How to choose: Employee, independent contractor, or both?

    The place I work as a Massage Therapist I believe is calling us IC to make all the finances work in their favor. They walk the fine line with the guidelines. It’s a Massage Center and I’m a Massage Therapist! The owner has determined what our percentage of commission will be paid as well as the cost of the service itself. They supply most tools and equipment. Idk how to remedy this! I’d like to be a 1099 but in that case I’d like some say in how I’m paid for my work! If not, I’d like the benefits of being an employee! No matter what you tell this woman, it’s her way or the highway sand it’s so frustrating! I live in a rural area so the work opportunities are few. I’ve also been with this place for nearly 13 years so I have a clientele…

      Thanks for the comment! I see that setup in massage centers, and in general, its not compliant. But every situation is different, and fighting it will not endear you to them! Best of luck!

    Hi Rhamy, I am a Per Diem nurse employee working solely for a medical firm, receiving a W-2 annually. Even if I sometimes do not get to complete 40 hours/week, what would my status be considered under this new law? Thanks for your videos.

      Hey Joe! PRN's are almost always W2 employees. Nursing by definition requires a pretty high degree of control, and are rarely "independent businesses"

    So I'm self employed I think but they say I'm a independent contractor, I work 70 hours a week to take care a permanently disability person. Position is until death, and I believe I'm a personal support care worker with a llc but they say I'm a companion worker so I'm a independent. Their trustee says so and there lawyer says so. A lil help here . Never paid for overtime for a year plus.

      One note... "Self Employed" = "Independent Contractor". Same thing. You say you have an LLC... which is a business. Definitely a lot of details needed. Id reiterate above, you need a lawyer if they have one!

      In general, offering employee benefits is a sign that the worker is an employee.
