribe
Glad it was helpful!
Can you explain how copyright works in regards to "reacting to" videos? Or
including a snip of someones video in a video you create?
yes, and then there's people who use other videos that have been uploaded. this video didn't really explain these situations.
RIP Juice World 999
Hello Ian,
Would please, explain to me the different licenses (example: Attribution 4.0 International (CC BY 4.0), CC0 1.0 Universal (CC0 1.0) Public Domain Dedication, Attribution 3.0 Unported (CC BY 3.0)) that CreativeCommons.org lists on their website and if it is You Tube safe and You Tube videos that are monetized safe? What I am reading on the website sounds to good to be true to use songs as intro music and background music for my videos on You Tube and for trade shows for a client.
PS: I think this might be a large video idea, would please make a video on the different licenses that are found on CreativeCommons.org (including what the different symbols represents on the license) to help educate other content creators that are struggling to understand the website?
I should do a video on that.
okay... so if i were to post smth with a copyrighted song in the background all that would likley happen is that i just give the artist the money from thay video?
Maybe. Maybe you’d get a DMCA takedown with a copyright strike.
@@iancorzine Should i take my chances?
(sry im asking so much. just anxious)
this is one of the first videos I see, sorry if this is already solved.
Who cares? Just setup a new channel.
Dear ian corzine im one of your subscribers.
I got a counter notification today, idk what to do and if i ignore the mail.
Is there will be a penalty to me
(To my channel/myself)?
I'm afraid that my account will be terminated
PLS RESPOND I NEED YOUR HELP :(
See response above.
@@iancorzine my friend said my account will be terminated, but I trust you more because you're a lawyer.
okay thank you sir
I'm thinking about making cooking videos on UA-cam. The kitchen has a lot of different brands and logos on various products and appliances. Is it legal to monetize these types of videos? Thank you!
Hi Ian, I need legal advice. Somebody (or some people) is falsely claiming my videos through false copyright claims. I need your legal help and advice filing counter-notification against them. I need legal consultation. Please get back to me. Thanks
i got one video that has copyright music but it is on game but it was one my first video i uploaed it getting close to 1mil views . Hasbro has it monetized it was manual detected and it been ok since i uploaded it that is only video i got copyright on if i want to use music it from youtube audio Library . but games are hit and miss
you deserve more subscribers man thx for your work and advise was only able to get 2 claims thx soo much man
i wonder tho if the things ye have said does also apply both in the British law (ye im British) and same aswell for the Japanese law
and which one should i follow since im a British citizen meanwhile working here in japan
anyways cheers man greetings from kobe japan 🍻
i know this is a rubbish question but it just bothers me or maybe im just scared loosing this channel since it holds some things that lets say im proud off
This copyright crap is dumb. Like you are not posting only the music it should be ok.
thank you very much
Ian thank you for reminders here.
This feels too much like an ad for social media lawyers but idk
LOL
I filmed our National Flag and so many youtuber are using the full video without my consent, it is my artwork and it is hard filming it in the hottest hour of the day it was noon. They don't asked permission and they don't even give a like or subscribe.

So you using his instrumento not copy right ? Lol so confusing
fr like what
OMG you are in Mammoth i'm so jealous LOL I had such great times there when i lived in CAL is that your dog in the background? Golden tips as always Ian and thank you ;-)
Ha! Yes 🙌 I’m so lucky. No ... that cute dog kept wandering into the shot. He was so sweet 😀

Is it possible to put these videos on private until i get this sorted?
so how have we strayed so far ? first amendment freedom of speech freedom of press , what about the fact UA-cam is a private business subject to the united states constitution vs a publisher where its a completely private business not subject to the constitution (acting a private entity) i remember in the early 2010s they had a huge lawsuit or court case about this
Hi sir I don't understand English well but I got some copyright when I uploaded videos please let me know if it can damage my channel thanks
LDC
Hurry up dube just go straight to the point next time thank you
Thank you ROCOPERA 👑💯👑
Can You Use Copyright Music if Your Channel is Not being Monetized?
so I used a 1.4 second clip of another youtuber and gave credit for my yt short, and he says he will copyright strike me, am I in thr wrong?
How about some videos about fraudulent copyright claims.
Can you tell me why I can show my flowers, crochet and other Stu but not my arrowheads? Not even mentioned in the title?
I don't use UA-cam to make money anyways because I don't trust them with my bank account but I do use other people's music So as long as you tell people who the song belongs to either in the discription or the video you can dodge the copyright?
Say if I upload Baseball video that another channel uploaded and I upload it with little changes and don't get copyright does it still go against copyright guidelines?
so if at the end of a youtube video i can’t have a song- oh no oh no this really ruins some of my plans. i don’t care about ads i just don’t want the video to be taken down
HHEELLPP!!!!!!!!!!! MMEE!!!!!!!!!!!!!!! I am Scared of getting copyright
It's ok. Just don't use other people's stuff.
Thanks
I know this is. Random but can anybody help me out? If i put credit in thumbnails can i still get copyrighted
Copyright Claimer
Under Section 107 of the Copyright Act 1976, a ''fair use'' consideration is made for the non permissable reproduction of someone elses personal intellectual property as long as that use is for non profit purposes such as criticism, teaching, scholarship or research.
How or where to get this permission from the artist? And how does UA-cam know that I have it?
If you wanna reupload some else video with little changes how can you get permission? And what do you need to do?
Thank you for taking time to explain. Where can I find out how many strikes I have ? Also, what're the costs for your services m
hi sir Ian corzine you said call to social media layer, how to call them can you answer it dear bro, 🙏🙏
Social Media attorney.
i got copyright because someone did a emote and i got scary and delete it i just start youtube
If UA-cam delete your video can you re-upload the video and change the music
Technically, the song "Lucid Dreams" is largely a sample of Sting's "Shape of my Heart". Maybe she should just ask for permission from Sting and use that song instead. Just saying.
Great Tutorial - absolutely no advice given... Just ro call your lawyer
I’m Using UA-cam Audio Library!
How does UA-cam’s AI know whether the uploader had permission from the original copyright holder?
What if I am perfectly fine with the person who owns it making the money? Or I do not monetize? I couldn't even make, say, a lyric video? Even if I don't attempt to make money off it? They would just take this video down?
Terimakasih atas informasinya 👍👍🙏
