While I do not always agree with Tun M on all matters, I can see that he's just looking out for the interest of his people. That's what a good leader does. During his first tenure as PM, the Malaysian ringgit was stronger and there was a lot of progress and development within the country. Im malaysian but the thing is singapore have water security problems in the past, now 65 % of water come from singapore themselves and 35 % from malaysia. The most important thing malaysia can do right now is to wait out the duration of the water deal itself. Morally it is wrong to buy water at such a low price but sells it at a bigger price. but a deal is a deal. The credibility of both countries at stake.

This is not a contract for human servitude (in which case the contract will be immediately void for illegality). But the legal principle is that a contract cannot be vitiated simply because one side made a bad bargain. If that is the case, transactional security will be completely lost and people can just walk back on their legally binding contracts with impunity anytime one of the parties feel it is 'unfair'. Transactional security is a cornerstone of contracts and contracts can really only be vitiated for unfairness when there is deliberate and overt exploitative conduct by one party over the other to the extent that it becomes unconscionable to uphold the terms of the contract. I seriously doubt that the current water agreement reaches this very high threshold. I don't think it is met in this case and so I will just uphold the original terms of the contract. Besides, Malaysia had the option to revise the terms of the contract in 1987 and chose not to do so. This fact tilts the circumstances even more favourably towards Singapore.

The presence of the navy and Coast Guard fleet to chase away a small boat is overwhelming. Crooked bridge is a concept by Dr M bcos Singapore didn't want to free the passage at causeway possibly on the raw water supply and the possibility of pasir gudang port becoming more successful. If Malaysia is hostile, they would have disable the bridge on their own. Why bother negotiations? For the airspace system. No country leader will accept limiting their airspace without compensation. Is there any compensation package on the table? Nope. Singapore side is trying to be sneaky by letting this slide pass. If Malaysia is hostile once again, they will build 5 construction cranes at the spot blocking planes entering or landing safely at seletar airport. I dun stand on Malaysia or Singapore side but facts are on the table. We bought millions of gallons of raw water per month and Inreturn they purchased pea sized volumes from us. Being neighbours closely related to each other both countries have gone beyond agreement to settle their differences. It's a fact Singapore should admit, they purchase water at a price that is completely obsolete and absurd to go on now eventhough it was mutually inked. If you are correct, then Malaysia should pay the Philippines billions of dollars for Sabah. Malaysia pays the Philippines "a price that is completely obsolete and absurd". What can a few thousand ringgit pay for cost of living of the Philippines sultan and royal family. Malaysia should be more generous before asking others to be generous. Singapore even acted in good faith, by selling way more water, on top of the surplus of the 11 million gallons of water in, in which i emphasise is only a ONE time event, when the water treatment plant in johor is affected by pollution. Additionally, by what Dr Mahatir has stated that, even though it may seem Singapore is the "richer" state, because our "GDP per capita" is greater than Malaysia on paper, that statement fails to account for other aspects, if Dr Mahatir wants to talk about "per capita" or each living heads in Singapore, the cost of living in Singapore per capita is far greater than that of Malaysia per capita. So his arguement that Singapore should pay more just because of the fact that Singapore is richer per capita is laughable. In fact, it just demonstrates how incapable the government is able to increase GDP per capita of Singapore. Malaysia has historically enjoyed the exact same benefits of Singapore, geographically, climate wise, diversity wise, and additionally Malaysia has natural resources, but why doesn't Malaysia have identical or greater GDP per capita? I am not against Malaysia, but their government does make some questionable choices sometimes, and I am sure that it is perplexing for the citizens to have to burden the cost from the mistakes from the government, no government is perfect, but you should not just blindly shill whichever suits the narrative.

It's quite clear that this student doesn't understand the principles of international law (which regarding this specific issue, would be of public international law, compared to private international law. The latter being that it is completely different in context as well as whether it has any legally binding actions.) Which in this case, can only be mutually agreed upon by the two nations, thus being in the context of _public_ international law. Looks like the person does not have any understanding of UNCLOS (the United Nations Convention on the Law of the Sea) as well. In essence, _both_ nations have to agree on the principles and terms of the agreement (or treaty which would likely be the case) between the two nations. *But if it is certain that the Government of Singapore is refusing to negotiate terms with Mahathir on the topic of water supply to Singapore, then Mahathir and the Government of Malaysia is not obliged to meet with them.* They have to discuss it in a such a way that the agreement is fair. (by the way, I'm neither a Malaysian nor a Singaporean.) If he had done his homework (something of which I'd expect a supposed Oxford undergrad to have done), he would have known this. Oh, and his ignorance shows.
International laws are less effective here, this plays into the deep roots and history Singapore and Malaysia have fought over on for decades, ASEAN rules (especially rules between SG and Malaysia) take precedence in this case. Most of the trades done between Malaysia and Singapore are back door and international laws are not prominent, Secondly, Singapore has never refused Malaysia of revisiting the water supply trade and Malaysia is dependent on Singapore for clean water as the bill of water trade in 1962 - 2061,in lieu of that, i disagree that the oxford kid was being ignorant he was probably aggravated by Mahathir’s response to his question as he was not directly responding to it. Nathan, I think you are apparently Unaware that the Water, Agreement referred to by the student and Mahathir was an Integral Part of the LEGAL Separation Agreement by Singapore FROM Malaysia, signed and ratified by both Singapore and Malaysia under the watch of the British. This agreement IN TOTAL, created Singapore as an Independent Country, recognised by the UN. I presume Mahathir knows what a Legal agreement is. But he probably knows that you don't know that the 2 WATER AGREEMENTS were Embedded into the Singapore Separation Agreement from Malaysia. Without this water agreement, Singapore would NOT have agreed to Separate as Singapore would not have sufficient water to sustain itself. And the Malaysian PM then and Government wanted Singapore Out of Malaysia. These are the historical facts in 1965.

It shows that you lack knowledge, that's all. It was a package deal which requires Singapore to ensure that Johore gets sufficient treated water supply, and also that Johore has sufficient water before selling raw water to Singapore. Singapore abide by the agreement and procure the water catchment area, paying huge compensation to the inhabitants, paying rent for the catchment area and building dams and pipelines to tap the rain water that would otherwise flood the villages or flow down into the river and sea. In addition, Singapore supplies water to Johore at below cost whenever it needs more. It cost billions of dollars to build all these infrastructure which eventually will be given to Johore - as it did with earlier with one of the reservoir. Mahathir stills sees the treaty with blinkered eye - he only sees the 3 cents and that's all matter. That's why he couldn't resolve the old railway for his entire terms as Prime Minister, nor the water issue. It was Najib who was able to seal the deal - getting a few pieces of prime land in the city centre in land-scare Singapore that is now probably worth more than a few billion Singapore dollars compared to the railway line. Mahathir couldn't see the situation in totality. Same blinkered eye he sees in his relation with China, which is Malaysia's No 1 trade partner.

Dr M responded that the 1962 Water Agreement is unfair to Malaysia. During our exchange, I understood his argument to mean that it was unfair for Malaysia to sell untreated water to Singapore at 3 sen per 1,000 gallons but buy treated water from Singapore at $60 per 1,000 gallons. Thinking that $60 per 1,000 gallons seemed strangely high, I subsequently double-checked this. It turns out that that Dr M was referring to the price at which Singapore's PUB sells water domestically (approximately RM 60 per 1,000 gallons). Singapore sells treated water to Johor at 50 sen per 1,000 gallons. Dr Mahathir thinks this is unfair but I disagree. Given that it costs Singapore RM 2.40 to treat 1,000 gallons of water, Singapore subsidises the water by RM 1.90 per 1,000 gallons. Johor sells this treated water to Malaysians at RM 3.95 per 1,000 gallons - meaning Johor earns a profit of RM 3.45 per 1,000 gallons. Dr M also noted that Singapore has bought water from Malaysia at a fixed price of 3 sen per 1,000 gallons since 1926, and that Singapore has stopped Malaysia from revising the price. This is also inaccurate. Singapore has purchased water at this price since 1962. Under the 1962 Water Agreement, Malaysia had the right to review the price in 1987 (when Dr M was PM). Malaysia chose not to do so. Furthermore, as Singapore's Foreign Minister noted in Parliament earlier this week, Singapore is obliged to sell Malaysia 5 million gallons per day (gpd) of treated water but out of goodwill supplies 16 million gpd. Two weeks ago, at Johor’s request, Singapore further increased the supply of subsidised water to 22 million gpd. The issue for Spore was not the price of water. It knows it's too cheap. Singapore was prepared to accept a price revision in the past but it wanted concessions on other areas from Malaysia . Unwise decisions from both sides by inviting hostility. One guy in small boat thought he was visiting international waters was then chased away by warships and coast guards. His intention is hear from his local naval experts on where the disputed waters are as he is no naval expert. The presence of the navy and Coast Guard fleet to chase away a small boat is overwhelming.
Crooked bridge is a concept by Dr M bcos Singapore didn't want to free the passage at causeway possibly on the raw water supply and the possibility of pasir gudang port becoming more successful. If Malaysia is hostile, they would have disable the bridge on their own. Why bother negotiations? For the airspace system. No country leader will accept limiting their airspace without compensation. Is there any compensation package on the table? Nope. Singapore side is trying to be sneaky by letting this slide pass. If Malaysia is hostile once again, they will build 5 construction cranes at the spot blocking planes entering or landing safely at seletar airport.

If ancestral claims hold strong position under international law, then Pedra Branca should remain with the Johor Sultanate (Malaysia) and not with Singapore.
In addition, if historical claims could be upheld, then, Malaysia, through the existing Johor Sultanate could put a claim on Singapore as well as the Riau Islands of Indonesia.
Malaysia too, via the historical territories of the Kedah Sultanate, could claim sovereignty over Thai provinces of Satun and Trang as well as Tenasserim in Myanmar.
This is nevertheless, not how international law operates and shows that ancestral claims do not carry much weight under international law.
The Philippines Government does not recognise the Sulu Sultanate as a sovereign entity within the Philippine Constitution. The Malaysian Government no longer pays the Sulu representatives since 2013, and the Malaysian Government had been seeking to legally abolish the secession payment (which were not rents, as the Filipinos mistakenly believe) since the late 1990s.
Stopping the payment indicates that Sabah is indeed Malaysian sovereignty. Any other claims are considered satire, and should not be entertained.

Singapore even acted in good faith, by selling way more water, on top of the surplus of the 11 million gallons of water in, in which i emphasise is only a ONE time event, when the water treatment plant in johor is affected by pollution.
Additionally, by what Dr Mahatir has stated that, even though it may seem Singapore is the "richer" state, because our "GDP per capita" is greater than Malaysia on paper, that statement fails to account for other aspects, if Dr Mahatir wants to talk about "per capita" or each living heads in Singapore, the cost of living in Singapore per capita is far greater than that of Malaysia per capita. So his arguement that Singapore should pay more just because of the fact that Singapore is richer per capita is laughable. In fact, it just demonstrates how incapable the government is able to increase GDP per capita of Singapore. Malaysia has historically enjoyed the exact same benefits of Singapore, geographically, climate wise, diversity wise, and additionally Malaysia has natural resources, but why doesn't Malaysia have identical or greater GDP per capita?
I am not against Malaysia, but their government does make some questionable choices sometimes, and I am sure that it is perplexing for the citizens to have to burden the cost from the mistakes from the government, no government is perfect, but you should not just blindly shill whichever suits the narrative.

It's quite clear that this student doesn't understand the principles of international law (which regarding this specific issue, would be of public international law, compared to private international law. The latter being that it is completely different in context as well as whether it has any legally binding actions.) Which in this case, can only be mutually agreed upon by the two nations, thus being in the context of _public_ international law. Looks like the person does not have any understanding of UNCLOS (the United Nations Convention on the Law of the Sea) as well. In essence, _both_ nations have to agree on the principles and terms of the agreement (or treaty which would likely be the case) between the two nations.
*But if it is certain that the Government of Singapore is refusing to negotiate terms with Mahathir on the topic of water supply to Singapore, then Mahathir and the Government of Malaysia is not obliged to meet with them.* They have to discuss it in a such a way that the agreement is fair.

International laws are less effective here, this plays into the deep roots and history Singapore and Malaysia have fought over on for decades, ASEAN rules (especially rules between SG and Malaysia) take precedence in this case. Most of the trades done between Malaysia and Singapore are back door and international laws are not prominent, Secondly, Singapore has never refused Malaysia of revisiting the water supply trade and Malaysia is dependent on Singapore for clean water as the bill of water trade in 1962 - 2061,in lieu of that, i disagree that the oxford kid was being ignorant he was probably aggravated by Mahathir’s response to his question as he was not directly responding to it. It was a package deal which requires Singapore to ensure that Johore gets sufficient treated water supply, and also that Johore has sufficient water before selling raw water to Singapore. Singapore abide by the agreement and procure the water catchment area, paying huge compensation to the inhabitants, paying rent for the catchment area and building dams and pipelines to tap the rain water that would otherwise flood the villages or flow down into the river and sea. In addition, Singapore supplies water to Johore at below cost whenever it needs more. It cost billions of dollars to build all these infrastructure which eventually will be given to Johore - as it did with earlier with one of the reservoir. Mahathir stills sees the treaty with blinkered eye - he only sees the 3 cents and that's all matter. That's why he couldn't resolve the old railway for his entire terms as Prime Minister, nor the water issue. It was Najib who was able to seal the deal - getting a few pieces of prime land in the city centre in land-scare Singapore that is now probably worth more than a few billion Singapore dollars compared to the railway line. Mahathir couldn't see the situation in totality. Same blinkered eye he sees in his relation with China, which is Malaysia's No 1 trade partner.

Had a great exchange with Malaysian PM Tun Dr Mahathir at the Oxford Union, where I asked him about the ongoing maritime dispute between Singapore and Malaysia. Dr M responded that the 1962 Water Agreement is unfair to Malaysia.
During our exchange, I understood his argument to mean that it was unfair for Malaysia to sell untreated water to Singapore at 3 sen per 1,000 gallons but buy treated water from Singapore at $60 per 1,000 gallons.
Thinking that $60 per 1,000 gallons seemed strangely high, I subsequently double-checked this. It turns out that that Dr M was referring to the price at which Singapore's PUB sells water domestically (approximately RM 60 per 1,000 gallons).
Singapore sells treated water to Johor at 50 sen per 1,000 gallons. Dr Mahathir thinks this is unfair but I disagree. Given that it costs Singapore RM 2.40 to treat 1,000 gallons of water, Singapore subsidises the water by RM 1.90 per 1,000 gallons. Johor sells this treated water to Malaysians at RM 3.95 per 1,000 gallons - meaning Johor earns a profit of RM 3.45 per 1,000 gallons.
Dr M also noted that Singapore has bought water from Malaysia at a fixed price of 3 sen per 1,000 gallons since 1926, and that Singapore has stopped Malaysia from revising the price. This is also inaccurate. Singapore has purchased water at this price since 1962. Under the 1962 Water Agreement, Malaysia had the right to review the price in 1987 (when Dr M was PM). Malaysia chose not to do so.
Furthermore, as Singapore's Foreign Minister noted in Parliament earlier this week, Singapore is obliged to sell Malaysia 5 million gallons per day (gpd) of treated water but out of goodwill supplies 16 million gpd. Two weeks ago, at Johor’s request, Singapore further increased the supply of subsidised water to 22 million gpd. In 2018, also at Johor’s request, Singapore supplied more than the usual 16 million gpd for 20 days. All the additional treated water has been supplied to Johor at the

The issue for Spore was not the price of water. It knows it's too cheap. Singapore was prepared to accept a price revision in the past but it wanted concessions on other areas from Malaysia . This Malaysia could not accept and rightly so. They see it as good negotiating strategy but Malaysia see it as ungrateful and stuck up neighbour.
