    Guilty or not, it seems wrong that he has been in jail since 2010, especially since there was a mistrial.

      @@fightevil.readbooks.5076 The last jury voted 10-2 to acquit, which clearly indicates the case is not a slam dunk. I understand the seriousness of the charges, but 12 years in custody without a conviction is wrong. He is presumed innocent.

      @@fightevil.readbooks.5076 I’m reserving my opinion as to the weight of the evidence until after the trial. But if he is acquitted, he will have served over 12 years that he will not get back. Maybe that doesn’t bother you, but it goes against basic legal principles.

      @@dottie9265 The death penalty was dropped in 2019 before the first trial started. I am not saying he is guilty or not guilty. But I have never heard of anyone in jail this long awaiting trial.

      Agreed. His first trial was in 2020 but 10 years for 1 trial is ridiculous. I do think some things popped up that required additional time; such as, his defense lawyer passing away or victims recovering before they can be interviewed & investigation to fully wrap up. However, no reason for 10 years. That’s ridiculous to hold someone for that long.

      @@dejuhvu1793 Yes, at some point the judge has to hold the parties’ feet to the fire and get things moving. Hopefully it will be resolved one way or the other this time around.

    This judge has a big fan club. I wasn't as interested in this case as I was when I found out he was presiding. So fair and so pleasant.

      Judge needs to address the defense and do a better job of controlling them...otherwise it looks like he fears them. He gives defense too much latitude.

    Imagine being in jail (not prison) for 13 years awaiting trail. That has to be the worst. Shouldn't be dragged out this long

      That’s Florida justice unfortunately. I’ve seen other cases take 8-10 years but this is my first one at 13. It’s usually due to mental health issues with the defendant but this is also a second trial for this guy so I’ll assume it was a number of issues that caused the long timeframe.

      That's what people don't realize. Prison isn't as bad because you're allowed privileges and comforts that jail doesn't provide. I'm talking no sunlight. Short and infrequent visits from friends and family. 12 is incredibly long and tortuous.

      @@guesswhat-chickenbutt It really is torture. This guy looks awful and I don’t even believe he’s guilt. Apparently the last jury came very close to acquitting him and I can see why. This guy has suffered a lot and it shows.

    Imagine sitting in court for a crime and having been in jail for a crime for years without having been convicted, and knowing nobody fought for your justice like this. He was shot 4 times and nothing was done. That’s really sad.

      I'm pretty sure it's his grandchildren. He's probably never seen them in person because he's been in jail so long. I don't think it's inappropriate for opening statements, maybe for the medical examiner's testimony.

The choice is yours." He can call me a hostile witness but I’d prefer petty. 😏😂😝😂

      @@Goulash45 Yes, I actually would. Going by your reasoning, I would also use a loud voice then… to make sure the jury could clearly hear MY responses. (As that is whats important to a jury anyway… attorneys questions are NOT evidence, they are to listen to the answers of the witnesses) And I’m a 50 year old woman… I’m not going to allow someone to yell & come at me for no reason, especially if I have done nothing to garner that type of behavior. Unfortunately, some of these “kids” get the title attorney or lawyer & suddenly grow 3 feet taller and think its “cool” to act all big, mighty & theatrical in the courtroom. No… treat me with respect & I’ll treat you with respect - - you’ll get it the same way you give it. And on what grounds would I be held in contempt for?? For not allowing an attorney to yell at me? Yeaaaa… thats not gonna work.

      Why is everyone so surprised by this? My dad took me to a murder trial as a kid to show me the judicial system and how it works. At the time I thought it was boring 😂 in retrospect, I appreciate that he did!

    This isn't siding with the accused here or taking away from the victims, it's a tragedy.
    But it's a case that points out the god awful delay in our system. Six years to bring a double homicide to trial?
    That immediately makes me think of the defendants who are innocent, have no bail and languish in these county jails to have their day in court.

      Typically in intense cases like this it’s best to let the public sentiment settle down to even have a chance at a fair jury. Also gives time to get a solid defense together

      it's just sick. I'm older now in life but I still hope and pray this doesn't happen to me...or anyone else who may be innocent. Not sure about this particular case, but defendant must have waived his right to a speedy trial (?)

      Florida is the worst state; they have a horrible judicial system. Especially in Brevard county; those cops look for trouble. Protect and serve is NOT Florida’s motto that’s for sure. Ugh

      My thoughts exactly. Furious + annoyed and insulted. There's no reason to repeatedly yell. It makes me think the facts can't stand on their own and he needs theatrics to make a point

      He also seemed rather unprepared. Not that he doesn’t know the facts of the case, but that he didn’t really practice his statement. He stumbled over his words more than once, even asking the jury to presume his client guilty rather than presume him not guilty. A bad first impression, if you ask me.

    I am sorry he was a victim of a crime but has not right to become vigilante so this defense dude going on about his injuries or talking with doctor is irrelevant. He didn’t even shoot the guy who shot him and no one even knows who it was

      his attackers have never been found and convicted, no justice for him. people get victimized every day and cops fail to bring any justice for them. If cops cant do their jobs, bringing justice to the victims, then who can?

    I'm so happy to see this judge again! This courtroom is a perfect example of how one should be ran. So vastly different from the currect Ex-boyfriend trial going on in Michigan.

    I think the mistrial should have been a guilty verdict last time. Even though it is VERY sad he got robbed and injured, a person can’t go and take the law into their own hands. The guy that robbed him wasn’t even there when he killed some and injured the others. I felt sorry for one of the young INNOCENT man he shot. He was a barber making an honest livelihood, and now can’t move his arm. This guy totally faked his injury during court. The evidence against him was solid enough to give a guilty verdict. He deserves to sit in jail.

      @@VotdTrades Strange that only two got it right. 🙂 I will admit he had a horrible lady lawyer last time. She really goofed by not doing a closing argument. She thought she’d be clever, thinking she was smarter than everyone and not do one so the prosecution couldn’t finish theirs with a rebuttal, and it cost him BIG TIME.

You don’t just ‘randomly’ have searches for “Creeper” on your laptop, then ask everyone you know if they know of him, THEN ask everyone at that house if he’s there before shooting everyone, unless it’s you! I’m still shocked it was a mistrial last time.

    The bald defence attorney was a part of the trial where an older gentleman shot a younger man during a movie matinee, citing self defence. That trial also took many years and he eventually was found not guilty. He’s very, very good.😮

      Yes, that was the Curtis Reeves trial where he shot a nether man for throwing popcorn at him, argument started over the victims cell phone, not being turned off or silenced during the movie

      @@buzzard777I tried to find out information as to why it was so delayed.. all that I could find was that due to “motions” and other “issues” it was delayed.. doesn’t say which party.. it astounds me that someone can serve 10 years before even seeing a jury

      Why are people being so judgemental about this.? Maybe the mother is the defendant's daughter who felt the need to be there for her Dad, and didn't have or couldn't afford childcare. Which do you choose? Not everyone has the same means and shouldn't be judged for having to make tough decisions

      @@stardust1593 I think you are giving their "undeveloped" minds to much credit. First of all about 99% of the trial does not discuss anything graphic at all. If anything, these children were most likely bored to tears and tuned out the proceedings within a short period of time. Exactly what has been presented that you would consider so damning? You think this will horrify them for years, when they most likely can't recall the days discussions by that night. Not everyone has suitable childcare or the means to afford this, much less for a six week period. And maybe she wasn't comfortable being away from her children for that lengthy period of time. I'm sure the mother knows more about her children than you do Miss Priss...

      Maybe they are his children, or relatives of his. Maybe they are his grandchildren and his daughter wants to be there for her Dad, but doesn't have or can't afford childcare. Don't be so judgemental. Not everyone comes from the same means. If this was his daughter I'm sure she wanted to be there for her Dad.

    He didn’t kill the guy he wanted to kill. So there’s that…And, He’s definitely a vigilante. Who walks up and shoots 6 people who hadn’t done a thing to him?
    He was angry then, and I imagine he is even angrier now. He would definitely be a danger to someone if he were out…

    I have seen this judge before and love the way he conducts court and I believe I’ve seen this prosecuting attorney before as well and if it is the same person I’ve seen in the past she is also very professional.

    I Really like this judge. I have watched quite a few of his courts and he is always on top of things, yet is very nice to everyone.

      But he worse bad deed, stopping at 1 hour for a break. Griffin came back, lost his place or MOJO. Day before had to listen he to Prosec. For 3h straight.

      @Roxy Moser yep, but I'm watching a case out of Kenosha. Judge Schrader. The Rittenhouse judge. But I've watched many cases out of FL. Always seem fair to me plus the lawyers comments. But then SC happened may be guilty but state never proved it. But obviously judge in the tank for prosecution.

      Exactly! I have studied criminal trials for many years. The first case I watched where the judge didn't stand for the jury kind of shocked me. It seems like for some reason, there has been a shift in judges not standing. I am seeing it more and more, but I don't understand it. It makes it seem like they don't have respect for the jury.

    I don’t think I could ever be a juror at this point. It just rubs me the wrong way when any attorney talks this way or questions this way. I would just hate to sit through it. For some reason in my head, it seems almost disrespectful in a way. I know it’s there job and he is doing his job etc. that is why I don’t know if I could sit there and listen to day after day of this type of questioning.

    When the defence team did their opening statements what made me laugh was when he accidentally said you are to put a guilty verdict then corrects himself not guilty lol even the defence is not convinced his innocent 😉

    Judge Sabella is so nice. He reminds me of Winnie the Pooh but with an excellent legal brain. Even in the Steven Lorenzo sentencing, he was calm and polite, and treated Mr Lorenzo with dignity, whether he deserved it or not.

    It appears that the prosecutor jumped the gun when she depicted the defendant twice in a row... of being upset when the police lacked leads on the investigation of his attackers. She followed up by saying that he independently investigated online and by talking to the locals, but that doesn't necessarily conclude being upset in any direct fashion. "Concerned" would've been a properly assumed description or if the prosecutor said "like practically anyone, Michael would've been upset" or "it's easy to conclude the chance of Michael becoming upset." Granted, I know attorneys aren't obligated to separate facts from speculations on every last occasion, but I would have in her position on this one.

    It’s crazy it’s taken this long to re try this case but I don’t feel bad I the least for him especially as he should have been found guilty and this done with the first time!

      You think _this guy_ should've been found guilty? Even though, in a test that does not rely on his self-report or his own effort, it was shown that he didn't have the dexterity to fire the weapon? (And by his treating physician, not someone it could be argued was hired for trial to say that.)
      The way this case was tainted by that text message _alone,_ let alone the improper second line-up, goes along way to reasonable doubt for me. The victims saw Michael all the time, yet _no one_ identified him on the night of the shooting. And it's not as though it's impossible -- or even unlikely -- that someone else did it. These guys were heavily involved in criminal activity in a rough part of town, just sitting outside their houses. People are gunned down like that _every day._

    This defense team is highly unlikable. Also, the detective cannot ask the doctor anything about the guys medications or injuries due to HIPAA, the prosecution needs to bring that up. Other than that, I have no excuses for the lazy detective.
