Some artists advise to trademark your art before licensing. What are your thoughts on that for a foreigner pitching to the US market? Would they exploit me if I don't trademark my art? Thank you so much in advance and thank you for your straightforward content. It's awesome!
This is a hard question for me because I only really know licensing in the US, not in other countries. I don't trademark my art, but I would be more likely to trademark my name and copyright my art. I would submit my art as a collection if I copyrighted it and I would do it before it was published (which means you copyright it before anyone has seen it or it has been put on social media or the web). I think art gets exploited and stolen whether or not it is copyrighted. But you can take better legal action against that (ie more substantial) if and when it is infringed upon if it IS copyrighted.
I think that it's common, but I can either choose to live in fear, or assume it may happen at some point and deal with it the best I can.
I also think it's much more likely to be stolen by companies like Temu or Shein or Chinese companies in general, not as much in the US.
I know people complain about those companies a lot. But I do think it happens everywhere and I don't think you are more likely to have an infringement issue if you are a foreigner and license in the US. I think both US citizens and non have the potential to run into this from time to time.
This is very much my opinion and I am not a legal expert at all! Lol. Take all that with a grain of salt because I certainly can't advise on that with any legal authority. 😉

Thanks for all this info! Question, say you licensed out some greeting cards to be used in stores like Target and Walmart. Could you still sell those designs in your own personal store?
@janeygraveman1755 It depends on what the contract says. You can negotiate that into it. I sell my art on my own website, in local galleries, and on Etsy in addition to licensing it. :)

Hi Julie! when you mentioned about picking a category did you mean a type of art category (abstract, traditional etc) or did you mean category of products (stationary, home decor etc). Just want to make sure I'm understanding correctly. 😊
Oh that's a good point and a good question! I meant category as in stationery, home decor, wall art etc. Because it's easier to focus on one area at a time and then pitch to those companies for stationery (for example) because you made some collections that work well or are intended for stationery. Get yourself into one area and then work on your next target, so you don't get overwhelmed (ask me how I know lol).

Hi, Ms. Maida, is there any art licensing companies that are only for editorals and magazine publishings. I already have an online store and am trying to get more traffic and sales on my online store, become a professional illustrator who does art commissions, and license my previous work to businesses. Any suggestions?🤔
Hi @amcthornart Licensing is usually done for products (puzzles, wall art, package design, home decor, stationery, etc) so it's different an illustration and editorial work. I would say, your best bet is to make sure your portfolio is excellent, and then start regularly putting your work on IG and Pinterest, and Etsy and talking about your process in videos. You have to be very consistent, so create a manageable schedule for yourself and focus on your work and growing "attention" or an audience for yourself. Then, start pitching your illustration work to companies who match your illustration style and subject matter. I hope that helps!

Would a comic be considered a collection?
I won't say never because I think there are exceptions to everything, but most likely, no. Not because comics aren't awesome, but because usually collections are meant to be something that would work on products. So for example, a dinnerware set. Maybe p[lates with a lemon pattern and bowls with an oranges pattern, etc. Licensing is generally used for products that people consume in stores - fabrics, wall art, day planners, candles, dishes etc. Does that help?

Yep. They sent an email back about a week later requesting a license to specific pieces and a copy of their contract to look over. It was very business - like ha ha. That very same art is now being sold in Target. :)
