      I agree with you! Glad he got called out for being ridiculous! The jury by now has to be sick of the two defense attorneys being so over the top with the theatrics! They are being too over dramatic when cross-examining the witnesses!
      I, someone who owns many of guns, don’t always remember which target I shot at or always which guns I take to shoot with or if I shot all of them etc…
      This witness is very believable, and with what he has testified to, and how the defense is reacting what else are they not wanting this jury to hear that happened to further incriminate that psychopath murderer!

It went to pattern and identity....because he used a similar knife and chased his girlfriend outside in that attack, as well. Which I agree with his decision...too many similarities between the crimes. His attorney argued it shouldn't be allowed in because the first victim survived...making it not similar....can you imagine that being the reason she felt it wasn't similar?!

    The way the witness responds during the cross examination is always most telling because they've rehearsed time and time again with the prosecution. Either the prosecution chose unreliable witnesses or there is more to this story than meets the eye. Although lets be real 13 years later most people aren't going to remember everything perfectly...

    • @CandaceRanee

      @@CandaceRanee witnesses generally are rehearsed obviously things come up that weren't rehearsed but usually attorneys will go through questioning with witnesses beforehand to help things go more smoothly on trial day. Obviously the time that has passed makes it hard to remember things perfectly but for the victims it will be easier to remember due to the nature of trauma, still not perfect recollection though.

      @workhorse7134 Рік тому

      @CandaceRanee the witnesses are given copies of their depositions by request but if they aren't the ones on trial I guess a lot of them don't bother.
      What we are seeing here is not a case of not remember events from 10 years ago which is understandable, but at times completely contradicting their original testimony to fit in with the prosecutions narrative.

    The defence get hyped up (I’d appreciate the vehemence by which I’m being defended) and I feel it’s too much. Most I don’t mind but when lawyers get snippy and vocalize things that are inappropriate, that’s too far. The witness is downplaying his job as being a machinists have so many facets, and he doesn’t seem to want to admit his full capabilities. It sounds like he is very skilled and with being in the States, living where he did, he would’ve been swamped with gun items. Glad for his family he moved away. It’s going to be the detriment to all of our societies, gangs, drugs, violence, etc

      @@Lexifer21 *Actually it is what he said.* Escobar said his “theory is that Smith has a motive. He has a motive to move his family out - he has a motive to KILL - maybe not necessarily has to do it himself, he can get someone else to do it.” He said his “theory is that Smith is HEAVILY INVOLVED in what ever happened there on Ocean Mist Drive.” “…… Smith had a motive against these gang members.” This is basically word for word but if you want to hear it yourself, it begins about 56:21. They were arguing about a Motion In Limine regarding Smiths reasoning for moving out of the neighborhood. Escobar is portraying Smith moved his family because his kids were being influenced by these gangs so he has a vendetta (motive) against them. He wanted this Motion in Limine overturned so he could present an alternative suspect/theory to the jury.

      @@SimplyLolly he was implying this guy knew something more, or may have well made the modified part for the real murder weapon. the fact remains the timing of his move is very suspect.

    Hooooow interesting!! HA! A mere day ago I wrote a comment that while some don’t take a lot, most defendants take SOME type of notes during their trials, especially a double murder trial… but Mike just sits there, all day long, emotionless with his chin in his hand which can’t be a good look to the jury. And guess what?! *Mike actually has a notepad in front of him for the 1st time all trial… with writing on it!! Could just be a prop but it’s in front of him… LOL!!* 😂 Are his attorneys reading our comments to get suggestions & ideas in hopes of bettering their case??🫣😏 I totally wouldn’t doubt it… Ha!! 😂😝😂😝😂
