So. The baggie was pulled from another passenger’s pocket by this officer. And then this officer put it into the car. It’s an empty baggie. No drug charges were filed against these guys and they “Caledonia police department” put out some body cam footage to show what happened. You can look up “Caledonia police department responds to viral video” in UA-cam and find the update.
The officers camera does not show him throwing the baggie in the car though. It is out of the frame of the camera so it does seem extremely suspicious. Why would he throw it there in the first place??? You got caught doing something illegal and are back pedaling. No one trust you guys and this is why.
Still haven’t seen the cop get the bag out of his pocket. They’re just showing a search and saying they got it out of his pocket. You can tell by the officers response he was caught. This is horrible journalism also.
And know that Penn. V Mimms ruled that its completely legal to ask someone out of a car and search them during a traffic stop. So there shouldn’t be a question of “escalating a routine traffic stop” especially when there is no such thing as a “routine traffic stop”. Even the reporter clearly says they wouldn’t give their IDs so that’s why he had them get out of the car to search them for some sort of identification.

In most jurisdictions passengers are not required to identify themselves during a traffic stop. So, the search might be challenged. If the contraband was found in plain view in the car, there is no problem. Two other issues. When the driver asked the officer "what's that?" The response was "what's what?" If the officer's action was innocent, he would have just explained what he was doing. The officer hemmed and hawed for a minute or so before he admitted to putting the baggie on the back seat of the car. It looks really suspicious. The chief's explanation is even more questionable. If they were just returning the baggie, why not give it back to the guy they took it from. I am convinced that if he had not been caught, the officer would have used the baggie's present in plain view as reasonable cause for a more in depth search of the car.
@@mervyngreene6687 in order to properly answer this question I would need more context on the passengers themselves but it can be legal to ask a passenger for ID that one really is a “it depends” and there isn’t enough information about what the passengers may or may not have been doing.

How bout you watch the actual body cam video….and not this 2:14 summary of it, the bag was confiscated off the other passenger who was being searched. It’s more than 2 angles so it’s no way it was planted on the other passenger either.

When they chose to act disrespectful after being pulled over for breaking a traffic law the laws are going to be applied and enforced. Cops were acting very respectful, courteous and informative, and disrespect was reciprocated. I hope the guy that posted the video gets a Defamation of Character suit filed against him from the officer AND the Police Department.
